4 4 MESSAGE FROM THE PRESIDENT: Retreat to Advance By Lenore Killam, IEHA President Greetings IEHA members. While January saw the environment around us solidly frozen in place here in Springfield, IEHA has been on the move. Each January, the IEHA Board of Directors holds a retreat to discuss the strategic plans for the organization. I would like to share a few of our important changes, decisions and highlights of the two-year strategic plan developed during the retreat. Before carving into the meat, I want to give a shout-out to the Illinois Public Health Association for graciously hosting the retreat in their conference room. If you have never been to their digs, they are a bit hard to find; especially when using GIS. The street runs parallel to the Amtrak rail line where you would not expect to find a bona fide office. But when you do, you have found a top-notch staff of dedicated professionals. We were pleased to meet with their legislative liaison Ralph Schubert, who gave us sage advice about advancing our legislative efforts. I encourage you to read Chris Pozzi's articles to learn more about our new legislative initiatives. One important decision reached during the meeting is to move the annual sewage conference to December of this year. We are looking for speakers and presentation ideas for the conference. We are also looking for members to serve on the conference committee and serve as conference volunteers. Please contact Kim Bradley or me if you are interested in being involved with the sewage conference. The second day of the retreat was devoted to developing a twoyear strategic plan. We identified five goals that I want to share with you and ask for your involvement. The first goal is to increase revenue, and a few of the options to do so include searching for grants, increasing membership and conference attendance, identifying sponsors and advertisers, and recruiting affiliate members. One important and beneficial option for all of us is to talk about what we learn at the annual conferences with our coworkers and bosses to whet their appetites to attend. Our second objective is to improve our legislative competence. This is a complex, fast-moving arena of policies and positions that demand urgent attention with what rarely feels like adequate time to fully deliberate the issues. Fortunately, although our resources are limited in terms of time and manpower, we have been able to team up with other organizations to allow our voice to be heard. We are at the beginnings of this process, and the best course of action at present is to carefully read the articles written by Chris Pozzi, our Legislative Committee Chair. She is doing yeoman's work building our initiative. If you are interested in joining the legislative committee and helping develop our legislative voice, please let Chris know. The third objective is increase outreach to industry, academia, government, and membership. I know it is considered bad form to brag, but I hope you will brag about our association to anyone who will listen. One of our "thinking cap" ideas is to identify benefits to members so please let either Giordan Kaplan or me know if you have an idea about creating a new, unique membership benefit. The fourth objective is to improve our educational outreach. We expect the changes to the sewage conference will prove invigorating, and we are in initial discussions to offer a sewage conference in southern Illinois. Additional ideas include offering special sessions at the conferences for second-year professionals and new managers. We are always interested in hearing how we can improve on doing what we do best; offering training and education for environmental health professionals throughout Illinois that is second to none. Our fifth objective is to improve our technological savvy. I must admit the water is over my head when the discussion turns to technical innovations, social media, and cutting edge developments in communication and technology. But I expect there are a number within our membership who are talented with these technologies. We would like to update our website and beef up our social media presence. If this sounds interesting, I encourage you to volunteer. Of course, the greatest strength and resource we have as an organization is the collective talent, experience, wisdom and just plain smarts of the membership. If any of these objectives sounds like something that would interest you, please let me know and I will put you in touch with the right person. 6 6 Understanding the Illinois Rule Making Process- Part 2 By Chris Pozzi, Legislative Chair The last issue of IEHA News discussed the process that a bill follows to become a law. Once a bill becomes law, often State agencies are required to develop rules or administrative laws to enforce the new law. The Illinois Administrative Procedure Act (IAPA) was enacted by the Illinois General Assembly to create a procedure through which agencies would generate laws by adopting regulations. In 1977 the IAPA was amended to add the Joint Committee on Administrative Rules (JCAR) to oversee this process. Rules of an administrative agency are valid and enforceable only if they have been through the IAPA rulemaking process. Rules are to be created for the purpose of interpreting and/or implementing the law that was passed. The rules