2 CASE NUMBER RZR GCID GWINNETT COUNTY BOARD OF COMMISSIONERS LAWRENCEVILLE, GEORGIA RESOLUTION ENTITLED: Amendment to the Official Zoning Map of Gwinnett County ADOPTION DATE: FEBRUARY At the regular meeting of the Gwinnett County Board of Commissioners held in the Gwinnett Justice and Administration Center, Auditorium, 75 Langley Drive, Lawrenceville, Georgia. HUNTER, which carried a 4-1 vote, the following Resolution to Amend the Official Zoning Map of Gwinnett County is hereby adopted: WHEREAS, the Municipai-Gwinnett County Planning Commission has held a duly advertised public hearing and has filed a formal recommendation with the Gwinnett County Board of Commissioners upon an Application to Amend the Official Zoning Map from C-2 to R-TH by EDGE CITY PROPERTIES. INC for the proposed use as TOWNHOMES on a tract of land described by the attached legal description, which is incorporated herein and made a part hereof by reference; and WHEREAS, notice to the public regarding said Amendment to the Official Zoning Map has been duly published in THE GWINNETT DAILY POST, the Official News Organ of Gwinnett County; and WHEREAS, a public hearing was held by the Gwinnett County Board of Commissioners on JANUARY 24, 2017 and objections were filed.

3 CASE NUMBER RZR GCID NOW, THEREFORE, BE IT RESOLVED by the Gwinnett County Board of Commissioners, that the aforesaid application to amend the Official Zoning Map from C-2 to R-TH is hereby APPROVED with the following enumerated conditions: I. To restrict the use of the property as follows: A Attached townhouse dwellings and accessory uses developed in general accordance with the site plan presented at the january 24, Board of Commissioners' hearing. Development shall not exceed 30 units. B. Buildings shall be constructed of brick or stone on all sides (front, sides, and rear). Front facades may include minor treatments (such as dormers, bay windows, gables, etc.) of fiber-cement siding or shake. Such treatments may be no more than 25% of the front fa~ade. Eaves of the units may be of fiber-cement siding. Architectural elevations shall be submitted for review and approval of the Director of Planning and Development. C. The minimum heated floor area per dwelling unit shall be at least 1,750 square-feet. D. Homes shall include a minimum of five different facades to create a variety in the community and to not appear identical. E. All homes shall have double car garages. F. The mandatory HOA shall limit the number of homes that may be rented at any one time to 20% of the development. G. Per the site plan presented at the January 24, Board of Commissioners' hearing, the development shall contain a park area and/or common area for the use of residents. 2. To satisfy the following site development considerations: A Revise the final site plan to meet the full landscaping, buffer, external setback, and internal yard requirements of the R-TH district. B. The landscaped setbacks along Hamilton Creek Parkway shall include a decorative fence/wall of masonry and/or decorative metal. The development shall have an entrance monument constructed of masonry and/or decorative metal. The entrance monument shall be located in the "Park" area at the entrance to the development. There is to be a four foot high berm with landscaping integrated into that area so as to provide a screening to the rear of units 28, 29, and 30. The landscaping is to be a mixture of plants with evergreen background trees that provide the maximum screening being a minimum of six feet tall at time of planting. Landscaping, fence/wall and entrance monument design shall be subject to review and approval of the Director of Planning and Development prior to the issuance of a Development Permit. C. All grassed areas shall be sodded.

4 CASE NUMBER RZR GCID D. All utilities shall be placed underground. E. The developer/builder agrees to create a mandatory HOA. The mandatory HOA shall control all common areas. The mandatory HOA shall be responsible for the exterior upkeep and maintenance of all townhomes, including roofs, and all the landscaping associated with the townhomes including, but not limited to, the entrance area, common areas, and individual lots. The HOA shall also maintain and keep in good repair, any perimeter fencing and/or landscaping and screening originally installed by the Developer, whether or not such fencing and/or landscaping and screening is located on a privately-owned lot, common area, or public right-of-way. F. Wooden privacy fences on interior lots shall be prohibited. G. Developer shall be responsible for providing asphalt topping on Hamilton Creek Parkway from SR 124 to the Development to Gwinnett County Department of Transportation standards in place at the time of original rezoning of the property. Limited to use as a single-family residence, a dog kennel and boarding facility, and a dog training/competition special event facility as a special use. 2. Obtain all necessary development and building permits, and bring the site and structure(s) up to all applicable zoning, development and building codes within 60 days of zoning approval. 3. No parking or special event area shall be allowed along Harbins Road. Special event areas shall only be allowed along Jones Phillips Road. Parking spaces shall be provided on a paved surface or approved porous paving system only. 4. The swimming pool shall be enclosed by a fence made from I 00% opaque material and painted in non-white (earthtone) colors within 60 days of approval of the Special Use Permit. Final fence design and colors shall be subject to the review and approval of the Director of Planning and Development. 5. Ground signage shall be limited to one monument-type sign, and shall be subject to review and approval by the Director of Planning & Development. The sign shall include a minimum two-foot high brick or stacked stone base. The masonry base shall extend at least the full width of the sign cabinet, and the sign cabinet shall be fully recessed and surrounded by the same materials. The ground sign shall not exceed six feet in height. 6. Lighting shall be contained in cut-off type luminaries and shall be directed in toward the property so as not to shine directly into adjacent properties or rights-of-way. All lighting shall be turned off at 9:00 p.m. 7. The use of an outdoor public address system shall be prohibited between 9:00 p.m. and 9:00 a.m. daily. 8. The applicant shall prepare and submit an animal waste management plan to the Department of Planning and Development for review by the appropriate agencies. 9. Outdoor storage shall be prohibited.
