3 GENESEE COUNTY METROPOLITAN PLANNING COMMISSION Tuesday, August 7, 2018, 8:00 a.m. MINUTES The Genesee County Metropolitan Planning Commission met at 8:00 a.m. on Tuesday, August 7, 2018, in the Conference Room of the Genesee County Metropolitan Planning Commission (GCMPC), 1101 Beach Street, Room 223, Flint, Michigan. I. CALL TO ORDER Chairperson Himelhoch called the meeting to order at 8:08 a.m. II. ROLL CALL Present: Alan Himelhoch, Alexander Isaac, David Martin, Gloria Nealy, Janice Karcher, Jeffrey M. Peake, and John Mandelaris. Absent: Reggie Smith, Mark Young, Martin Cousineau, and Cheryl Sclater. Others Present: Derek Bradshaw, Christine Durgan, Sheila Taylor, Jason Nordberg, Jacob Maurer, and Nichole Odette. III. MINUTES A. Minutes of the July 10, 2018 Regular Meeting Motion: Action: Approve, Moved by John Mandelaris, Seconded by Janice Karcher, to approve the July 10, 2018 regular meeting minutes as presented. (Approved minutes are on file in the GCMPC office) Draft IV. OPPORTUNITY FOR INDIVIDUALS TO ADDRESS THE COMMISSION No one spoke at this time. V. COMMUNICATIONS A notice from Beckett & Raeder, Inc. was received to inform the Commission that Fenton Township s draft Master Plan is available for review and comment. Friends of the Mt. Morris Library sent a thank you card and photo of a new flag pole purchased for the library with funds from the beautification grant won by the City of Mt. Morris. Michigan s 2017 Roads and Bridges Annual Report was received from the Michigan Transportation Asset Management Council. 1

4 John Mandelaris asked the Commission to consider moving the September meeting date to the 11 th due to the Labor Day holiday. Discussion ensued. Motion: Action: Approve, Moved by John Mandelaris, Seconded by Janice Karcher, to approve moving the September GCMPC meeting date to September 11, VI. COMMITTEE REPORTS A. Personnel Committee John Mandelaris stated that he and Chairperson Himelhoch met with Derek Bradshaw on July 26 th to review his annual evaluation and Mr. Bradshaw has 30 days to comment on the evaluation. The Director-Coordinator evaluation will come before the full Commission for approval at next month s meeting. Motion: Action: Accept, Moved by Janice Karcher, Seconded by Jeffrey M. Peake, to accept the report of the Personnel Committee. VII. NEW BUSINESS A. FPR ; City of Swartz Creek, Water Main Improvements Jacob Maurer gave an overview of FPR ; City of Swartz Creek, Water Main Improvements. Discussion ensued. Motion: Action: Endorse, Moved by Janice Karcher, Seconded by Alexander Isaac, to endorse FPR ; City of Swartz Creek, Water Main Improvements. (Document on file with minutes) Draft VIII. FINANCES A. Contract, Vouchers and Bills Motion: Action: Approve, Moved by Alexander Isaac, Seconded by Janice Karcher, to approve the August Contract, Vouchers and Bills for a total of $44, and to authorize the proper authorities to sign the checks. Financial Update Derek Bradshaw stated that Nicole Lewis continues to work with the Controller s office to finalize our budget. This year the Board of Commissioners requested that each department give a budget presentation. Mr. Bradshaw will deliver GCMPC s budget presentation on August 15 th. 2

