1 I-69 Angelina and Nacogdoches Counties Committee Conference Call MEMORANDUM OF CONFERENCE CALL SUBJECT: DATE: I-69 Angelina and Nacogdoches Counties Committee Meeting March 19, :00 PM-2:00 PM LOCATION: Conference Call ATTENDING: Committee members participating on the conference call are listed in Attachment 1 Purpose: The purpose of this conference call was to prepare for the March 25 th and 26 th public Open Houses including: 1) discussion of staffing; 2) review of materials; 3) discussion of setup; and 4) discussion of the objective. The conference call agenda is included as Attachment 2. Welcome/Roll Call Tracy Hill, I-69 Angelina and Nacogdoches Counties Committee meeting facilitator, began the meeting by welcoming all those on the call. He then went through a roll call of the committee members and staff. Public Open House Staffing As of the conference call, eight committee members were confirmed to attend the public Open Houses as follows: Nacogdoches County o David Alders o Roy Bolden o Jim Jeffers o Joe English Added after the call Angelina County o Sid Roberts, M.D. o Greg Shrader o Wes Suiter o Lynn Torres o Keith Wright Further efforts will be made to contact the other committee members regarding their participation at the Open Houses. Tracy asked what the expectation was for public turn-out at the Open Houses. Kelly Morris, TxDOT Lufkin District I-69 Manager, noted that because of the news regarding the Open Houses, she has seen an increase in the number of the members of the public stopping by the TxDOT Lufkin District Office and in phone calls from the public. 2 I-69 Angelina and Nacogdoches Counties Committee Conference Call Public Open House Materials Tracy referred those on the call to Packet #1 (Attachment 3) that was ed to committee members from Kelly yesterday. He noted that committee members had been provided this information previously. Tracy then explained that the Frequently Asked Questions is an excellent source for committee members to use in preparing for the Open Houses. He also explained that the Fact Sheet, Pocket Card and Comment Form will be provided as handouts at the sign-in table. Tracy asked if there were any questions regarding the Open House materials. There were no questions asked by committee members. Public Open House Setup Tracy referred committee members to Packet #2 (Attachment 4), the Draft Typical Room Layout and Staffing. He explained that the stations and items included at each station were shown in the box on the left of the page and that staffing assignments were shown on the right of the page. Tracy also noted that the boards that will be located at each station are included in Packet 3 (Attachment 5).Tracy then reviewed each station as follows: Station 1 The sign-in table will be where the public signs in and receives the handouts. If there are enough committee members at the Open House, it would be good for a committee member to be stationed at the sign-in table to greet the members of the public. Station 2 There will be five boards total which will provide information/background on I-69 and the committee. Committee members will be stationed here. If there is no one from the public at the station, these committee members should feel free to roam and help at other stations. Station 3 There will be four tables, each set up with an aerial map with the two options under consideration, a county specific US 59 Upgrade Option/New Location Option layout board, and a typical section board. Markers will be available for the public to mark features on the maps. Station 4 A looping presentation, similar to the one that committee members have been giving at local civic meetings, has been prepared with narrative for the public to come and go and watch as they please. It will be set to run continuously at each Open House through a laptop on a projection screen and speakers. Station 5 A comment table will be setup with chairs, pens, comment box, and comment forms to record written comments. Station 6 A computer bank will be set up at each Open House for the public to provide comment and/or take the survey. Jim Jeffers noted that the computers will be delivered to Nacogdoches County Open House between 2:30 and 3:00. Kelly will follow up with Lynn Torres to find out when the computers will be delivered to the Angelina County Open House. Tracy asked if there were any questions regarding the Open House setup. There were no questions asked by committee members. Public Open House Objective Tracy explained that the purpose of the Open Houses was for the committee members to engage the public and gather input on the two options under consideration. Tracy then noted that committee members should get the word out to the citizens in the area regarding the upcoming Open Houses and suggested that studying the Frequently Asked Questions would be good preparation for committee members. The committee will select cochairs, one from each county, and will include citizen and community outreach as part of their work in finalizing their recommendations. The representatives from each county will function as one committee reviewing current transportation needs and concerns as they relate to regional mobility and local access. This review will lead to one set of recommendations on I-69 route locations and/or improvements to US 59 to meet Interstate standards. These recommendations will guide TxDOT on future I-69 project development.

