21 PROJECT NEON FACT SHEET PROJECT NEON BENEFITS Safety: Project NEON system modifications, including traffic weaving reduction, will improve safety and help reduce congestion related crashes. Capacity: Projected traffic numbers show more than a half million vehicles a day are expected to travel the project corridor by The progressive solutions included in Project NEON will expand capacity and improve are traffic movement. Access: Innovative expansion in the downtown area will be easily accessible with improved access through Project NEON. Medical facilities, commercial centers, and arts and entertainment venues FACT SHEET Connections: While the Project NEON corridor is located in the downtown area, the project runs through the heart of Las Vegas and will positively affect travelers valley wide. Expanded High Occupancy Vehicle (HOV) connections, an entire system of traffic improvements, and easy downtown access will benefit commuters, visitors, and property owners. Local Economy and Jobs: As a 20-year program of improvements, Project NEON is expected to create hundred of planning and engineering jobs and thousands of local construction jobs over it s lifetime. It it anticipated that as long as the project moves forward, the local economy will benefit not only from maintaining existing jobs, but adding to the work force with construction workers, skilled laborers, engineers, planners, technical workers, and a myriad of other positions. The project will also improve access to downtown businesses and majority employment and entertainment centers, all of which can positively affect the local economy. Without NEON: Without Project NEON, it is expected that crash rates will continue to increase, safety will be compromised and travel times will worsen to stand-still traffic within the corridor. Level of service on the I-15 between the Spaghetti Bowl and Sahara Avenue is already suffering. Project NE- ON is essential to the progression of Las Vegas transportation and quality of life. 22 PROJECT NEON FACT SHEET FACT SHEET Major Project Elements: High-Occupancy Vehicle (HOV) Flyover: The one-mile flyover connects US-95 and I-15, providing more than 20 miles of seamless access via carpool lanes or express buses from the northwest valley to the back door of the Las Vegas Strip. This will benefit motorists who travel or take public transit from around the Las Vegas Valley to the Strip or downtown. Charleston Boulevard Interchange Reconstruction: Motorists will find Charleston Boulevard far easier to access with a tight diamond interchange that eliminates the looping ramp from eastbound Charleston to northbound I-15. This portion of the project will also improve traffic flow and help improve safety along I-15 at Charleston. SB Ramp Braiding: Several southbound ramp braids frontage-like roads that dip underneath or over major arterials, will help remove vehicles from I-15, allowing for a smoother commute for motorists traveling through the resort corridor. Landscape and Aesthetics: In line with NDOT s vision for I-15 corridor landscape and aesthetics, Project Neon will include structural and landscape treatments, flora and fauna overlays, and textures depicting the Meadows imagery for which the city was named. In addition to comprehensive landscape and aesthetics, the Spaghetti Bowl bridges will be repainted as part of this project. MLK Extension: The awkward Charleston off-ramp that chugs through MLK will be removed; instead motorists who depart southbound I-15 will exit onto MLK and either bypass Charleston using a new overpass or access Charleston with a customary off-ramp. MLK will stretch to Oakey Boulevard. Grand Central / Western Connection: Northbound I-15 traffic will be able to access Western Avenue and Grand Central Parkway from the center lanes of the freeway. Grand Central Parkway will lead motorists to Charleston Boulevard or on to the Clark County Government Center, the Las Vegas Outlets and downtown. Local Street Improvements: Alternate routes to downtown have become critical over the past three years as the community has celebrated the openings of The Smith Center, the Downtown Arts District, Container Park and local businesses. Project Neon will improve local street connections, enhancing east-west travel and access to downtown on the east side of I-15 and the new Medical District on the western side. 23 Frequently Asked Questions: Nevada Department of Transportation Disadvantaged Business Enterprise Program 1. What is a Disadvantaged Business Enterprise (DBE)? A Disadvantaged Business Enterprise or DBE is a for-profit business concern that is at least 51 percent owned by one or more individual(s) who is/are both socially and economically disadvantaged. The business concern may be structured as a: Sole Proprietor Partnership Corporation (Incorporation) Limited Liability Company In the case of a corporation, the socially and economically disadvantaged owner must own at least 51 percent of each class of voting stock issued and outstanding. 2. What is the Nevada Unified Certification Program (NUCP)? The Nevada Unified Certification Program (NUCP) is a consortium of Nevada certifying agencies that have mutually agreed to come together to implement the certification of prospective DBE applications. 3. What are the objectives of the DBE Program? The DBE Program objectives are as follows: To ensure nondiscrimination in the award and administration of federallyfunded contracts on Nevada highway, transit, and airport financial assistance programs. To create a level playing field on which certified DBEs can compete fairly for federal-funded contracts. To ensure that the DBE Program is narrowly tailored in accordance with applicable laws.

