6 Minimum Educational Requirements I. General Educational Development a. Have passed a general educational development (GED) testing indicating high school graduation level b. Be a high school graduate; c. For peace officers and armed public security officers: i. Be 21 years of age, or ii. 18 years of age if the applicant has received an associate s degree or 60 semester hours of credit from an accredited college or university or iii. Have received an honorable discharge from the armed forces of the United States after at least 2 years of active service; iv. For jailers, be 18 years of age. II. Background Check a. Be fingerprinted and subjected to a search of local, state, and national records and fingerprint files to disclose any criminal record. b. Not ever have been or currently on court-ordered community supervision or probation for any criminal offense above the grade of Class B misdemeanor or class B misdemeanor within the last 10 years. c. Not currently under indictment for any criminal offense; d. Not ever have been convicted of an offense above the grade of a class B misdemeanor or a class B misdemeanor within the last 10 years; e. Never have been convicted of any family violence offense; f. Is not prohibited by state or federal law from operating a motor vehicle; 5. Is not prohibited by State or Federal law from possessing firearms or ammunition; 6. Be subjected to a background investigation and be interviewed prior to appointment by representatives of the appointing authority.

8 III. Medical Exam a. Be examined by a physician, selected by the appointing or employing agency, who is licensed by the Texas State Board of Medical Examiners. b. The physician must be familiar with the duties appropriate to the type of license sought and appointment to be made. c. The appointee must be declared in waiting by that professional within 180 days before the date of appointment by the agency to be: i. Physically sound and free from any effect which may adversely ii. affect the performance of duty appropriate to the type of license sought; and Show no trace of drug dependency or illegal drug use after a physical examination, blood tests, or other medical tests; d. Be examined by a psychologist, selected by the appointing or agency, who is licensed by the Texas State Board of Examiners of Psychologists. i. The Psychologist must be familiar with the duties appropriate to the type of license sought and appointment to be made. ii. A psychiatrist may also conduct this examination. iii. The appointee must be declared in writing by that professional to be in satisfactory psychological and emotional health to serve as the type of officer for which the license is sought within 180 days before the date of appointment by the agency. iv. The examination must be conducted pursuant to professionally recognized standards and methods; e. The commission may allow for exceptional circumstances where a licensed physician performs the evaluation of psychological and emotional health. i. This requires the appointing agency to request in writing and 2

9 receive approval form the commission, prior to the evaluation being completed; and f. The examination may be conducted by a qualified psychologist exempt from licensure by the Psychologist Certification and Licensing Act, Section 22, who is recognized under exceptional circumstances; IV. Military a. Not have been discharged from any military service under less than honorable conditions including, specifically; i. Under other than honorable conditions; ii. for bad conduct; iii. that is dishonorable; or iv. for any other characterization of service indicating bad character. V. Not have had a commission license denied by final order or revoked, nor have voluntarily surrendered a license currently in effect. VI. Meet the minimum training standards and pass the commission licensing examination for each license sought; VII. Not violate any commission rule or provision of Occupations Code, Chapter VIII. The commission will construe any court-ordered community supervision, probation or conviction for a criminal offense to be its closest equivalent under the Texas Penal Code classification of offenses if the offense arose from: a. Another penal provision of Texas law; or b. A penal provision of any other state, federal, military or foreign jurisdiction. IX. A classification of an offense as a felony at the time of conviction will never be changed because Texas law has changed or because the offense would not be a felony under current Texas laws. X. An agency must retain records required under this section for a minimum 3

10 XI. of five years after the licensee s termination date with that agency. a. These records must be maintained in a format readily accessible to the commission. An agency must report to the commission any failure to appoint an individual in the reported capacity within 30 days of the reported date of appointment. a. Philosophy: It is the sincere belief of the instructional staff of the Northeast Police Academy that the police profession is among the most noble and honorable professions in which a young man or woman can hope to serve. To serve as a law enforcement professional in a free and democratic society is both rewarding and challenging. The rewards consist of serving in a respected profession and knowing that you are serving your fellow citizens in ways that improve their safety, their security and their quality of life. The challenges consist of knowing that you are working in a complex legal system that respects the rights, privileges and immunities of all citizens, to include those accused of the commission of crime. Another challenge involves the fact that the job is often dangerous. The fact that you must continually confront dangerous situations and persons includes the risk of potential injury or death, or in some instances legal liability. Inherent in the training and education that you are here to receive are two principle considerations on the part of the instructional staff. The first of those considerations is that you must be able to demonstrate, upon completion of the program 3

