1 STATUS OF RACT PROGRAM Background: Section 182 of the Federal Clean Air Act requires the Department of Environmental Protection (Department) to develop and implement a Reasonably Available Control Technology (RACT) program for major stationary sources of volatile organic compounds (VOCs) and oxides of nitrogen (NOx) The Department s RACT regulation, effective upon publication in the Pennsylvania Bulletin (24 Pa. B. 467) on January 15, 1994, is codified at 25 Pa. Code Sections Facilities subject to the RACT regulation were required to develop and submit RACT proposals to the Department and the U. S. Environmental Protection Agency (EPA) by July 15, Affected NOxemitting sources had the option of complying with presumptive RACT requirements or consider sourcespecific factors and establish case-by-case RACT requirements. The Department subsequently approved the RACT proposals and NOx RACT emission limitations were established in plan approvals or operating permits. The RACT permits and plan approvals involving case-by-case RACT determinations were submitted to EPA as a revision to the State Implementation Plan (SIP) as required under 25 Pa. Code Section (h). On March 23, 1998, EPA granted conditional limited approval to Pennsylvania s RACT program. In general, this approval, effective April 22, 1998, is based on the Department s commitment to submit all case-by-case RACT proposals as source specific revision to the SIP no later than twelve months from the effective date of EPA s approval. When this commitment is fulfilled, the conditional limited approval of the RACT will become a limited approval. Conversion of the limited approval to full approval will occur when EPA has approved all of the case-by-case RACT proposals as SIP revisions. Further information can be found in the Federal Register dated March 23, 1998 (Vol. 63, No. 55, Page ). As of March 4, 2003, the Department has submitted 614 case-by-case VOC/NOx RACT SIP revisions for EPA s approval. This includes SIPs relating to sources located in Philadelphia and Allegheny Counties. As defined in EPA s rulemaking on the Department s VOC and NOx RACT regulations, the emissions from any remaining subject facilities represent a de minimis level of emissions. Section 110(k)(2) of the 1990 Clean Air Act Amendments requires EPA to act on State Implementation Plan (SIP) revisions within a year of submittal.
