2 Town of Bloomsburg is requesting proposals for the purchase of Professional Design Services necessary during calendar years 2017, 2018, and 2019, for its Community Development Block Grant (CDBG) Program. These services include all necessary engineering design and specifications for the bidding of and contracting for various CDBG-funded and CDBG-Disaster Recovery projects in the Town. The Town may also require inspection services for these projects. 3 REQUEST FOR PROPOSALS FOR PROFESSIONAL DESIGN SERVICES TOWN OF BLOOMSBURG COLUMBIA COUNTY, PENNSYLVANIA COMMUNITY DEVELOPMENT BLOCK GRANT ACTIVITIES DURING CALENDAR YEARS 2017, 2018, and 2019 Town of Bloomsburg anticipates using Community Development Block Grant (CDBG) and CDBG- Disaster Recovery (CDBG-DR) funds to undertake a variety of public projects during calendar years 2017, 2018, and Although the projects are yet to be identified, they may include recreation activities, public facilities, street improvements, and/or removal of architectural barriers. Additionally, the Town anticipates utilizing CDBG-DR funds for flood recovery type projects. The estimated cost of the Entitlement CDBG funded public improvements is $720,000. Additional CDBG-DR funding could be awarded to the Town for multiple projects. The Town of Bloomsburg is hereby requesting proposals for Professional Design Services for the design, bidding, and supervision of these projects. The following narrative outlines the major responsibilities of the proposers. These responsibilities include the provision of design assistance for each project from preliminary design to final inspection. It should be recognized by all proposers that the Scope of Services included herewith may exclude some minor, incidental design responsibilities not currently identifiable. Proposals shall include the attached "Design Service Rate Sheet". Proposals will be accepted until 3:30 PM, prevailing time, July 29, 2016, at which time they will be publicly opened at SEDA-Council of Governments. 4 Preparation of Contract Plans and Specifications SCOPE OF SERVICES The Design Consultant shall prepare all necessary design plans and specifications to be used for the construction of the improvements, and should therefore, be complete in detail and contain all necessary information. Such design services shall include all concept plans, specifications, contract documents, plans and reports as required. Specifications shall include the contract documents for the approval of the Town's Solicitor, as well as Bid Bond forms, the form of Construction Contract; detailed Construction Specifications; and forms for Performance and Payment Bonds. The Design Consultant shall be responsible for coordinating the bidding process, including printing and distributing the bid documents, publishing the required advertisements, and management of any required deposits. Cost of bid document printing shall be passed on to bidders; cost of advertising shall be paid by the Town of Bloomsburg. Insofar as federal Community Development Block Grant (CDBG) monies are being used in the projects, forms meeting the requirements of the US Department of Housing and Urban Development are to be used. Drawings shall conform with standard professional practice and consist of all architectural and design drawings, including profiles and sections, plot and site plans, and all else necessary to illustrate the interest and scope of the work. Working drawings are to be prepared for structural, hydraulic, mechanical, electrical and all other branches of the construction work, as needed. Survey work required for easements and rights-of-way, or necessary to define the scope of work, shall be provided by the Design Consultant. The Town of Bloomsburg anticipates that most projects will be public works in nature. However, there may be building projects which require architectural concept drawings and design. Firms proposing services shall have architectural services capacity, either within their staff complement or through subcontracted services. Firms proposing to provide these, or any of the required services, through subcontracts, shall identify the subcontractors to be used. Additionally, with the possibility of several CDBG-DR projects concurrent with the regular CDBG Program, firms shall confirm their capacity to design and manage several such projects. The Design Consultant will be expected to furnish customary design advice and assistance necessary to enable the Town to understand the project, and toward that end, attend local meetings as necessary. The Design Consultant shall also furnish any and all information required by federal and/or state agencies that have jurisdiction for the approval of designs and reports and shall conduct any negotiations with these or other agencies as is necessary for design approval and issuance of any necessary permits. If additional applications for public funds are to be submitted, the Design Consultant will aid in the preparation of the forms which require technical design information. If test borings or other subsurface explorations are necessary, the Design Consultant will furnish necessary specifications and offer advice. When instructed, the Design Consultant shall investigate any existing systems and advise the Town in the most appropriate method of modifying the systems. The Design Consultant may be required to prepare separate bids for each of the services to be modified. Plans and specifications shall be developed in such a manner to delete or add segments should the project be overbudget or underbudget. Priorities shall be established by the Town relative to these deletions or additions. Project Descriptions Town of Bloomsburg is a Community Development Block Grant (CDBG) Entitlement community under the US Department of Housing and Urban Development. As such, it anticipates receiving approximately $720,000 of CDBG funds during the next three years for community development projects. These funds may be blended with other funds to undertake multiple projects within Town of Bloomsburg. Furthermore, the Town of Bloomsburg is an eligible community for receipt of CDBG-DR funds and anticipates disaster assistance. The Town of Bloomsburg reserves the right to seek outside Project Design Services on any CDBG or CDBG-DR funded project throughout this contract period.