Project Status 1. 3-C Transportation Planning July 2018 Status Report Jason Nordberg gave an overview of the Michigan Transportation Planning Association (MTPA) conference. GCMPC will host the conference in three years. Derek Bradshaw congratulated Mr. Nordberg on his successful term as MTPA Chairperson. Environmental Program Update July 2018 Status Report Sheila Taylor reviewed the Environmental Program Update. Community Development Program July 2018 Status Report Sheila Taylor stated that an NSP home was sold last Friday, leaving one NSP home for sale and one to be rehabilitated. The remaining Operation Unification home did have a cash offer; however, the client was over income. The Lyndon Avenue home acquired from Salem Housing is occupied by a tenant that is interested in leasing to own the property. Mr. Bradshaw stated that there is RPI funding in the state budget for next year, however, the amount listed was a typo and is being corrected. 6 (Original on file with minutes) B. Commissioner Comments Commissioners made comments at this time. Gloria Nealy gave an update of the Parks and Recreation Commission meetings and events. Derek Bradshaw stated that five applicants were interviewed for the Planner 1 positions yesterday. The Accountant position became vacant and has been offered to one of the interviewees. Human Resources is completing the background check. Staff is re-thinking how to fill the Housing Rehabilitation Specialist position; in the meantime, Habitat for Humanity s Inspector has been helping with the back log of HIP inspections. Chairperson Himelhoch stated that the election of officers will take place at the September meeting. If you are interested in serving as Chairperson, Vice Chairperson, or Secretary please let staff know. X. Jennings Trust Application For Farmland Agreement I. LEGISLATIVE BASIS FOR GCMPC REVIEW Part 361 of the Natural Resources and Environmental Protection Act, 1994 Act 451 as amended, more commonly known as P.A. 116, enacted in 1974, establishes the right of a landowner, if all qualifications are met, to enter into a temporary restrictive agreement where the owner and the state agree to jointly hold the right to develop a parcel of farmland. This covenant is an agreement to not develop the property except as specifically stated within the agreement. The covenant runs with the land and is for a jointly agreed upon length of time (at least 10 years). Upon receipt of an application, the local governing body has 45 days to approve or reject the application. Within this 45-day period, the local governing body must seek comment from a number of bodies including the county or regional planning commission. Any comment received is strictly advisory as these reviewing agencies do not have an approval or rejection power over the application. II. STAFF ANALYSIS The request for comment from the Genesee County Metropolitan Planning Commission was received within the required 45-day period starting at the onset of application. The parcel listed in Gaines Township at T-6N, R-5E, Section 9, measures 56.4 acres according to the assessor s description, of which 35 acres are used for cultivation. The parcel is located between Hill Road to the north, Reid Road to the south, Nichols Road to the west, and Van Vleet Road to the east. The parcel does meet the criteria of being 40 acres or larger in size and a minimum of 51% of the land is agriculturally active. 8 designation except a small parcel of land to the north being designated Residential Suburban. The Existing Land Use map shows the parcel in question is designated as Agricultural with the parcels to the north and south designated Single-Family Residential. The parcels to the west and east are designated Agricultural. Two of the objectives of the recently adopted Master Plan for Gaines Township aim to Encourage retention of the best soils and most productive lands in agricultural production, and to Protect agricultural lands from fragmentation and the negative impacts of residential encroachment through new zoning initiatives. The Future Land Use Map of Gaines Township, updated in 2017, intends for this parcel to be Rural Residential. The parcels to the north, east, south, and west have the same designation. According to the 2017 Gaines Township Master Plan, the Rural Residential classification allows limited farming opportunities. It is intended for residential activities on parcels of five acres or greater. Single-family residential development at this density will also serve as a buffer between agricultural uses and the more dense suburban residential uses. Open space developments should be considered in rural residential designation to preserve the rural character while discouraging the further parcelization of road frontage. There are several other parcels in Gaines Township which are protected under PA 116, however, none are directly adjacent to the property being reviewed. III. STAFF RECOMMENDATION Pursuant to the provisions of Public Act 116, staff recommends that the Genesee County Metropolitan Planning Commission, submit the following comments to Gaines Township in regards to FOS : 1. Based on the initial review, this application for Farmland Agreement is eligible for the Farmland and Open Space Preservation Program. The parcel does meet the criteria of being 40 acres or larger in size and a minimum of 51% of the land is agriculturally active. 2. Preservation of farmland addresses the County s call that, special attention should be given to farmland and open spaces, as stated in GCMPC s, A Changing Landscape: 2006 Land Use Analysis & Trends. 3. The enrollment of this parcel in PA 116 is consistent with local planning. The parcel under consideration is designated Rural Residential on the Gaines Township Master Plan Future Land Use map and is consistent with the goals stated within the plan. IV. 13 MEMORANDUM TO: FROM: Members of the Genesee County Metropolitan Planning Commission Damon Fortney, Planner III DATE: September 11, 2018 SUBJECT: MPR ; Fenton Township Master Plan I. LEGISLATIVE BASIS FOR GCMPC REVIEW The Michigan Planning Enabling Act, Act 33 of 2008, as amended, provides the legislative basis for planning commissions to create, adopt, and amend a basic plan. Municipalities shall follow Part Section 41, Subsection (2) which states: the secretary shall submit a copy of the proposed plan, for review and comment, to all of the following: (c) the county planning commission The secretary of the planning commission shall concurrently submit to the county planning commission, in the manner provided in section 39(3), a statement that the requirements of subdivision (a) have been met or, if there is no county planning commission, shall submit to the county board of commissioners, in the manner provided in section 39(3), a statement that the requirements of subdivisions (a) and (d) have been met. The statement shall be signed by the secretary and shall include the name and address of each planning commission or legislative body to which a copy of the proposed master plan was submitted under subdivision (a) or (d), as applicable, and the date of submittal. Additionally, as part of these procedures, Part , Section 41, Subsections (3) and (4) specify that: An entity described in subsection (2) may submit comments on the proposed master plan to the planning commission in the manner provided in section 39(3) within 63 days after the proposed master plan was submitted to that entity under subsection (2). If the county planning commission or the county board of commissioners that receives a copy of a proposed master plan under subsection (2)(e) submits comments, the comments shall include, but need not be limited to, both of the following, as applicable: (a) A statement whether the county planning commission or county board of commissioners considers the proposed master plan to be inconsistent with the master plan of any municipality or region described in subsection (2)(a) or (d).(b) If the county has a county master plan, a statement whether the county planning commission considers the K:\MPR\2018\MPR Fenton Twp Master Plan.docx

