6 California State Personnel Board Meeting Notice and Agenda January 5, 2017 Non-Hearing Agenda Attachment 2 The following proposals are made to the Board by either CalHR or SPB. It is anticipated that the Board will act on these proposals without a hearing. Anyone with concerns or opposition to these proposals should submit, in writing, a notice to the Executive Officer clearly stating the nature of the concern or opposition. Such notice should explain how the issue in dispute is a merit employment matter within the Board's scope of authority as set forth in the State Civil Service Act (Government Code Section et seq.) and Article VII of the California Constitution. Matters within the Board's scope of authority include, but are not limited to, personnel selection, employee status, discrimination and affirmative action. Matters outside the Board's scope of authority include, but are not limited to, compensation, employee benefits, position allocation, and organization structure. Such notice must be received not later than close of business on the Monday before the Board meeting at which the proposal is scheduled. Such notice from an exclusive bargaining representative will not be entertained after this deadline, provided the representative has received advance notice of the classification proposal pursuant to the applicable memorandum of understanding. 24 FIVE-MEMBER STATE PERSONNEL BOARD JANUARY 5, 2017 PAGE 2 NOTIFICATION: The affected collective bargaining organization was notified of this proposed specification changes on October 6, CLASSIFICATION CONSIDERATIONS: Civil Service Improvement (CSI) is a collaborative effort to improve California state human resource processes to be less complicated and more flexible. The goal of CSI is to create a system that makes the State of California an employer of choice and to build a workforce prepared to meet the challenges our state government will face in the future. Streamlining and updating the state s job classification system is a key component of the CSI initiative spearheaded by the Government Operations Agency, as well as the California Department of Human Resources (CalHR) Strategic Plan. CalHR is working to simplify the current classification plan by significantly reducing the number of existing classifications, thereby facilitating the modernization of recruitment, examination and hiring practices statewide. Under a broader classification structure, we anticipate individuals seeking employment with the State of California will find it much easier to navigate available employment opportunities and employers will have the ability to choose employees from a broader candidate pool. Analysis: The CNA classification establishment was proposed by CalVET and adopted by the Board on April 21, The proposal consolidated the Hospital Aid and Geriatric Nursing Assistant classifications and incorporated the Federal requirements mandating maintenance of a current Nursing Assistant Certificate issued by the Department of Health Services, now the Department of Public Health. The CNA-CF classification establishment was proposed by CDCR and adopted by the Board on July 1, The request was based on CDCR s need to create a classification to attend to inmates who require 24-hour nursing services in long-term care facilities. Prior to the establishment of the CNA-CF classification, CDCR utilized the Hospital Aid classification. However, due to various court mandates, CDCR was required to use medical classifications that required licensure/certification in the adult institutions. Due to the specialized duties and requirements of the CNA and CNA-CF classifications, there are no other classifications which perform similar functions impeding the classifications ability to be consolidated with any other civil service classification. However, it is viable to consolidate the two department-specific classifications and convert them into one civil service classification allowing for a broader statewide use of the class. Subsequent to the establishment of the two CNA classifications, the user departments had demonstrated a recruitment and retention issue. Specifically, the private sector health care setting does not require CNAs to have the six months of nursing experience currently identified in the minimum qualifications of the existing classification specifications. Additionally, CalVET and CDCR concur that an extension of the probationary period from 6 to 12 months provides sufficient time to observe and evaluate the ability of employees to perform duties comparable to experience gained outside of state service. That the proposed revised specification for the class of Certified Nursing Assistant, as shown in this calendar be adopted. 2. That all appointments to the class of Certified Nursing Assistant that require a probationary period and that are effective on or after January 5, 2017, shall require service of a one-year probationary period before an employee may attain permanent status in the class. 