ADOPTION OF MINUTES FROM PREVIOUS MEETING Motion No Moved by: Councillor Dennis Casey Seconded by: Councillor Susan Norcross CARRIED Be it resolved that the minutes of the September 6, 2016 meeting of the Environment and Conservation Committee meeting be adopted as presented. ITEMS OF BUSINESS Proposed 2017 Sewage Capital Works Projects The Committee reviewed the Sewage Capital Works Budget. Rob noted that ASI lists the budget items in order of priority. The Committee recommended that Randy Friesen from ASI attend the next meeting in order to comment to provide some expertise on the technical parts outlined in the sewage budget. Rob informed the committee that the sewage plant is due to replace blowers and diffusers, and MOE approval is needed to replace aging parts. The Public Works department will be submitting an amended Environmental Compliance Approval for the plant in order for this work to take place. Solar Projects - Draft Policy The Committee discussed the Solar Projects draft policy. After a first look at this draft policy, the committee had the following suggestions for changes: 1. It was agreed that we might want to consider allowing Small Scale Ground Mount Solar in rural residential zones. 2. Pat suggested that committee might want to review the screening requirements outlined in Ground Mount Solar - Micro or Small Scale under 2.i. viii and better define what these mean. 3. The committee agreed that we should consider better defining the section on Large Ground Mount Solar projects. Page 4 of 16

5 4. The committee agreed that we might want to revisit the fee structure for Ground Mount Solar Projects. 5. The committee discussed the restriction on the combined total acreage for Ground Mount Solar Projects within the Municipality and agreed that we will need to follow up with the applications that have already been approved by FIT in our area and look at ways to close this loop. The committee agreed that staff will need to go through all of our solar applications we have received thus far to see where they stand. 6. Pat recommended that we incorporate timelines into this policy so that the Planning Department is given at least a month to push these applications through in the even that a flood of applications are received at once. The committee passed the policy back to the staff for further review. It will be examined again at the next meeting. Conservation and Demand Management Plan - 5 Year Renewal Plan Tamara explained that it is time to start considering our update to the Conservation and Demand Management Plan. Councillor Casey recommended that the committee revisit this policy after our departments are given time to update the information. Class Environmental Assessment for Geotube Technology - Clean Water and Wastewater Fund Rob explained to the committee that we have applied to the Clean Water and Wastewater Fund and we are waiting to hear back. This fund would partially fund a Class Environmental Assessment for geotube technology at three potential sites in the Municipality. The geotubes would be available to private septic haulers in the area for a fee as regulations preventing field spreading are expected in the near future. Status of Landfills and Future Steps Rob explained to the committee that Thomas Contracting has declined their contract for West Bay Landfill. The Public Works department plans to arrange for the bins from West Bay to be transferred to another landfill within the Municipality. Public Works will incur the expense of transporting the waste with the use of companies possessing roll off bins. Road maintenance at West Bay will be covered by the municipal road crew. All other landfill tenders were accepted as awarded. The committee discussed the Construction and Demolition deficit this year. There was an increased expense because a build-up of old C&D was hauled out of our landfills. Rob explained that we will be tracking 2017 really tightly to see if a tipping fee increase is needed. The committee discussed the future of Haliburton Landfill. Rob explained that Public Works will be recommending putting a plan in place to convert Haliburton Landfill into a Page 5 of 16

6 transfer station. The Committee formally requested that we move forward with a strategy for Haliburton Landfill. Rob informed the committee that capacity at the Haliburton Landfill is estimated at under five years and the West Guilford Landfill is about eight years if we continue landfilling at our current rate. Inclement Weather Policy for Landfills The committee discussed that our landfills become a safety hazard to residents and staff during certain weather events. The committee recommended that our landfills should close at the discretion of the Landfill Manager. The committee recommended that we provide permanent signage warning residents that the landfill could be closed in the event of inclement weather. The committee also recommended that we track when the landfills have closed due