Purpose. To publish regulations concerning the purchase, sale, possession, control and consumption of alcohol and tobacco products on the U.S. Naval Air Station, Keflavik (NASKEF) installation, and to publish regulations concerning the removal of duty-free alcohol and tobacco from the NASKEF installation. These regulations are published in enclosure (1). 2. Cancellation. NASKEFINST L and C 3. Scope. This instruction is applicable to all Defense Force Members and all buildings located on the NASKEF installation. This instruction is punitive in nature. Defense Force Members who violate this instruction or the regulations contained herein are subject to administrative actions and/or punishment under the Uniform Code of Military Justice (UCMJ). Non-Defense Force Members are subject to barment from base. 4. Authority. Reference (a) establishes regulations for control of alcoholic beverages within military installations under Naval jurisdiction. Reference (b) delegates to the Commanding Officer (CO), NASKEF, the authority to regulate the purchase, sale, possession and consumption of alcohol and alcoholic beverages aboard NASKEF. Reference (c) implements Icelandic alcohol and tobacco customs regulations that apply to all Defense Force Members. Reference (d) is the Icelandic law establishing 20 years as the minimum age for possession of alcohol in Iceland. Reference (e) ensures medical inspection of barracks quarters (BQ) lounges for health and safety purposes. Reference (f) is the Navy and Marine Corps tobacco policy. Reference (g) is the

8 CHAPTER 1 DEFINITIONS The following definitions apply to this instruction: 1. Agreed Area. The Agreed Area includes the U.S. Naval Air Station, Keflavik (NASKEF) and all outlying/supporting sites. 2. NASKEF Installation. That part of the Agreed Area containing the premises of NASKEF, within the boundaries of the fence line in Keflavik, Iceland. 3. Alcohol or Alcoholic Beverages. Liquids and beverages that contain the colorless volatile flammable liquid, C 2 H 5 OH, that is the intoxicating agent in fermented and distilled liquors. Under this instruction, alcohol or alcoholic beverages include: a. Distilled spirits such as whiskeys, vodka, gin, rum and brandy. b. Malt beverages such as beer, ales and malt liquors. c. Wines, champagnes and liquors. 4. Defense Force Commands. Defense Force commands include NASKEF and all tenant commands. 5. Defense Force Members. Members of the Defense Force are: a. All active duty U.S. military personnel, permanently or temporarily attached to a U.S. military command, unit or U.S. Government-related activity on the Agreed Area, and their family members. b. All non-icelandic civilians employed by DOD or its contractors, assigned to, attached to, or employed by a U.S. military command, unit or U.S. Government-related activity on the Agreed Area, and their family members. 6. Tobacco Products. The leaves of cultivated tobacco plants prepared for use by smoking or chewing. Products include: a. Cigarettes/cigars. b. Pipe tobacco. c. Smokeless tobacco such as snuff and chewing tobacco. 1-1

9 CHAPTER 2 POLICY AND REGULATIONS CONCERNING THE IMPORTATION OF ALCOHOL AND TOBACCO PRODUCTS INTO ICELAND 1. Policy a. The U.S. military has been authorized to import alcohol and tobacco products duty-free onto the NASKEF installation by the Government of Iceland as long as the duty-free alcohol is for the exclusive use of Defense Force Members. b. Alcohol, alcoholic beverages and tobacco may not be sold, transferred, exchanged or given away to non-defense Force Members. This does not restrict a defense force member from offering an alcoholic drink or cigarette as an expression of courtesy in a social situation. c. These regulations are promulgated to ensure compliance with references (a) through (d) and Icelandic customs laws and regulations. Continued alcohol and tobacco privileges for Defense Force Members are contingent upon strict adherence to this instruction. 2. Importation of Alcohol into Iceland. Per reference (c), Defense Force Members may import alcohol into Iceland via commercial or military aircraft. A Defense Force Member, 20 years of age or older, may import only the amounts in one of the following paragraphs: a. One liter of distilled spirits (not exceeding 47% alcohol) and one liter of wine (less than 22% alcohol), OR; b. One liter of distilled spirits (not exceeding 47% alcohol) and six liters of beer, OR; c. One liter of wine (less than 22% alcohol) and six liters of beer, OR; d liters of wine (less than 22% alcohol). 2-1

