General Permit No.: VAR10 Page 21 of 21 X. State permit actions. State permits may be modified, revoked and reissued, or terminated for cause. The filing of a request by the operator for a state permit modification, revocation and reissuance, or termination, or a notification of planned changes or anticipated noncompliance does not stay any state permit condition. Y. Transfer of state permits. 1. State permits are not transferable to any person except after notice to the department. Except as provided in Part III Y 2, a state permit may be transferred by the operator to a new operator only if the state permit has been modified or revoked and reissued, or a minor modification made, to identify the new operator and incorporate such other requirements as may be necessary under the Virginia Stormwater Management Act and the Clean Water Act. 2. As an alternative to transfers under Part III Y 1, this state permit may be automatically transferred to a new operator if: a. The current operator notifies the department at least 30 days in advance of the proposed transfer of the title to the facility or property; b. The notice includes a written agreement between the existing and new operators containing a specific date for transfer of state permit responsibility, coverage, and liability between them; and c. The department does not notify the existing operator and the proposed new operator of its intent to modify or revoke and reissue the state permit. If this notice is not received, the transfer is effective on the date specified in the agreement mentioned in Part III Y 2 b. 3. For ongoing construction activity involving a change of operator, the new operator shall accept and maintain the existing SWPPP, or prepare and implement a new SWPPP prior to taking over operations at the site. Z. Severability. The provisions of this general permit are severable, and if any provision of this general permit or the application of any provision of this state permit to any circumstance, is held invalid, the application of such provision to other circumstances and the remainder of this general permit shall not be affected thereby. 407

VIRGINIA DEPARTMENT OF TRANSPORTATION SPECIAL PROVISION FOR SECTION 108.02 LIMITATION OF OPERATIONS PROTECTION OF BATS Date: July 11, 2015 Project Number: 0095-109-S02,C501,B01,B02 (UPC 83164) A. Background Bridges included in this project may provide roosting habitat for federally protected bat species, which are protected by the Endangered Species Act (16 USC 1531 et seq., hereinafter the Act ). The Act makes it illegal to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect any species protected under that Act. Activities associated with bridges included in this project must conform to the VDOT Road and Bridge Specifications, Section 107.01 Laws to be observed, the Act, and the requirements of this special provision. This special provision is intended to be protective of federally protected species that may be occupying bridges. B. Requirements 1. This special provision applies throughout the Commonwealth of Virginia. 2. This Special Provision does not apply to work that will be performed between September 16 th and April 14th in any year. 3. Work outside the footprint of the bridge deck (or on or above the deck surface) does not require coordination. 4. In the event that bats are observed roosting on the structure, the District Environmental Manager shall be notified immediately and work in the immediate vicinity of the bat(s) suspended until approved to continue. To facilitate review, provide photos of any observed bats to help determine if they are a protected species. Work may continue in other areas as determined by the District Environmental Manager. 5. If the Contractor fails to comply with the requirements of this special provision, the work may be suspended and administered in accordance with Section 108 of the Specifications. D. Measurement and Payment The cost of compliance with the requirements of this provision shall be included in the cost for other appropriate items. 408

VIRGINIA DEPARTMENT OF TRANSPORTATION SPECIAL PROVISION FOR SECTION 108.02 LIMITATION OF OPERATIONS TREE REMOVAL (Protection of Federally Protected Bats) Project: 0095-109-S02,C501,B01,B02 (UPC 83164) Effective Date: July 7, 2015 A. Background This project has been identified as occurring in an environmentally sensitive area for federally protected bat species. These species are protected by the Endangered Species Act (16 USC 1531 et seq., hereinafter the Act ) and the Virginia Endangered Species Act (29.1-563 et seq.). These acts makes it illegal to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect any species protected therein. Removal of trees greater than 3 inches dbh may result in adverse impacts to bat species by removing roosting habitat during summer months and is restricted by this special provision. Tree removal activities associated with this project must conform to VDOT Road and Bridge Specifications, Section 107.01 Laws to be observed, the Act and the requirements of this special provision. B. Requirements 1. This Special Provision applies throughout the Commonwealth of Virginia. 2. Time of Year Restriction No tree removal will be conducted during a Time of Year Restriction (TOYR) of April 15 through September 15. 3. Notification and Cessation of Work In the event the Contractor fails to comply with the requirements of this special provision, the work may be suspended in accordance with Section 105.03 of the Specifications. The District Environmental Manager, or his designee, shall be contacted immediately. E. Measurement and Payment The cost of compliance with the requirements of this provision shall be included in the price bid for other appropriate items. 409