to unforeseen circumstances. Motion No Moved by: Councillor Susan Norcross Seconded by: Councillor Dennis Casey CARRIED The Environment and Conservation Committee recommends to Council that, in the event of inclement weather, the Dysart landfills will close at the discretion of the Landfill Manager or designate. New Process for Cottage Kits The committee discussed the possibility of a local company preparing and storing our Cottage Kits in exchange for free advertising. The Committee recommended that we pilot this process with an expression of interest. It was agreed that we should ensure 100 kits are available at all times for a standby supply. The Committee recommended that we have these kits available for purchase by Easter Weekend. Councillor Norcross recommended that the committee review the Cottage Kit materials and ensure that the information is still relevant. The committee recommended that we ask our landfill attendants to retain our disposable Cottage Kit landfill cards so the Municipality can track the number of people using the landfill passes from the kits. ADJOURNMENT AND NEXT MEETING DATE The Committee discussed the format of the Environment and Conservation Committee. Councillor Casey recommended that the committee meet monthly. Councillor Norcross explained that experts would attend meeting as needed. The next meeting was set for March 2, 2017 at 10:00 AM. Page 6 of 16

9 THE CORPORATION OF THE UNITED TOWNSHIPS OF DYSART, DUDLEY, HARCOURT, GUILFORD, HARBURN, BRUTON, HAVELOCK, EYRE AND CLYDE POLICY NO. SOLAR PROJECTS POLICY PURPOSE: The purpose of this policy is to establish principles and priorities for the consideration of solar projects in Dysart et al and to establish a procedure for the processing of requests for Municipal Support Resolutions and/or public consultation and/or municipal commenting processes for applications under the Green Energy Act or any other approval process. The Municipality will consider Applications for Solar Projects on a case by case basis. SCOPE: This policy applies to the whole of the geographic area of the Municipality of Dysart et al including public lands. DEFINITIONS: Abutting means a property which shares a common boundary or is separated from an adjacent property by a road allowance open or closed. Applicant means the person(s) submitting the proposal to the Municipality and any Application(s) for permits or approvals from any government or agency. Environmental Protection means lands designated and/or zoned Environmental Protection Zones in the Municipality of Dysart et al Official Plan or Zoning By-law. Ground Mount Solar is defined as a solar project which is pad mount, rack mount or otherwise mounted for installation on the ground. Official Plan means the Dysart et al Official Plan and any amendments thereto. Owner(s) means a person(s) identified as the Owner(s) in the Municipality property system as may be amended from time to time upon the receipt of Land Transfer Deeds, written Solar Projects Policy: Page 1 Solar Projects Draft Policy Page 9 of 16

10 notification from lawyers handling estates or property sales and/or reports from the Municipal Property Assessment Corporation. Residential is defined as a property which is zoned in a Residential category in the Municipal Zoning By-Law. Road Authority means the Ministry of Transportation, the County of Haliburton or the Municipality of Dysart et al. Rooftop Solar is defined as a solar project installed on the roof of any structure. Settlement Area means a Hamlet or Existing Residential area as designated in the Municipality of Dysart et al Official Plan. Large Scale Industrial Solar Project means any Ground Mount Solar project of more than 5 acres on a property. Wetland means an area identified as a Provincially Significant Wetland (PSW), Locally Significant Wetland or Unevaluated Wetland in the County of Haliburton Geographical Information System (GIS) based on data received from the Ministry of Natural Resources. Zoning or Zoning By-law means the Dysart et al Comprehensive Zoning By-law and any amendments thereto. PRINCIPLES: The Municipality of Dysart et al supports, in principle, solar projects as an alternate form of energy generation. However, municipal support is prioritized and limited as follows: ROOFTOP SOLAR 1. First Priority will be given to Rooftop Solar projects on existing structures. 2. Applications for Rooftop Solar projects will be processed on new or expanded structures only when and where the purpose or use of the structure is permitted in the Zoning Bylaw and the proposed structure is setback from property lines and/or screened in such a manner as to address any potential land use conflicts to the satisfaction of the Municipality. 