The attached map shows the portions ofkent Island and Grasonville that meet the requirements. This designation by the Census Bureau, comes with a requirement under Federal Law, that every Urbanized Area be included as part ofa Metropolitan Planning Organization (MPO). The Baltimore Regional Transportation Board is the MPO for the Baltimore region. As an MPO, the BRTB is directly responsible for making sure that funds spent on existing or future transportation projects and programs is based on a continuing, cooperative and comprehensive planning process. The BRTB is an 11 member board representing the cities ofannapolis and Baltimore, the counties ofanne Arundel, Baltimore, Carroll, Harford and Howard and the Maryland Department oftransportation, the Maryland Department ofthe Environment, the Maryland Department ofplanning, and the Maryland Transit Administration. Re: Bus Wash Rehabilitation & Re-Painting - Construction Bid Bids were received and opened on Thursday, September 17,2015 for the Bus Wash Rehabilitation & Re Painting construction project. The contract consists of the removal, disposal and replacement of rusting and corroding metal parts, rehabilitation ofacid damaged concrete floor and re-painting of elements ofthe facility and portions of the structure and all other included and peripheral work as described and detailed in the contract documents. The project was solicited in accordance with the current County Purchasing Policy. Four (4) bids were received were publicly opened. The responsive and responsible bids received are listed below: Vendor Lawrence C. Bathon Builders, Inc. PrismaLLC Harper & Sons, Inc. Pro Coat LLC Location Elkton, MD Silver Spring, MD Easton, MD Salisbury, MD Bid $ 66, $ 73, $ 97, $ 140, Local Vendor Participation was not applicable to this project since the project is 90% funded via a reimbursable grant through the Maryland Transit Administration (MTA). Adequate County matching funding is available from the FY-16 approved Capital Facilities Program. The MTA has been sent all required documentation and we are waiting for their concurrence ofthe award. The contract documents have been reviewed and approved by the County Attorney. Based on the above, staffrecomrnends award ofthe contract to Lawrence C. Bathon Builders, Inc. ofelkton, Maryland. Shane Moore ~ Public Ways and Sidewalk Ordinance ACTION ITEM Attached for your review is proposed legislation, County Ordinance This new bill is for the purpose of regulating the use, repair, replacement and maintenance of sidewalks constructed within county and state rights-ofway. More specifically, this bill assigns the maintenance of sidewalks located within public rights-of-way to the adjacent property owners. Currently, the state as well as many towns and other counties have similar ordinances. There are very few sidewalks located within county rights-of-way. There are several sidewalks within developments prior to the changing of our design standards that moved the sidewalk out of the right-of-way into a pedestrian easement. Maintenance of these sidewalks falls to their respective Home Owners Association (HOA), as stipulated in their covenants (ie. The Woods, Anchorage). We have several sidewalks constructed by SHA, where the road was later transferred to the County (ie. Postal Road). We also have a sidewalk along Grasonville Cemetery Road that was constructed by a grant through the Department ofhousing and Community Services. 5 COUNTY ORDINANCE NO A BILL ENTITLED AN ACT CONCERNING Public Ways and Sidewalks; FOR THE PURPOSE OF regulating sidewalks constructed in State or County rights-of-way; providing for the maintenance thereof, including snow removal; providing for the free and unobstructed use of such sidewalks, adopting standards for repair, replacement and maintenance of such sidewalks, authorizing and providing for the assessment of the costs of repair, replacement or maintenance against adjoining property owners and providing for the collection of same in the same manner as County real estate taxes; redesignating Part 5 of Chapter 23 of the Code of Public Local Laws; and generally regulating the use, repair, replacement and maintenance of certain sidewalks in Queen Anne's county, Maryland. BY ADDING a new Part 5 entitled "Sidewalks" and a new Section to Chapter 23 of the Code of Public Local Laws of Queen Anne's County. SECTION I BE IT ENACTED BY THE COUNTY COMMISSIONERS OF QUEEN ANNE'S COUNTY, MARYLAND that a new Part 5 entitled "Sidewalks" and a new Section be ADDED to the Code of Public Local Laws to read as follows: Part 5. Sidewalks Sidewalks. A. Maintenance. The owners of property adjoining a State or County right-of-way in which a sidewalk has been constructed shall be responsible for the maintenance, repair and replacement thereof, including the responsibility to remove any snow or ice accumulated thereon. B. Obstructions. No person shall obstruct a sidewalk located in a State or County right-of-way or impede or hinder the free passage of persons over and across such sidewalk. C. Standards. Any construction, repair, maintenance or replacement of a sidewalk located within a State or County rightof-way shall comply with the design requirements of the Queen Anne's County Roads Design Manual. 1 Pg 5
6 D. Costs. Should an adjoining property owner fail to maintain, repair or replace a sidewalk as required hereunder, the Department of Public Works of Queen Anne's County shall perform or cause to be performed, such maintenance, repairs or replacement and the costs of same shall be assessed as a lien against the adjoining property collectible in the same manner as real property taxes. SECTION II BE IT FURTHER ENACTED that Part 5 of Chapter 23 of the Code of Public Local Laws be redesignated as "Part 6". SECTION III BE IT FURTHER ENACTED that this Act shall take effect on the forty-sixth (46 th ) day following its enactment.
