Introduction The management of health & safety at work regulations 1999, regulation 5 requires employers to plan, organise, control, monitor & review their health & safety arrangements. Reporting & investigating form an essential part of this process. The Reporting of Injuries, disease & dangerous occurrence regulations require certain notifiable incidents are recorded & reported to the Health & Safety Executive Purpose The company requires accident and incident information in order to be pro active in improving health & safety, to help reduce the likelihood of injury to persons involved with our business, especially the services users for whom we have an extra duty of care towards. 1.2 Implementation It is the Policy of Outcomes First Group to investigate all accidents which result in injury or significant loss or damage to property. 2 1.3 Scope The scope of this policy includes all members of staff, service users & visitors involved in or witness too an accident, incident or near miss, or who have observed a hazard that is associated with the business activities and / or premises. 2. Recording of Events Any accident resulting in an injury that has occurred on company premises or off site but whilst carrying out company business activities, must be recorded in the statutory accident report book. This record is required under legislation. 2.1 Accident Book 1. Outcomes First Group organisation shall only use accident reporting books & procedures that comply with the Data Protection Act (It is an offence to disclose personal details to a 3 rd party without prior written permission of the individual, Parent or Guardian) Accident books shall be made available at all Outcomes First Group premises. 2. The accident report must be completed for any accident, incident or dangerous occurrence that occurs on Outcomes First Group premises including Outcomes First Group staff, service users, visitors or contractors. Must also be completed for any incident involving staff or service users off site. 3. The report form must be completed by a 2 nd person where ever possible and not the injured person & signed by both parties. 4. Copies of reports involving service users must be kept in both their personal file and in the Centre central file. 5. Copies of reports involving staff must also be kept in their personnel file and the Centre central file. A copy should also be made available to the injured person upon request. 6. Copies of reports involving visitors or contractors must be kept in the Centre central file & provided to the injured person or personnel department. 2.2 Accident / Incident Register An accident / incident register shall be maintained at each Regional Centre where all data will be processed. As required by RIDDOR, details of each accident or incident shall be entered on to the register for the purpose of reference and statistical analysis. Statistical analysis will be presented to the Board of Directors as well as the Group Health and Safety committee. 3. Reporting an Accident or Incident to the HSE (Health & Safety Executive) At each service the Head of Service must ensure that there is a robust system in place to identify reportable events. All reports to the HSE must be completed by a nominated person(s) approved by the Head of Service, these can be a Senior Manager or a Health and Safety representative or person overseeing safety & health matters. All HSE submissions should checked for quality and content by the Group Health and Safety Manager prior to submission. The report must be made within 15 days of the initial event / injury. The person carrying out the report form, must ensure they have the full facts of what has taken place in order to give a full & accurate account of the incident. Including if any action has been taken to prevent an occurrence. Reports must be submitted online at Fatal or Major injuries can be reported online or by telephone on (8:30 5:00pm) 3.1 Follow up action All RIDDOR reports must be copied to the Responsible Individual (CEO) and the Group Health and Safety Manager. All accidents / incidents must be investigated to help prevent an occurrence. Copyright Outcomes First Group, All rights reserved. 2

3 All IP s (Injured Persons) must have a return to work interview prior to commencing their shift by their Line Manager, to satisfy the Manager they are fit for full duties or to implement any additional requirements until the IP is fully able. It may be required that the IP is referred to Occupational Health for professional assessment and advice regarding their ability to carry out full working duties. 