1 Local Sports Clubs and CAA Compliance Bylaw KASAS ATHLETICS STAFF IVOLVEMET WITH LOCAL SPORTS CLUB The intent of this guide is to serve as a summary of CAA regulations applicable to local sports clubs. This summary is not intended to be all-inclusive. All athletics department staff members are encouraged to review CAA Bylaw and contact the Athletics Compliance Office for complete information. *Updated Summer 2011

2 Local Sports Clubs and CAA Compliance Bylaw Staff Involvement in Local Sports Clubs General Bylaws CAA Bylaw A member institution, on its campus or elsewhere, shall not conduct (or have conducted on its behalf) any physical activity (e.g., practice session or test/tryout) at which one or more prospective student-athletes (as defined in Bylaws and ) reveal, demonstrate or display their athletics abilities in any sport except as provided in Bylaws and CAA Bylaw In sports other than men s basketball, for purposes of the tryout rule, a prospective studentathlete shall include any individual who has started classes for the ninth grade and is not enrolled in the member institution at the time of the practice or test therein described. Exception for Local Sports Clubs CAA Bylaw In sports other than basketball, an institution s coach may be involved as a participant, administrator or in instructional or coaching activities in the same sport for a local sports club or organization located in the institution s home community, provided all prospects participating in said activities are legal residents of the area (within a 50-mile radius of the institution). CAA Bylaw Exception: The 50-mile radius restriction shall not apply to a prospective studentathlete who resides outside a 50-mile radius of the institution, provided the institution documents that the local sports club is the closest opportunity for the prospective student-athlete to participate in the sport. Applicable Bylaws and Official Interpretations 1. CAA Bylaw Multiple Teams/Sports. If the local club sponsors multiple teams or multiple sports, the 50-mile radius is applicable only to the team with which the institution s coach is involved; however, it is not permissible for the coach to assign a prospect who lives outside the 50-mile area to another coach of the club. 2. CAA Bylaw Below inth Grade. A coach of a local club team may be involved in activities with individuals who are not of prospect-age (i.e., prior to ninth grade) regardless of where such individuals reside. 3. Definition of Home Community. For purposes of CAA Bylaw , the institution s home community should be considered equivalent to an area within a 50-mile radius of the member institution. (CAA Interp 06/03/92). a Legal Resident. A prospective student-athlete who relocates to within a 50-mile radius of the institution on a temporary basis (e.g., to participate on a club team or attend an institution while maintaining a permanent residence outside of the 50-mile radius) is not a legal resident of the area regardless of whether the prospect meets legal standards of state or local residency for governmental purposes. Exception: The 50-mile radius restriction shall not apply to a prospective student-athlete who resides outside a 50-mile radius of the institution, provided the institution documents that the local sports club is the closest opportunity for the prospective student-athlete to participate in the sport. (CAA Bylaw ) 4. CAA Bylaw Institutional Sponsorship. either an institution s athletics department nor an institution s athletics booster club may sponsor a local sports club that includes prospective student-athletes. It is permissible for a department of the institution that operates independent of the athletics department (e.g. physical education department, recreation department) to sponsor a local sports club that includes prospective studentathletes, provided no athletics department staff member is involved with the club team. 2