14 proposed master plan to be inconsistent with the county master plan. (4) The statements provided for in subsection (3)(a) and (b) are advisory only. II. III. PAST GCMPC ACTION GCMPC previously reviewed and endorsed the Fenton Township Master Plan in 2000 (MPR ) and the Fenton Township Land Use Plan in 2003 (MPR ). STAFF ANALYSIS Overall, the Fenton Township Master Plan is a very comprehensive document which goes beyond just meeting all planning requirements. The Master Plan includes a variety of maps, graphics and photographs that make it interesting to read, even for the average citizen. The plan includes useful data and analysis on demographics, housing types, natural resources, potential hazards, infrastructure, economic development, and more. The development of this plan offered a great deal of public involvement. The Township s public participation process included a survey to residents, a visioning session, activities with middle school students, and one-on-one stakeholder interviews. The in-depth statistics collected from these activities should help guide implementation of the Master Plan. The Master Plan includes a Future Land Use Map and Zoning Plan which will be used as a framework to guide land use and policy decisions over the next 15 to 20 years. Additionally, an action plan is provided which provides goals and objectives to be achieved in the next five years. The action plan covers five overarching goals: Environmental Preservation, Housing, Infrastructure, Recreation, and Communication. The plan recommends that Township officials should review the action plan annually and reprioritize if necessary. GCMPC was properly notified by Fenton Township of their intention to update the Master Plan. Upon completion of the Draft Plan, sufficient time was provided for review and comment by GCMPC staff. A public hearing for the Master Plan will be held on October 11 th, IV. STAFF RECOMMENDATION Pursuant to the provisions of Public Act 33, Michigan Public Acts of 2008, as amended, the Michigan Planning Enabling Act, staff submits the following comments and recommendations to the Genesee County Metropolitan Planning Commission, for consideration at its meeting of September 11, 2018, regarding the project described as MPR ; Fenton Township Master Plan, for the following reasons: 1. The Fenton Township Master Plan provides data, maps, trends, goals and policies which should help guide new development in the Township. 2. Fenton Township has met the notification requirements for the revision of their Master Plan.

15 3. GCMPC has not received comments from adjacent municipalities regarding the draft Master Plan. 4. Staff considers the draft Master Plan to be consistent with the plans of neighboring municipalities.

