Details of persons making submission Robert Adamson Patricia Adamson Helen Collinson Russell Collinson Joanne Trigg Lawrence Trigg C/- Shane Stratton Surveying Ltd P.O. Box 7144 Tikipunga 2. General Statement 2.1 The joint submitters cannot gain an advantage in trade competition through this submission. They are directly affected by the plan change. The effects are not related to trade competition. 3. Background and Context 3.1 The submitters own 5 allotments that are included within the proposed Rural Production Environment. This pocket of land adjoins sites to the north of Sands Road that is identified as proposed Living Three. 4. The specific provisions of the Plan Change that this submission relates to are: 4.1 The proposed boundary of the Living Three / Rural Production Environment. The joint submitters seek for their sites to be included in the proposed Living Three Environment. 4.0 The sites that the submitters seek to be included in the Living Three Environment are legally described as follows: Lot 2 DP 186162

Lot 3 DP 186162 Lot 2 DP 366781 Lot 1 DP 498699 Lot 2 DP 498699 5. The reasons for seeking amendment are as follows: 5.1 The sites owned by the submitters do not currently constitute Production Land. The sites are too small to operate as economic production units. 5,2 The limited rural land use options for the sites are at odds with the objectives and policies for the Rural Production Environment. The objectives and policies tend to encourage rural options for Rural Production land by seeking large site sizes and avoiding reverse sensitivity effects. These outcomes cannot be achieved by the 5 sites, which the submitters seek to have included in the proposed Living Three Environment. 5.3 The pocket of land that is owned by the submitters is ideally suited to low density residential living as per the Living Three Environment Rules. The land is flat and is not subject to any flood hazard. 5.4 Infrastructure is already in place to support low density residential development in this location, with the Council reticulated sewer line already in place on Ngunguru Road. 6.0 The submitters wish to be heard in support of this submission at a hearing if one is held. Antony Lydiard & Sarah Hirst 2108 Whangarei Heads Road McLeod Bay RD4 Whangarei 0174 p. 09 434 0140 e. ccruz@xtra.co.nz Submission on Plan Change PC87 Coastal Area We would like to make a submission against this plan change but would look to support the changes with the addition/alteration in respect to the following rules; CA.2.3 - Discretionary activities; add 1D or if the ONL is within a Living 3 environment. The reason for this is that is contrary to the rule LAN3.4.2 Note: D is in addition to rules 1a,1b & 1c. The following changes to CA.2.3(2) Earthworks in a Coastal Area; 2a. The maximum volume of material removed exceeds 750m2, (changed from 500m2) b. The maximum face height of any cut or/batter exceeds 2.5m, (changed from 2metres) CA.3.1 - High Natural Character Area Land Use -Discretionary Activities; 3f. Up to 500m2 for the clearance of native vegetation for an approved dwelling. Note: F is in addition to rules a- e. CA.4.2 - High Natural Character Area Land use - Non-Complying Activities 2a. Unless the clearance is for building a dwelling in Living 3 The reason for this is that it is contrary to Rule LAN 3.4.2 CA.5.1 - Eligibility Rules 2. Subdivision with an ONL area is a restricted discretionary activity if the underlying zone is living environment. Submission on Plan Change PC114-Landscapes We would like to make a submission against this plan change with respect to the following rules; However would support this with the following considerations and alterations to the plan.