should not expand beyond or limit the scope of the passed law. Management Act create a special process allowing the Pollution Control Board and the IEMA to adopt regulations that are identical to federal regulations that the State is required to adopt and enforce. These rulemakings are reviewed by JCAR after adoption. Required Rulemaking. These are rules of an Agency that can be adopted by the Agency by filing with the Secretary of State. Examples of these types of rules include organizational charts, Freedom of Information Act information, hearing officer qualifications, etc. JCAR reviews these rules after they are adopted. The Process Types of Rulemakings Proposed Rules. These can be new rule proposals or amendments to existing rules. These proposals can be referred to as "regular" or "permanent" rulemaking. The proposed rules follow a 2 step process, including a First Notice and a Second Notice. The process can take anywhere from days. The submitting Agency controls the timing of the process. Both the general public and the General Assembly (through JCAR) can have input on the rules prior to their adoption. Emergency Rules. Emergency rules are effective immediately upon the Agency submitting the rules to the Secretary of State or within 10 days of filing. JCAR reviews the rules after they are adopted. Emergency rulemaking usually lasts about 150 days, unless an earlier date is specified or the emergency rule is replaced by a permanent rulemaking. Emergency rulemaking can be used only if the Agency finds a threat to the public interest, safety, or welfare exists. Peremptory Rules. The IAPA allows for the immediate adoption of a rule required as a result of a federal law, federal rule, collective bargaining agreement or a court order. Peremptory rules are effective when they are filed with the Secretary of State or on the date required by the federal law, federal rule or court order. JCAR reviews these rules after their adoption. Exempt or Identical in Substance Rules. The IAPA, the Environmental Protection Act and the Illinois Emergency Drafting the Rules. Rules are drafted by the enforcing State Agency. It is up to the State Agency's discretion to determine whether to involve the public in the initial drafting process. IAPA encourages early public involvement and requires Agencies to publish semiannually a Regulatory Agenda indicating the scope of the Agency's rulemaking activity in the upcoming 6 months. The First Notice Process Once the Agency publishes a Notice of Rulemaking in the Illinois Register, the First Notice Period starts. The Illinois Register is the official State publication through which the public is informed of rulemaking activity. The Illinois Register is prepared by JCAR and published by the Secretary of State every Friday. The Illinois Register can be accessed at the General Assembly website or the Secretary of State website. The Illinois Register contains First Notice publications, JCAR actions, a list of Second Notices, Notices of final adoptions of rules, regulatory agendas, executive orders and proclamations. The First Notice Period lasts a minimum of 45 days and ends when the Agency files the Second Notice with JCAR. The only limitation is that a rulemaking process expires if the proposed rules are not adopted within 1 year after the start of the First Notice Period. See RULES on Page 9

8 8 BUGS!(and other critters) By Randy Markillie. IEHA Pest/Vector Control Technical Section Chair Is It An Infestation Or Something Else? In the December 2014 issue of Pest Management Professional Magazine, "Ask the Expert" column, Technical Consultant Dr. Doug Mampe is asked: Q: We're experiencing a so-called bite problem in a commercial building's offices and conference room. We've placed many sticky monitors but haven't found any mites or insects. All areas in question have carpeting. The customer is becoming intolerant because we can't solve the problem. Should we just spray the areas and hope for the best? A: So far, you have done the correct thing: monitoring without pesticides. You might well have an environmental problem unrelated to insects or mites. Don't treat unless you can identify a biting insect or mite. In the mind of the customer, treating confirms there's an insect or mite present. The treatment will fail to solve the problem so the customer will ask you to treat again. Eventually, the customer will dump you and find someone else to solve the problem. Bring in an industrial hygienist to sample the air for contaminants. You also might have static electricity from the carpet. That can be treated with an antistatic compound. Be a professional - don't treat until the cause is known. In the long run, the customer will thank you for getting to the root of the problem. FACT vs FICTION: Starlings FICTION: All blackbirds are starlings. FACT: As with most common names, several species are referred to as blackbirds. Starlings (Sturnus vulgaris), however get their name from the word star. When they undergo their annual molt after breeding, they have white tips on their feathers that give them a speckled appearance. By spring, the tips are worn off, and they sport a sleek, black appearance. Their bills also change from black in the fall to yellow in the spring. FACT: Starlings have an unusual beak that's spring-loaded. It springs open to pry apart