16 MEMORANDUM TO: FROM: Members of the Genesee County Metropolitan Planning Commission Jason Nordberg, Principal Planner Genesee County Metropolitan Planning Commission DATE: September 11, 2018 SUBJECT: 3-C Transportation Planning August 2018 Status Report Transportation Update The Transportation Management Subcommittee (TSM) committee met several times in August to develop applications and policies and procedures for the Transportation Improvement Program (TIP) call for projects. The TSM will meet again in early September to finalize the TIP call for projects materials and will be recommending approval to the Technical Advisory Committee (TAC) and the Genesee County Metropolitan Alliance (GCMA) for their September meetings. It is projected that a call for projects for the TIP will be released in October. Rideshare During the month of August, staff provided 100 Rideshare brochures to the Genesee County Human Resources Department. These brochures will be provided to new employees as part of their overall orientation process. Two confirmation s and three match lists were sent to prospective participants through the online registration program and one new active member joined the Rideshare Program in August. IX A 1

17 MEMORANDUM TO: FROM: Members of the Genesee County Metropolitan Planning Commission Sheila Taylor, Principal Planner Environmental Program DATE: September 11, 2018 SUBJECT: Environmental Program Update August 2018 Status Report Solid Waste Program The third Tuesday Recycle Day event of 2018 was held on August 14 th from 2:00 p.m. to 6:00 p.m. at Mott Community College. 308 vehicles came through the event to drop off many hard-to-dispose of items. Wait times were minimal with it taking approximately 5 10 minutes to get through the site. As a result, many positive comments were received from those who attended the event. This success could not have been achieved without the help of Mott Community College, ERG Environmental Services, Emterra, Jonnie-on-the-Spot, Keep Genesee County Beautiful, ELGA Credit Union, and the City of Flint. The next Recycle Day event is scheduled for Saturday, September 15 th from 10:00 a.m. to 2:00 p.m. at Carman-Ainsworth Middle School and the Flint Water Service Center. Staff provided engaging recycling presentations to students at the Sylvester Broome Empowerment Village summer camp program in Flint. Staff also presented to members of the Burton Senior Center. Over 80 people were reached through these presentations. Staff is in the process of collecting Waste Hauler Permit Applications for Every hauler picking up waste in Genesee County must obtain a permit for each vehicle per the Solid Waste Ordinance. Many of the waste haulers have already submitted their application with payment, which is $20 per vehicle. Staff will continue reaching out to all other companies to collect their applications. 19 MEMORANDUM TO: FROM: Members of the Genesee County Metropolitan Planning Commission Sheila Taylor, Principal Planner Community Development Program DATE: September 11, 2018 SUBJECT: Community Development Program August 2018 Status Report Community Development Block Grant Program (CDBG) During the month of August, staff received approval of the 2018 Action Plan from the U.S. Department of Housing and Urban Development (HUD) and received the grant agreements. A request to accept the grant funds and sign the grant agreements will go to the Board of Commissioners on September 24, 2018 along with approval of all subrecipient contracts. Staff continued to assist local units of government with project implementation and funding reimbursements. HOME Investment Partnerships Program (HOME) The 2017 Habitat project had been delayed due to a change in building locations. The 2017 contract for $150,000 has gone to the Genesee County Board for approval and signatures. The Board Chair and Habitat will sign the contract in early September. Houses will be built on Lord Street in Gaines Township and Calkins Road in Flint Township. Home Improvement Program The CDBG Home Improvement Program completed one residential unit in August. Durgan, Assistant Director DATE: September 11, 2018 SUBJECT: Genesee County Plan Update August 2018 Status Report The data collection and analysis of information for the Genesee: Our County, Our Future planning document continued in the month of August. To date, all paved federal-aid roads have been surveyed and staff is two-thirds completed with surveying non-federal aid roads. Data collection and methodology for the roundabout study continued and staff is reviewing data to identify safety and physical characteristics of intersections that may be suitable for a roundabout. Housing survey information collected from all local units is being compiled, landfill data and environmental asset data has been analyzed and data reports drafted. Due to the resignation or retirement of three key staff this summer, we have had to face the challenge of reassigning and reevaluating the original plan timeline. Modifications are currently being made and we will keep the Planning Commission apprised of these changes. IX A 4

Staff will be hosting an informational session on September 12 th for each marketing firm to present their proposals to members of the Region 6 Steering Committee. A final decision is expected by the end of September. Staff is working closely with Networks Northwest and the UM Flint Outreach Center to add the complete non-motorized network for the I-69 Thumb Region to The launch date is expected in late October. With the assistance of I-69 Thumb Region Economic Development Partners, staff is developing a draft budget, timeline and work plan for the 2019 RPI Application. The application is due on October 15, The next GLS Region V Planning and Development Commission meeting will be held on September 25, The next I-69 Thumb Region Steering Committee meeting will be held on October 10 th at 10:30 a.m. at the Lapeer County Health Department.
