Won Pat International Airport Auth()rity, Guam to issue differential pay to EMT -B certified firefighters of the aircraft rescue and fire fighting unit. I. OVERVIEW PUBLIC HEARING: The Committee on Municipal Affairs, Aviation, Housing, and Recreation convened for a public hearing on Friday April24, Proceedings began shortly after 9:00a.m. to receive testimony on the nomination of Dr. Marilyn C. Salas to the Guam Historic Preservation Review Board and Bill 93 (COR). Notice of the hearing was disseminated to all local media outlets via electronic media and published in the Pacific Daily News. 6 firefighters to seek that certification as an EMT and keep that certification. Looking at the historical response data, it is very minimal. Within a 24 hour period, if they respond for 30 minutes, in the proposed bill will say three hours, then after that it would be based on actual time. Senator Respicio asked Mr. Salas if he could see the disparity. Carlos Salas replied yes. He continued that at the same time the GFD firefighters are also EMT-A and get clocked in as a full time EMT-A. He said our firefighters are only EMT-B and only be paid if they respond at the terminal or within the airport premise. Senator Respicio asked if their salary is comparable to the Guam Fire Department personnel or if it is a little higher. Carlos Salas replied that he believed they were comparable. He said they follow what the schedules for salaries are and that they flow along with what the GFD personnel are getting paid. Senator Respicio stated that this is an issue that has to be reconciled between your agency, the Fire Department, and this committee. Senator Rector said that this issue does not seem to make a lot of sense. If someone goes to school and is trained to get a certain certification they should be constantly rewarded for that certification. An EMT-B is an EMT-B and are always on stand-by ready to respond to an emergency. It is important that we have these trained certified personnel on stand-by. I know you have a minimum of three hours, be every fire fighter should get the EMT certification pay the whole time they are working. They have earned that certification. He asked Mr. Salas how he would feel about that. Carlos Salas replied he would agree as long as they are working for the Guam Fire Department and are actually assigned to the ambulances. In the case of the airport we are not required to be EMTs. There is medical training and sessions required, but not EMT certified. At the minimum, EMT certifications are not a requirement. What they are proposing is an added value of the airport as a service to our people. Then they could compensate for the firefighters for that. This bill does not make the certification a requirement. The airport is willing to make comparable payments for EMT firefighters that actually respond to emergencies at the airport. And maybe it will make more sense for them to set a minimum of three hours. He said they have previously discussed this with the Fire Chief and our fire fighters; of course there is always a better deal. Senator Rector gave the example of teaching certifications, citing the fact that as teachers continue with their education they receive higher pay. He thinks the same thing

7 should happen for fire fighters. They should be rewarded for their certifications all of the time. He asked if the airport be adverse to making this a permanent certification bonus. Carlos Salas said that in terms of progressions in their career there are steps to progress and get compensated for it. These are not all in the EMT area. EMT is not really a part of their core requirements and certifications. Senator Rector asked if it is an additional certification that would add to their job. Carlos Salas replied that it would be. While it is not a requirement, if this bill becomes a law, then at least they will be able to appropriately compensate them for that kind of certification. Senator Cruz asked for clarification by saying that there is one EMT-B certified personnel on every shift. If he or she responds to an EMT situation, he or she gets the additional 15 % for a minimum of three hours. He thinks what Senator Rector is suggesting is that if a firefighter receives an EMT-B certification that their actual salary is increased 15 % in recognition of the work they have done to get this certification. He asked that maybe Mr. Salas could provide the committee with an impact statement of what it would cost that would compare the 3 hour minimum and the suggestion that Senator Rector suggested. Carlos Salas said they have started that already. He said the issue we take is clocking them in when they are actually not responding to a required medical service. That is how we evolved to proposing a 3 hour minimum. Senator Cruz responded that he thinks Senator Rector's suggestion is that a certified EMT has completely designation then his or her colleagues and should be recognized for that difference. Senator Respicio said he appreciated the Fire Chiefs testimony because it reminds us to be mindful of disparities. The disparity is if we are going to give the airport firefighters and outright 15 % for working on the ambulatory service side then we better be prepared to give the fire fighters at the fire department this increase as well.