3. That the proposed Alternate Range Criteria 348 as shown be adopted. Range A. This range shall apply to incumbents who do not meet the criteria for Range B. Range B. This range shall apply to persons who have satisfactorily completed one year in the California state service performing the duties of a Certified Nursing Assistant, Range A., or Certified Nursing Assistant, Correctional Facility, Range A. When the requirements for a particular criteria are met and upon recommendation of the appointing power, the employee shall receive a rate under the provisions of DPA Rule California Code of Regulations, title 2, section That the class of Certified Nursing Assistant Correctional Facility be abolished. RESOLUTIONS: a. WHEREAS the State Personnel Board on January 5, 2017, revised the class of Certified Nursing Assistant and the duties and responsibilities of the class are substantially included in the previously existing class of Certified Nursing Assistant - Correctional Facility; and WHEREAS the knowledge and abilities required for the class indicated in Column II were substantially tested for in the examination held for the class of Column I; Therefore be it RESOLVED, that each person with civil service status in the class in Column I on January 5, 2017, be reallocated to, and hereby granted the same civil service status without further examination in the class in Column II; and be it further RESOLVED, that any existing employment lists other than reemployment lists established for the class of Certified Nursing Assistant, Correctional Facility, shall be used to certify to fill vacancies in the class of Certified Nursing Assistant, until such lists are abolished, exhausted, or superseded by lists for the class of Certified Nursing Assistant, and persons on any existing reemployment lists for Certified Nursing Assistant, Correctional Facility, shall also be placed on reemployments lists for the class of Certified Nursing Assistant until expiration of their eligibility on reemployment lists for the class of Certified Nursing Assistant, Correctional Facility; and Governor Edmund G. WHEREAS Title 2, California Code of Regulations Section 431 states Unless otherwise provided by resolution of the board, the maximum rate of the lowest salary range currently authorized for a class is used to make salary comparison ; and WHEREAS alternate ranges within the new class of Certified Nursing Assistant are being established to add a new entry level and to replace the previously existing class of Certified Nursing Assistant Correctional Facility; Therefore be it RESOLVED that salary Ranges A, and B for the class of Certified Nursing Assistant may be used individually as if each represents the salary range of a separate class to make salary comparisons for discretionary actions between the class of Certified Nursing Assistant and other classes; and be it further RESOLVED, That for the class of Certified Nursing Assistant the maximum currently authorized for Range B of the class shall be the salary range used to make salary comparisons for mandatory actions. ANALYSIS The current classification structure for Certified Nursing Assistant (8185) and Certified Nursing Assistant Correctional Facility (8182) are narrowly defined classifications with duties and characteristics that overlap, and are limited to small numbers of positions at specific departments in the state. This duplicative structure was established over a period of many years under historical general guidelines that focused on classification specificity, uniqueness and titles that reflected individual department organization rather than a statewide hiring perspective. CalHR, in partnership with participating departments, has consulted various classification systems such as found in other states, the federal government, and private sector for comparative classification information. In addition, CalHR and its partners have conducted an occupational analysis of Certified Nursing Assistant (8185) and Certified Nursing Assistant Correctional Facility (8182) by consulting with departmental subject matter experts, and reviewing existing minimum qualifications, typical duties and responsibilities, and the required knowledge, skills and abilities for state classifications within the occupational category. In light of the goal to streamline and update the state s job classifications, we have determined that these existing classifications can be consolidated into a broader classification structure while still adhering to Government Code , which states that positions may be considered part of the same classification only when: 1
29 The positions are sufficiently similar in respect to duties and responsibilities that the same descriptive title may be used; Substantially the same requirements as to education, experience, knowledge, and ability are demanded of incumbents; and Substantially the same tests of fitness may be used in choosing qualified appointees. Of the two (2) classifications analyzed, CalHR recommends that: Certified Nursing Assistant-Correctional Facility (8182) be consolidated into Certified Nursing Assistant (8185) classification. Revise the minimum qualifications and remove the six months of nursing experience. Extend the probationary period from six months to twelve months. Revise the Alternate Range Criteria 348. Abolish the Certified Nursing Assistant Correctional Facility Classification. See attached memo and draft specification for specific recommended classification actions. 2

MINIMUM QUALIFICATIONS Possession of a valid Nursing Assistant Certificate issued by the California Department of Public Health. and Six months of patient care experience as (1) a medical corpsman in a branch of the armed forces; (2) a practical vocational nurse under the direction of a doctor; or (3) an attendant caring for the physically ill, handicapped or disabled patients in a public or private institution. All employees must have general qualifications as described by California Code of Regulations, title 2, section 172.