seeds and plants (winter) or to grip insect prey (summer). Their intestinal tract adjusts seasonally to accommodate a high-carb winter diet and a highprotein insect summer diet. FICTION: Starlings have a distinctive call. FACT: Starlings are distantly related to myna birds and love to mimic. They imitate other birds, noisy children, and barking dogs. FICTION: Starlings are easy to discourage and manage. FACT: Starlings are aggressive, they're known to attack and destroy nests and young of other species. They even parasitize their species by egg dumping. First broods are destroyed this way about 15 to 30 percent of the time. It's important to routinely destroy nesting areas because returning females often use the same location year after year. FICTION: Starlings aren't economically important. FACT: Starlings account for more than $800 million in agriculture losses a year. So the next time you see a 100,000 plus flock of hungry starlings on the move, remember the Migratory Bird Treaty Act doesn't cover starlings and pest professionals can do something to stop this non-native, invasive species. 9 IEHA NEWS // March 2015 RULES continued from Page 7 During the First Notice period, the IAPA requires the Department of Commerce and Economic Opportunity review each proposed rule to determine possible impacts on small business. The general public, including organizations like IEHA, local health departments, etc., can submit comments on the proposed rules at this time. The Agency can voluntarily hold a hearing or must conduct a hearing when requested by the Governor, JCAR, an association that represents over 100 persons, 25 individuals or by a local government. Requests for hearing must be filed within 14 days of the First Notice publication. The Agency can modify their proposed rules during the First Notice, provided they submit a First Notice Changes document to JCAR when it gives Second Notice. The Second Notice Process The Second Notice period starts when the Agency files the Second Notice with JCAR and lasts for a maximum of 45 days. If JCAR and the Agency agree, the Second Notice period can be extended by an additional 45 days. When the rulemaking goes to second notice, JCAR receives a copy or summary of all written comments submitted to the Agency. Additionally, the public can directly notify JCAR if the agency refused to modify the proposed rules in response to public comment, or if they missed the comment period during the First Notice. During the Second Notice period, a legislative review of the rules is first conducted by JCAR staff and then at a meeting of legislative members. JCAR reviews the proposed rules for statutory authority, economic effects, clarity, procedural requirements and technical aspects, etc. During JCAR's review, JCAR and the Agency can agree to modifications in the rulemaking. As part of its review process, JCAR can take several actions. JCAR motions. Certificate of No Objection. With this Certificate, the Agency can proceed to adopt the rules by filing them with the Secretary of State for publication in the Illinois register. Recommendation. JCAR can issue a recommendation along with the Certificate of No Objection. The Agency has 90 days to respond in writing to JCAR's recommendation. The Agency can either modify the proposed rule in accordance with the recommendation or withdraw the rule. After going to Second Notice the Agency cannot modify or withdraw the rule except in response to a JCAR recommendation. The Agency however may adopt the rules with no changes any time after receiving the Certificate of NO Objection. Filing Prohibition/Suspension. If JCAR determines that a proposed rule constitutes a threat to the public interest, safety or welfare, the members can prohibit filing of the proposed rule or suspend an emergency or peremptory rule by a 3/5 vote. When this happens, the proposed rules cannot be accepted by the Secretary of State or enforced by the Agency. Emergency and peremptory rules, which have already been adopted, become null and void for 180 days, after which they are automatically repealed. By Chris Pozzi and David Banaszynski House Bills HB132 - Food Handling - Farmers Markets Sponsored by Tryon This bill would amend the Food Handling Regulation Enforcement Act and provide that the provisions and rules set forth in a Section concerning farmers' markets only apply to that Section (currently, the entire Act). Passed House; Senate-referred to Assignments HB Food Prep-Indoor Play Areas Sponsored by Mussman This bill would amend the Sanitary Food Preparation Act, requiring that all premises of a permitted food establishment, including indoor play areas, be kept clean, fully operative, and in good repair. The bill would set forth specific requirements for an owner or operator of a permitted food establishment with an indoor play area, sets mandatory procedures for when vomiting or fecal accidents occur in or around an indoor play area, and sets forth provisions concerning signage. Referred to Consumer Protection Committee HB E-Cigarettes Sponsored by Wills This bill would amend the School Code and the Smoke Free Illinois Act and provides that specified provisions concerning cigarettes apply also to electronic cigarettes. The amendment defines "electronic cigarette" as any electronically actuated device which in operation