26 that you have successfully mastered the skills, procedures, theory and legal knowledge with which to enter into the field of police work as an entry level police officer. The second consideration is the fact that you must demonstrate proficiency in those survival skills that are required to protect you and your fellow officers from harm, injury or death. 3. Basic Qualifications: The basic requirements for attending a law enforcement academy in the state of Texas are outlined in the Rules of the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE). Each of you who have been accepted in the Northeast Police Academy have been informed of the basic entry level rules for attending law enforcement training in Texas. Each of you have been provided with information regarding the basic qualifications and have signed a statement indicating that you have read the conditions, and that you meet those standards. A copy of that document will be a permanent part of your personnel folder. A copy of that portion of the TCLEOSE rules may be found in the TCLEOSE Rules in the back of your text. 4. Ability to Achieve Success: Every attempt will be made during your training program to test your ability to operate in the field of law enforcement. If an individual cannot cope with the stress of a training program, such as the police academy, it is unlikely that he/she could cope with the real-world stress of actual police work. To be successful in this training environment requires patience, determination and dedication to the task at hand that of learning! For the entire period of this academy, it is expected that every opportunity to study and to learn must be utilized. Your participation and dedication to the learning process will be monitored and measured continually during the course. 5. Attendance: As a police candidate of this academy, you are expected to be at the appointed place at the appointed time. Be where you are supposed to be when you are supposed to be there. Punctuality is a standard of conduct that is expected of each police candidate. Failure to be punctual, or to be absent without justification will result in sanctions which could, if not corrected, lead to your dismissal from the program. 6. Appearance: 4

27 All candidates attending the Northeast Police Academy will wear the distinctive police academy uniform. Candidates are required to wear the uniform daily unless directed to wear other attire for specific training, such as physical training. The uniform will consist of 8 or 10 black leather boots, black BDU (battle dress utility) trousers, a black belt (leather duty belt or military web belt) and the black uniform tee shirt with the distinctive Northeast Police Academy logo. Undergarments, such as tee-shirts may be worn underneath the uniform shirt only if they blend with the uniform color scheme. If undergarments of a different color are worn beneath the shirt, the shirt must be buttoned at the neck so that the undergarment does not show. During cool weather, a sweat shirt, coat or a turtle neck may be worn if the garment is black and does not detract from the color scheme of the uniform. The uniform is to be worn with pride. Pride is indicated when an individual wears a uniform that fits properly, is properly maintained, and when the student is continually mindful of the fact that he/she is continually in public view. Sloppiness or neglect in personal appearance may result in disciplinary sanctions and corrective action. High standards for personal grooming are expected. Candidates will maintain high standards of personal hygiene while attending the academy. Indications of a lack of personal hygiene, such as offensive body odor or indications of unsanitary conditions will be a subject of counseling, corrective action, or sanctions. Males will have neatly trimmed hair. The hair of male candidates will not cover the ears or the collar. Military hair styles are encouraged but not mandatory. The hair should be clean and well groomed. Males will be clean shaven and sideburns should not extend below the level of the ear canal. Neatly trimmed moustaches are permitted. Females will ensure that their hair is neatly gathered in a fashion that will not allow the hair to flow about the face or shoulders. A neatly tied pony-tail or bun is encouraged. Excessive make-up is discouraged. No body piercing will be allowed. The use of body rings or other jewelry using body piercing (to include earrings or studs) is a potential source of personal injury and is not permitted whether it is visible, or may be concealed by clothing. Jewelry, with the exception of wedding bands and watches will not be worn. Watches will be removed during hands-on training, such as defensive tactics. 7. Behavior and Conduct: All police candidates will conduct themselves in a professional manner throughout the training program. All candidates must understand that preparation for entering the police field is serious work. The time for childish or foolish behavior is past, and such conduct will not be condoned. 5

28 The instructional staff of the police academy will constantly be vigilant for unacceptable conduct. Infraction of Academy rules will result in sanctions which will include corrective action or dismissal. A list of prohibited behavior is attached to this manual. This list consists of two categories of unacceptable behavior: 1) serious infractions of Academy rules and 2) procedural violations. The commission of a serious infraction will be grounds for immediate dismissal from the program. Procedural violations that are noted by the instructional staff will be grounds for sanctions or corrective action that might include demerits or physical activity such as push-ups. Exemplary behavior will be noted and rewarded in most cases. Exemplary behavior may include such things as excellence in academic achievement, appearance or attitude. Candidates are encouraged to inform the instructional staff of exemplary behavior on the part of their peers when such behavior is considered above and beyond the normal duty requirements of the candidate. No tobacco use on campus. Effective with the beginning of the spring 2004 semester, the main campus is a tobacco free area. The only place where smoking is allowed is in vehicles in the campus parking lots or in designated areas. Cell (mobile) phones. Cellular telephones are not allowed in the classroom at anytime. The instructor will consider any exceptions to this rule for emergency purposes. 8. Physical or Health problems: It is the duty of every candidate to inform the instructional staff of a health problem or a physical condition that may affect the health or safety of the candidate when performing police academy duties. Physical or health problems will not (in most instances) preclude an individual from completing the police academy program. Such problems must be known by the instructional staff prior to allowing the candidate to participate in high stress training activities. Candidates should remember that much of the training of a potential police officer is physical and physically demanding. It is not unusual for training related injuries to occur. Every precaution is taken to avoid the risk of injury. Despite the best precautions, injuries sometimes occur. If an individual has a health condition such as asthma or diabetes, serious reactions could occur during O.C. pepper spray training. A female who is experiencing pregnancy should not participate in certain aspects of police training. Individuals with joint problems (such as knees and shoulders) should insure that the instructional staff knows of these conditions. Each candidate will be required to complete a medical release form prior to the beginning of the academy. 6