24 To ensure that only firms that fully meet the requirements in the eligibility standards are permitted to participate as DBEs. To help remove barriers to the participation of DBEs in federally-funded contracts. 4. What are the criteria for DBE certifications? Or can be rephrased as, What are the requirements for DBE certification? The eligibility requirements for certification as a DBE are stated in 49 CFR, Part 26, Subpart D Certification Standards. The following six requirements must be proved by a DBE applicant, but does not cover all the requirements found in 49 CFR, Part 26. Social and Economic Disadvantage: A disadvantaged owner must be a U.S. Citizen (USC) or a Legal Permanent Resident (LPR) also known as Resident Alien and meet the Federal definition of socially and economically disadvantaged as defined in 49 CFR, Part Presumptive groups include women, Black Americans, Hispanic Americans, Native Americans, Asian- Pacific Americans, Subcontinent Asian-Americans, or other minorities found to be disadvantaged by the regulations, or any individual found to be socially and economically disadvantaged on a case-by-case basis. Personal Net Worth: Only disadvantaged persons having a Personal Net Worth (PNW) of less than $1,320,000 (One Million, Three Hundred and Twenty Thousand Dollars) can be considered a potential qualified DBE. Items excluded from an individual Personal Net Worth calculation includes that individual s ownership in interest in the applicant s firm, and his or her equity in their primary residence. Business Size Standard: A firm (including its affiliates) must be a small business as defined by the Small Business Administration (SBA). It must not have an annual gross receipts over $22,410,000 in the previous three fiscal years ($56,420,000 for airport concessions in general and with some exceptions). Depending on the type of work the business performs, other lower size standard may apply. The number changes, so check to make sure your business gross receipts does not exceed the requirement. Ownership: Must be a for-profit small business where socially and economically disadvantaged individuals owned at least 51 percent interest and control management of the day-to-day business operations; ownership cannot be in name only.

25 Independence: The business must not be affiliated with another firm in such a way as to compromise its independence and control. These include, but are not limited to, such area as personnel, facilities, equipment, financial and/or bonding support, and other resources. This means a business should be operational and on its own, without support beyond what is applicable under normal industry standards. Management and Control: The socially and economically DBE owner(s) must possess the power to direct or cause the direction of the management and policies of the firm and to make day-to-day decisions, as well as long-term decisions on matters of management, policy and operations. Any delegation of duties must be revocable and where state law requires the owner to have a particular license or other credential in order to own and/or control a certain type of firm, then the socially and economically disadvantaged persons who own and control a potential DBE firm of that type must possess the required license or credential. A mere change in business structure to meet DBE requirements may not be sufficient to prove management and control. 5. How can I prove my group membership? Any of the following documentation which indicates group membership will be considered: Your birth certificate, naturalization papers, passport, Tribal Role Card or registration with the Tribe, United Indian Development Association and any other documentation that provide evidence of group membership. However, if you do not have any of the preceding documentation to show as evidence of group membership, you will have to submit one (1) Notarized statement from a relevant community organization attesting that you are regarded as a member of the group and stating how long you have been regarded as a member of that particular group. Group membership cannot be claimed solely upon being born in a certain country; and personal photographs are not acceptable evidence of group membership. Any documents presented as evidence of group membership in a language other English, must be translated and notarized. 6. If I do not fall within the presumptive groups, can I still be considered to be eligible for DBE? Yes, but you must prove by providing documentary evidence that you are socially and economically disadvantaged as stated in 49 CFR, Part 26, Appendix E. Socially and Economically disadvantaged individual means any individual who is a United States Citizen or Lawfully admitted Permanent Resident and who meets the criteria set forth in 49 CFR, Part 26, and any individual found to be socially and economically disadvantaged on a case-by-case basis. In every