3.2 Reportable events summary Reportable injuries include an Over Seven day Injury; An accident or incident at work, including physical violence, that results in an employee being away from work or unable to do the full range of their normal duties for more than seven days (including rest days i.e. weekends or holiday etc) not counting the day of the injury itself. Specified injuries to workers include: Fracture other then to, fingers, thumbs or toes. Amputation. Dislocation of the shoulder, hip, knee or spine. Injury resulting in the permanent loss of sight or reduction insight Any crush injury to the head or torso causing damage to the brain or internal organs Chemical burn to the eye or any penetrating injury to the eye. Serious burns including scalds which; o Covers more than 10% of the body o Causes significant damage to the eyes, respiratory system or other vital organs Any Scalping requiring hospital treatment Any loss of consciousness caused by head injury or asphyxia Any other injury arising from working in an enclosed space which; o Leads to hypothermia or heat induced illness o Requires resuscitation or admittance to hospital for more than 24 hours Injury resulting from electric shock or electrical burn leading to unconsciousness or requiring resuscitation or admittance to hospital for more than 24 hours. Any other injury leading to hypothermia, heat induced illness, unconsciousness, requiring resuscitation or admittance to hospital for more than 24 hours. Reportable Disease include Carpal Tunnel Syndrome: where the person s work involves regular use of percussive or vibrating tools Cramp of the hand or forearm: where the persons work involves prolonged periods of repetitive movement of the fingers, hand or arm Occupational dermatitis: where the persons work involves significant or regular exposure to a known skin sensitiser or irritant Hand Arm Vibration Syndrome: where the persons work involves regular use of percussive or vibrating tools, or holding materials subject to percussive processes causing vibration Occupational Asthma: where the persons work envolves significant or regular exposure to a known respiratory sensitiser Tendonitis or tenosynovitis: in the hand or forearm, where the persons work is physicall demanding and involves frequent, repetitive movements Certain poisonings. Some skin disease such as occupational dermatitis, skin cancer. Lung disease including occupational asthma, asbestosis. Infections such as hepatitis, tuberculosis, legionellosis and tetanus. Reportable dangerous occurrences include; Electrical fault causing fire or explosion. Any unintended explosion, or injury caused by an explosion. 4 Collapse or partial collapse of scaffold over 5m high or erected near water where there could be a risk of drowning after fall. Unintentional collapse of any building or structure under construction, or demolition. Explosion or fire causing suspension of work for over 24 hours. A full list of reportable diseases, major injuries and dangerous occurrences is available online: or ring the HSE info line: Specified injuries to workers The list of specified injuries in RIDDOR 2013 replaces the previous list of major injuries in RIDDOR Specified injuries are (regulation 4): 4. Recording of events (for investigation purposes) Following any accident or incident the Outcomes First Group report form must also be completed in addition to the Accident book (section 2). This form provides detailed information including; First Aid or advice provided Details of witnesses The requirement for follow up action required and by who For further information & forms for investigation, please see Accident Investigation Policy and associated forms. This information will aid any investigation and the completion of an action plan to help prevent an occurrence. 5. Archive record keeping requirements 5.1 Adult Services & Staff, Visitors and members of the Public Accident records must be kept securely in the home, kept up to date and are available for inspection. Records should be maintained for not less than 3 years from the date of the last entry. 5.2 Children s Services Accident records should be kept securely whilst the child is resident at the home and then passed to the local authority when the placement ends. A copy also needs to be kept for 15 years at the home after the placement ends. 6. Monitoring Audit & Review The ongoing implementation of this Policy will be monitored through supervision & the company H&S Audit process. Monthly statistical analysis will be provided to the Board of Directors in a monthly report prepared by the Group Health & Safety Manager. Where appropriate, RIDDOR will be a regular agenda item for health & safety team meetings. This policy will be reviewed as part of the regular cycle of reviews, unless changing circumstances require an earlier review. Copyright Outcomes First Group, All rights reserved. 4

5 Appendix 1 RIDDOR & Accident Book Report Procedures Flow Chart Arrangements for reporting Accidents, Injuries, Disease & Dangerous Occurrences Injury to Employee or Non Employee, Dangerous Occurrence or Disease NON EMPLOYEE EMPLOYEE Ensure both the Statutory accident record and the Outcomes First Group accident / incident / near miss forms are completed. Once completed these must be filed correctly and the relevant people must be informed of the undesired event. It is important that all 1 st Aid advice and treatment is recorded and signed by the 1 st Aider together with details about what happened immediately after (e.g. went back to work, went home, taken to hospital). Fatal or Major Injury Dangerous occurrence Injury causing a Seven day incapacity Reportable disease Notify the Centre Head & Head Office immediately. Delegated person to inform the HSE The Centre Head or delegated person must notify the HSE online within 15 days of the initial incident.