10 3. Importation of Tobacco Products into Iceland. Per reference (c), Defense Force Members may import tobacco into Iceland via commercial or military aircraft. A Defense Force Member, 18 years of age or older, may import only the amounts in one of the following paragraphs: (a) 200 cigarettes (1 carton), OR; (b) 250g of other tobacco products except for smokeless tobacco. 4. Smokeless Tobacco. It is illegal to import, possess and/or use smokeless tobacco in Iceland except aboard NASKEF installation. 2-2

11 CH-2 10 Nov 04 CHAPTER 3 SALE, STORAGE AND CONSUMPTION OF ALCOHOL ON THE NASKEF INSTALLATION 1. General Regulations Concerning Alcohol aboard NASKEF a. Only defense force members over the age of 20 years may purchase, possess and/or consume alcoholic beverages aboard NASKEF and in Iceland. b. Defense force members are prohibited from giving, selling or transferring alcohol or alcoholic beverages to any person under the age of 20 years. c. Defense force members are not authorized to sell, give or transfer duty-free alcoholic beverages to non-defense force members except as authorized by reference (c). d. Open containers of alcohol are not authorized in motor vehicles aboard NASKEF. e. Defense force members in a watch and/or duty status are prohibited from consuming alcohol beverages 6 hours prior to assuming the watch or assuming duties and will not consume alcoholic beverages during watch or duty hours. f. Defense force members will not consume alcohol for 6 hours prior to operating a motor vehicle. g. Medicinal, Religious and Law Enforcement Uses. The possession and use of alcoholic beverages is authorized for U.S. Naval Hospital, Keflavik (NAVHOSPKEF) or medicinal purposes under the cognizance of medical or dental officers. Alcoholic beverages consumed for the purpose of religious service or sacrament are not prohibited by this instruction. The possession of alcoholic beverages is authorized within the law enforcement and legal offices of defense force commands for evidentiary use in non-judicial punishment or courts-martial proceedings. 2. Storage of Alcohol a. Storage of alcohol inside a privately owned vehicles is not authorized aboard NASKEF. It is permissible to transport closed alcohol containers from the place of purchase to another destination for an authorized purpose. Alcohol shall not be stored or transported in a government vehicle unless for authorized purposes for MWR or NEX operations. b. Alcohol may only be stored aboard NASKEF at the following locations: 3-1

12 CH-2 10 Nov 04 (1) Any location where by-the-drink sales are authorized. (2) Navy Exchange (NEX) (3) NEX and MWR warehouses (4) Family housing units when occupied by a person entitled to possess and consume alcohol. (5) BQ locations when occupied by a person entitled to possess and consume alcohol. (6) The BQ locations listed in appendix A to this instruction. (7) Any other location authorized by NASKEF CO in writing. 3. Sale of Alcohol a. By-the-Bottle/By-the-Case sale of unopened containers of alcohol and alcoholic beverages to defense force members is authorized at the Navy Exchange Mini-Mart. b. By-the-Drink sale of opened containers of alcohol and alcoholic beverages to defense force members for on-premise consumption is authorized in locations listed in appendix A. 3-2

13 CHAPTER 4 CONSUMPTION OF ALCOHOL IN HOUSING UNITS, BQs AND OTHER AUTHORIZED LOCATIONS 1. Housing Units and BQ Rooms a. Unless otherwise prohibited, Defense Force Members may store and consume alcoholic beverages in housing units and BQ rooms. b. Authorized guests over the age of 20 may consume alcoholic beverages in housing units and BQ rooms. c. The sale of alcoholic beverages in housing units and BQ rooms is not authorized. 2. Housing Unit Day Rooms a. Authorized Defense Force Members over the age of 20 may consume alcoholic beverages in housing unit day rooms. b. Authorized guests over the age of 20 may consume alcoholic beverages in housing unit day rooms. All guests must leave the housing unit day room when their sponsors leave. c. The sale of alcoholic beverages in housing unit day rooms is not authorized. d. Storage of alcohol in housing unit day rooms is not authorized. e. The NASKEF CO has authority to close any housing unit day room that is not being operated in compliance with this and other applicable NASKEF instructions. 3. BQ Lounges a. Authorized Defense Force Members over the age of 20 may consume alcoholic beverages in BQ lounges. b. Authorized guests over the age of 20 may consume alcoholic beverages in BQ lounges. All guests must leave the BQ lounge when their sponsors leave. c. Per this instruction, BQ residents are responsible for ensuring only authorized Defense Force Members and authorized guests consume alcohol in BQ lounges. d. The sale of alcoholic beverages in BQ lounges is not authorized. 4-1

