1 37 th TRIPARTITE TECHNICAL EXPERTS GROUP MEETING GRAND COPTHORNE WATERFRONT HOTEL, SINGAPORE 26 TO 27 SEPTEMBER OPENING OF THE MEETING REPORT OF THE MEETING 1.1 The 37th Tripartite Technical Experts Group (TTEG) meeting on Safety of Navigation in the Straits of Malacca and Singapore was held from 26 to 27 September 2012 at the Grand Copthorne Waterfront Hotel, Singapore. 1.2 The meeting was attended by representatives from the three littoral States Indonesia, Malaysia and Singapore; and observers from Australia, China, Germany, India, Japan, Republic of Korea, United States, the International Maritime Organization, Malacca Strait Council, The Nippon Foundation, ICS, BIMCO and JICA. The list of participants is in Annex A. 1.3 Capt M Segar, Assistant Chief Executive (Operations), Maritime and Port Authority of Singapore, representing the host Singapore, expressed his appreciation and thanked the delegations from the littoral States and all other participants for attending the meeting. Capt Segar highlighted the importance of the TTEG as a key platform for the littoral States to discuss and co-operate on issues relating to the Straits of Malacca and Singapore, and its important role in ensuring the success of the Co-operative Mechanism. 1.4 Indonesia and Malaysia thanked Singapore for hosting the 37th TTEG meeting, thanked and welcomed observers to the meeting, and wished for a positive and fruitful discussion. 1.5 Mr Leon Muhamad, Secretary-General of Ministry of Transportation, acting as Director General of Sea Transportation, representing Indonesian delegation, noted the importance of TTEG in bringing together the three littoral States, user States and other stakeholders, to formulate the best strategy for improving safety of navigation and environmental protection in the Straits of Malacca and Singapore (SOMS). Indonesia also updated on the Marine Electronic Highway (MEH) Data Centre handover from the International Maritime Organization (IMO) to Indonesia in August 2012, and highlighted that the three littoral States had agreed for the MEH to be sustained under the Co-operative Mechanism and TTEG. 1.6 Mr Baharin Dato Abdul Hamid, Deputy Director General of Marine Department, representing Malaysian delegation, pointed out that the TTEG bore testament to the close cooperation between littoral States as provided for in Article 43 under the United Nations Convention on the Law of the Sea (UNCLOS). Malaysia noted the TTEG s key achievements and affirmed its commitment to continue working with the littoral States, user States and other stakeholders to ensure that SOMS remained safe and open to Page 1

2 international shipping. 2 ELECTION OF CHAIRMAN AND VICE-CHAIRMAN 2.1 Capt Segar of the Singapore delegation and Mr Kemal Heryandri, Director for Ports and Dredging, DGST were elected as Chairman and Vice- Chairman respectively. 3 ADOPTION OF AGENDA 3.1 The Meeting agreed to Singapore s request for the inclusion of the item MEH to the TTEG s standing agenda henceforth. The Meeting further agreed to convene an MEH Working Group. 3.2 The Meeting considered and adopted the agenda set out in Annex B. 4 BUSINESS ARRANGEMENTS 4.1 The Meeting noted the business arrangements presented by the secretariat of the Meeting. 5 STATUS REPORTS 5.1 Update on the Aids to Navigation The Meeting noted the status reports on Aids to Navigation by Indonesia, Malaysia and Singapore. The reports are attached as Annex C. 5.2 Update on Marine Casualty Affecting Traffic Movement The Meeting noted the status reports on Marine Casualty Affecting Traffic Movement by Indonesia, Malaysia and Singapore. The reports are attached as Annex D Singapore shared with the meeting that the collision, reported by Indonesia, in the Singapore Strait between a coastal vessel Sempurna Sejati (GT 214) and an unknown vessel was a man overboard incident instead of a collision Malaysia thanked Singapore for its prompt information to Malaysia on the incident involving the M.V. SST and requested for Singapore s further cooperation to provide information, if necessary, to assist with its investigation into the incident. Singapore updated that it had recently responded to a request from Malaysia in this regard. The meeting noted the good cooperation between the littoral States. 5.3 Updates on Mandatory Ship Reporting System (STRAITREP) The Meeting noted the update from Malaysia and Singapore that there had Page 2