29 The college does not carry medical insurance for students. Each student should be aware of the fact that the treatments of injuries incurred during training programs are the responsibility of the student. Insurance is available for the students, but Student Services must be contacted for more information concerning this service. Academic Ethics: Northeast Texas Community College may initiate disciplinary proceedings against a student accused of scholastic dishonesty. Scholastic dishonesty includes, but is not limited to, statements, acts, or omissions related to applications for enrollment or the award of a degree, and/or the submission as one s own work material that is not one s own. Scholastic dishonesty may involve, but is not limited to, one or more of the following acts: cheating, plagiarism, collusion, use of annotated texts or teacher s editions, and/or falsifying academic records. Plagiarism is defined as the appropriation of any person s work and the unacknowledged incorporation of that work in one s own work offered for credit. Cheating is defined to include the following: copying from another students paper; using materials during a test not authorized by the person giving the test; collaborating with any other person during the test without permission; knowingly obtaining, using, buying, selling, transporting, or soliciting in whole or in part the content of test not yet administered; substituting for another student or permitting any other person to substitute for oneself; copying computer or Internet files, using someone else s work for assignments as if it were one s own, or any other dishonest means of attempting to fulfill the requirements of a course. 10. Academic Achievement: The police academy presents a challenging academic environment for the student. The entire program is intended to prepare the student to sit for and successfully pass the Texas Basic Peace Officer Examination at the end of the course. If it becomes apparent during the course that a student is not or cannot handle the academic load, it may be necessary to remove that student from the program as early as possible. The course consists of twenty-nine TCLEOSE training units, each with specific learning objectives that are subject to testing by TCLEOSE. During the training 7

30 program, candidates will be tested over each instructional unit. Often, they may be tested more than once over material covered in the academy curriculum. A minimum grade of 80 (of a 100 point system) is required for successful completion of a unit of instruction. If a student fails a test (scores below 80 percent), he or she will be given one opportunity to retest. That retest will be taken on the student s own time, within one calendar week of the failed test. Cadets, who are unable to be present at the beginning of a unit of instruction regardless of reason, will not be allowed to take the unit exit exam as a pretest. If the student still fails to score an 80 percent or better including retakes, he/she will be dropped from the program or, in some instances, recycled to a later academy. In addition to individual unit examinations, periodic comprehensive examinations will be given, usually at four-week intervals (quarter semester). These examinations may cover any material that has been taught in the academy to that date. The same passing grade (80%) is required for these examinations. Time limitations will also be imposed during testing procedures. If a student fails one of the periodic comprehensive examinations, he or she will have one opportunity to retake the examination within one calendar week. Failure to pass such examination on the second attempt will be grounds for removal from the academy. An end of course examination will be given at the conclusion of all instructional units at the end of the academy. This examination consists of at least 300 questions. The test will be taken under time constraints. In order to qualify to take the exit exam, the cadet must take and pass a battery of 10 twenty five question exams. The same rules concerning passing grades and retakes apply as to those examinations mentioned above, e.g., a passing grade of 80, and a single re-test within one week. Failure of these examinations will result in withholding the Endorsement of Eligibility that is required to sit for the state examination. A battery of 13 exams will be made available on the NTCC- Web-CT website under the heading of Capstone Exams. Each cadet must take and pass all Capstone Exams with an average grade of 90 or better in order to become eligible to take the TCLEOSE exam. The exams will not enter into the cadet s overall average and may be taken as often as is needed until the required score is attained. Proof of passing each exam must be furnished the academy coordinator before an endorsement of eligibility to take the TCLEOSE exam will be issued. 11. Removal from the program: On occasion, an individual may not successfully complete the program for a variety of reasons. Students have voluntarily removed themselves from the program for personal, financial or family reasons. Others have been removed because they were unable to meet the minimum academic requirements. On rare occasions, candidates have been removed from the program for unacceptable conduct. Cadets who are unable to 8

31 attend class for 10 consecutive days regardless of reason will automatically be dropped from the program. 12. Reward and Punishment: Attached to this document is an explanation of the reward and punishment (merit and demerit) system which will be used to evaluate the day-to-day conduct and performance of candidates of the program. This program is separate from and in addition to the academic evaluation process. A student will begin the program with 100 merit points. Additional merit points will be awarded for exemplary or outstanding performance. Points will be deducted (demerits) for rule infractions or poor performance or appearance. 9
