Box NAIROBI 7th RIly, SCHEME OF SERVICE FOR ' INSPECTORS OF DRUGS I am pleased to inform you that the Scheme of Service for Inspectors of Drugs, which forms an appendix to this letter, has been finalised and is ready for implementation. with effect from 1st March, The Scheme establishes 6 grades for. Inspectors of Drugs. It is my hope that the Scheme of Service will assist in recruitment, career development and motivation of the officers concerned. 3. 3 SCHEME OF SERVICE FOR INSPECTORS OF DRUGS 1. AIMS AND OBJECTIVES To provide for a clearly defined career structure which will attract and facilitate retention of suitably qualified Inspectors of Drugs in the Civil Service. To provide for advancement within the career structure on the basis of qualifications, experience, merit and ability as reflected in work performance. To establish standards for recruitment, training and development which will enhance efficiency in the management of drugs services. 2. ADMINISTRATION AND TRAINING SCOPE OF THE SCHEME Responsibility for Administration The Scheme of Service will be administered by the Permanent Secretary, Ministry of Health in conjunction with the Public Service Commission and where necessary, in consultation with the Permanent Secretary/Director of Personnel Management. The Permanent Secretary will ensure that the provisions of the Scheme are strictly observed for fair and equitable treatment of officers and that officers are confirmed in appointment as soon as possible. Training Scope In administering the Scheme, the Permanent Secretary will ensure that adequate training facilities and opportunities are provided to serving.officers to enable them to acquire the necessary additional qualifications, knowledge and competence required for both efficient performance of their work and advancement within the career structure provided in the Scheme of Service. The officers should also be encouraged to undertake training privately for self-development. However, in all matters of training, the Permanent Secretary administering the Scheme, will consult the Permanent Secretary/Director of Personnel Management. 3. GRADING STRUCTURE AND SCOPE (1) Grading Structure The Scheme of Service embraces six (6) grades of Inspectors of Drugs. The personnel embraced by the Scheme will be designated and graded as follows:- Inspector of Drugs III, Job Group "H" Inspector of Drugs IT, Job Group "J" Inspector of Drugs I, Job Group "K" Senior Inspector of Drugs, Job Group "L" Deputy Chief Inspector of Drugs, Job Group "M" Chief Inspector of Drugs, Job Group "N"
4 Conversion to the new grading structure: Serving Inspectors of Drugs will convert to the new grades as follows:- Present Designation JG New Designation JG Inspector of.drugs III "G" Inspector of Drugs III "H" Inspector of Drugs II "H" Inspector of Drugs H J" Inspector of Drugs I "J" Inspector of Drugs I "K" Snr Inspector of Drugs "K" Snr Inspector of Drugs L" Dpt Chief Inspector of Drugs "M" Chief Inspector Of Drugs "N" Note: The grades of Inspector of Drugs Job. Groups "H/J/K" will form common establishment, for the puipose of this Scheme (?f Service. (iv) Serving Officers Serving officers will convert and adopt as appropriate to the new grading structure and designations provided in this Scheme of Service though they' may not be in possession of the requisite, minimum qualifications specified for the present grade. For advancement within the career structure, all officers must possess the prescribed minimum qualifications and/or experience required for appointment/advancement to the next grade. Provision of posts A scheme does not in itself constitute authority for creation or up-grading of posts. Any additional posts required under the new grading structure must be included in the establishment proposals for consideration and approval by the Permanent Secretary/Director of Personnel Management on the basis of staffing, needs in the.. Inspectorate of. Drugs Division. 4. THE INSPECTORATE OF DRUGS FUNCTION The Inspectorate of Drugs function entails administration and enforcement of the provisions of the Pharmacy and Poison Act. Cap. 244; the. Narcotic Dfugs and..psychotropic Substances Act; the Food, Drugs and Chemical Substances Act Cap. 254; the Medical Practioners and Dentists Act; and the Nursing Council Act. This entails carrying out inspections to ensure proper accountability of Government drugs and to minimise theft of the same;.. investigation and prosecution of drugs law offenders; and verification -of imported and exported.drugs to ensure.that they adhere to the legal requirements in force. 5. RECOGNIZED QUALIFICATIONS The following are the recognised qualifications for the purpose of this Scheme:-! The Kenya Certificate of Secondary Education mean grade D+ or its equivalent. Diploma in Pharmacy. Two years Departmental Training.