3. Rooftop Solar projects being proposed on a property under Site Plan Control or any Rooftop Solar projects being proposed on any existing or proposed structures on a non- Residential property or non-agricultural lands may be subject to Site Plan Control to address any site development or redevelopment related issues at the sole discretion of the Municipality, if such property is subject to Site Plan Control in the Official Plan. 4. In the event that the Owner(s) is not the Applicant for a Rooftop Solar project, written authorization shall be received as part of the Building Permit and/or Site Plan application process. 11 GROUND MOUNT SOLAR MICRO OR SMALL SCALE 1. Second Priority will be given to Micro Ground Mount Solar projects consisting of one of two pad mount or rack mount installations (i.e. MicroFIT) per property located on lands outside of Settlement Areas when and where the proposed project is suitably setback from property lines and/or screened in such a manner as to address ant potential land use conflicts to the satisfaction of the Municipality. 2. Third Priority will be given to Small Scale Ground Mount Solar projects of 5 or less acres (i.e. FIT). These projects will be considered subject to the following: a. For the purposes of the 5 acre area calculation, the Applicant shall include the area of the proposed Ground Mount Solar project on the property, including the proposed layout and any access routes, buffer zones or setbacks that would take Agricultural land out of production and area required to facilitate the solar project. b. The Applicant shall provide a written authorization from the Owner(s) of the Property. c. The subject portion of the property shall be located outside of a Settlement Area (i.e. a village or hamlet). d. The subject portion of the property shall not be designated Agricultural or Environmental Protection. e. The subject portion of the property shall not be zoned Residential. f. The subject portion of the property shall not be abutting a Residential property without written clearance from the abutting property owner, said authorization to accompany the Application. g. The subject portion of the property shall not be located within 120 metres of a Provincially Significant Wetland or located within a Locally Significant or Unevaluated Wetland unless an Environmental Impact Study has been prepared to the satisfaction of the Municipality of Dysart et al and the recommendations contained within the EIS are addressed by the Applicant. h. The subject portion of the property shall not be zoned Environmental Protection or located within 30 metres of a watercourse or located within a floodplain. i. The Applicant shall submit a detailed drawing(s) drawn to scale showing the proposed Ground Mount Solar project on the subject portion of the property including: i. Property dimensions and area ii. Site location, dimensions and area of the proposed Solar Project iii. Layout of proposed solar installation iv. Location and type of any existing structures on the property v. Proposed location of entrance and access roads to solar project vi. Proposed setbacks from the solar installation to the property lines, existing buildings, watercourses and wetlands vii. Distance from proposed solar project to any residences on all abutting properties Commented [MB1]: The Environment and Conservation Committee ( the committee ) agreed that we might want to consider allowing Small Scale Ground Mount Solar in rural residential zones. 12 viii. Existing and/or proposed screening or buffering between proposed solar installation and the adjacent road and/or abutting residences type and location ix. Aerial photography showing the existing land uses together with proposed Solar Project site j. The Applicant shall submit confirmation from the Road Authority that an entrance would be available to access the subject site such to any requirements of the Road Authority to obtain permits or approvals. 3. The combined total acreage of all Ground Mount Solar projects of 5 or less acres which may be endorsed by Council across the Municipality shall not exceed 100 acres which represents the equivalent of one Municipal lot. 4. Once Council has endorsed Applications for Ground Mount Solar projects which, if approved to proceed, would reach the maximum combined total acreage set out above, no new Applications will be processed. This combined total acreage includes prior Applications endorsed by Council which may not have received funding but which may be resubmitted to the Municipality. 