14 e. Storage of alcohol in BQ lounges is not authorized except for the organizations listed in appendix A. Before storing alcohol, the organizations listed in appendix A shall: (1) Obtain the NASKEF CO s written permission to store alcohol in a specific BQ lounge. (2) Route requests to the CO via NASKEF Legal Department and include a copy of the organizations by-laws/regulations. (3) Ensure mess members and guests are aware of restrictions imposed by their by-laws, this instruction and reference (b). (4) Ensure NAVHOSPKEF conducts quarterly health and sanitation inspection, per reference (c), and to have those reports forwarded to the NASKEF Legal Department. Noncompliance will result in immediate revocation of authorization to store alcohol until compliance. (5) Restrict access to all persons under 20 years of age. f. BQ lounges will remain unsecured for unlimited access by all BQ personnel and authorized guests. The Billeting Officer shall periodically inspect BQ lounges to ensure the cleanliness, material condition and sanitation meet the established standards set by reference (c). g. The NASKEF CO has authority to close any BQ lounge that is not operated in compliance with this instruction and references (a) and (b). 4. Other Authorized Locations for Alcoholic Beverage Consumption. In addition to the locations listed in appendix A and in paragraphs 1 through 3 above, alcoholic beverages may be consumed on an occasional basis as approved in writing by NASKEF CO. 4-2

15 CHAPTER 5 REMOVAL OF ALCOHOL AND TOBACCO FROM THE NASKEF INSTALLATION 1. Removal of Alcohol from the NASKEF Installation a. Only Defense Force Members 20 years of age or older and who are authorized to purchase duty-free alcoholic beverages aboard NASKEF may remove from the NASKEF installation, in any one day for personal use, the following quantities: (1) One.75 liter bottle of wine under 22% alcohol content (one can substitute wine coolers, spritzers, etc.) and no more than 72 ounces of beer or malt liquor (i.e., six 12 ounce cans or bottles), (2) No more than 1.0 liter of distilled spirits (hard liquor) per day. OR; b. Removals are limited to five occasions per month and will be tracked using appendix C. Per reference (c), removal of one liter of distilled spirits will count as two of the five allotted removals for that month. No more than 2.5 liters of distilled spirits may be removed from the NASKEF installation per month. 2. Request for Additional Removals of Alcohol. If occasions arise where removal of greater quantities of alcohol for personal use is desired, Defense Force Members may submit a request with appropriate rationale through Iceland Defense Force (IDF) Provost Marshall s Office for approval by the Keflavik Airport District Commissioner s Office a minimum of ten working days prior to the date of request. 3. Removal of Tobacco from the NASKEF Installation. Only Defense Force Members 18 years of age or older and who are authorized to purchase duty-free tobacco products aboard the NASKEF installation may remove from the NASKEF installation, in any one day for personal use, the following quantities: a. Two packages of cigarettes, b. Five cigars, OR; OR; c. One pouch of pipe tobacco. 5-1