3 been no incidents of non-compliance with the Mandatory Ship Reporting System (STRAITREP) since the 36 th TTEG Meeting. 5.4 Contravention of Rule 10 of the Collision Regulation (COLREGS) The Meeting noted the status reports by Indonesia and Singapore on contravention of Rule 10 of the Collision Regulations (COLREGS). The reports are attached as Annex E Indonesian agreed to Singapore s request to provide details of the 12 cases of contravention involving Singapore-registered ships as highlighted in Indonesia s report The Meeting concurred with ICS that the records of incidents and contraventions would be very useful information for the TTEG to develop measures in the SOMS. 6 UPDATE ON PROGRESS OF THE CO-OPERATIVE MECHANISM 6.1 Report of 8 th Aids to Navigation Fund (ANF) Committee Meeting The Meeting noted the update on contributions to the ANF, presented by Malaysia. It was also noted that the 9 th ANF Meeting will be held on December 2012 in Johor Bahru. The detailed report is attached as Annex F Singapore thanked Malaysia for chairing the ANF since 2008, and expressed appreciation to all Committee members for their contributions to and support of the ANF, which is critical in enhancing navigational safety in the SOMS. Singapore further shared that it looked forward to continuing the good work and receiving the support of Committee members when Singapore takes over the Chairmanship of the ANF Committee from 2013 to Report of 5 th Co-operation Forum The TTEG noted Singapore s update on the key outcomes of the 5 th Cooperation Forum The Meeting supported the establishment of the correspondence group to develop the contents of the Safe Passage Pamphlet. The Meeting agreed for BIMCO and Singapore to co-chair the correspondence group. The Meeting noted the plan to finalise the pamphlet in time for its launch at the 6th Co-operation Forum in BIMCO Mr Thomas Timlen Asia Liaison Officer tt@bimco.org Page 3

4 Singapore Mr Chan Keng Nee Deputy Director (VTM) On the topic of Concept Study on Real-time Monitoring of Under Keel Clearance (UKC) in the Straits of Malacca and Singapore, the Meeting noted that the details could be discussed at the MEH Working Group. 6.3 Updates on Straits Project 1 Removal of Wrecks in the Traffic Separation Scheme in SOMS The Meeting noted the update on Straits Project 1 as presented by Malaysia India provided an update on its provision of technical assistance under Straits Project 1, and conveyed its willingness to provide further technical assistance. The Meeting thanked India for its offer and agreed to further discuss this at the Project Coordination Committee (PCC) meeting on 28 Sep The Meeting noted with appreciation the pledged contribution of 20,000 EUR from Germany to the IMO Malacca and Singapore Straits Trust Fund towards Straits Project Updates on Straits Project 2 Cooperation and Capacity Building on Hazardous and Noxious Substance Incidents Preparedness and Response in SOMS The Meeting noted the update on Straits Project 2 as presented by Malaysia. 6.5 Updates on Straits Project 4 Setting up a Tide, Current and Wind Measurement System for the Traffic Separation Scheme in SOMS to Enhance Navigation Safety and Marine Environmental Protection The Meeting noted the update on Straits Project 4 by Singapore and agreed that Project 4 was completed The Meeting agreed with Singapore s proposal that the issue on funding the continued and sustainable operations of the system be discussed under the agenda item on MEH. 6.6 Updates on Straits Project 5 on Replacement and Maintenance of Aids to Navigation in SOMS The Meeting noted the update on Straits Project 5 as presented by Indonesia. The Meeting also noted that the second technical workshop will Page 4