5 (iv) (v) (vi) Non-Commissioned Officers Law Examinations in the Kenya Police Force and a clean certificate of discharge from the Kenya Police Force. A course in investigation and prosecution at the Criminal Investigation Department (C.1 D) Training School. Such other qualifications as the Permanent Secketary/Director of Personnel Management may approve. 6. ENTRY INTO THE SCHEME OF SERVICE Direct Appointment Direct appointment will normally be made in the grade of Inspector of Drugs III, Job Group 'H'. In exceptional cases, however, direct appointment to the higher grades may be made by the Public Service Commission on the recommendation of the Permanent Secretary, Ministry of Health and the approval of the Permanent/Director of Personnel Management. Incremental Credit IncreMental credits will be awarded. for approved experience acquired after obtaining the requisite minimum qualifications for the grade at the rate of one increment for each completed year of approved experience provided the maximum of the scale is not exceeded. In granting incremental credits, any period of service 'or experience stipulated within the basic requirements for appointment or promotion to a particular grade. will be excluded. 7. ADVANCEMENT TO HIGHER GRADES The Scheme of Service sets out the minimum qualifications and experience required for appointment or advancement from one grade to another. It should, however, be clearly understood that these are the minimum qualifications entitling an officer to be considered for appointment' or promotion to the,next higher grade. In addition, advancement from one -grade to another will depend. on:- the existence of a vacancy in the authorized establishment; merit and ability as reflected in work performance; and approval of the Public Service Commission. 8. IMPLEMENTATION OF THE SCHEME The Scheme will become operative with effect from 1st March, On its implementation, all, serving officers will automatically become members of the Scheme..3
6 9. JOB AND APPOINTMENT SPECIFICATIONS I. INSPECTOR OF DRUGS III, JOB GROUP "H" Duties and Responsibilities This is the entry grade for this cadre and an officer at this level will be considered as a training grade.duties and responsibilities will include maintaining a register of all medical institutions both private and public; maintaining a register of all wholesale and retail dealers in drugs and poisons; carrying out inspections to ensure that medical practictioner licences are secured and renewed regularly, statutory records are duly kept by authorized sellers of poisons, dispensed prescriptions originate from duly qualified medical practitioners, dentists and veterinary surgeons; monitoring the flow of drugs from the store - the pharmacy to the wards and comparing previous consumption rates to detect any anomalies and assign responsibility for them through investigations; monitoring the rates of consumption of Dangerous Drugs (narcotics) in all medical institutions and submiting regular reports quarterly; ensuring that imports and exports of drugs are accompanied with the necessary documentation from competent authorities and ensuring that drugs on the market in his area of jurisdiction are registered by the Phamarcy and Poison Board and that such registration is renewed regularly as per the regulations. The officer may head a division and will be responsible to the Inspector of Drugs heading the district. Requirements for Appointment For appointment to the grade Inspector of Drugs III, the candidate must have:- (iv) the Kenya Certificate of Secondary Education mean grade D+ or its equivalent; and diploma in Pharmacy from the Kenya Medical Training College; or diploma in Law; or passed the Non-Commissioned Officers Law Examinations in the Kenya Police Force and a clean certificate of discharge from the Kenya Police Force. II. INSPECTOR OF DRUGS H, JOB GROUP "J" Duties and Responsibilities. Duties and responsibilities will involve supervision of drug law enforcement activities within a district; initiating and collecting necessary evidence for prosecution of those found violating drug laws; initiating and organizing seminars, workshops for the officers in the cadre. The officer will also give lectures (public) on Preventive Education against illegal activities in drugs; compile data on drug laws in his district and liaise with police and customs officers on the same; carry out institution inspections and make reports; and supervise disposal of expired drugs within his area of jurisdiction. The officer may be in-charge of a district hospital and will be responsible to the Inspector of Drugs heading.the district. 4
7 Requirements for Appointment For appointment to the grade of Inspector of Drugs I, an officer must:- have served satisfactorily in the grade of Inspector of Drugs III for at least three (3) years; have successfully completed two (2) years Departmental Training; and have demonstrated ability and competence in work performance. III. INSPECTOR OF DRUGS I, JOB GROUP "K" Duties and Responsibilities An officer at this level will head a district if deployed in the field operations. He will be responsible for efficient organization and management of drug law enforcement activities in the district. The duties and responsibilities will involve coordination of field operations in the district; prosecutions of drug law offenders; and giving feed-backs on reports received from officers in charge of divisions and giving appropriate guidance. The officer shall be a member of the District Tender Board, District Health Management Team and will attend the Board of Survey for disposal of drugs. The officer may head a district and/or take charge of a provincial hospital and will be responsible to the Inspector of Drugs in-charge of a province. OR At the