8 III. Findings and Recommendations: The Airport authority does not have ambulatory services. Occasionally there is a need to respond to medical emergencies of passengers. There are also occasions where the transfer of medical referral patients from the terminal to the airplane requires EMT certified personnel. This legislation would provide compensation for firefighters responding to airport medical emergencies and would also give incentive for firefighters to acquire and maintain their EMT certification. The committee also discussed the possibility of a permanent salary increase if the EMT certification is acquired by the firefighter. This would have to be consistent with both the Guam airport firefighters and fire department firefighters. The committee requested a financial impact statement for the costs of enacting a permanent certification bonus compared to the 3 hour minimum compensation that this bill proposes. Although airport firefighters and first responders provide first 3 aid response to emergency calls within the airport premises, many times a 4 call to the Guam Fire Department needs to be made in order for EMT 5 services to be provided, causing a delay in service. Just like in any 6 emergency, a delay of even a minute can mean a life or death situation. 7 Therefore, it is the intent of I Liheslaturan Guahan to encourage airport 8 firefighters and rescue personnel to gain EMT certification in order to ensure 9 life-saving skills are readily available to all patrons of our island's only 10 commercial airport. 11 Section 2. A new subsection is added to 6223 of Title 4 Guam Code 12 Annotated, relative to Firefighters EMT Duty, to read as follows: 13 (a) Antonio B. Won Pat International Airport Authority, Guam, 14 Aircraft Rescue and Fire Fighting Unit- EMT-B Differential Pay. 15 A Firefighter in the Antonio B. Won Pat International Airport Authority, 16 Guam, Aircraft Rescue and Fire Fighting Unit (ARFF) who is certified 17 Emergency Medical Technician-Basic (EMT-B) and who actually performs 18 as an EMT-B during a period when he or she is assigned as an EMT-B shall 19 be entitled to differential pay calculated at the rate of his or her regular 20 wage plus fifteen percent ( 15% ). The differential shall be applicable only 21 during a time of actual performance. The employee shall be compensated a

An Act to authorize the Antonio B. Won Pat International Airport Authority, Guam to issue differential pay to EMT-B Certified Firefighters of the Aircraft Rescue and Fire Fighting Units". The Guam Fire Department supports the intent of Bill 93 (COR) however, with concerns. Bill 93 authorizes the compensation of differential (EMT Pay) for the Aircraft Rescue Firefighters from the Airport Authority, who are Emergency Medical Technician-Basic (EMT-B) certified and who actually performs as an EMT~B during a period when he/she is assigned as EMT-B. The rate of compensation is 15% of the regular rate of pay and is only applicable during the time of actual performance. As you may be aware of, 10 GCA, Chapter 72, mandates that every Guam Fire Department firefighter shall obtain and maintain EMT-B certification. However, EMT-B differential pay which is governed by 4 GCA, is according to an Attorney General's Opinion, restricted only to those who are certified as an EMT and assigned to the Ambulance and Advance Life Support units. In other words, firefighters who are EMT certified and assigned to the Engine and Rescue Units are not eligible for compensation. GFD's policy mandates that all Engine Units and/or Rescue Units respond to emergency medical calls to areas where there is no ambulance assigned or when an assigned ambulance is out of their assigned area due to an emergency response. 17 that any citizen requiring emergency medical assistance is provided immediate care within a four ( 4) minute response time as required by the National Fire Protection Association (NFP A). Personnel assigned to these engine and rescue units perform actual EMT duties, yet are not compensated for their work. In most cases, personnel assigned to units on highly populated areas (i.e. Dededo, Tamuning, Yigo, Barrigada, Agat, etc.) perform more EMT duties that those assigned to an ambulance in less populated areas. Executive Order No recognized this and initially provided compensation for these group or personnel, including firefighters from the Aircraft Rescue Firefighting (ARF) Unit, at a lower percentage rate than those assigned to the Ambulances. However, this Executive Order has since been rescinded and past efforts to codify it through legislation has failed. Passage of this bill in its present form will result in firefighters from the Guam Fire Department seeking just compensation for the EMT duties they perform. It is my recommendation that further study be made to address all issues relative to EMT differential pay and for ALL firefighters. Should this bill gamer the support needed for passage, I recommend that hours of compensation for actual EMT duties performed be amended to read, "for every hour actual EMT duties are performed" rather than setting a minimum of three (3) hours of initial compensation. 