2 Bid Number Suburban Schools Food Service April 2013 Purchasing Co-Op General Instructions The Suburban Schools Food Service Purchasing Co-Op solicits sealed bids for supplying bread and rolls to its member schools for the 2013/2014 school year. The purchasing co-op reserves the right to reject any and all bids. Bids are due in the office of Ms. Doreen Deola, Nutritional Services Supervisor, c/o Centennial School District Administration Building, 433 Centennial Road, Warminster, PA on or before 11:00 a.m., April 26, Bids will be opened at 11:00 a.m. on April 26, 2013 at the above address. 3 Bid Number General Specifications April All bids must be submitted on the attached set of forms. The original bid shall be signed in ink and submitted as an original bid. Unsigned bids will be rejected. The company submitting a bid should retain a copy as a reference. 2. All bids will remain firm for the 2013/2014 school year beginning July 1, 2013 through June 30, 2014, which would also be the contract period. 3. Each school district is exempt from the payment of any Federal, State, Local, or Transportation taxes and sales tax. The price submitted must be net exclusive of taxes. 4. All prices will be F.O.B. destination to include inside delivery to the school or schools as specified when contracts are awarded. Freight, delivery, and any other costs and fees must be included in all pricing submitted in the bid. 5. The Co-op reserves the right to accept or reject any or all bids and to waive any informalities permitted by law. 6. Any inability to comply with the conditions and specifications as outlined must be clearly stated in your bid. 7. Only strictly fresh product made with pure, good quality ingredients will be acceptable. Delivery of day old product or frozen then thawed product, broken or unclean packaging, inferior or inconsistent products, or unclean racks will be cause for rejection of deliveries and cancellation of contract. 8. The supplier will submit a current product list of all items, including prices not included in this bid. 9. Deliveries have to be made to each school no later than 9:00 a.m. of each delivery day. NO DELIVERIES ARE TO BE LEFT OUTSIDE ANY BUILDING during school hours. All products are to be packed in waxed or plastic sanitary containers. If early deliveries are necessary, secure breadboxes or wrapping are mandatory for delivery. 10. All vendors shall comply with the Commonwealth of Pennsylvania, Department of Health, and United States Department of Agriculture rules and regulations relative to bakeries and baked products. HACCP Guidelines should be followed. All product and ingredients shall be grown and processed in the United States of America. It is expected that each vendor shall have a written policy in place regarding Bio Security and Food Supply. 11. Delivery slips are to be itemized, priced and totaled. Statements are to be sent monthly, on or before the 5th working day of the following month, to each participating district. All deliveries made to individual schools shall be substantiated by obtaining the signature of the Cafeteria Manager or designee on the delivery slip, a copy of which is to be left at the school. 12. No substitutions will be accepted at any time unless approved by the appropriate Director of Food Service. 13. U.S.D.A. Commodity foods are to be used, when available, in the manufacture of all bread and rolls listed on this bid and the districts must receive the prices that reflect the government commodity discount. 14. Uniform product size must be maintained throughout the school year for the accepted product.

4 Bid Number April A nutrient analysis sheet in the IFDA format of all the food products listed shall be included with the bid for all items bid. The sheets submitted are to be based on a per serving amount and include detailed information of the content of each ingredient in the product by weight. All ingredients of product must be listed. The nutrient analysis sheets must also list the following: 1) Bread/grain equivalents in accordance with the National School Lunch Program 2) Percent of whole grain/whole wheat per serving 16. Be advised that in order to enter into a contract with the Suburban Schools Food Service Purchasing Coop, it will be necessary for you to comply with Public School Law Section III relating to employee screening for certain criminal offenses and to enter into an indemnification agreement with the Suburban Schools Food Service Purchasing Co-op in the event of a violation of the law by the vendor/contractor if certain persons have contact with children. The enclosed agreement must be signed and returned with your bid. 17. Failure to complete and return the enclosed Non-Collusion affidavit with your bid will result in disqualification. 18. 8 ANTI-DISCRIMINATION CLAUSE (Section 755, Pennsylvania School Code) 1. In accordance with the provisions of the Pennsylvania School Code, the contractor agrees: a. That in the hiring of employees for the performance of work under this contract, or any subcontractor hereunder, no contractor, subcontractor, nor any person acting on behalf of such contractor of subcontractor, shall by reason of race, creed, color, discriminate against any citizen of the Commonwealth of Pennsylvania who is qualified and available to perform work to which the employment relates; b. That no Contractor, subcontractor, or any person acting on behalf, shall in any manner discriminate against or intimidate any employee hired for performance of work under this contract on account of race, creed, or color; c. That there may be deducted from the amount payable to the contractor under this contract, a penalty of five dollars ($5.00) for each person for each calendar day during which such person was discriminated against or intimidated, in violation of the provisions of the contract; and, d. That this contract may be canceled or terminated by the school district, and all money due or to become due hereunder may be forfeited, for a second or any subsequent violation of the terms or conditions of this portion of the contract.

9 AGREEMENT BY VENDOR OR INDEPENDENT CONTRACTOR OF THE CENTENNIAL SCHOOL DISTRICT TO COMPLY WITH ACT 111 OF THE PUBLIC SCHOOL LAWS 1. This agreement is part of the agreement between the undersigned business person or entity and the Centennial School District, dated, for the sale of goods or the provision of services as an independent vendor or contractor in the nature of:, Bid/Quote No.. 2. The undersigned understands that after January 1, 1986 independent contractors and their employees hired after that date must comply with 111 of the School Code, which provides, among other things, that a CRIMINAL HISTORY INFORMATION RECORD SEARCH must be obtained for each employee who could come into contact with school children, showing that such employees have not been convicted of certain crimes. A copy of the law is available upon request. 3. It is agreed that the Centennial School District has no right of direct control over the hiring, retention, screening or assignment of employees, agents or officers of the undersigned, and further that the undersigned is responsible for compliance with this law. In addition, should any official or employee of the school be subject to any claim, proceedings, lawsuit, fine, civil penalty or other legal involvement arising from the neglect or failure of the undersigned, or its officers, agents or employees, to comply with said law, then the undersigned, as part of the consideration of doing business with the School District, hereby agrees to indemnify and hold harmless the District and all District employees for all losses, including costs of counsel and all expenses incident thereto. 10 INSTRUCTIONS FOR NON-COLLUSION AFFIDAVIT 1. This Non-Collusion Affidavit is material to any contract awarded pursuant to this bid. According to the Pennsylvania Antibid-Rigging Act. 73 P.S et seq.. governmental agencies may require Non-Collusion Affidavits to be submitted together with bids. 2. This Non-Collusion Affidavit must be executed by the member, officer or employee of the bidder who makes the final decision on prices and the amount quoted in the bid. 3. Bid rigging and other efforts to restraint competition, and the making of false sworn statements in connection with the submission of bids are unlawful and may be subject to criminal prosecution. The person who signs the affidavit should examine it carefully before signing and assure himself or herself that each statement is true and accurate, making diligent inquiry, as necessary, of all other persons employed by or associated with the bidder with responsibilities for the preparation, approval or submissions of the bid. 4. In the case of a bid submitted by a joint venture, each party to the venture must be identified in the bid documents, and an affidavit must be submitted separately on behalf of each party. 5. The term "complementary bid" as used in the Affidavit has the meaning commonly associated with that term in the bidding process, and includes the knowing submission of bids higher than the bid of another firm, any intentionally high or noncompetitive bid, and any other form of bid submitted for the purpose of giving a false appearance of competition. 6. Failure to file an Affidavit in compliance with these instructions will result in disqualification of the bid.