9 Frequently Asked Questions I 69 Angelina and Nacogdoches Counties Committee I-69 ANGELINA AND NACOGDOCHES COUNTIES SPECIFIC FAQS Why is this study being done? US 59 has been identified as a future part of the I-69 system in Texas; however, it does not meet Interstate standards. This study is being done to identify and consider two options to develop an Interstate type roadway in the area which would become I-69. One option is to upgrade the existing US 59 roadway and expand it to meet present and future needs. (US 59 Upgrade Option) Another option is to build relief routes around Nacogdoches and Lufkin. (New Location Option) Will I-69 really be built in this area? I-69 was authorized by Federal law and is supported by the Texas Transportation Commission. However, regardless of whether the US 59 Upgrade Option or the New Location Option is developed, it will be expensive. Currently, construction funding has not been dedicated to either option. What are the differences between the US 59 Upgrade and New Location Options? Route - The US 59 Upgrade Option follows existing US 59, and as such has a greater potential to affect businesses, community facilities and a greater potential to disrupt traffic and travel patterns during construction. The New Location Option is in mostly undeveloped rural areas and has a greater potential to affect residential and agricultural properties. Construction The US 59 Upgrade Option can be constructed as smaller stand-alone projects. Whereas, the New Location Option would need to be constructed in larger sections that connect to existing roadways in order for the project to be useful to the traveling public. Traffic and Mobility The US 59 Upgrade Option can be developed as smaller standalone projects that upon completion, would provide immediate safety and mobility benefits to drivers on US 59. The New Location Option would improve operations along existing US 59 by separating through traffic, e.g. trucks, from local in-town traffic but only upon completion of the entire relief route (US 59 to US 59 on either side of Lufkin or Nacogdoches). The relief route would also serve as another route for hurricane evacuations. Access As of this time, it is assumed that the US 59 Upgrade Option would have continuous frontage roads and that the New Location Option would not have continuous frontage roads. The cost effectiveness of purchasing access rights versus constructing frontage roads would be studied during the environmental process. Cost Based on data from the I-69 Angelina and Nacogdoches Counties Scoping Study, which is a high level planning study, preliminary cost estimates were prepared in 1 Draft and Subject to Change March 11, 2013

Preliminary estimates are as follows: COSTS ARE DRAFT AND SUBJECT TO CHANGE County US 59 Upgrade Option Preliminary Cost Estimate New Location Option Preliminary Cost Estimate Angelina $535 million to $680 million $430 million to $550 million Nacogdoches $400 million to $505 million $305 million to $390 million Right-of-Way Both options under consideration would require additional right-of-way. Based on data from the I-69 Angelina and Nacogdoches Counties Scoping Study, which is a high level planning study, preliminary estimates indicate that the New Location Option would require more additional right-of-way than the US 59 Upgrade Option. This is because the US 59 Upgrade Option maximizes the use of existing US 59 right-of-way. Preliminary right-of-way needs are estimated as follows: ROW QUANTITIES ARE DRAFT AND SUBJECT TO CHANGE County US 59 Upgrade Option Preliminary Right-of-Way Needs (Acres) New Location Option Preliminary Right-of-Way Needs (Acres) Angelina Nacogdoches I-69 Designation - Upon completion of a US 59 Upgrade section it could be signed as I-69. The New Location Option route could not be signed as I-69 until the entire length (US 59 to US 59 on either side of Lufkin and Nacogdoches) is completed. Either option must be part of a plan that connects to an existing Interstate by June 30, 2037 as per Federal law before signing as I-69. Why is relief route shown around Diboll and which option is that a part of? A relief route at Diboll was previously environmentally cleared and will be advanced as an independent project regardless of which option in Angelina County is carried forward into the environmental process. If the US 59 Upgrade Option is advanced, will it just follow the existing US 59? If the US 59 Upgrade Option is carried forward in the environmental process the existing route will be upgraded to the greatest extent possible except in areas where it may be necessary to shift the route to avoid large developments or other sensitive resources. Regardless of which option is carried through the environmental process, TxDOT would continue to refine the option location to avoid and minimize potential impacts. 2 Draft and Subject to Change March 11, 2013