18 Senator Muna-Barnes, Hafa Adai my sister! First let me say thank you for introducing Bill 93(COR), it's been an ongoing issue for far too long at the airport and I'm hopeful that this will be one of those issues we can soon close. I would however like to share comment and a few suggestions with you if I may, but I would like to first preface my comments by saying I am very appreciative for your support and it is not the intent of this letter to make things difficult or complicated and I would like very much to assist in any way I can with your office and the management of the Airport Authority to make this program as effective and beneficial to all that we serve. This is a program that I've long advocated and supported for over the past 14 since being employed at the airport and I am a little confused as to why the bill as introduced, only makes Emergency Medical Technician-Basic a "voluntary" certification. As I'm sure you can appreciate, Emergency Medical Technicians training is a skill that has become synonymous with a firefighter's duty and responsibility and the public has an expectation that all firefighters. When a family member becomes ill or is injured and needs medical assistance, the call to 911 will put a firefighter at the scene to provide the necessary care and potentially life saving skills for that family member. If I could ask that you consider revisiting some of the verbiage in Bill 93 with the intent to make the Bill as strong as it can be so that when passed into Jaw (I'm confident with your leadership it will) that it will be a bill not only that benefits the traveling public, but the people of Guam. This could be realized by our two agencies crafting an MOUIMOA that would have us support GFD with medical support should the need arise and not just limit our capabilities to the confines of the airfield. If I could please call your attention to line eleven of page two of your bill beginning with the words "Section 2", more importantly because you wish to add a new subsection in ss of Title 4 GCA. Bill93 reads; (a) Antonio B. Won Pat International Airport Authority, Guam, Aircraft Rescue and Firefighting Unit- EMT-B Differential Pay. "A Firefighter in the Antonio B. Won Pat International Airport Authority, Guam, Aircraft Rescue and Fire Fighting Unit (ARFF) who is certified Emergency Medical Technician-Basic (EMT-B) and who actually performs as an EMT -B during a period when he or she is assigned as an EMT -B shall be entitled to differential pay calculated at the rate of his or her regular wage plus fifteen percent ( 15% ). The differential shall be applicable only during a time of actual performance. The employee shall be compensated a minimum of three (3) hours for any periods of actual performance up to three (3) hours, and hourly for the actual time of performance over the three (3) hours." Current law reads: Title 4 GCA "Public Officers & Employees" Ch. 6 Compensation of Public Employees. It states and I quote; "Notwithstanding any Jaw to the contrary, a Firefighter in the Guam Fire Department who performs work as an Emergency Medical Technician- Ambulance (EMT-A) and is a certified EMT -A shall be entitled to differential pay calculated at the rate of his or her regular wage plus fifteen percent (15%) for all periods he or she is assigned as an EMT-A and is a certified EMT-A." 1 highlight this Senator as the Bill as introduced does not state the same as current law applied to GFD and I was just wondering why we wouldn't just keep the law uniform. Why would we not pay those ARFF members who are current in their certification and are assigned to our ARFF I unit (medical response unit) the same way GFD is compensated? They do not get the 15% for responding to a medical call, they get it for being certified and assigned to a medical responding unit. Also, just for clarification, there is no longer an "A" identifier for the EMS program. It's identified as EMT-B (Basic), Intermediate (1), or Paramedic (P). The ambulance (A) identifier has not been used for about 10 years. The Basic (B) identifier took the place of the (A) identifier.

