As defined in the Special Conditions for Funding pursuant to Section 5 Para. 2 to 5 K-KFördG and the CFC Guidelines, the undersigned issues the

Declaration that he/she accepts the obligation: a) to use the funding sum exclusively in accordance with the intended purpose, and that by a date to be notified in a separate letter he/she will provide evidence of the use of the funding, attaching totalled original supporting documents; b) after the completion of the project to submit a final statement of account (detailed list of the actual total revenues and actual expenditure) attaching the original supporting documents relating to this; c) to consent to any financial inspection by the province of Carinthia; d) in the event of non-compliance with the conditions, to return the funding that has been granted immediately. The undersigned undertakes to comply with the provisions contained in the Austrian Federal Disability Equality Act [Bundes- Behindertengleichstellungsgesetz], Federal Law Gazette I No. 82/2005 as amended from time to time (BGStG), and in the Carinthian Anti- Discrimination Act [Kärntner Antidiskriminierungsgesetz], Provincial Law Gazette No. 63/2004 as amended from time to time (K-ADG), and declares that the project will be planned and executed to take account of the principle of equality and respecting the rights of people with disabilities, and that above all it will be created to be as barrier-free as possible. In the event of funding being awarded a) that he/she will provide his/her consent to publication of the associated information (see Section 19 Para. 1 K-KFördG 2001 and Point 6. of the CFC Guidelines) in the official culture report of the province of Carinthia and on the CFC website, and b) that he/she accepts the obligation after the conclusion of the funding agreement to make reference to the fact that the project has received financial support from the province of Carinthia by displaying the respective logos Land Kärnten Kultur, Carinthian Film Commission and the brand architecture of the lettering Carinthia in the opening or closing credits of the completed film, on any promotional media, in crosspromotions (posters, leaflets, programmes, books, etc.) and on all film, video, DVD and other reproductions for playback; this applies analogously for the respective logos prescribed in the funding agreement with reference to the fact that the project has been funded by the province of Carinthia (Land Kärnten Kultur). The undersigned notes and agrees that no liability is accepted for the specimen copies provided to the province of Carinthia, the CFC, etc. For all disputes arising from this contractual relationship it is agreed that the court with competence for the matter in 9020 Klagenfurt am Wörthersee shall have jurisdiction pursuant to Section 104 of the Austrian Jurisdictional Standards [JN]. By signing, the undersigned confirms that the information provided is correct and complete, and that he/she notes and agrees to the attached information sheet on the calculation of funding pursuant to K-KFördG (including the extract from Section 5 K-K-FördG) and the allowable costs for the Carinthian film industry effect. The funding applicant confirms that he/she bears responsibility for the execution of the planned project and that in the event of funding, he/she will ensure that the calculated costs are adhered to. The funding applicant declares in particular a) that he/she is not involved in any insolvency or liquidation proceedings; 9 b) that apart from the funding institutions named in the context of this application, the project in question has not been submitted to any funding institutions to date; c) that he/she will present the same documents describing the project to all persons, companies or funding institutions that are going to (co- )finance the project; d) that he/she is not in default in respect of providing evidence to any public funding institution of the use of granted funding in accordance with the intended purpose; e) his/her agreement that in the event of funding being approved, during the media reporting all the information provided on the project for which the application is being submitted can be further edited for editorial purposes (publication of a film trailer for the funded film for advertising) and published. If the project should contain information that is not intended for the public, this must be explicitly identified. The funding applicant notes and agrees that the provisions of the Carinthian Culture Promotion Act [Kärntner Kulturförderungsgesetz] and the funding guidelines as amended from time to time are an integral element of the funding application. The funding applicant declares that he/she will immediately inform the province of Carinthia via the CFC of all changes concerning the project. The funding applicant irrevocably declares that after the completion of the film (in all events however before the cinema launch) he/she will provide the province of Carinthia and the CFC free of charge each with one DVD, one photo CD, one specimen copy of the screenplay and the advertising media relating to this film for the purpose of internal documentation. The funding applicant declares that without the funding from the province of Carinthia which is being applied for via the CFC, the project is not implementable, or can only be implemented to an insufficient extent. The funding applicant notes that no legal entitlement exists to funding for the project from the province of Carinthia. The funding applicant notes that in respect of the preservation of the European film culture heritage, after the presentation and evaluation he/she will be asked to deposit a technically perfect copy of the funded film with Filmarchiv Austria free of charge in archivable format in the context of the regulations on legal storage. By signing, the funding applicant issues his/her express consent pursuant to the Data Protection Act [Datenschutzgesetz] 2000 Federal Law Gazette No. 165/1999 as amended from time to time for his/her personal details of relevance to the project that are contained in the application and the attached documents (in particular name and address of the funding recipient, date of birth, name and form of the project submitted) to be electronically recorded and processed and passed on within the CFC, and that these can also be transmitted to the official bodies of the province of Carinthia, the Federal Republic of Austria and the European Union that are involved with the funding or with the supervision of aid. I N F O R M A T I O N for statements of account in respect of funding (K-KFördG 2001, Provincial Law Gazette No. 45/2002 as amended from time to time) 1. The statement of accounts must contain a cover sheet in the form of a list of the supporting documents provided stating the amounts, and totalling these. At the same time it must be stated whether the funding applicant (person, institution, association, etc.) is authorised to deduct input VAT or not. 2. If the funding applicant is authorised to deduct input VAT, only the net amounts (excluding value added tax) will be recognised as evidence of the funding sum. 3. If there is a large number of receipts, these must be organised in groups in accordance with the intended purpose of the expenditure (e.g. carriage, fees, office supplies, etc.). 