causes the user to exhale any smoke, vapor, or other substance other than those produced by unenhanced human exhalation. The amendment permits theater actors to use electronic cigarettes within performance spaces, as well as defining other terms. Referred to House Rules Committee HB Home Kitchen & Cottage Food Ops Sponsored by Tryon This bill would amend the Food Handling Regulation Enforcement Act and clarify that a home kitchen operation does not include a person who produces or packages non-potentially hazardous baked goods for sale by a religious, charitable, or nonprofit organization for fundraising purposes. The bill would add additional requirements in order to qualify as a home kitchen operation and make changes concerning the jurisdiction of the local governing body over home kitchen operations. The bill would remove a provision prohibiting certain types of jams and jellies from cottage food operations and increase the gross receipt threshold of exempt food from $25,000 to $36,000. Referred to House Rules Committee HB Smoking Cessation Prescriptions & Medicaid Sponsored by Martwick This bill amends the Medical Assistance Article of the Illinois Public Aid Code and provides that smoking cessation products shall not be subject to prior approval as a result of the 4-prescription limit. Referred to House Rules Committee HB Good Samaritans-Medical Clinic Sponsored by Fine This bill would amend the Good Samaritan Act to provide liability protection for the Volunteer Medical Reserve Corps members assisting certified local health departments during emergencies that are not declared disasters. Referred to House Rules Committee HB Sale of Unpasteurized Milk Sponsored by Breen This bill would amend the Grade A Pasteurized Milk and Milk Products Act and permits the sale and distribution of any milk or milk product for human use or consumption only if such milk or milk product has been produced and processed in accordance with rules adopted by the Department of Public Health. The bill would require the Department to adopt rules for the production and processing of unpasteurized milk or milk product. Provides that a seller or distributor is not liable for any injury caused to another person by that person's consumption of unpasteurized milk or milk product if that product has been produced and processed in accordance with the Department's rules. Referred to House Rules Committee HB Tattoo & piercing parlor registry Sponsored by Anthony This bill would amend the Tattoo and Body Piercing Establishment Registration Act, defining "person", and provides that the Department of Public Health is authorized to establish and assess penalties or fines against any person who violates the Act or rules adopted under the Act (instead of "a registrant for violations of this Act or regulations adopted under this Act"). Throughout the Act, the bill would replace references to "owner" with "operator" and provides that the operator of an establishment (rather than "an establishment") must meet specified operating requirements. The bill would provide that the Department of Public Health may assess a late fee if the renewal application and renewal fee are not submitted on or before the registration expiration date, and provides that in no circumstance will any penalties or fines exceed $1,000 per day for each day the violation continues (instead of "for each day the registrant remains in violation"). 11 IEHA NEWS // March 2015 Legislative Watch continued from previous page HB Food Handling-Bake sale exempt Sponsored by Meier This bill would amend the Food Handling Regulation Enforcement Act, providing neither the Department of Public Health nor the health department of a unit of local government may regulate the selling of food that is brought to a bake sale sponsored by a group of individuals or a religious, charitable, or nonprofit organization by individuals attending the bake sale for consumption at the bake sale. The bill would prohibit a business establishment dealing in the sale of food items from sponsoring a bake sale and provides that no fee may be charged for admission to a bake sale exempt from regulation under the amendatory Act, and defines "bake sale". Referred to House Rules Committee HB Food allergen information Sponsored by Gabel This bill would amend the Food Handling Regulation Enforcement Act, requiring restaurants to be aware of food allergy recalls from the U.S. Food and Drug Administration. The bill would require restaurants to indicate on a placard, poster, or menu that consumers with food allergies should inform a waiter or waitress of the restaurant of their allergy, and sets forth the requirements for the placard or poster or menu information. Referred to House Rules Committee HB Food Handler Training Sponsored by Pritchard This bill would amend the Food Handling Regulation Enforcement Act and provides that a non-restaurant food handler must receive training in basic safe food handling principles within 30 days of employment and every 3 years thereafter (currently, within 30 days of employment). The bill provides that a non-restaurant food handler who obtains American National Standards Institute-accredited training in basic safe food handling principles shall be deemed to have satisfied the training requirements of the Act., and allows the transfer of training