19 .. On page three (3) of Bill 93(COR) beginning with line three (3), It states and I quote; "Nothing herein shall require any ARFF personnel to become EMT-B certified. Such certification shall be strictly voluntary." Again I'm curious as to why the bill would read that way when under Title 10 GCA "Health and Safety" Chapter 72 Guam Fire Department under ss "Emergency Medical Technicians. [Effective Date one year after June 30, 2005] states and I quote; ' "Every Guam Fire Department firefighter shall obtain and maintain Emergency Medical Technician Basic (EMT-B} certification, after which he may Ufldergo advanced training to earn either an Emergency Medical Technician-Intermediate (EMT-1} or Emergency Medical. Technician-Paramedic (EMT-P) certification subject to the written authorization of the Fir Chief:of the Guam Fire Department." (as per P.L :7) Being that the Guam Fire Department by this very law, is made to have it's Firefighter's obtain and maintain at the very least EMT -B certification, would it not be beneficial to have ARFF also maintain that same level of certification, if for nothing more than to keep all firefighter standards the same? After all, a civilian of Guam should not have to guess as to which firefighters are EMT-B certified, they should know that all Firefig~ters are certified and are their first line of defense for illness or injury. As you know Senator, Guam has had it's fair share of disasters, from two airliner accidents to the "Mobil" Fuel Farm Fire that took place after one of the numerous typhoons that have hit our beautiful island. Being that Guam is geographically separated from any "real" support for a better part of 72 hours from the "main land" it is my humble opinion that t)y mandating that ALL civilian firefighters on Guam, inclusive of ARFF, be at the very least EMT-B certified. I feel this would serve the community of Guam far better if this certification become a job requirement, much like my fellow firefighters in the "main land". The people of Guam deserve at least that. As you may already know, ARFF up until a little over a year ago provided EMT -B service for the airport. We also budgeted each year to not only maintain skill levels, but also to resupply medical supplies and equipment used when ARFF was dispatched to a medical call. A service that one hope's is never needed but is comforted knowing it is immediately available when you do. It is my desire to one, encourage the re-establish of this vital life saving program and two to continue to provide similar services to our airport and it's tenants by way of educating and training in areas such as Cardio Pulmonary Resuscitation (CPR) and Automated External Defibrillation (AED) training and healthy living classes. 20 Bill No. 93 (COR)- by T. R. Muna-Barnes, J. T. Won Pat, A. B. Palacios, Sr. Written Testimony: Hafa Adai! My name is Cindy M. I. Toves-Corpuz, currently a Firefighter I with the Aircraft Rescue and Fire Fighting (ARFF) division at the A. B. Won Pat Int'l Airport Authority. I am submitting my testimony as a concerned citizen and not representing the authority in any manner. I would like to begin by saying that I am in support of the EMT certification of the firefighters. However, I am not in support of this bill, as written. Currently, there are no firefighters at ARFF who are certified as an EMT-B. In essence, we already do not meet the minimum standards the regulation requires. The Federal Aviation Regulation Part 139 requirement states: The curriculum for initial and recurrent training must include at least the following areas: (4) At least one individual, who has been trained and is current in basic emergency medical services, is available during air carrier operations. This individual must be trained prior to initial performance of emergency medical services. Training must be at a minimum 40 hours in length and cover the following topics: (i) Bleeding. (ii) Cardiopulmonary resuscitation. (iii) Shock. (iv) Primary patient survey. (v) Injuries to the skull, spine, chest, and extremities. (vi) Internal injuries. (vii) Moving patients. (viii) Bums. (ix) Triage. This regulation can be found at i\.''~ \\.ji1a._g_0l under the CFR FAR Part 139- Certification of Airports, Subpart D: Subsection ARFF Operational Requirements. The loophole that the Airport Administration uses is that fact that the regulation lacks the word "certification", and whether to obtain and maintain the certification. It only states initial and recurrent training. In addition, it does not specify EMT-B or any other level. It only refers to emergency medical services. However, the subjects that are listed above are all EMT-B topics/subjects/skills. So it would not behoove the airport to make this program (1) voluntary, and (2) the incentive unattractive to interested firefighters to obtain/maintain the certification. How can the airport expect to meet the regulation requirement to have this bill pass as currently written?

21 Give for example: Out of the entire division only one firefighter is willing to obtain and maintain the certification. Therefore, when that firefighter is off, who will fulfill that requirement? It does not make sense. In addition, what medical call is going to last 3 hours and beyond? If I respond to a medical call and lasts only half an hour (30 mins ), I will only earn $2.29 per run. Is that attractive? Is it worth all the tedious training that includes both text book and hands-on/clinic hours? Also, who is responsible for paying the cost to obtain and maintain the certification? If the firefighter is responsible for paying for the certification, they must do it on their own time. Again, how much does the course cost? Are all these factors worth $2.29? Therefore, 1 suggest that the incentive to be paid as follows: When a firefighter is assigned to the medical unit, they will be entitled to the pay (15%) for the whole shift@ 24hrs, to be offered, at the very minimum. Yes, it will cause havoc on the accounting/payroll side, but once our ARFF Admin. Assistant, who does our payroll, has the process in place, everyone will win. Being assigned to the medical unit can be very stressful. Firefighters get burnt out. Everyone who holds that certification should be given the opportunity to be assigned (and rotate) and respond to these medical calls each shift. I humbly believe that is fair and comparable to our brothers in GFD. Why shall we re-invent the wheel, when it exists? The only difference that remains between GFD and ARFF is that we do not provide transport services. Otherwise, when we are all EMT-B certified, we are able to provide the services at the same skill level as our brothers in GFD. I would also like to bring to light our current situation at the fire house and how EMT impacts us: Our minimum staffing requirement set by management is six (6). We are required to have 3 fire apparatus respond to any aircraft emergency (due to Index requirement with the PART 139 regulation). So with the six manning requirement, (most of the time we have 7, including the Assistant Chief) the daily assignments look like this: Assistant Fire Chief Unit 1 Captain (or acting) Driver (or acting) Unit2 Captain (or acting) Driver (or acting) Unit3 Captain (or acting) Driver (or acting) If our manning is down to 6 for the day, it would look like this with the exception that 1 vehicle will only have one person, (we usually joke and say they are Superman because they are the acting captain, driver, and frrefighter on that unit) for the day/shift.