16 4. Removal of Smokeless Tobacco. Snuff and chewing tobacco is illegal in Iceland and can only be legally used on the NASKEF installation. Removal of smokeless tobacco from the NASKEF installation is prohibited. 5. Removal Controls and Verifications. All Defense Force Members must have a control card (appendix C) or a copy of their orders with a ration control stamp in order to remove alcohol and/or tobacco purchased on the NASKEF installation from the NASKEF installation. The following controls and verifications apply: a. Those temporary additional duty (TAD/TDY) transient personnel on orders for 60 days or less must have a ration control stamp on the back of their orders. TAD/TDY transient persons shall present their orders containing this stamp and the alcohol they wish to take off the NASKEF installation to the Icelandic Police inside the Main Gate, building 943, for verification and documentation PRIOR to leaving the NASKEF installation. b. Any defense force member or TAD/TDY transient person on orders in excess of 60 days must possess a control card. Those with a control card shall present it and the alcohol they wish to take off the NASKEF installation to the Icelandic Police inside the Main Gate, building 943, for verification and documentation PRIOR to leaving the NASKEF installation. c. Control cards will be issued by the NASKEF Security Administration Office upon completion of base indoctrination, and shall only be issued to Defense Force Members. 6. General Regulations Regarding the Control Card a. The control card is an official military document. Requests for replacement of lost or stolen cards will receive careful consideration. Maximum effort shall be made to recover lost or stolen control cards. To protect the entitlement of authorized personnel, the following procedures will be followed when a control card is believed lost, stolen or destroyed: (1) The person issued the control card or the military sponsor, under whose cognizance a control card has been issued, will immediately report the loss, in person, to the NASKEF Security Administration Office to file a report. (2) The NASKEF Security Administration Office will invalidate the serial number of the lost control card. (3) The NASKEF Security Administration Office will issue a replacement control card at their discretion. 5-2

17 b. Control cards found by any person will be promptly delivered to the NASKEF Security Administration Office or Police Dispatcher. c. Control cards are not transferable. Use of a control card by an individual other than the person to whom the card was issued is prohibited. d. Control cards shall be turned in as part of the base permanent change of station (PCS) check-out procedure prior to departure from Iceland. e. Control cards may be confiscated for the following reasons: (1) When so requested by the NASKEF Security Officer or his/her direct representative as evidence of a crime. (2) When so requested by the commander, commanding officer or officer-in-charge of that military member, or by the NASKEF CO or NASKEF Executive Officer (XO). Reinstatement of privileges and return of the control card must be requested in writing to NASKEF CO, via the commander, commanding officer or officer-in-charge of the unit to which the requesting member is assigned. 5-3

18 CH-1 20 Aug 04 CHAPTER 6 RESTRICTIONS AND REGULATIONS CONCERNING THE SALE OF TOBACCO ON THE NASKEF INSTALLATION 1. General Policy on Tobacco a. Persons 18 years of age or older may purchase or consume tobacco products in Iceland, whether on or off the Agreed Area. b. Defense Force Members younger than 18 years of age who purchase or consume tobacco products in Iceland, may be subject to administrative actions and/or barment from base. c. Defense Force Members who provide tobacco products to persons under 18 years of age, may be subject to administrative actions and/or punishment under the UCMJ. d. Smokeless tobacco such as snuff and chewing tobacco is illegal in Iceland and shall not be removed from or used off the NASKEF installation. e. The sale or transfer of duty-free tobacco products to non- Defense Force Members is a violation of this instruction. f. All tobacco products must be properly disposed in waste receptacles. Disposal of tobacco products directly onto the ground is littering and is prohibited. g. Smoking is prohibited aboard NASKEF installation except as listed in Chapter 7 of this manual. h. Use of tobacco, smokeless or otherwise, is prohibited during briefings, meetings, classes, formations, inspections, watches and in all other situations not listed above where proper decorum is required. 2. Sale of Tobacco to Defense Force Members a. Tobacco sales to Defense Force Members are authorized at: (1) The following Navy Exchange (NEX) facilities: (a) NEX main store. (b) NEX Viking Mall. (c) Navy Lodge. (2) The following Morale, Welfare and Recreation (MWR) facilities: 6-1

19 (a) Three Flags Club. (b) Top of the Rock. (c) Arctic Bowling Center. b. Any on-base establishment that sells tobacco to persons under the age of 18 may be subject to administrative sanctions including but not limited to, loss of privileges to sell tobacco and/or activity closure. 3. Sale of Tobacco to Icelandic Non-Defense Force Members. Per reference (h), tobacco sales to Icelandic non-defense force R) members are limited to two packs of cigarettes or two cigars or a combination of one cigar and a pack of cigarettes per day from the following MWR facilities: a. Three Flags Club b. Arctic Bowling Alley 6-2