11 Frequently Asked Questions I 69 Angelina and Nacogdoches Counties Committee I have heard of something called the US 59 Master Plan; what is that? In the late 90 s to early 2000s, the TxDOT Lufkin District studied relief routes for US 59 at Diboll, Lufkin and Nacogdoches. These studies were referred to as the US 59 Master Plan. The US 59 Master Plan was placed on hold when the concept of the Trans-Texas Corridor (TTC) first surfaced. Now that the TTC is no longer a consideration, TxDOT is studying the development of I-69 in the region. If the New Location Option is advanced will it exactly match the US 59 Master Plan? Even though the US 59 Master Plan had been studied previously, there may be new information discovered during the environmental process such as new development or environmental resources, which could cause a change in the original plan. Changes to the New Location Option could include shifts in alignment, interchanges and frontage roads. Additionally, the original US 59 Master Plan terminated at US 259 and did not include a connection to US 59. A connection to US 59 would need to be developed in order for this option to function as I-69. Regardless of which option is carried through the environmental process, TxDOT would continue to refine the option location to avoid and minimize potential impacts. So if you have not chosen a precise location for the New Location Option why do you show lines for it on a map? Since the US 59 Master Plan had been studied previously, it was used as the basis for locating the New Location Option on the map. Lines were drawn on the map to give the committee and the public a sense of what the two options under consideration may look like. Regardless of which option is carried through the environmental process, TxDOT would continue to refine the option location to avoid and minimize potential impacts. GENERAL I-69 FAQs Will I-69 affect my home or business? Specific plans for I-69 major roadway improvements and relief routes have not been decided. However, using the recommendations and guiding principles of the I-69 Advisory and Segment Committees, TxDOT is reviewing existing highways along the I-69 Texas route and working with the Federal Highway Administration and other partners to get suitable existing freeway sections designated as I-69. Currently there is funding for some local-level I-69 project development to begin studying roadway improvements. Specific plans for developing I-69 will require public input and studying the surrounding environmental features including businesses, homes, schools, churches and other property. Will I-69 be tolled? I-69 Texas is in the early planning stages so the manner in which it will be paid for has not been determined. 3 Draft and Subject to Change March 11, 2013

12 Frequently Asked Questions I 69 Angelina and Nacogdoches Counties Committee Paying for I-69 can be done traditionally using the state highway fund or alternate financing tools such as public-private partnership or pass-through financing. Local communities may decide to develop and fund portions of I-69 in their area and use these alternate financing options. Under Texas law, the number of existing free lanes cannot be reduced if a toll road is built. Will I-69 bring more traffic to my community? During the 2010 US Census, counties along the I-69 system saw significant population increases. Population and traffic increases are already occurring along the I-69 Texas system. An interstate with additional lanes and capacity will better serve population growth and additional freight traffic projected from the Panama Canal expansion. How will I-69 help my community? As population growth continues in Texas, I-69 will serve and provide for the next generation. Many counties and communities along the I-69 Texas system are close to the gulf coast. Emergency Evacuation - An interstate would provide additional lanes and capacity for emergency evacuations such as hurricanes. Improved Safety - An interstate highway has safety features that undivided two and four-lane highways do not have such as overpasses at crossroads, entrance and exits ramps and shoulders. Economic Development - An interstate may also support economic development because convenient interstate access is a factor when businesses undergo site selection. Does all of the state fuel tax go to TxDOT? No. Twenty cents per gallon is the state tax. Added to the 18.4 cents per gallon in federal tax, the total is 38.4 cents per gallon. The 20 cents of state tax goes into the state highway fund, but some of this money is diverted for other funding purposes, such as state public education and the Department of Public Safety. Texas: A Donor State - Additionally, at the federal level, Texas is known as a donor state. This means part of the 18.4 cents Texans pay in federal gas tax goes to other states to fund their transportation projects. Fixed Rate - The motor fuels tax is set at a fixed rate and does not fluctuate with fuel prices. Simply put, Texans pay a flat rate total of 38.4 cents per gallon, regardless of the price of gas. Will my property be affected or taken? If it is impacted, how will I be compensated? 4 Draft and Subject to Change March 11, 2013

13 Frequently Asked Questions I 69 Angelina and Nacogdoches Counties Committee The segment and advisory committees stressed that TxDOT should keep road improvements for I-69 within and along existing highway right of way to the greatest extent possible. For much of the I-69 Texas system, new right of way will not be needed for many years. Future Right of Way Needs - Should future portions require additional right of way, TxDOT must carefully follow federal and state law and only obtain the property it needs for the highway project. Market Value of Property - Affected property owners must be adequately compensated for the market value of the property, as established by an independent state-certified real estate appraiser, that is acquired and certain damages, if any, to remaining property and also compensated for necessary relocation expenses to the remaining property not acquired. Relocation Benefits - In addition, a displaced property owner may be entitled to certain relocation benefits Note: "Compensation" required for real property interests is distinguishable and handled differently from relocation benefits. 5 Draft and Subject to Change March 11, 2013