3 Local Sports Clubs and CAA Compliance Bylaw Coach Organizing Own Club. If an institution s coach wishes to organize his or her own local sports club pursuant to , such a club must be an established, ongoing club that is engaged in competitive activities and is not formed only to provide instruction to prospects. The coaching staff member who is organizing his or her own local sports club may use his or her own funds, independent of the institution, to establish and/or operate the club. (CAA Interp 09/26/96) 6. Mixing Club Duties with Institutional Duties. An institution may not pay a coach s expenses to attend a contest in which the coach s local sports club is participating if the coach also will be performing recruiting duties related to his position at the institution. (CAA Interp 08/11/89) 7. Staff Members Involved with Local Sports Clubs. Athletics department staff members who are not included in the institution s coach limitations (e.g., director of athletics, academic advisor, director of volleyball operations) may be involved with a local sports club located in the institution s home community that includes prospects participating in any sport regardless of whether those prospects live within a 50-mile radius of the institution. The subcommittee noted that it is not permissible for these non-coaching staff members to engage in any recruiting activities on behalf of the institution while participating in any activities with a local sports club team. (CAA Interp 05/17/00) 8. Private Instruction. Any institution s coaching staff member who is not employed by a local sports club may not provide individualized instruction to prospects (e.g., private lessons). If the coaching staff member is employed by a local sports club (e.g., tennis club, swim club), the coach may provide individual instruction to prospects or serve as a coach for the club s team that involves prospects, provided the club is an established, ongoing club, and all prospects participating in said activities are legal residents of the area (within a 50-mile radius of the institution). (CAA Interp 09/16/93) Exception: The 50-mile radius restriction shall not apply to a prospective student-athlete who resides outside a 50-mile radius of the institution, provided the institution documents that the local sports club is the closest opportunity for the prospective student-athlete to participate in the sport. (CAA Bylaw ) 9. Employment of Student-Athlete. An institution s coaching staff member who owns or operates a local sports club or organization may employ a student-athlete who is a member of his or her own team as a coach/counselor for the club or organization. The student-athlete may be paid only for hours actually worked at the going rate for similar employment in that locale. o benefits may be provided to student-athletes that are not provided to other club staff (e.g., transportation, meals, etc.). 10. CAA Bylaw Fee-for-Lesson Instruction. In Division I, CAA rules permit student-athletes to receive compensation for teaching or coaching sports skills or techniques in his or her sport on a fee-for-lesson basis, provided: a. Institutional facilities are not used; b. Playing lessons shall not be permitted; c. The institution obtains and keeps on file documentation of the recipient of the lessons(s) and the fee for the lesson(s) provided during any time of the year; d. The compensation is paid by the lesson recipient (or the recipient s family) and not another individual or entity; e. Instruction to each individual is comparable to the instruction that would be provided during a private lesson when the instruction involves more than one individual at a time; and f. The student-athlete does not use his or her name, picture or appearance to promote or advertise the availability of fee-for-lesson sessions. g. In addition, the student-athlete may not represent Kansas Athletics with the intention of recruiting or soliciting the enrollment of a prospect to the institution. 11. Sports Club or Outside Organization Providing Membership Dues. The membership services staff confirmed that an individual may receive expenses from a sports club or outside organization to cover membership dues to 3

4 Local Sports Clubs and CAA Compliance Bylaw a local sports club as long as the dues are related to actual and necessary expenses for participation on the team as specified in Bylaw (CAA Interp 12/18/02) 12. Use of an Institution s Facility. A local sports club may use a member institution s facility, provided the local sports club is charged the same rental rate other outside groups would be charged to use the facility. (CAA Interp 09/23/92) 13. Use of Institution s Accounting Services. An institution s department of athletics may provide an outside club team (whose coach is also the coach of a local club team) with accounting and financial services, only if the department of athletics offers these services to other outside agencies (e.g., outside club teams coached by the member institution s athletics department staff members) and the club pays for such services at the going rate. (CAA Interp 09/22/89) 14. Using an Institution s Weight Room. Prospective student-athletes who are members of a local sports club may use the institutional weight room facility provided the club rents such facilities at the normal rate and such facility usage is related to legitimate club activities (e.g., conditioning activities). (CAA Interp 06/15/88) 15. Evaluation Limitations. If an institution s coaching staff member is involved in a local sports club during the academic year, the institution does not use one of its permissible evaluations for any prospect participating in any competition against the local team the individual coaches. Any other contest observed by the coaching staff member involving prospects (e.g., scouting future opponents for the club team) must count as an evaluation for each prospect participating in the contest. (CAA Interp 02/13/92) a. CAA Bylaw Exception: Evaluation Days Women s Volleyball: In women s volleyball, each institution is limited to 80 evaluation days per Bylaw A coach s employment activities in instructional camps/clinics do not count toward the evaluation days limitation. A coach s involvement outside the contact/evaluation period with a local sports club per Bylaw shall count toward the limit. b. Women s Volleyball Additional Restrictions. During a dead or quiet period, institutional coaching staff members may not coach a local sports club team at an off-campus competition where prospective student-athletes are present. It is permissible for an institution s coach to coach his or her own local sports club team in practice activities. Basketball Specific Guidelines 1. CAA Bylaw In men s basketball, for purposes of the tryout rule, a prospective student-athlete includes any individual who has started classes for the seventh grade and is not enrolled in the member institution at the time of the practice or test therein described. 2. on-coaching Staff Member in Local Basketball Club. An athletics staff member who is not included in the institution s coaching limitations in the sport of basketball may participate in coaching activities for a local basketball sports club, provided the conditions set forth in CAA Bylaw are satisfied. (CAA Interp 01/12/93) 3. CAA Bylaw onscholastic-based Basketball. In basketball, a member of an institution s coaching staff or an institutional staff member with basketball specific duties (e.g., director of basketball operations, manager, administrative personnel) may only participate in coaching activities involving nonscholastic-based basketball teams that include the staff member s child or children and are of the opposite gender than the team the staff member is associated with at the institution. Coaching staff or institutional staff members with basketballspecific duties may not participate on teams that include individuals with eligibility remaining or that include individuals of prospective student-athlete age or younger, regardless of the gender of the participants. 4