between employers, but not individuals, if an employer uses an accredited American National Standards Institute training program. The bill prohibits the transfer of training between individuals or employers if an accredited American National Standards Institute training program is not used. Referred to House Rules Committee Senate Bills SB46 - Food Handling Regulation Sponsored by Martinez This bill would amend the Food Handling Regulation Enforcement Act, and provide that any individual seeking a food service sanitation manager certificate or a food service sanitation manager instructor certificate must receive a passing score on the examination set by the certification exam provider accredited under standards developed and adopted by the Conference for Food Protection or its successor organization (rather than a score of at least 75% on the examination). 2nd Reading Senate scheduled for 3/3/15 SB49 - Food Handling - Farmers Markets Sponsored by Koehler This bill would amend the Food Handling Regulation Enforcement Act, providing that the provisions and rules set forth in a Section concerning farmers' markets only apply to that Section (currently, the entire Act). Effective immediately. 2nd Reading Senate scheduled for 2/19/15 SB729 - Smoking while driving with Minors in Vehicle Sponsored by Silverstein This bill would amend the Illinois Vehicle Code, defining the term "smoking." This bill would prohibit the operation of a motor vehicle while a person is smoking in the vehicle if a person under the age of 18 is present in the vehicle. The bill indicates that police officers may not stop or detain a motor vehicle or its driver for violation or suspected violation of this Section, and makes a violation of this Section a petty offense with a fine not to exceed $100. Referred to Public Health Committee-postponed SB839 - Counties Code - Insurance Ordinances Sponsored by Althoff This bill would amend the Counties Code, and provide that a county board may by ordinance define, prevent, and abate nuisances including, but not limited to, noise pollution. Referred to Senate Assignments SB IDPH - Local Health Protection Sponsored by Delgado This bill would appropriate $20,000,000 from the General Revenue Fund to the Department of Public Health for local health protection grants for health protection programs. Referred to Senate Assignments SB Good Samaritans - Medical Clinic Sponsored by Silverstein This bill would amend the Good Samaritan Act to provide liability protection for the Volunteer Medical Reserve Corps members assisting certified local health departments during emergencies that are not declared disasters. 12 12 Legislative Watch continued from previous page SB Municipal Code - Restaurant Self-Inspection Sponsored by Steans This bill would amend the Illinois Municipal Code, providing that retail food establishments in a municipality in a county having a population of 2,000,000 or more inhabitants shall either receive one inspection every 2 years or submit one self-inspection report every 2 years if certain criteria are met. The bill would require the local health department for such retail food establishments to develop the self-inspection form and submit it to the Department of Public Health for approval before it may be used. Referred to Senate Assignments SB Private Water Well Testing Sponsored by Rezin This bill amends the Environmental Protection Act, and provides that in counties with a population of more than 100,000 and less than 150,000, an owner or operator of a solid waste disposal site, clean construction or demolition debris fill operation, waste transfer station, recycling center, or other similar landfill site shall conduct and pay for semiannual water well testing for private well owners in a 5-mile radius around the site. Referred to Senate Assignments JCAR Communicable Disease Code This rulemaking is being proposed to add the reporting of Reye's Syndrome to reporting requirements under Section Reporting is currently required under 77 Ill. Adm. Code 663 (Rules Governing the Reporting of Reye's Syndrome), which is being repealed. Because of the extremely low incidence, the Reye's Syndrome reporting rules will be repealed and Reye's Syndrome reporting will be added to Section of the Control of Communicable Diseases Code. 1st comment period expires 3/29/15 Communicable Disease Code The proposed amendments are to aid the Department in the restriction of travel of persons infected with or potentially exposed to infectious or communicable diseases in an effort to stop the spread of disease. The definition of "observation" will be amended to remove language related to travel. Definitions for "monitoring", "quarantine, modified" and "public transportation" will also be added 2nd Notice expires 3/14/15 Food Service Sanitation Code This rulemaking will amend definitions, amend requirements for certification and recertification issuance for Food Service Sanitation Manager Course (FSSMC) Certified Instructors, update course criteria qualifications, the procedure for becoming an instructor and the renewal process, add a new proctor application fee and approval process, and amend enforcement procedures for instructors administering the FSSMC course and exam. Several Sections and Appendices in the Code are being repealed to implement PA , which reduced the required training hours for an FSSMC from 15 down to seven and eliminated the State FSSMC exam. Clean-up changes are being made in the Section detailing required training hours for the Food Service Sanitation Manager Certification. The outdated number of hours that should have been removed in the amendment effective May 21, 2014 is now being removed. 