5 be organised by Japan in Updates on Straits Project 6 on Replacement of Aids to Navigation Damaged by the Tsunami Incident of The Meeting noted the update on Straits Project 6 as presented by Indonesia. 6.8 Update on Straits Project 7: Feasibility Study on Emergency Towing Vessels (ETV) The Meeting noted the update on Straits Project 7 as presented by Singapore. The Meeting agreed with the formation of a Correspondence Group to examine the legal and liability regimes, and regulatory frameworks of the littoral States before working out the details of the ETV proposal. The Meeting also agreed that a Working Group could be established at the next TTEG, subject to the findings of the Correspondence Group. 6.9 Review and Enhancement of Measures Implemented in SOMS Analysis of Marine Casualties The Meeting noted the update as presented by ICS and conveyed its appreciation to ICS on the work carried out. The Meeting agreed that the project was now completed and the TTEG could take into account the analysis carried out under this project for the MEH going forward Review and Enhancement of Measures Implemented in SOMS Port Reception Facilities Directory The Meeting noted the update as presented by BIMCO on behalf of INTERTANKO. 7 UPDATE ON DISPLAY OF NIGHT SIGNALS BY VESSELS CROSSING THE TRAFFIC SEPARATION SCHEME AND PRECAUTIONARY AREAS IN THE SINGAPORE STRAIT 7.1 The Meeting noted the update provided by Singapore and declared that the Working Group had completed its work. 8 THE MARINE ELECTRONIC HIGHWAY (MEH) 8.1 Noting the need to sustain the MEH in SOMS, the Meeting agreed that this should be discussed in detail by the Working Group. Accordingly, the Meeting agreed to the TOR of the MEH Working Group as set out in Annex G. 9 REPORT OF THE WORKING GROUP ON THE DEVELOPMENT OF VESSEL TRAFFIC SERVICE (CHAIRED BY INDONESIA) Page 5

6 9.1 The Meeting noted that Indonesia agreed to provide the coordinates of the 3 working sectors of the Batam VTS sectors. 9.2 The Meeting also noted the Working Group s agreement that support vessels engaged in support of authorized marine events and special operations, i.e. survey and salvage operations, should not be exempted from reporting to Batam VTS in order to ensure the safety of navigation. 9.3 The Meeting endorsed the report of the Working Group attached as Annex H. 10 REPORT OF THE WORKING GROUP ON VOLUNTARY PILOTAGE SERVICES IN SOMS (CHAIRED BY MALAYSIA) 10.1 The Meeting agreed that an intersessional meeting would be hosted by Indonesia in the first quarter of 2013 to first, Revise the Draft Guidelines for Voluntary Pilotage Services in the SOMS, and second, to discuss the concept paper on the Joint Management Pilotage Board The meeting endorsed the report of the Working Group attached as Annex I. 11 REPORT OF THE WORKING GROUP ON MARINE ELECTRONIC HIGHWAY (CHAIRED BY SINGAPORE) 11.1 The Meeting approved the proposed Concept Study on Real-time Monitoring of Under-keel Clearance in the Straits of Malacca and Singapore The Meeting agreed to establish Straits Project 8: Concept Study on Realtime Monitoring of Under-Keel Clearance in the Straits of Malacca and Singapore to be led by Singapore. The Meeting accepted IMO s offer to fund Straits Project 8 using the IMO Straits of Malacca and Singapore Fund. The study is estimated to cost US$45, The meeting endorsed the report of the Working Group attached as Annex J. 12 REPORT OF THE DRAFTING GROUP ON TERMS OF REFERENCE (TOR) FOR THE EMERGENCY TOWING SERVICE CORRESPONDENCE GROUP (CHAIRED BY SINGAPORE) 12.1 The Meeting approved the report of the Drafting Group and the TOR for the Correspondence Group on ETV as set out in Annex K. 7 Malaysia Capt Mohamad Halim Ahmad Senior Principal Assistant Director, Marine Department Indonesia Mr Untung Deputy Director for Sea and Coast Guard, DGST / 13 ANY OTHER MATTERS 13.1 No issues were raised under this agenda item. 14 VENUE OF NEXT MEETING 14.1 The Meeting agreed that the 38 th TTEG Meeting would be held in September 2013 in Bali, Indonesia. 15 CONSIDERATION AND ADOPTION OF THE REPORT 15.1 The meeting considered and adopted the report of the meeting. 16 CLOSING REMARKS 16.1 The Chairman thanked all delegations for their positive contributions and cooperation for making the 37th TTEG Meeting a success. The strong commitment from the littoral States and observers amply demonstrated the spirit of cooperation of the TTEG Australia, India, Indonesia, Malaysia, ROK, ICS, and the IMO expressed their appreciation to Singapore for hosting the 37th TTEG Meeting and expressed their confidence that the TTEG would continue its progress in enhancing safety of navigation and marine environmental protection in the Straits of Malacca and Singapore.
