I: PROJECT INFORMATION 5.0 MANDATORY PRE BID CONFRENECE A mandatory pre-bid conference and site tour will be held, Wednesday, October 15, 2014, starting at 10:30 a.m. at Piney Point Elementary School, 8921 Pagewood Lane, Houston, Texas 77063. All general contractors and subcontractors are encouraged to attend this meeting. 6.0 RECEIPT OF BID see section 6.0 7.1 See document AA: Bid Check List for packaging instructions. 7.2 Four (4) sets of all bid documents will be received Tuesday, November 4, 2014 at 2 p.m. at the Board Services Offices, 4400 West 18 th Street, Houston, Texas. 7.3 One (1) original and three (3) copies of the M/WBE Participation Forms will be received Tuesday, November 4, 2014 at 2 p.m. at the Board Services Offices, 4400 West 18 th Street, Houston, Texas. 7.4 All forms schedules and statements including subcontractors information will be due Tuesday, November 4, 2014 at 2 p.m. marked with Project number to the attention of Raymond Hooks. 7.5 FAILURE TO SUBMIT A COMPLETED BID WILL BE VIEWED BY THE OWNER AS A NON RESPONSIVE BID AND WILL BE SUBJECT TO REJECTION. 7.0 PROGRAM CONSTRUCTION ESTIMATED RANGE, ESTIMATED DURATION AND TARGET COMPLETION. Estimated Construction Cost (Range) Estimated Maximum Project Duration (Calendar Days) $90,000.00 to $110,000.00 INSERT DAYS: 120 days per Project Note: Estimated range does not include cost of alternates 8.0 LIQUIDATED DAMAGES The Contractor agrees that if he is awarded the Contract for the Work and fails to complete the Work on schedule, he shall pay the Owner, as liquidated damages, the sum listed below for each calendar day the Work remains uncompleted. Since the exact amounts of the Owner s losses due to the Contractor s delay in completion of the Work are not readily ascertainable, the amounts herein constitute agreed upon damages and are not a penalty. At the Owner s option, any such HISD I-2

I: PROJECT INFORMATION accrued liquidated damages may be deducted from sums due the Contractor under the terms of this Contract. In Addition, the lowest bidder must be in good standing with HISD and submit complete required paperwork for the M/WBE participation. Failure to provide the required M/WBE documentation will be considered non-compliant. If a company is deemed noncompliant, it can lead to disqualification from the provision of goods and services to the district for current and/or future projects. 12.0 SCOPE OF WORK WORK COVERED BY CONTRACT DOCUMENTS 12.1 Project Identification: Piney Point Elementary School 12.1.1 Project Location: 8921 Pagewood Lane Houston, Texas 77063 12.1.2 Owner: Houston Independent School District 4000 West 18 th Street Houston, Texas 77092-8501 12.2 Description of Work: 12.2.1 The work will consist of adding a walking/jogging trail, various fitness stations, landscaping throughout and drainage/grading improvements. I: PROJECT INFORMATION SCHOOL OPERATIONS PARAMETER STATEMENT 13.2a Safety is Priority-One. HISD core values include Safety Above All Else and HISD Goal 2 is Provide a Safe Environment. Contractor acknowledges the critical need for safety of all persons involved in the project, and shall conduct construction operations in such a way as to minimize disruption of adjacent facility operations. It is the obligation of the Contractor to protect the Work, materials and equipment from vandalism and theft; it is not the responsibility of HISD security personnel to perform this function. 13.2a The Owner currently plans to perform the following other work, either with other contractors or its own forces, on or near the site of the Work during the period provided for construction under this Contract: 13.2a.1 There may be some normal maintenance work by HISD personnel. This contemporaneous work shall be taken into account by the Contractor and shall not serve as the basis for a Claim for additional time or compensation under this Contract. 13.3 School Operating Hours and Access After-Hours. Access to the existing school facilities shall be limited to the school s normal working hours between 7:00 am and 6:00 pm. Any requirements by the Contractor to enter areas of the school after normal operating hours shall be coordinated through the school principal s office. A minimum of one working day notice prior to the needed access date is required. The Owner currently plans the following school operations on or near the site of the Work during the period provided for construction under this Contract: 13.3.1 Full school operations will be conducted at the adjacent school during the normal school year. During the summer vacation, limited school operations will be conducted such as general maintenance and administrative work. Contractor must coordinate with school operations during the summer. Please refer to the HISD website for summer hours by school location; and/or refer to General Conditions 3.10.5 and 3.10.6. 13.3.2 (not used) 13.3.3 Schedule: The school will be in full operation during the upcoming school year; August 25, 2014 through May 29, 2015. School will not be in session during the following 2014-2015 holidays: School Holiday Event Month, Date, Year Labor Day September 1, 2014 Fall Holiday October 3, 2014 Thanksgiving November 26 28, 2014 Winter Break December 22, 2014 - January 2, 2015 HISD I-5