22 However, we do have 2 additional auxiliary vehicles to man, the Medical Unit (ARFF I - pathfinder), and the Rescue Unit (ARFF II- Van). So, when the manning is at 6 or 7 minimum, in addition to driving the fire apparatus, those same 2 people have to respond on ARFF I (medical vehicle), (usually the driver of Unit 1 and the driver of Unit 3). When we do respond, our standard operation procedures only allow us to respond and be present at the scene until GFD medics arrive. Because we are not EMT' s, we do not provide those skills. Therefore, GOD FORBID, someone close to you is in dire need of oxygen or is experiencing difficulty breathing, all we can do is tell you that we must wait for GFD to arrive because we can no longer provide EMT services. Not to mention, the nearest responding GFD medic is coming from the Y ona Fire Station. What are you going to do then? How do you think we feel not being able to assist or tend to the patient? Unfortunately, we must wait until they collapse or either have no pulse and not breathing to perform CPR. Because we are only trained or allowed to perform CPR, use the AED, and provide first aid skills. Many of the responsibilities are on the firefighters, the people on the bottom of the totem pole. Most of the time, we Firefighter I's and II's are usually assigned to do both duties, drive the fire trucks and to respond on medical emergencies. (We have been driving these trucks since 2003 for FF I' s, and even earlier for FF II' s, and have been doing so without just compensation for performing these duties required of the Driver/Operator position and the EMT incentive. So to offer us only $2.29 per run is basically a slap in our face for the hard work that we do or are expected to do. Now don't you wonder why morale at the ARFF Division does not exist? We, the ARFF division, were not involved in any discussion(s) of any decision(s) that was made, regardless of how greatly it will impact us. We are only informed of the decision(s) after it has been made and/or approved by the Board of Directors. So in closing, I humbly ask the committee members to compare this Bill, as currently written, and the law that was passed for our brothers at GFD and make the program and the incentive comparable to what they (GFD) already receive or have in place. 29 Senator Tina Mufia Barnes Bill 93 to honor differential pay for GIAA firefighters FOR IMMEDIATE RELEASE April 13, 2009 (JO'h Guam Legislature) With a clear direction towards providing equality for the island's community, Senator Tina Rose Muna-Barnes, Legislative Secretary and Chair for the Committee on Municipal Affairs, Aviation, Housing and Recreation, has proposed Bill 93, effectively calling for differential pay compensation for Emergency Medical Technician-Basic [EMT-B] certified Aircraft Rescue and Fire Fighting [ARFF) Unit firefighters employed at the Antonio B. Won Pat International Airport, also known as the Guam International Airport Authority [GIAA]. Under current Guam law, there are no requirements to honor differential pay for GIAA's ARFF unit firefighters. As a result, some of based firefighters have either allowed their EMT certification to lapse or have not been compel1ed to seek additional certification. Bill 93 calls for an additional IS percent to be calculated into the regular wages of ARFF firefighters, if and only if that firefighter is on EMT-B assignment. Furthermore, the honoring of the differential pay shall only come into play when the assigned EMT -B has taken part in, "actual perfonnance." Bill 93 also states that the decision of ARFF unit firefighters to obtain EMT -B certification will remain on a purely voluntary basis; thus, differential pay will only be honored to ARFF unit firefighters who choose to seek such certification.