5 Local Sports Clubs and CAA Compliance Bylaw Local Sports Club Packet 1. The information provided in this packet is specific to all sports. All Kansas Athletics staff members that are involved with local sports clubs are required to document such involvement with the Kansas Athletics Compliance Office on an annual basis. If any changes occur throughout the year, it is the staff members responsibility to notify the Compliance Office of these changes. 2. In accordance with CAA guidelines, it is only permissible for a Kansas Athletics coach to be involved with a prospect-aged individual on a regular basis if the involvement is through an organized local sports club. An organized local sports club is defined by the following qualifications/specifications: - It must be an established club that is operated independent of Kansas Athletics - It must have a name - It must be incorporated and operated according to appropriate business guidelines - It must have rules - It must have insurance or require such of its participants - It must participate in competition against outside teams (it cannot be used only to practice with the prospective student-athletes) Please note that any activity with prospects throughout the year may only be conducted in accordance with the guidelines set forth in CAA Bylaw Tryouts or CAA Bylaw Camps and Clinics. All other activity that occurs between a Kansas Athletics staff member and a prospective student-athlete outside of the guidelines defined could be deemed a violation of CAA rules and regulations. 3. This information provided in this packet is not intended as a substitute for the CAA Manual, binding interpretations of the CAA legislation, Kansas Athletics Policy and Procedure, or professional legal advice. Instructions: 1. Read Staff Involvement In Local Sports Clubs. 2. Complete the Information Form. 3. Attach all required documentation to completed Information Form and submit to the Kansas Athletics Compliance Office. Reminders For Other Outside Amateur Competition 1. Per CAA rules, it is not permissible of a coach to work with a Local Sports Club that has a current Student- Athlete as a member during the academic year. 2. A coach is allowed to work with a Student-Athlete outside of the academic year when that Student-Athlete is participating in Olympic and national team development programs provided: a. The national governing body (GB) conducts and administers the developmental program; b. The GB selects coaches involved in the development program; and c. The GB or the selected coaches select the involved participants. 5

6 Local Sports Clubs and CAA Compliance Bylaw Academic ear Prior to becoming involved with a Local Sports Club, all Kansas Athletics staff members are required to document their association with a Local Sports Club on an annual basis. Please provide the following information and submit to the Athletics Compliance Office. IFORMATIO FORM ame of Local Sports Club: ame of Director for Local Sports Club: Address/City/State of Local Sports Club: Facility of Local Sports Club Activities: Schedule of Operations of Local Sports Club: Amount of Membership Dues: The following documentation must be included with this Information Form for review by the Compliance Office: Employees of Local Sports Club (See Attachment 1) Membership List of Local Sports Club (See Attachment 2) Outside Competition Schedule for Current Season Facilities Agreement (Only if using a Kansas Athletics facility) Incorporation Status (Only if staff member owns/directs the Local Sports Club) Proof of Insurance (Only if staff member owns/directs the Local Sports Club) Copy of Club Policies/Membership Criteria Attach Policy for Discounts and Waiver of Membership Dues (if any) All Promotional Materials (If none, please include a statement indicating such): I acknowledge my understanding of the rules and regulations regarding my involvement with this Local Sports Club. Failure to abide by such rules and regulations could result in a violation of CAA legislation. I have submitted complete and accurate information. In addition, I will notify the Kansas Athletics Compliance Office of any changes that may occur with this Local Sports Club. I will not participate in any activity with the Local Sports Club until I receive final approval from the Kansas Athletics Compliance Office. I understand my opportunity to operate a Local Sports Club is a privilege, which may be revoked at any time by the Director of Athletics for the University of Kansas. I agree to allow all components of this Local Sports Club and the corresponding information to undergo an audit conducted by the Kansas Athletics Compliance Office. I agree to document with the Compliance Office any outside income earned as a result of my involvement with a Local Sports Club.
