Chapter 9 Sheriff Page 1 of 8 CHAPTER 9 SHERIFF 9.01 TRAFFIC PATROL ABOLISHED. The Taylor County Traffic patrol is hereby abolished and all duties transferred to the sheriff's office. The sheriff shall enforce all County and State traffic ordinances and laws. History: Resolution, 11/18 Resolution, 5/36 Resolution, 11/36 Resolution, 1/39 Resolution, 5/39 Resolution, 11/55 Resolution, 7/66 Resolution, 11/67 Amended, 11/73 9.02 SNOWMOBILE PATROL. The Law Enforcement and Emergency Services Committee may establish within the sheriff's office a County snowmobile enforcement patrol program. The committee or its designee shall apply for federal, state, or private funds for such program. History: Amended, Ordinance 412, 2/98 9.03 TRAFFIC SAFETY COORDINATOR. The sheriff or his designee shall assist the Traffic Safety Commission by serving as the traffic safety coordinator. History: Repealed, 11/79 (Juvenile Officer) Ordinance 180, 1/84 9.04 EMPLOYEES OVER 55. The Taylor County Board of Supervisors authorizes the Law Enforcement & Emergency Services Committee to grant, upon majority approval, annual extensions of employment beyond age 55 to protective service employees, but no extensions shall be granted beyond age 65. History: Resolution, 4/75 Amended, Ordinance 412, 2/98 9.05 AMBULANCE. The Taylor County Sheriff's Department shall immediately refer all requests for ambulance service that it receives to the Memorial Hospital of Taylor County. 9.06 DEPUTY SHERIFF RESIDENCY REQUIREMENT WHEN INVOLVED IN THE ONE ON ONE SQUAD PROGRAM. (1) Purpose. Taylor County does hereby establish residency requirements for Deputy Sheriffs of Taylor County who are involved in the One on One Squad Program. The program provides the residents of Taylor County and the Taylor County Sheriff's Department with a number of positive benefits. The program will increase the number of police units available to the Sheriff's Department in the event of an emergency and

Chapter 9 Sheriff Page 2 of 8 increase the visibility of the department to the citizens of Taylor County. Further, it will demonstrate to the public the efficient response of the Sheriff's Department personnel thereby increasing their overall peace of mind. (2) Additionally, squads parked at the officer's residence will act as an effective deterrent to unlawful activity in the area. One on One assignments of departmental squads will increase the Department's ability to summon off-duty deputies in the event of an emergency. It is anticipated that the maintenance and reliability of the units will be improved by placing the responsibility for the care of the squad with the assigned deputy. (3) Officers Affected. Participation in the One on One Program is voluntary. The program is a privilege. Participation in the program can be suspended or revoked by the Sheriff or his/her designee for violation of the rules. It will be necessary for each deputy participating in the program to agree to the guidelines set forth. This chapter shall not affect deputies who take squads home to their current residence as of January 1, 1999. Deputies who change location of their current residence shall obtain written permission to stay in the One on One Program. The purpose is to distribute officers throughout the County as much as possible. (4) Defined Boundaries. The Sheriff and the Law Enforcement Committee may jointly determine boundary areas that squads will be assigned to. The Sheriff and the Law Enforcement Committee may combine any of the areas listed to provide the most efficient delivery of law enforcement services. AREA WITHIN TAYLOR COUNTY defined as within the boundaries of: Gilman. 1. The Townships of Pershing, Cleveland, Aurora, Ford, Taft, and Village of 2. The Townships of Rib Lake, Greenwood, and Village of Rib Lake. 3. The Townships of McKinley, Jump River, and West Westboro. 4. The Townships of Westboro and Chelsea. 5. The Townships of Roosevelt, Maplehurst, Holway, and Village of Lublin. 6. The Townships of Little Black, Deer Creek, and Village of Stetsonville more than 3 miles from the City of Medford limits. 7. The Townships of Medford, Hammel, Molitor, and Grover more than 3 miles from the City of Medford limits. 8. All of the above #7 area plus City of Medford. 9. Townships of Goodrich and Browning more than 3 miles from the City of Medford limits.

The residency One on One Squad Program shall apply only for such period as the County shall provide the vehicles for the deputies affected. (1) The County of Taylor hereby elects to participate in the recruit qualifications and training program of the Wisconsin Law Enforcement Standards Board. Before any individual may commence employment on a probationary or temporary basis as a law enforcement officer, that individual must have met the recruit qualifications set by the Wisconsin Law Enforcement Standards Board, and before an individual may commence employment on a part-time or full time basis as a law enforcement officer, that individual must have been certified by the Board as having met the recruit qualifications and as having successfully completed the preparatory training course required under the Board's recruit training standard. Such recruit training must be successfully completed by the trainee within his probationary period. Under justifiable circumstances, this period may be extended, but the total period during which a person may serve as a law enforcement officer on a probationary or temporary basis without successfully completing a preparatory training course approved by the Wisconsin Law Enforcement Standards Board shall not exceed two years. (2) The Taylor County Law Enforcement & Emergency Services Committee, when hiring sheriff's deputies, may consider prior law enforcement experience of job applicants in setting beginning monthly salaries at amounts other than the starting salary range of said sheriff's deputies, but not to exceed the salary range established by the Personnel Committee of the Taylor County Board of Supervisors. History: Resolution, 7/71 Amended, Ordinance 173, 10/83 Amended, Ordinance 412, 2/98 9.08 CHIEF DEPUTY. (1) The position of undersheriff of Taylor County is hereby abolished. There is hereby created the position of chief deputy within the sheriff's department of Taylor County. (2) The chief deputy shall be hired by the Taylor County Law Enforcement and Emergency Services Committee subject to all provisions of the County Civil Service Ordinance. The qualifications of the chief deputy shall be determined by the Law Enforcement and Emergency Services Committee. The chief deputy shall hold office in the same manner as other deputy sheriffs. (3) The chief deputy shall outrank all other personnel in the sheriff's department except the sheriff. In addition to being the highest ranking officer of the department and