20 CHAPTER 7 SMOKING AREAS AND REGULATIONS REGARDING NONCOMPLIANCE OF THE SMOKING POLICY 1. Smoking Policy Aboard NASKEF Installation. Tobacco smoking is prohibited except as outlined in paragraph 2 of this chapter and appendix D. 2. Smoking Areas. Tobacco smoking is authorized in the following indoor areas aboard the NASKEF installation only: a. MWR facilities: (1) Slot machine area in the Arctic Circle Bowling Alley facility. (2) Slot machine area in the Privateers Club. b. Personal automobiles and vehicles. c. Individually assigned family housing units and Navy Lodge quarters aboard NASKEF installation that have been designated as smoking quarters (see appendix D). d. Balconies attached to non-smoking designated quarters. e. Outdoor Designated Smoking Areas. Tobacco smoking is authorized in designated smoking areas near all buildings. These areas are to be maintained and cleaned by the organizations, personnel and/or families that occupy these buildings. 4. Violation of this chapter may be subject to one or more of the following actions that may be taken: a. Administrative action. b. Non-judicial punishment. c. Reassignment to smoking quarters at the resident s expense. d. Demand for reimbursement/garnishment for cost of carpet replacement, deep cleaning of quarters or for cost of painting as determined by the inspecting official. e. Expulsion of civilians, authorized to live off-base, from government housing/barracks who continue to smoke in nondesignated quarters and areas. 7-1

21 CHAPTER 8 RESPONSIBILITIES 1. NASKEF Security Officer shall: a. Issue control cards to authorized Defense Force Members and renew expired control cards during the week of the stamped anniversary date (one year after issuance). b. Maintain an accurate and current file of all Defense Force Members to whom a control card was issued. 2. NEX Manager shall ensure all requirements contained in this instruction are strictly followed at all NEX facilities aboard NASKEF. Sales of alcohol and tobacco to host nationals at NEX facilities is strictly prohibited. 3. NEX employees shall ensure all requirements contained in this instruction are strictly followed at all NEX facilities aboard NASKEF. 4. MWR Director shall ensure all requirements contained in this instruction are strictly followed at all MWR facilities aboard NASKEF. 5. MWR employees such as bartenders, sales personnel or clerks employed at locations authorized to dispense alcoholic beverages and tobacco will be held responsible for unauthorized sales. Sale of alcohol, alcoholic beverages and tobacco to any MWR patron will be terminated by the bartender, club manager or command duty officer when circumstances warrant. 6. Housing Director shall ensure all residents are aware of the alcohol and smoking regulations and that they are aware of designation of smoking areas in housing units. The Housing Director will continually evaluate the need for smoking and nonsmoking designated quarters to ensure comparable waiting times between each category. 7. Supply Officer shall ensure all residents are aware of the smoking and alcohol regulations in all officer and enlisted bachelor quarters. 8. Commanders, Commanding Officers (COs) and Officers-in-Charge (OICs) are responsible for monitoring and controlling activities of their personnel in their unit s BQs and enforcement of the regulations contained within this instruction, and forwarding to the NASKEF Security Officer a letter authorizing suspension or revocation of privileges when such action, as it pertains to members of the defense force under their cognizance, is deemed necessary or prudent. 8-1

22 9. Defense Force Members are responsible for complying with the regulations and policies contained in this instruction. 10. Defense Force Members and TAD/TDY transient who desire to remove alcohol and tobacco from the NASKEF installation shall: a. Familiarize themselves with the provisions of this instruction. Defense Force Members not residing on the NASKEF installation will pay particular attention to reference (c). b. Obtain a control card during base indoctrination or from the NASKEF Security Administration Office. c. Abide by all limitations and restrictions delineated in this instruction regarding the purchase of alcoholic beverage or tobacco products. d. Assume responsibility for the care and proper use of the control card(s) issued, including those of family members. e. Inform the NASKEF Security Administration Office of lost, stolen or significantly damaged control card(s). f. Reapply for control card(s) when previously issued control card(s) have expired. Control cards automatically expire one year from the date of issue. g. Relinquish control card(s) when requested by appropriate authority as outlined in this instruction. 8-2