5. In the event that any Application is formally withdrawn by an Applicant or an Owner withdraws their authorization in writing, the Municipality may consider an alternate Application that meets the requirements listed above provided that the total acreage proposed in the new Application would not exceed the maximum combined total acreage. Commented [MB2]: Pat Martin suggested that committee might want to review the screening requirements outlined in Ground Mount Solar - Micro or Small Scale and better define what these mean. GROUND MOUNT SOLAR LARGE SCALE INDUSTRIAL SOLAR PROJECTS 1. No Large Scale Industrial Solar Applications for Ground Mount Solar projects exceeding 5 acres will be considered by Council for endorsement unless they are completely screened and meet all other conditions required by Micro and Small Scale Solar Projects. APPLICATION PROCESS: Rooftop Solar All inquiries regarding the proposed development of Rooftop Solar projects shall be processed by the Chief Building Official or designate in accordance with the Ontario Building Code Act and its regulations and, where applicable, the Official Plan policies and Site Plan Control By-law. Commented [MB5]: The committee agreed that we should expand on this section/offer a better definition. Commented [MB6]: The committee agreed that we should incorporate timelines into the application process so that the Planning Dept is given adequate time to push these applications through Applications for Roof Top Solar projects shall be submitted on the Municipality application forms for building permits and/or site plan approval, including prescribed information. Applications shall be accompanied by the fees and deposits as may be determined by Council in the Building By-law and/or Fees By-law as may be applicable. In the event of Site Plan Approval, the Owner shall be required to enter into a Site Plan Agreement to be registered on the property and shall pay the fees, deposits and/or securities as applicable. 13 Ground Mount Solar All inquiries regarding the proposed development of Ground Mount Solar projects in the Municipality shall be directed to the Chief Building Official or designate. The Chief Building Official shall provide a copy of this Policy to any prospective Applicant. Any person seeking to file an Application for a Micro Ground Mount Solar installation shall file an Application with the Chief Building Official or designate. If the Application meets all of the requirements of this Policy, the Chief Building Official shall Report to Council recommending endorsement. If the Application does not meet the requirements of this Policy, the Applicant will be notified in writing and may come as a Delegation to Council in support of their Application. Commented [MB7]: Currently Council or Planning would provide this policy. Any person seeking to file an Application for a Small Scale Ground Mount Solar installation of 5 acres or less will be advised whether or not the Municipality has processed the maximum number of Applications under this Policy. The person will be given the option to place their complete Application on file, in the event that other Application are withdrawn for future consideration. In the event that a person chooses to proceed without municipal support, a letter of opposition will be issued by the CAO as per this Policy to the approval body. If the Application meets the municipal requirements, the Chief Building Official shall prepare a Report to Council and arrange with the Municipal Clerk for the Applicant to attend as a Delegation at a Regular Council Meeting. A copy of any presentation to be made by the Applicant to Council shall be submitted not less than 10 days prior to the Council meeting in order that the Chief Building Official or designate may prepare a Report to Council to be considered at the same meeting. Council, in its sole discretion, will decide whether or not to endorse any Solar project. If Council chooses to support an Application, they will pass the necessary Resolution for signing by the Reeve and/or Clerk. Upon Council endorsement of an Application, the Chief Building Official or designate may sign any Forms as may be required with respect to conformity with the Official Plan and/or Zoning By-law and/or land use planning clearance. Large Scale Industrial Solar Any person seeking to file an Application for a Large Scale Industrial Solar project of greater than 5 acres will be advised that any Application will not be processed unless approved by Council. Prior Applications endorsed by Council In the event that an Applicant has previously received Council endorsement for a Small Scale Ground Mount Solar Application prior to the approval date of this Policy and in the event that Solar Projects Policy: Page 5 Solar Projects Draft Policy Page 13 of 16

14 one or more of the requirements of this Policy have not been met, Council may decide whether or not, in its sole discretion, to reaffirm its Municipal Support Resolution. Any such request for endorsement shall be filed with the CBO and placed on the next Council agenda by the Clerk. The CBO may prepare a Report to Council or recirculate the Report to Council prepared at the time of the original request if no changes have been made to the Application. FEES & CHARGES: Rooftop Solar The usual fees for building permits and/or site plan approval shall apply to Rooftop Solar. In the event that a Municipal Official is required to sign a form in conjunction with any Rooftop Solar Application, this Authority is delegated to the CBO and Clerk (second signature) and no Council approval is required provided that the