Headquarters, the officer will be responsible for training of staff and staff development through seminars and workshops; liaising with International Agencies to provide ground and resources for training of Inspectors of Drugs in law enforcement techniques; liaising with C.I.D. Training School to secure places for the training of staff; initiating gazetternent of officers; and assisting in the day to day administrative matters at the Headquarters. Requirements for appointment. For appointment to the grade of Inspector of Drugs I, an officer must:- (iv) have served satisfactorily for at least three (3) years in the grade of Inspe6tor of Drugs II; have shown merit and ability in work performance and results; have successfully undergone a course in investigation and prosecution at the C.I.D Training School; and have been gazetted as a Public Prosecutor under the Criminal Procedures Code. Note: The grades of Inspector of Drugs IIMN, Job Groups "1-11.1/K" will form common establishment for the purpose of this Scheme of Service. 5
8 IV. SENIOR INSPECTOR OF DRUGS, JOB GROUP "L" Duties and responsibilities The Senior Inspector of Drugs will be incharge of a province or the Medical Supplies Co-ordinating zonal depots in the country. His duties Will include the management and co-ordination of drug law enforcement activities in the Province; initiating continuing education programmes through seminars and - workshops on drug law enforcement techniques for officers in his province; and Membership to the Provincial Health Management Team. OR At the medical supplies co-ordinating unit duties will involve participating in the prequalification of tenders; ensuring accountability and proper custody of accountable documents e.g. S12; overseing all the despatches of drug supplies to out-reach stations; laying down logistics for transport of drugs from the Medical Suplies Coordinating Unit to ensure security of the same; follow-up of deliveries to zonal depots; carrying out frequent inspection on drug stores; verifying any shortages and assigning responsibility for such shortages; and initiating recovery of losses through staff negligence of duty through surcharge. The officer may be in-charge of a province or the medical supplies co-ordinating zonal depots in the country and is responsible to the Chief Inspector of Drugs. Requirements for Appointment For appointment to the grade of Senior Inspector of Drugs, an officer must:- have satisfactorily served for at least three (3) years in the grade of Inspector of Drugs 1; have consistently demonstrated outstanding leadership and administrative capability required at this level; and be able to compile statistics regarding crimes and drug usage in his Province/Medical Supplies Co-ordinating Unit for planning purposes. V. DEPUTY CHIEF INSPECTOR OF DRUGS, JOB GROUP "NI" Duties and Responsibilities Duties at this level will involve initiation of review of the Inspector's of Drugs Working Manual; staff training, development, appraisal, postings and transfers; administration of the Pharmacy and Poiscins Act, the Food Drugs and Chemical Substances Act; preparation of forward estimates of expenditure and vote control; initiation of policy:- review and updating of existing regulations in Drug Laws; compiling statistics on drug crimes in the country; and preparing annual reports for the department. OR At Tomo Kenyatta International Airport the officer will be in charge of all sea and inland entry points in the country. Duties will involve ensuring that the regulations relating to external trade and transportation of drugs are compilied by importers and exporters of drugs and poisons; ensuring that drugs in transit are securely stored 6
9 pending shipment to their final destinations; and that all entry points are adequately catered for by Inspectors of Drugs. OR In the Medical Supplies Co-ordinating Unit, the officer will be incharge of the drug inspectorate services at the M.S.C.U. and zonal depots in the country. He will be answerable to the Chief Inspector of Drugs. Requirements for Appointment For appointment to the grade of Deputy Chief Inspector of Drugs, an officer must:- have satisfactorily served for at least three (3) years in the grade of Senior Inspector of Drugs or a comparable position; and have constantly demonstrated outstanding leadership, administration and management qualities. VII. CHIEF INSPECTOR OF DRUGS, JOB GROUP "N" Duties and Responsibilities The Chief Inspector of Drugs shall be the head of the Drug Inspectorate Division. He will be responsible to the Director of Medical Services for advice on the overall administration of the Drug laws and the enforcement of the United Nations conventions; formulation' of policy and administration of the drugs laws at the National level. He shall be a member of the Pharmacy and Poisons Board. He will initiate adaption and implementation of all the U.N. Conventions related to drug control; be the Ministerial representative at all International meetings organized by Narcotics Control Board; and a member of Inter-Ministerial (multi-sectoral) Committee on Drug Abuse. He shall liaise with the Head of the Narcotics Division within the Police Department for joint efforts in combating crime in illicit drug trafficking and also with relevant authorities in the neighbouring states in combating drug crimes in their common borders. Requirements for Appointment. This is the highest grade in the Scheme of Service for Inspectors of Drugs. Appointment to the grade of the Chief Inspector of Drugs will be made from officers who have served as Deputy Chief Inspector of Drugs for a period of at least three (3) years and have consistently demonstrated outstanding qualities of leadership, management and organizational capabilities at the management level. 7