4. Only original supporting documents clearly documenting the payment will be accepted, and these must include the date of supply, the purpose of the supply and confirmation that the supply was factually correct. 5. In the case of payment by bank transfer, the proof of payment must take the form of the original payment form, or a confirmation by the bank (statement of electronic banking) that the transfer order was actually executed, or the presentation of an original of the bank statement (recipient of the transfer, customer, amount). Failing this, the signature of the recipient is required with confirmation of the sum received. 6. In the case of advertisements, a copy of the advertisement must be attached to the invoice. 7. On till receipts and restaurant receipts, the object or consumption purchased must be clearly stated, including the purpose of the consumption and the name of the person entertained. 8. Invoices for professional fees or proof of casual work must contain the name and address of the recipient as well as the date and form of activity in legible writing. 9. A written report on the use of the grant funding must be attached. If the funding sum is 35,000.00 or more, immediately after the completion of the funded project detailed documentation must be submitted on the progress of the project, the achievement of the project goals and a proper, detailed list of the total revenues and total expenditure, attaching the original supporting documents relating to this. 10. The accounting dates set for the funding applicant must be strictly complied with, otherwise the funding subsidies granted must be repaid immediately. Extract from the Special Conditions of Funding pursuant to Section 5 of the Carinthian Culture Promotion Act [Kärntner Kulturförderungsgesetz] 2001, Provincial Law Gazette No. 45/2002 as amended from time to time Section 5 Para. 2: The application must describe the activity or project to be funded and contain a detailed financing plan stating the total costs and how these are to be raised by means of revenues or funding from other legal entities, etc. This applies analogously to a funding proposal from an expert advisory board. Para. 3: The funding must not exceed the extent that is necessary for the further development of the activity or for the project to come into existence. In cases in which a personal contribution by the funding applicant comes into consideration, this must be a requirement of the funding in a reasonable amount. Para. 4: Funding must only be awarded if the funding applicant offers his assurance that he/she has all the resources necessary for the execution of the project to be funded, insofar as these are not going to be secured by the requested funding in accordance with this Act and any other funding. Before the funding is awarded, it must be established whether the project in question is also going to be funded by other public funding providers. Para. 5: The awarding of the funding must be linked to the funding applicant s commitment a) to use the funding solely in accordance with the intended purpose, b) to submit evidence of the use in good time, c) to consent to any financial inspections by the province, and d) in the event of non-compliance with the conditions, to return the awarded funding immediately. 13 Allowable costs for the Carinthian film industry effect The Carinthian film industry effect means all the expenditure that is undertaken in Carinthia during the production of a film project and that is relevant for tax purposes in the region. In terms of salary, fees and other personal expenditure, the place of residence principle (location of the centre of a person s life) is decisive when recognising the film industry effect. For all other expenditure, the company principle (place of invoicing) is decisive. Expenditure that does not lead to actual payment streams can also be included when calculating the film industry effect if this is of relevance for the execution of the project. Allowable expenditure in Carinthia: Expenditure undertaken for the production of the film (e.g. permission to film, location costs, equipment, costumes, technology, accommodation, dietary needs, travel, transport, film and sound material, post-production, insurance and other general costs). Fees/wages and salaries of Carinthian film professionals (gross amounts) when there is proof that their main place of residence is in Carinthia (copy of extract from the register of inhabitants). Ancillary wage costs can only be taken into account if registration has taken place with the Kärntner Gebietskrankenkasse this provision applies only to Carinthian film professionals with their main place of residence in Carinthia (copy of extract from the register of inhabitants). Invoices from film professionals, service providers and companies resident and assessed for taxation in Carinthia will be recognised at their net amounts. Mileage; only for film professionals who are assessed for taxation in Carinthia and use their own vehicle (copy of extract from the register of inhabitants and copy of authorisation). Non-allowable costs: Invoices that are not made out to the recipient of the subsidy or the film project being supported, or payments that have not been made by the grant recipient. VAT. The original invoice documents including the associated proofs of payment will be used to evaluate or recognise the allowable costs in Carinthia.