14 I-69 Angelina and Nacogdoches Counties Scoping Study Fact Sheet Why Texas Needs I-69 The I-69 Advisory and Segment committees, led by citizen volunteers, recommend the development of I-69 in Texas to relieve traffic congestion caused by a growing population, provide safer travel through the state, improve emergency evacuation routes, and support economic development. As a continuation of the citizen-led I-69 development effort, the I- 69 Angelina and Nacogdoches Counties Committee was created to further guide TxDOT on future I-69 project development. Development of I-69 The I-69 Advisory Committee recommends a two-pronged approach to developing I-69. First, identify those sections of existing highways along the I-69 route that meet Interstate standards and designate them as I-69. TxDOT is currently reviewing the entire I-69 route and working with the Federal Highway Administration and other partners to designate those Interstate-ready sections as I-69. Second, identify those sections that do not meet Interstate standards and begin the project development process which includes identifying community and environmental concerns and needed improvements. TxDOT has initiated several studies to identify projects along the I-69 route. Ultimately, these identified projects will be constructed as funding becomes available. Study Purpose US 59, the I-69 route through Angelina and Nacogdoches Counties, does not currently meet Interstate standards. The purpose of this study is to collaborate with the citizens and communities of these two counties to determine their recommendation on an option for improving US 59 to Interstate standards, with the eventual goal of designating and signing US 59 as I-69. Two broad options are under consideration: One option is to upgrade the existing US 59 roadway and expand it to meet present and future needs. Another option is to build relief routes around Nacogdoches and Lufkin. The recommended option may be one or the other or a combination of the two. Information and feedback from the scoping study will be used to develop recommendations. The study will include: A comprehensive look at travel and traffic patterns An inventory of existing roadway and environmental features along each option Public outreach and input through a stakeholder committee, community presentations, and other meetings The recommendations from the scoping study will be carried forward into one or more environmental studies. The scoping study is anticipated to be complete in summer Public Input The I-69 Angelina and Nacogdoches Counties Committee is comprised of local citizen stakeholders. The committee is reviewing the US 59 Upgrade and New Location options and talking with the community and neighbors about their recommendations and any concerns and issues that may need to be addressed. The work and recommendations of the committee, along with citizen input, will guide TxDOT on future I-69 project development. 15 I-69 Texas - Planning and Funding I-69 will be developed as a series of local projects; it will not be a single project where the entire Interstate is constructed all at once. Instead, local projects such as adding an overpass, improving sections of the current road to a controlled access freeway-type facility, or constructing relief routes, would be done as funds become available. The local projects, once completed, would be added to the existing I-69 Texas system (US 59, US 77, US 84, and US 281), provided they meet specified criteria. The graphic below shows estimated timelines for roadway projects. It's important to note that funding has to be made available before each step in this process. Using this timeline, a project would take 6-15 years to go from the planning stage to construction, assuming funding is available for each step. Currently, the I-69 scoping study for the Angelina and Nacogdoches County area is only funded for the first step so additional funding would be needed to complete this road project. The entire project timeline is dependent on additional funding being available to continue the project development process. Some areas of the I-69 Texas system are just beginning the planning process now, while others have been planned and with newly assigned funding, can now move forward on further environmental, design, or construction work. While the 15 years shown in the graphic below may seem like a long time, the input that you are giving is important because it lays the ground work for potential local projects that will advance I-69 Texas. As we all know, planning and ideas have to start at the local level - with citizens and communities. Planning needs to begin now so that when funding does become available, the ground work has been laid and the local community has a plan in place. *Funding must be identified and secured before each step of the process.

The I-69 Advisory Committee recommended US 59 relief options for Diboll, Lufkin and Nacogdoches. Currently, existing US 59 does not meet Interstate standards and will require improvements before being designated I-69. In working towards the I-69 goal, TxDOT has initiated an I-69 Angelina and Nacogdoches Counties Scoping Study to consider two options for improving US 59 to Interstate standards. The I-69 Angelina and Nacogdoches Counties Committee, comprised of local citizen stakeholders, is gathering citizen input and helping develop a project that fits the needs of the local community. Community and citizen input is a critical part of this study and the I-69 Angelina and Nacogdoches Counties Committee asks that you consider and provide comments on the potential improvement options. One option (the US 59 Upgrade Option, shown in red) is to upgrade the existing US 59 roadway and add capacity to meet present and future needs. Another option (the New Location Option, shown in blue) is to build relief routes around Nacogdoches and Lufkin. The recommended option may be one or the other or a combination of the two and will be carried forward into one or more environmental studies.
