Submission on Plan Change PC114-Landscapes We would like to make a submission against this plan change with respect to the following rules; However would support this with the following considerations and alterations to the plan.
39 In relation to our property at 2108 Whangarei Heads Road, we feel that the ONL & ONF mapping do not truly represent the characteristics of the property and as such we would request alteration to this in order better protect the area that it is designed for. LAN Non-Complying Activities 1. Subdivision within an ONL within the Coastal Area is a Restricted Discretionary Activity The reason for this alteration is we believe that the rule is contrary to the Objectives & Policies of the LAN.1 & LAN.1.3 whereby the objective is to Restrict NOT prevent subdivision. Submission on Plan Change PC85C- Rural Village Environment We would like to support the Rule Change RVE. However we would like to submit as part of this rule change that an area of 2000m2 on the northern corner, closest to the main Whangarei Heads Road, be rezoned under this plan change to Rural Village Centre. Our reason for this is that we believe McLeod Bay is a developing area that requires future business and services within the next 10 years that would be independent to the Parua Bay Centre. Our property is situated approximately 50 metres from the existing Rural Village Centre, and is one of the larger parcels of land which offers substantial road frontage and is able to buffer any adverse effects on neighbouring residential property. In summary, our property was purchased in December 2015 with a view to develop the property as well as beautify and protect its natural characteristics as the land and dwellings were in a poor state.we had begun this process when notified of the ONL & ONF provisions that we had not been made aware of at the time of purchase, (Not in LIM report obtained at the time nor disclosed when speaking with Planners during the Due Diligence period when discussing subdivision)as per our submission on this and our communication with Glenn Mortimer. We have also included this in our submission as above. However the recent proposed changes have made us consider various options for the property and look towards a positive approach to the new plan. With this in mind as the plan changes require us to protect from development and subdivision approximately half of our land we would like to consult further on the mutual benefits that this may have to the overall environment and impact upon it. We do find the numerous zonings and rules are unessarily confusing even with a background in land development and wonder how the general public are expected to understand them. We feel that more weight should be placed on the Living Environment Rules and the overlays should be less rule based and more of a policy statement.

I support/oppose/seek amendment to the specific provision listed above. My submission is: The land identified as Area 1 on the attached map be zoned as Rural Village Residential Environment. My Reasons are: 1) This land in its new subdivided form fits neatly into the adjoining Rural Village Environment RVE (Waipu Cove Village) Proposed Rural Village residential rather than the Proposed Rural Productive Environment land. 2) The adjoining lands to the North and to the East of the properties are already proposed to be Rural Village Environment. 3) The land is fully serviced with Access roads, Pedestrian access, Reticulated Potable Water, Reticulated community Wastewater, Power & communications. 4) The lot sizes are 1,492 sqm, 2,653 sqm, 2,589 sqm & 3,301 sqm which does not fit with Proposed Rural Productive Environment - RPE objectives or policies but more closely aligns with objectives and policies of the Rural Village Environment. 5) Almost 50% of each lot is in covenanted native bush (Included within the Proposed High Natural Character Area) so the actual building areas of each lot are approximately 800sqm, 1,200sqm, 1200sqm, 1,500sqm the imposition of the Rural Productive building boundary setbacks would make it impractical to build on these sites without encroaching into the native bush conservation area. 6) There are sufficient other covenant controls e.g. height restrictions on the buildings to protect the nature of the area. 7) Better protection is afforded to the area by inclusion in the Rural Village Residential Environment. 8) The area does not meet many of the Objectives and Policies of the Proposed Rural Productive Environment. a. Lot Size e.g. RPE minimum net site area of 20ha. b. Land Use Productive land This land is now effectively larger lot residential Holiday homes in Waipu Cove village. 9) The Proposed Rural Productive Environment rules restrict the land use, but do not achieve many of the objectives and policies of the RPE.