In relation to our property at 2108 Whangarei Heads Road, we feel that the ONL & ONF mapping do not truly represent the characteristics of the property and as such we would request alteration to this in order better protect the area that it is designed for. LAN.4.2 - Non-Complying Activities 1. Subdivision within an ONL within the Coastal Area is a Restricted Discretionary Activity The reason for this alteration is we believe that the rule is contrary to the Objectives & Policies of the LAN.1 & LAN.1.3 whereby the objective is to Restrict NOT prevent subdivision. Submission on Plan Change PC85C- Rural Village Environment We would like to support the Rule Change RVE. However we would like to submit as part of this rule change that an area of 2000m2 on the northern corner, closest to the main Whangarei Heads Road, be rezoned under this plan change to Rural Village Centre. Our reason for this is that we believe McLeod Bay is a developing area that requires future business and services within the next 10 years that would be independent to the Parua Bay Centre. Our property is situated approximately 50 metres from the existing Rural Village Centre, and is one of the larger parcels of land which offers substantial road frontage and is able to buffer any adverse effects on neighbouring residential property. In summary, our property was purchased in December 2015 with a view to develop the property as well as beautify and protect its natural characteristics as the land and dwellings were in a poor state.we had begun this process when notified of the ONL & ONF provisions that we had not been made aware of at the time of purchase, (Not in LIM report obtained at the time nor disclosed when speaking with Planners during the Due Diligence period when discussing subdivision)as per our submission on this and our communication with Glenn Mortimer. We have also included this in our submission as above. However the recent proposed changes have made us consider various options for the property and look towards a positive approach to the new plan. With this in mind as the plan changes require us to protect from development and subdivision approximately half of our land we would like to consult further on the mutual benefits that this may have to the overall environment and impact upon it. We do find the numerous zonings and rules are unessarily confusing even with a background in land development and wonder how the general public are expected to understand them. We feel that more weight should be placed on the Living Environment Rules and the overlays should be less rule based and more of a policy statement.

4 th October 2016 James & Cynthia Mackenzie Seaforth Pacific Ltd PO Box 380 Orewa Auckland 0946 Whangarei District Council - Proposed Plan Changes 85 This letter provides further information as an appendix to Form 5 (attached) The specific provisions of the Plan Change(s) that my submission relates to are: The rezoning of DP495648 Lots 1,2,3,4 of Mackay Lane Waipu cove from Countryside Environment to Rural Productive Environment. I support/oppose/seek amendment to the specific provision listed above. My submission is: The land identified as Area 1 on the attached map be zoned as Rural Village Residential Environment. My Reasons are: 1) This land in its new subdivided form fits neatly into the adjoining Rural Village Environment RVE (Waipu Cove Village) Proposed Rural Village residential rather than the Proposed Rural Productive Environment land. 2) The adjoining lands to the North and to the East of the properties are already proposed to be Rural Village Environment. 3) The land is fully serviced with Access roads, Pedestrian access, Reticulated Potable Water, Reticulated community Wastewater, Power & communications. 4) The lot sizes are 1,492 sqm, 2,653 sqm, 2,589 sqm & 3,301 sqm which does not fit with Proposed Rural Productive Environment - RPE objectives or policies but more closely aligns with objectives and policies of the Rural Village Environment. 5) Almost 50% of each lot is in covenanted native bush (Included within the Proposed High Natural Character Area) so the actual building areas of each lot are approximately 800sqm, 1,200sqm, 1200sqm, 1,500sqm the imposition of the Rural Productive building boundary setbacks would make it impractical to build on these sites without encroaching into the native bush conservation area. 6) There are sufficient other covenant controls e.g. height restrictions on the buildings to protect the nature of the area. 7) Better protection is afforded to the area by inclusion in the Rural Village Residential Environment. 8) The area does not meet many of the Objectives and Policies of the Proposed Rural Productive Environment. a. Lot Size e.g. RPE minimum net site area of 20ha. b. Land Use Productive land This land is now effectively larger lot residential Holiday homes in Waipu Cove village. 9) The Proposed Rural Productive Environment rules restrict the land use, but do not achieve many of the objectives and policies of the RPE. Please see the RC38634 and Hearing Decision by Alan Withy Friday 4 Feb 2011 File Ref SD0438634 Please also see our submission on Plan Change 95 dated 1 Nov 2010

State the decision you wish the Council to make to ensure the issues you raise can be dealt with: 1) The identified area 1 DP495648 Lots 1,2,3,4 of Mackay Lane Waipu cove is zoned as part of the adjoining Rural Village Environment. (Rural Village residential) 2) We support the Proposed Resource Character areas: a. High Natural Character Area and b. Coastal area To be applied to the submitters land as laid out in the Proposed Plan change maps as shown on the WDC GIS maps.