26 case, consideration is given to education, employment and business history to prove disadvantage in entering or advancing in the business world. 7. Which business owner should complete the Personal Financial Statement (PFS)? The majority disadvantaged owner(s) whose ownership interest in and control of the business is/are relied upon for DBE certification should complete a Personal Financial Statement. Usually this is the person(s) who own 51 percent or more of the firm. If two disadvantaged owners make up a majority of 51 percent ownership, both individuals will be required to complete the PFS. For example, if there are 3 (three) owners A, B, and C; if owner A owns 33 percent, Owner B owns 33 percent and owner C owns 34 percent, the two disadvantaged owners whose ownership and control of the business is being relied upon MUST each complete a Personal Financial Statement. 8. When completing the Personal Financial Statement (PFS), should I include my primary residence even though it is excluded from the Personal Net Worth calculations? Yes, you must indicate the current market value of your primary residence on Page 2 of the PFS form together with any debt you owe against it. However, do not include the present market value or mortgage amount of your primary residence on summary Page 1 of the PFS. 9. Once my business is DBE certified, does the certification expires? No. DBE certification does not expire. Once a business is certified as a DBE, it shall remain certified until the certification is removed (the DBE owner is accorded due process opportunity). Also, certify DBE firms are required to update their certification by completing and submitting an Annual No Change Affidavit. 10. How long does it take to process an application? This will depend on the workload, the completeness of the file and how many applications are being processed. Generally, a certifying agency should not take more than 90 days to complete a prospective DBE application for certification. Under the UCP, it is reasonable to expect compliance with the 90 days, if all the certifying agencies work collaboratively. If the certifying agency cannot meet the 90 days timeline, it could request in writing for an extension once. The certifying agencies will explain fully and specifically why it needed the extension. The extension should be for no more than 60 days.

27 11. How much does it cost to apply for DBE certification? Absolutely nothing. The NUCP certifying agencies does not charge a DBE applicant any fee for processing DBE applications. The only cost to a DBE applicant may be the cost associated with notarizing the application. 12. If I have questions regarding the DBE application process, who can I contact for assistance? The DBE Application package comes with an instruction on how to complete the forms. However, if you have any questions, you can call any member of the NUCP. The certification application can be obtained online or you can contact Nevada Department of Transportation, Civil Rights Office, for information on how to complete the application on-line. 14. What is the difference between a DBE, SBE or SBA designations? DBE stands for Disadvantaged Business Enterprise and certification is under the 49 CFR Part 26. Only NDOT/NUCP certified DBE can be used to attain DBE credit to satisfy DBE goals on NDOT s project. SBE is a designation used for Small Business Enterprise. A SBE firm cannot be used to meet a DBE goal. The SBE certification requirements are quite different from those required of DBEs. SBA certification is granted through the U.S. Small Business Administration. The certification criteria is different from those required of DBEs. There are other certifying jurisdictions or entities out there. Make sure you know under what jurisdiction your firm is certified. The DBE is the designation that we are certifying under using the 49 CFR Part 26 for guidance.

28 15. Can I use the DBE Application to apply for Airport Concession as well? Yes. You can obtain a DBE application from NDOT or the Airports (McCarran and Reno) to apply for certification. All these certifying agencies under the U.S. DOT are required to use the same application for DBE certification and to have a Unified Certification Program (a one-stop-shop) for DBE certification within the state.