5 General Supervision of Construction The Design Consultant shall furnish necessary plans and specifications, assist the Town in securing proposals or bids from contractors and generally assist with the review and awarding of the construction contracts. The Design Consultant shall also visit the site to observe progress and quality of executed work, to determine if work is proceeding in accordance with contract documents, to keep the Town informed of progress, to guard against defects and deficiencies and to disapprove work not in conformance with contract documents. The Design Consultant shall serve as the Town's representative at the project site, issue all instructions to the contractors and prepare any change orders. The Design Consultant will also check and approve samples, schedules, shop drawings, catalogue data, laboratory, shop and mill tests of materials and equipment, and other data which the contractors are required to submit to ensure conformity with project design concept and requirements. The Town may request resident inspection services or may provide its own inspection services and require support from the Design Consultant. These options are included in the cost sheet. Where participating state and federal agencies require reports relating to construction, The Design Consultant shall prepare and submit such reports. The Design Consultant, in accordance with accepted professional standards and practice, shall review contractors' payment requests and approve, in writing, payment to the contractors in such amounts. All necessary plans and applications for permits, rights of way or utilities which may be involved are to be prepared by the Design Consultant. The Design Consultant will also conduct, in company of the Town, a final inspection of the project for conformity with design concept and contract documents. When a project is complete, the Design Consultant will correct all drawings to show construction and installation as actually accomplished, and will furnish one paper set and one electronic copy of "As Built" prints to the Town. In addition, the Design Consultant will assist the Town's solicitor throughout the project including, but not limited to, the preparation of documents involving design matters and preparation of contract documents for solicitor's approval. TERMS OF PAYMENT The Design Consultant will be required to enter into a written Agreement with the Town which will incorporate this Request for Proposals. While the contract for these services is in effect, the Design Consultant will agree to the hourly rates/fees for design services as detailed in this Request for Proposals and Design Service Rate Sheet. Before the start of each CDBG-funded project, the Design Consultant shall prepare and issue to the Town an estimate of the cost for design services for that project (based upon the rates included in this proposal). Costs sometimes separately billed as reimbursable costs shall be declared in this proposal, and any subsequent estimate of cost. If the Town agrees that the cost for these services is reasonable, the Town will authorize the work based upon this project specific cost estimate. If the Town believes that the costs are not reasonable, the Town reserves the right to negotiate project costs with the selected Design Consultant or seek alternate design services. Payment shall be made to the Design Consultant on a monthly basis. Invoices shall be provided setting forth the project, hours worked, date and establishing the amount due based on the hourly rate as of the date of the invoice. Invoices shall reflect the design service fee by project, previous payments, current charges, and remaining balance. Payment shall be expressly contingent upon receipt of funds from the US Department of Housing and Urban Development. MBE/WBE GOALS It is the public policy of the Town of Bloomsburg to promote the opportunity for full participation by minority and women s business enterprises ( MBE s and WBE s ) and Section 3 business concerns in all projects receiving Federal funds from the United States Department of Housing and Urban Development.
6 The Town of Bloomsburg has established a Minimum Participation Level (MPL) of five percent (5%) for Minority Business Enterprises, and three percent (3%) for Women Business Enterprises participation on projects with CDBG, ESG, and/or HOME funding. SECTION 3 GOALS The Town of Bloomsburg has adopted a Section 3 Action Plan in accordance with Title 24 Part 135 Code of Federal Regulations. As such, at least three percent (3%) of the total dollar amount of all nonconstruction Section 3 covered contracts shall, to the greatest extent feasible, be awarded to Section 3 business concerns. The purpose of Section 3 of the Housing and Urban Development (HUD) Act of 1968, as amended, is to ensure that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with existing federal, state, and local laws and regulations, be directed to low- and very low-income persons, particularly those who are recipients of government assistance for housing; and to business concerns which provide employment opportunities to low- and very low-income persons, as summarized in the Section 3 Clause, herein incorporated. The Section 3 Clause, in its entirety, can be located in the Federal Code of Regulations 24 CFR Part 135. The parties, if awarded this contract, agree to comply with HUD s regulations in 24 CFR Part 135, which implement Section 3. The parties certify that they are under no contractual or other impediment that would prevent them from complying with the Part 135 regulations. If awarded the contract, the proposer, agrees to include this Section 3 clause in every subcontract subject to compliance with regulations in 24 CFR Part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this Section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR Part 135. The proposer will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR Part 135. The proposer will certify that any vacant employment positions, including training positions, that are filled were not filled to circumvent the contractor s obligations under 24 CFR Part 135. Noncompliance with HUD s regulations in 24 CFR Part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts.
7 PROPOSAL SUBMISSION AND EVALUATION Three (3) copies of the proposal must be submitted to: Tyler Dombroski Community Development Program SEDA-Council of Governments 201 Furnace Road Lewisburg, PA Proposals must be received no later than 3:30 PM, prevailing time, July 29, Proposals that are faxed or ed to SEDA-COG cannot be accepted. Proposals will be reviewed and evaluated by the Bloomsburg Town Council, staff, and SEDA-COG. The evaluation will include the following areas in order of relative importance: Relevant experience and past performance Adequacy of resources to manage multiple concurrent projects Record of completing projects on time Adequacy of proposal in the terms of addressing the needs that are set forth in the Request for Proposals Quality of previous work Rates Section 3 Compliance Equal Employment Opportunity/Minority/Women-Owned Business
8 REQUIRED INFORMATION Each Design Consultant shall comply with all proposal information aforesaid. Further, no proposal will be considered unless the attached Design Service Rate Sheet is completed in its entirety. Each proposer shall provide a minimum of three (3) references where similar design services have been performed during the past three years. Previous experience with CDBG-funded projects should also be detailed. Proposers may be requested to sit for interviews and/or negotiation of contract terms and fees prior to contract award. Town of Bloomsburg reserves the right to accept or reject any and all proposals or to waive any irregularities. A company profile, key personnel resumes, and certificate of professional liability insurance shall be provided. If the proposer is an MBE/WBE or Section 3 business concern, a certification form shall be submitted with the bid attesting to the firms status as such. If any part of the project is subcontracted, requires purchases for services, or requires hiring of additional employees, the proposers must submit documentary evidence of MBE/WBE and Section 3 business concerns who have been contacted and/or to whom commitments have been made. If no solicitation was made to MBE/WBE s or Section 3 business concerns or residents, please indicate the reason(s). If there is no need for additional employees or trainees, or no need to contract for work, then the Section 3 and MBE/WBE requirements are not triggered.