2nd Notice expires 3/14/15 Local Health Protection Grant The proposed amendments make changes to the program standards for the four public health programs (Infectious Diseases, Food Protection, Potable Water Supply, and Private Sewage Disposal) funded by Local Health Protection Grants. The proposed amendments outline the specific program standards that the Department will use to evaluate local health departments. Summary of changes: 1. Section adds definitions for terms used in the rules and removes the definition of a term no longer used. 2. Section deletes an out-of-date publication from the list of incorporated materials and adds a list of referenced statutes and administrative rules. 3. Section clarifies how the Department will conduct reviews of local health departments, outlines how the Department will determine substantial compliance for the four public health programs during the local health department reviews, and clarifies the process the Department will use to notify local health departments of the determination of substantial compliance. 4. Section brings the infectious disease reporting requirements into line with the Control of Communicable Diseases Code (77 Ill. Adm. Code 690) and other Department rules. These amendments also update references and define the electronic reporting systems to be used for infectious disease reporting and investigations, and clarify training requirements for infectious disease staff. 5. Section replaces specific information that is contained in the Food Service Sanitation Code (77 Ill. Adm. Code 750) with appropriate references to those rules instead. This will eliminate the need to amend Section when changes to the Food Service Sanitation Code are made in the future. These amendments also clarify the selfevaluation/quality assurance review requirements and expand the training requirements for program staff. 6. Section adds licensing and inspection responsibilities for closed loop wells, in accordance with recent amendments to the Water Well Construction Code (77 Ill. Adm. Code 920). The amendments also clarify the requirements for inspecting water wells and closed loop wells and clarify training requirements for program staff. Section changes the reporting requirements for the Food Protection, Potable Water Supply, and Private Sewage Disposal programs from annual reports to quarterly reports. These amendments update references to statutes and Department personnel, and consolidate the record retention requirements for the four public health programs. 2nd Notice expires 2/18/15

Benny was born on September 25, 1930 in Chicago to the late Jean and Mary Lawanda (Simmons) Weiss. On March 31, 1956 he married Shirley Elaine Archer. Benny worked as a soil scientist and later worked at the Southern 7 Health Department as an inspector. He attended Walnut Grove Baptist Church and attended Pankeyville Baptist Church; he was also a Navy Veteran. Surviving family members include his wife: Shirley Weiss of Harrisburg; son: Randy Weiss of Morris, IL; son; Jerry (Becky) Weiss of Harrisburg; four grandchildren: Jason Weiss, Ben Weiss, Brian (Sydni) Weiss, and Matt (Maddie) Weiss; two great-grandchildren: Jaden Sigler and Mason Weiss; brother: Paul (Bonnie) Weiss; sister: Mary June (Gene) Hanson; several nieces and nephews. Benny was preceded in death by his parents and brother: Mike Weiss. Funeral services will be held at 11 AM, Thursday, February 19, 2015 at Reed Funeral Chapel. Rev. Mark Smith will officiate. Burial will follow in Walnut Grove Cemetery south of Harrisburg. Military graveside rites will be conducted by the Harrisburg and Carrier Mills American Legions and the National Guard. 31 Hoarding Center Clutter Image Rating In our work on hoarding, we ve found that people have very different ideas about what it means to have a cluttered home. For some, a small pile of things in the corner of an otherwise well-ordered room constitutes serious clutter. For others, only when the narrow pathways make it hard to get through a room does the clutter register. To make sure we get an accurate sense of a clutter problem, we created a series of pictures of rooms in various stages of clutter from completely clutter-free to very severely cluttered. People can just pick out the picture in each sequence comes closest to the clutter in their own living room, kitchen, and bedroom. This requires some degree of judgment because no two homes look exactly alike, and clutter can be higher in some parts of the room than others. Still, this rating works pretty well as a measure of clutter. In general, clutter that reaches the level of picture # 4 or higher impinges enough on people s lives that we would encourage them to get help for their hoarding problem. These pictures are published in our treatment manual (Compulsive Hoarding and Acquiring: Therapist Guide, Oxford University Press) and in our self-help book (Buried in Treasures: Help for Compulsive Acquiring, Saving, and Hoarding, Oxford University Press).