Applicant has met or will meet the requirements set out in this Policy prior to installation. Ground Mount Solar The Application Fee for Micro Ground Mount Solar Clearance is $500 which is non-refundable. The Application Fee for Small Scale Ground Mount Solar Clearance is $1500. In the event that the Applicant for a Small Scale Ground Mount Solar has preconsulted with the Chief Building Official or designate and the Application meets the Municipality requirements, half of the Application Fee ($750) will be returned to the Applicant at the time of Council endorsement provided that no external costs have been incurred while processing the Application. In the event that the Applicant does not preconsult and/or the Application does not meet the requirements set out in this Policy, the entire Application Fee is non-refundable. Commented [MB8]: The committee agreed that we may want to reduce the fees. In the event that the Application is a resubmission for a Council resolution only and there are no changes and no Delegation or Report to Council required, no Application Fee would apply. If there are any changes to the Application at the time of resubmission which require a Report to Council, an Application Fee of $750 is required. PUBLIC CONSULTATION: Rooftop Solar Projects There is no Public Consultation process for Rooftop Solar projects provided that the Applications meet the requirements of this Policy. Ground Mount Solar Projects Prior to Council consideration, the CBO shall issue a Notice to the Applicant, property owner and all abutting land owners notifying them of the date, time and location of the meeting where the Application will be considered by Council as well as when, where and how to obtain a copy of the Report to Council prior to the meeting. This Notice shall be issued not less than 20 Solar Projects Policy: Page 6 Solar Projects Draft Policy Page 14 of 16

15 days prior to the meeting date and the Report shall be publicly posted not less than 72 hours prior to the Council meeting for viewing. Large Scale Industrial Solar Projects In the event that any person proposes a Large Scale Industrial Solar project in the Municipality, the Applicant shall register their intent with the CBO including the proposed location(s) or areas of the Municipality under consideration. Upon registration, Council shall be copied on all correspondence to the public by the Applicant including any invitations of notices to attend a public consultation session. Council may, at its sole discretion, convene its own Public Meeting to inform the public of any Large Scale Industrial Solar projects proposed in the Municipality. Public Notice shall be given by the CBO to the Applicant, the Owner(s) and the Owners of all properties within 120 metres of the subject property/ies. Said notice shall be given by regular mail not less than 20 days prior to the Public Meeting. Notice shall also be posted on the municipal website and in any other manner deemed appropriate by Council to make the public aware of the meeting. All Public Submissions received at any Public Meeting will be forwarded to the Premier, Minister of Agriculture, Minister of Energy and the local MPP together with Council s letter of objection. Solar Projects Policy: Page 7 Solar Projects Draft Policy Page 15 of 16

16 Municipality of Dysart et al Request for Expression of Interest Assembly and Storage of Dysart et al Cottage Kits The Municipality of Dysart et al is issuing a Request for Expression of Interest from local businesses interested in the assembly and storage the Dysart et al Cottage Kits. In exchange for this service, the business will be given the opportunity to include one (1) piece of advertising material for their company in each kit. Since 2011, the Municipality has distributed 500 kits each summer to cottage rental agencies, lake associations and visitors renting in our area. The Cottage Kit contains literature explaining items such as hours of operation and locations of landfills, rules and regulations, recycling guide, a onetime Landfill Pass, two (2) transparent blue recycling bags for containers, one (1) transparent bag for garbage, one (1) paper bag for fibres, and some additional safety and tourism information. The Municipality will provide bags and content for a total of five hundred (500) kits. The kits will need to be stored off site with one hundred (100) kits ready and available on standby for the Municipality s use at all times while supplies last. The first one hundred (100) kits will need to be available by Wednesday, April 12 th, Submission Details and Requirements Expressions of Interest can be sent via to Mallory Bishop, Environmental Coordinator (mbishop@dysartetal.ca) until closing at 3:00 pm local time on Thursday, March 16 th, Submissions should be under one (1) page in length and will indicate the type and size of advertising content that will be included in each kit (e.g. 1 page, 1 brochure, 1 fridge magnet, etc.).
