1 4 ORDINANCE NUMBER,2000 Seventh 2000 General Fund Budget Supplemental Appropriation, Creation of l'iew Position and Creation of New Line Item for Adult Probation: Drug Court P.O. BE IT ENACTED by the County Council of the County oferie, pursuant to Article II, Sections 1 C(l), 3B(2)(t), and 3C(1), and Article VIII, Section 8 ofthe Home Rule Charter for the County of Erie, and based upon the Certificate ofthe County Executive, that a supplemental appropriation be and hereby is made to the 2000 General Fund Budget in the amount of$18,545. BE IT FURTHER ENACTED by the County Council of the County of Erie, pursuant to Article VIII, Section 7 of the Home Rule Charter, that the transfer of $18,545 for this purpose is hereby approved, as outlined on the attached Exhibits A and B. This ordinance shall be effective immediately upon adoption. Lewis, Director 7.5c / Adult Probation/Parole Department RE: Funding for position of Drug Court P.O. for seven months DATE: January 03,2000 As you are probably aware, the Erie County Office of Drug and Alcohol Abuse, in conjunction with efforts from the Erie County Adult Probation/Parole Department has secured grant funding from the PA. Commission on Crime and Delinquency in the approximate amount of $318,531 to fund drug and alcohol treatment. (See attached award letter dated September 29, 1999). This money is being used to establish a Drug Treatment Court in Erie County with a start date of February 1, The grant covers the salary and fringes for a Drug Court Case Manager but not for a Probation Officer. These two positions must work closely together for this project to be successful. The Erie County Adult Probation/Parole Department will be seeking federal grant monies in 2000 to fund this P.O. position, but monies will not be available until September 1, 2000 at the earliest. Because of this delay, we would need seven months of funding for salary and fringes for this P.O. position. (See the attached job description and salarylfringe requirements). We have been working closely with Namon McWilliams and others as a result of receiving a drug court feasibility grant from the federal government in Because of our need, Namon has agreed to fund the Probation Officer Position for seven months beginning February 1,2000 through August 31,2000 from monies in his budget. This would require no additional county monies for this period of time. County Council has already approved 6 months funding for the Drug Court Case Manager which I stated

6 Page 2 Mrs. Lynch before is the other half of this two person team. We are requesting that the County Personnel Department, with the Office of Finance if necessary, create a P.O. position solely designated for the Drug Court Program. Once this is done I realize that we will want to attend a County Council Finance Committee meeting to formalize this request. Judge Cunningham has agreed to attend such a meeting in order to answer any questions surrounding this project and this specific request. 8 TITLE: Adult Probation Office I - Drug Court P.O. Assigned to the Erie County Drug Treatment Court DEPARTMENT: Adult Probation GRADE: 204 JOB NO: DEFINITION OF CLASS: Under direct supervision, supervises, counsels, transports, and directs Court assigned adults on supervision who are placed into the Erie County Drug Treatment Court. DUTIES & RESPONSmILITIES: The Drug Court P.O. will be part ofthe Drug Court Treatment Team He/she will be assigned to work and interact with the Drug Court Judge, Public Defender, Assistant District Attorney, Drug Court Case Manager, Treatment Provider and others. As a Drug Court Team Member, the Drug Court P.O. will conduct all legal, Criminal Justice and background evaluations of all potential Drug Court candidates. A knowledge of sentencing guidelines are required along with supervision, monitoring, and intervention techniques. Additionally, the Drug Court P.O, will be responsible to conduct drug testing on Drug Court participants as needed. Part ofthis position will require regular Court attendance for placement ofindividuals into Drug Court and for regular case reviews/stallings. Attends training sessions and observes the operation of all phases ofthe work done in the Adult Probation Department, Prepares all pre-parole and pre-probation reports requested by the Probation Department or the Courts, Provides counseling services to probationers and parolees. Procures treatment for clients or assistance from other departments or agencies as required. Advise probationers and parolees as to their rights under the laws, and to see that these rights are enforced, Collect, supervise disbursement, and keep an accurate record ofrestitution as ordered by the Courts. Refer the families ofpersons on parole or probation for assistance by other agencies. Collects data for statistical studies. Transport clients to various locations. Coordinate efforts with Court Officials, other probation officers, lawyers, and other persons or agencies. Seek and arrest individuals that have violated terms ofprobation or parole. Make recommendations on the placement ofclients, Attend court and present for unscheduled work on a twenty-four hour, seven-day-a-week basis. Other duties as required. The above statements reflect the general details considered necessary to describe the principal functions ofthe job and shall not be considered as a detailed description ofall the work requirements that may be inherent in the job.

Ability to learn the laws, rules, and regulations pertaining to probation and parole. Ability to meet and deal successfully with parolees, probationers, and the public under trying circumstances. Ability to prepare case histories. Emotional stability and good self-control under stress. Ability to learn good judgment in matters relating to human service work. Impartiality and firmness. Supervisory ability. Ability to learn and understand the working of the Court, government, and human service agencies goals, service and limitations. An ability to analyze complex problems and make appropriate decisions based on established guidelines. Ability to learn the use ofphysical restraints. M1NIMUM REQUIREMENTS/QUALIFICATIONS: Four year college degree in a curriculum oriented to the problems and the solutions to problems of human behavior. Adequate physical and mental health to withstand rigorous activity under pressure. Period ofexperience in human services and substance abuse and treatment preferred by not required. Pennsylvania operators license.
