POLICY A. All police personnel, when not inconsistent with a police officer's responsibilities to enforce the Pennsylvania Crimes Code, will report any dangerous condition, which may create a degree of probability that injury may result. 2. RESPONSIBILITY A. Police Officers shall: 1. Report all dangerous highway conditions and damaged or defective City property in their area of assignment. 2. Take whatever action necessary at the scene to protect the community. (This may include the placing of barricades and/or lights, yellow marking tape, item removal, etc.) a. Any hazardous condition requiring immediate action observed by or called to the attention of patrol personnel shall be immediately called into Police Radio. These conditions include, but are not limited to, gas leaks/odors; electric wires down; widespread electrical outages; hazardous material incidents; cave-ins; buildings in danger of collapse; defective traffic lights, signs and warning devices; dead animals on the highway; broken or leaking water mains, water pipes, fire hydrants; damaged or missing inlet or manhole covers. b. Non-emergency conditions such as potholes, damaged street, and/or traffic signs, parking meters, electric light outages, etc., shall be reported as soon as practicable to the district ORS who will make the notifications as described in Section C below. 3. A separate Complaint or Incident Report (75-48) shall be submitted for each condition. Briefly describe the problem and note any corrective action taken. DIRECTIVE 3.13-1

B. Patrol Sergeants shall: 1. Be alert to any dangerous highway condition, damaged or defective City property, etc. and shall ensure that patrol personnel under their supervision are promptly and properly reporting these conditions. 2. Ensure that precautionary safety devices (barricades, etc.) are placed and maintained at dangerous locations until the condition is corrected. 3. Ensure that safety devices are removed promptly when the dangerous condition is corrected. C. Operations Room Supervisor (ORS) shall: 1. Ensure that a District Control (DC) Number is obtained for any type of dangerous condition reported to the operations room by telephone, in person, by police officer(s), or via computer message from the police on-line web site. 2. Review all 75-48s for accurate reporting. 3. Immediately notify the Municipal Radio Message Center at (215) XXX-XXXX. (Record on the 75-48 the name of the Municipal Radio Dispatcher, time notified, and the name and badge number of the notifying officer.) 4. Distribution of 75-48: White Copy: - Reports Control Unit Canary Copy: - District File 5. Send an e-mail, fax message, or phone the appropriate agency responsible for the condition (as noted below) and describe pertinent information. 6. Notification will be placed on the S&R and successive squads informed, should follow up action be required. a. Notifications: 1) Non emergency emission or escape into the open air of any dust, fumes, gas, mist, odor, smoke, vapor, or any combination thereof, of a quantity or character constituting an air pollution nuisance notify the Health Department, Air Management Services. Complaints or Concerns during normal business hours, Monday-Friday 8 am to 4 pm call (215) XXX- XXXX. After hours contact Municipal Radio. DIRECTIVE 3.13-2

2) Buildings presenting fire or safety hazards; Richard Quigley (215) XXX- XXXX lots, yards, or cellars in filthy conditions; notify Rochelle Smith (215) XXX-XXXX or (215) XXX-XXXX Department of Licenses and Inspections (L&I), Municipal Services Building. *1 3) Street or alley light outages, damaged lights, or lights functioning improperly can be reported to 3-1-1 in addition to the Streets Department at (215) XXX-XXXX or contact Municipal Radio at (215) XXX-XXXX. 4) Traffic lights, signs, and warning devices damaged, or obscured from view, notify 3-1-1 or the Streets Department s Customer Affairs Unit at (215) XXX-XXXX. 5) Missing, damaged or obscured street signs (pole bent, leaning, broken-off or damaged), damaged No Stopping-Bus Only signs, and any dangerous conditions on the highway or sidewalk (cave-ins, fallen or dangerous trees or stumps, large potholes) the operations room supervisor will ensure that an e-mail message is sent to the Streets Department, Traffic Division, Attn E-mail: REDACTED, or call (215) XXX-XXXX. NOTE: Damaged Transit Stop signs will be reported to SEPTA Police at(215) XXX-XXXX or (215) XXX-XXXX 6) Damaged parking meters (include on 75-48 the meter number and exact location); no parking signs, parking restriction signs (loading/unloading zone, time restrictions, handicapped parking zones, etc.) will be reported to the Philadelphia Parking Authority via fax at (215) XXX-XXXX. The fax will be addressed to the attention of Richard Dickson or call Corinne O Conner at (215) XXX-XXXX. 7) Parks and Recreations, Operations and Lands Management will be notified at (215) XXX-XXXX of any street trees being pruned, sprayed, planted, cut down or removed from any highway, street, or road without a permit. NOTE: Utilities have a "Blanket" permit to trim trees. 8) All incidents occurring on railroad property will be reported to the Department of Licenses and Inspections, Emergency Services (215) XXX- XXXX or call 3-1-1 as well as the affected property owner. These incidents may include SEPTA, Amtrak, and Conrail properties. 9) When patrol personnel observe city owned escalators at the following locations to be out of service they will notify Police Radio immediately and a 75-48 will be prepared. CEASE OPERATIONS/STOP WORK ORDERS A. When it is determined that grounds exist for the issuance of a Cease Operations/Stop Work Order by either the Department of Health or the Department of Licenses and Inspection, a Health or L&I Inspector: 1. May request a police supervisor to respond to the scene. 2. May issue a Cease Operations/Stop Work Order. a. The L&I and or Health Department shall indicate on the Cease Operations/Stop Work Order the specific code(s) violated, and post the order in a conspicuous place at the location where the violation(s) exist. b. Forward a copy of the Cease Operations/Stop Work Order to the pertinent district Commanding Officer. 3. The responding police supervisor will witness the issuance of the violation and will sign the notice and enter their badge number. (The supervisor will sign the notice even if the violator refuses to sign or violator is not at the scene.) The pink copy of the notice will be given to the supervisor to be forwarded to the Police District Commanding Officer. 4. The L&I and/or Health Department will forward the notice to Police District Commanders where corrective measures have been taken and the "Cease Operations /Stop Work Order has been removed. B. The Commanding Officer shall ensure that patrol personnel are aware of posted notices and that periodic inspections are made at these locations to ensure that the "Cease Operations/Stop Work Order" is being obeyed. DIRECTIVE 3.13-4

