Application of the SC Procurement Code This code applies to every procurement or expenditure of funds by this State under contract acting through a governmental body as herein defined irrespective of the source of the funds.

A Governmental Body Means a state government department, commission, council, board, bureau, committee, institution, college, university, technical school, agency, government corporation, or other establishment or official of the executive or judicial branch. Governmental body excludes the General Assembly or its respective branches or its committees, Legislative Council, the Office of Legislative Printing, Information and Technology Systems, and all local political subdivisions such as counties, municipalities, school districts, or public service or special purpose districts or any entity created by act of the General Assembly for the purpose of erecting monuments or memorials or commissioning art that is being procured exclusively by private funds.

Local Governments All political subdivisions of the State (counties, towns, cities, school districts, etc) shall adopt ordinances or procedures embodying sound principles of appropriately competitive procurement no later than July 1, 1983.

Competitive Sealed Bids The lowest responsive and responsible bidder meeting specifications wins.

Competitive Sealed Proposals The most advantageous offer as determined by an evaluation committee based upon price and other award criteria wins.

Competitive Best Value Bids A hybrid between competitive sealed bids and competitive sealed proposals combining price (60%) and other award criteria. The best value wins.

Competitive Fixed Price Bids A multiple award schedule - All qualified bidders willing to sell for a pre-determined price win a license to sell to agencies

Sole Source A unique item or service only available from a single vendor

Emergency An unforeseen crisis that must be addressed immediately; that does not allow time for normal processes.

Is It Less Than $10,000? If so, the contract still will be awarded based upon telephoned requests for written quotes. Use the list above