Chapter 9 Sheriff Page 4 of 8 performing the duties of deputy sheriff, it is the intent of this resolution that he shall be head administrative officer and chief investigator under the sheriff and assume such other duties as the Law Enforcement and Emergency Services Committee may direct. History: Amended, Ordinance 412, 2/98 (4) The chief deputy shall not be entitled to an automobile allowance. History: Resolution, 1/68 Resolution, 1/70 9.09 SERGEANT. (1) There is hereby created the position of sergeant within the Taylor County Sheriff's Department. (2) The sergeant shall be appointed by the Sheriff with the approval of the Law Enforcement and Emergency Services Committee. History: Amended, Ordinance 412, 2/98 (3) The sergeant shall outrank all other personnel in the Sheriff's Department except for the Sheriff and the Chief Deputy. In addition to performing the duties of a deputy sheriff, the sergeant shall perform supervisory duties assigned by the Sheriff. History: Ordinance 231, 3/87 9.10 COOPERATION WITH OTHER COUNTIES. The Taylor County Sheriff is authorized and directed to negotiate with the sheriffs of Wisconsin counties a detailed plan to implement the general purpose stated herein. The agreement shall provide for mutual assistance between counties in the event of emergencies of such magnitude that the law enforcement unit of a particular county finds it impossible to handle. Such contracts shall be written under the authority of Section 66.30, Wisconsin Statutes, and approved by the County Board before being effective. In the event of emergency and when authorized by the sheriff or his or her subordinate, members of the Taylor County Sheriff's Department are authorized and directed to perform enforcement work and other work related to public health and safety beyond the territorial limits of the County. When enforcement personnel are assigned to duty beyond the territorial limits of Taylor County under emergency circumstances provide herein, the sheriff shall, within ten (10) days, make an appropriate report to the Taylor County Board. History: Resolution, 7/67 9.11 COOPERATION WITH MUNICIPALITIES. Agreements may be made with the City of Medford and the Villages of Gilman, Rib Lake, Stetsonville, and Lublin, subject to the approval of the Common Council of said City and the village boards of said villages, under which the sheriff's office of Taylor County is authorized to enforce the traffic ordinances of the City of Medford and said villages, said agreements to provide that in all cases of enforcement of such City and village ordinances wherein prosecution is instituted by the

Chapter 9 Sheriff Page 5 of 8 Taylor County Sheriff's Department, the forfeitures collected shall be divided equally between Taylor County and the corporate municipality; the Law Enforcement and Emergency Services Committee of the County Board is hereby authorized to enter into such agreements with the City of Medford, and the villages of the County. History: Resolution, 7/58 Amended, Ordinance 412, 2/98 9.12 MEALS FOR PRISONERS. The Taylor County Jail is equipped with a working kitchen. The Sheriff is authorized to negotiate, with the assistance of the Taylor County Corporation Counsel, the best rate for services related to meeting the nutritional needs of the inmates each day. A day is defined as three meals. Prior to making any formal agreement with a food service provider, the Sheriff shall gain the approval of the oversight committee. (1) The County Board hereby sets a daily per person Huber Release rate of $30.00 for the first day and $18.00 per day thereafter as the board rate to be charged prisoners who participate in a work release or similar program. For expenses in relation to the crime for which a person was sentenced to a county jail, or for which the person was placed on probation and confined in jail pursuant to Section 302.372, Wisconsin State Statutes, the County Board hereby sets a daily per person jail rate of $30.00 for the first day or part of a day and $12.00 per day thereafter. Such fees will be collected for the entire period of time that the person is or was confined in the jail, including any period of pretrial detention. The Sheriff or his designee shall choose, for each prisoner, whether to seek reimbursement under the section as provided in Section 302.372(2)(d), Wisconsin State Statutes. The County Board hereby sets a daily per person rate of $15.00 as the amount to be charged prisoners who participate in an electronic monitoring system or similar program. History: Created, Ordinance 381, 10/96 9.15 DESK SERGEANT AND ASSISTANT INVESTIGATOR. History: Repealed, 11/79 Cross-Reference: Section 3.23, this Code. 9.16 PETTY CASH ACCOUNT. (1) The sheriff is authorized to establish a petty cash account; said account to be cash only and not a checking Account. (2) This account shall contain no more than $250 at any one time and be operated under written rules and procedures prescribed by the sheriff and only for the purposes permitted in writing by the sheriff. History: Ordinance 197, 11/84 9.17 PAYMENT OF JUDGEMENTS. (1) Taylor County shall, within the confines of the Wisconsin Statutes, pay any judgements taken against those deputies employed by the County of Taylor. who: (2) Taylor County will pay any civil judgement against any non-employee deputy (a) Is a duly qualified elector and resident of Taylor County; (b) Is currently certified as a law enforcement officer by the Wisconsin Law Enforcement Training and Standards Board; (c) Acts within the scope of his or her authority and within the laws of the State of Wisconsin and the United States;

Chapter 9 Sheriff Page 7 of 8 (d) Acts in conformity with the Sheriff's departmental policies governing the use of force and firearms; (e) Complies with the Sheriff's departmental policies relating to part-time employment as a law enforcement officer outside the officer's regular employing jurisdiction. (3) No coverage will be provided by Taylor County to any person acting, directly or indirectly, as a law enforcement officer for or on behalf of his or her regular employing agency.