1. Any activity in violation of a "Cease Operations/Stop Work Order" is illegal. Under provisions of the Philadelphia Code, Chapter 5, Section A-504.7 and Section A-505.8, It shall be a violation for any person with knowledge of a Cease Operations/Stop Work Order to continue to work in or about, enter any structure, premises, land or part thereof after a Cease Operations/Stop Work Order has been issued except to correct the dangerous or unsafe condition described in the Cease Operations/Stop Work Order. Any person who violates this section shall be issued a Summary Citation (03-8). 2. Notification: The ORS will notify L&I and/or Health Department of all violations of Cease Operations Orders/Stop Work Order and request that a Health or L&I Inspector respond to the location of violation. During normal working hours, 9 AM to 5 PM, Monday through Friday, notify L & I directly. After working hours, and on holidays and weekends, notify the Municipal Radio Operator. C. Requests for enforcement of Stop Work/Cease Operations Orders by L&I or Health Inspector: 1. When an on scene L&I and/or Health Department Inspector requests assistance for enforcement of these orders, Police Radio will dispatch a patrol supervisor to the scene to handle such requests. 2. The patrol supervisor will render assistance in the enforcement of these orders and have the power to enter the premises for such enforcement and to arrest any violators. Upon the patrol supervisor's arrival at the scene, they will: a. Request the Health or L & I official to produce City identification. b. Prepare a 75-48 listing the name and payroll number of the Health or L&I Inspector making such request and the alleged violation. c. Ascertain that a valid Cease Operations/Stop Work Order exists for the premises in question. d. Ensure that the provisions of the Cease Operations/Stop Work Order are enforced. e. Any persons observed by police in violation of any Cease Operations/Stop Work Order, will be issued a summary citation in accordance with Philadelphia Code of General Ordinances governing Stop Work Orders (Section A-504) and Cease Operations Orders (Section A-505). 4. FIREARMS AND AMMUNITION, SALE AND DISPLAY OF A. Sections 9-606 and 9-607 of the Code of General Ordinances provide that: 1. No firearm shall be displayed in a dealer's window during non-business hours. All pistols and revolvers must be placed in an approved safe, vault, or properly secured storeroom. 2. During business hours, no ammunition may be displayed on any open counter or in any other place readily accessible to the public. During non-business hours, ammunition shall not be displayed in windows. 3. No person shall sell, give, or deliver any ammunition to persons less than 18 years of age. (EXCEPTION: Ammunition supplied by a parent or guardian to his child or children for lawful purposes). B. Police officers observing any of the above violations shall report them on a 75-48 and submit to the ORS. 1. The Operations Room Supervisor will: a. Forward any pertinent information to the Deputy Commissioner of Licenses and Inspections at Email address: REDACTED or call (215) XXX-XXXX 5. FIREWORKS A. Licenses and Inspections will notify the pertinent Chief Inspector, Regional Operations Command whenever a Fireworks Permit is issued. B. The Chief Inspector, Regional Operations Command will notify the Commanding Officer of the Police District wherein the fireworks display is to be held so that the existence of the permit can be included on the roll call slate for the applicable date and time. C. Police officers observing any individual exploding fire works without a permit will immediately issue the violator a Summary Citation (03-8). *1 NOTE: Police Officers WILL immediately notify a street supervisor when any fireworks are found. The street supervisor will make the final determination as to whether the Bomb Disposal Unit should be notified in accordance with Directive 4.5 Bomb Scares, Explosive Devices and Explosions.
