Section 22425(m)(7) of Article 4, Chapter 22, Division 2, of Part 1 of Title 5 of the Guam Code Annotated, as repealed and reenacted by 3(e) of Chapter 111 of Public Law Number 24-59, is hereby repealed and reenacted to read as follows: "(7) To the extent of any bond proceeds not required for the projects listed in Items (1) through (6) of this Subsection (m), any remaining balance other than the portions designated to be used for the Northern High School, or to pay General Fund expenses, may be applied to the cost of: (i) repairing or reconstructing the Inarajan Elementary School; (ii) repairing or reconstructing the earthquake-damaged Ordot-Chalan Pago Elementary School; (iii) reconstructing the earthquake-damaged gymnasium and classrooms at Inarajan High School; (iv) repairing and reconstructing Upi Elementary School; (v) repairing or reconstructing earthquake damage at any other school; (vi) construction of additional elementary schools in Northern Guam, subject to Subsection (n) of this Section; (vii) needed infrastructure improvements for schools;

7 (viii) the completion of design plans for the Northern High School; (ix) the design, construction and renovation of fahies on the existing campus of the Guam Community College not to exceed Two Mdlion Eight Hundred Fdty Thousand Dollars ($2,850,000) within the following categories: Water Storage System; Water Distribution; Stormdrain Upgrades for Buildings A, B and C; Renovation of Buildings A, B and C; Upgrade of Science Labs in Building A; Renovation of the Administration Building; Elevator Upgrade in the Administration Building; and Repair of Building F; (x) the Department of Education's ten percent (10%) local share, over and above the approved FEMA funding, for the architectural, engineering design, construction and repair of the Jose Rios Middle School (formerly Piti Middle School) from damage resulting from Super Typhoon Paka; or (xi) other projects approved by subsequent legislation."

OVERVIEW The Committee Education held a public hearing on Friday, March 26, 1999 at 10:OO a.m. at I Liheslaturan Public Hearing Room. Public Notice of the hearing was announced in the March 2oth, 25th and 26th 1999 issues of the Pacific Daily News. Committee Members Present: Vice Speaker Lawrence F. 15 Providing Testimony on the Bill: Mr. John T. Cruz, President, Guam Community College (oral) Mr. Atanacio T. Diaz, Chairman, Guam Community College (written) Dr. Rosa Roberto Carter, Vice Chairperson, Guam Community College (written) 11. Testimony Mr. John T. Cruz, President, Guam Community College. Mr. Cruz testified in favor of the Bill. He stated that the funds appropriated for a new campus could be better spent on renovating the existing campus. He hrther stated that, given the Government's present financial situation, the likelihood of GCC obtaining the funding to build a new campus is not realistic. Mr. Atanacio T. Diaz, Chairman, Guam Community College. Mr. Diaz submitted written testimony in favor of the Bill. Mr. Diaz noted that GCC has not received any capital improvement funds in over five years and that the campus and facilities are "in dire need of repair". Mr. Diaz concluded that Bill No. 118 will greatly improve the campus and provide students with adequate facilities and basic infrastructure. Dr. Rosa Roberto Carter, Vice Chairperson, Guam Community College. Dr. Carter submitted written testimony in favor of the Bill. She noted that re-allocating funds that had been previously appropriated for the construction of a new campus to the existing campus is a "more realistic purpose". She requested that the Legislature take action promptly for safety reasons and improved day-to-day operation Findings and Recommendation The Committee on Education finds Bill No. 118 (COR) will make it possible for the Government of Guam to meet its ten percent (10%) share of Typhoon Paka recovery costs. The Committee further finds that prior year appropriations of school bond hnds for infrastructure on a new GCC campus could be better spent on renovating and improving the existing campus and facilities. The current financial condition of the Government of Guam does allow for realistic expectations that a new campus can be built any time soon. The reallocation as provided in the Bill however, will allow GCC to make much needed repairs on its existing campus and facilities. It is the recommendation of the Committee on Education that Bill No. 118 (COR) be reported out with the recommendation TO DO PASS.

On behalf of the Board of Trustees, I wholeheartedly support Bill 118, specifically the following section, "reallocate funds previously appropriated to the Guam Community college for infrastructure on a new campus for design, construction and renovation of facilities on the existing campus." As you know, the College has not received capital improvement funds from the General Fund for well over five years. GCC has been able, barely, to meet Life Safety, ADA, Building Code and other operational requirements through internally generated funds. Our facilities are in dire need of repair. The current state of the campus is, we believe, substandard and will continue to deteriorate unless substantial funding is committed. Major problems at the campus include flooding during heavy rainfall due to substandard drainage, chronic lack of water supply in the campus vicinity that poses health hazards and forces cancellation of classes, severe rust on administration building I-Beams and purlins which greatly weaken the structural integrity of the building thus posing a potential safety hazard. Substandard electrical distribution panels in buildings A, B and C cause breaker tripping and power disruption. These buildings were constructed in the late 60s earq 70s and did not account for the current electrical requirements. In February 1998, the Guam Community College Board of Trustees voted to focus efforts on renovation and construction of the current campus. The College has received a $3 million federal loan to Construct student housing. The design work for this project is ongoing. The housing project requires the construction of a water storage tank in order to receive the proper building permits.

20 The College is also planning, without impacting the General Fund, to construct a Campus Center Building. This building will house the bookstore, student gathering areas, meeting rooms and cooking and dining facilities. The Campus Center Building will give GCC the identity of a college and give students a sense of belonging to an institution of higher leaming instead of a high school for which the campus was originally constructed. Bill 118 will greatly support our efforts to improve the campus and provide our students with adequate facilities and basic infrastructure.