I: PROJECT INFORMATION 13.3.4 Periodically, HISD s Schools will be testing students. The Contractor shall plan Construction Activities that will not disturb the Schools students during critical achievement test periods. 13.3.5 Contractor recognizes the critical need for safety of all persons involved in the school program, and the need to conduct construction operations in such a way as to minimize disruption of school program operation. Contractor understands that it is the obligation of the Contractor to protect the Work, materials and equipment from vandalism and theft, and that it cannot rely on school security personnel to perform this function. Refer to additional information attached to this section. 13.3.6 (not used) 13.4 (not used) 13.5 (not used) 13.6 Owner furnished material and equipment on this project will not be available before the following dates: NONE 13.7 (not used) 13.8 School Personnel and Student Safety and Security during the Construction Work shall be a primary concern of the General Contractor. The following requirements are established by the Owner to be monitored and enforced by the General Contractor: a. The contractor(s) shall enforce HISD s requirement that each employee of the Contractor and each employee of each subcontractor for the Project wear an identification badge which includes the Employee Name and Employer. These badges shall be provided by the Contractor(s) at Contractor(s) expense. Contractor must assure that the Crisis Management contact information is provided to workers. Refer to General Conditions Article 19 for background check requirements b. The Contractor shall not use the School s cafeteria, telephones or restrooms. The Contractor shall provide for these services for all job site workers. c. The Contractor shall at no time perform overhead lifting over any areas occupied by students, HISD, or school personnel or visitors. A minimum of fourteen (14) days notice shall be provided by the contractor before overhead lifting over those areas to allow termination of school activities and evacuation of student and/or HISD school personnel, as required. d. HISD does not permit smoking on its property which includes this School s Construction Site. 13.9 Any Contractor (or Subcontractor) who will be providing and installing (or removing) equipment, that requires access to the equipment location greater than existing is available to the space, shall be responsible for providing such access. HISD I-6

I: PROJECT INFORMATION Please note additional information regarding HISD School Operations Parameter: 1. Critical Systems and Areas of Operation. Critical systems including air conditioning systems, water systems, fire alarm, intercom, intrusion alarm, CCTV systems, electrical systems and critical areas such as kitchen/food service areas must remain functional at all times school is in operation. Any work that would require a shut down of these items must be accomplished during vacations, holidays and other times when the school is not operating unless the Contractor makes arrangement for temporary systems or services that are acceptable to HISD. 2. Construction Fencing, Parking and Staging Areas. The contractor shall erect construction fences as indicated in the documents. Access to the site may be limited as indicated in the documents. Contractor site activities, storage offices and fabrication shall be limited to the area enclosed by the construction fences. Contractor parking shall be limited to the area enclosed by the construction fence or as indicated in the documents. 3. 10-Day Notice of Power Shutdown. HISD AUTHORITY AND INTERPRETATION OF M/WBE DOCUMENTATION HISD shall have sole authority for the interpretation of all rules and regulations concerning M/WBE participation and for all determinations of compliance or non-compliance of any proposer with the M/WBE participation requirements as set forth herein. The decision of HISD shall be final and conclusive as to such compliance or non-compliance. All proposers, by the submission of a proposal, acknowledge and agree that HISD shall have such sole and exclusive authority to make such interpretations and determinations and that all such interpretations and determinations shall be conclusive. M/WBE SPEND REPORTING & COMPLIANCE To ensure that all M/WBE participation obligations under the awarded contract are met, the Business Assistance Department will require documentation of the awarded supplier s M/WBE participation throughout the performance of the contract and upon the contract renewal. The awarded supplier will be required to report M/WBE subcontracting participation on a monthly basis to the Business Assistance Department. Documents requested by the Business Assistance Department from the awarded supplier s company to show documentation of M/WBE spend include, but are not limited to: invoices, purchase orders, and other pertinent documents that the district deems necessary to verify the usage of M/WBE companies. Awarded proposers will also be required to complete M/WBE documentation provided by the Business Assistance Department, which includes monthly reporting. The awarded supplier could be deemed as non-compliant if they fail to meet and/or report their M/WBE subcontracting commitment, provides inaccurate, incorrect, and/or false information related to reporting M/WBE information. If the district determines that a supplier is non-compliant, actions include, but are not limited to the following. 1. If the supplier, during any year of the contract, (i) fails to meet their M/WBE subcontracting commitment; and/or (ii) fails to provide the requested and accurate M/WBE documentation will be subject to having the contract terminated. 2.
