Town of Londonderry Site Plan Regulation Amendments Presentation to the Londonderry Planning Board July 2016 John Vogl Colleen Mailloux, AICP Objectives: Codify current Planning Board processes through amendments and additions to the regulations. Update regulations for consistency with state statute. Rework the regulatory process to provide a more equitable, predictable and flexible process. 1
Changes are proposed in the following sections: Section 1.04 Definitions Section 2.02, 2.03 & 2.04 Application Procedures, Submission Requirements & Schedule Section 2.06 Administrative Plan Review Section 2.07 Minor Site Plan Review Section 3.07 Stormwater Management Section 3.10 Landscape Standards Section 3.13 Lighting Standards Section 3.14 Traffic Impact Analysis Section 4 Specifications for Plans and Documents Section 7 Administration Section 8 Checklists Consistency Section 1.04 Definitions Updates to the definitions section will be handled along with the upcoming Zoning Ordinance overhaul. At this time, changes in some definitions (i.e. frontage, lot, wetland) are being amended to match what is currently in the Zoning Ordinance. The current amendments also propose some new definitions for clarity (i.e. off site improvement, performance guarantee) 2
Codify Current Process Section 2.02d Review of Application, Section 2.03 Pre Application Reviews, Section 2.04b Submission Items Updates which make the regulation consistent with the administrative process, including clarification of required submission items, escrow and third party review procedures, and provides a deadline for submission of conceptual review requests. Section 2.04c and 2.04f.2 Notification of Design Review Abutters are notified of all design review applications submitted to the Town (as required by RSA 676:4.II(b)). This further clarifies that if a design review meeting with the Planning Board is requested, additional notification fees are required. Codify Current Process Section 2.04d Schedule Requires staff to provide DRC comments within 30 days of receipt of a complete DRC submission. Section 2.05k.4 Development Agreement Puts applicant on notice that a Development Agreement may be required by the Board. Section 2.05ib Compliance with Conditions of Approval Amends the regulation to be consistent with current practice on review of administrative or technical conditions of approval by Staff. 3
Streamline Process Section 2.06 Administrative Plan Review This amendment provides a process and criteria for administrative plan review. This process would require that there are no impacts to the Town and neighboring properties and very little technical review. Section 2.07 Minor Site Plan Review Minor Site Plan Review is currently permitted through review and public hearing by the Administrative Review Committee. Minor site plan review picks up where Administrative Review leaves off and allows approval of minor plan changes by the (re named) Minor Site Plan Review Committee. This process involves a public hearing by the MSPR Committee. Design Requirements Section 3.07 Stormwater Mangement Allows underground detention where the site conditions are appropriate Section 3.10 Landscape Standards Change in the minimum site for plant material Existing vegetation analysis Tree replacement standards Mitigating impact of parking lots Section 3.11 Soil Wetland Identification Renumbered as part of the Parking and Loading update Section 3.13 Lighting Requirements Amend to allow adequate lighting at driveway intersections. 4
Submission Items Section 3.14 Traffic Impact Amendments provide an alternative when a proposal does not warrant a full or short traffic analysis and mirrors current practice. Section 4 Specifications for Plans and Documents Adds a Master Site Plan sheet as a required sheet to be provided Requires identification of tree protection areas and tree protection details for protection of existing trees during construction Adds a note requiring that the CO district be delineated prior to construction Adds Development Agreement to the possible agreements between the Town and Applicant Created new administrative review checklist Submission Items Section 7 Administration Updates the regulation to match the current practice of granting extensions for 1 to 2 years. Amend substantial completion reference to phased approvals.
