6 Introduction to the Film Office The West Virginia Film Office is a section under the West Virginia Department of Commerce, Division of Tourism, and is a member of the Association of Film Commissioners International ( a non-profit, educational association and the official professional organization for film commissions around the world that provide support services to the filming industry. SERVICES PROVIDED BY THE FILM OFFICE The WVFO provides clients with complimentary location scouting and photography, mapping, research, and logistical and technical support services; conducts in-person scouting and coordination of itineraries; assists in securing site access and location permits; acts as a liaison between the production team and an established statewide network of governmental agencies and economic development, tourism, and community leaders; acts as a liaison between the production team and private residential and business property owners; acts as a liaison between the production team and media agencies; and provides general support to the production team to ensure a wrinkle-free shoot. PRODUCTION SERVICES DIRECTORY The Production Services Directory (PSD) is published annually by the WVFO and is available in print, on CD, and on the web at The PSD is a comprehensive resource containing filming guidelines and other information for production teams in need of West Virginia workforce, production and technical support services, accommodations, recreation, and much more. Getting Listed. Only West Virginia residents and businesses may be listed in the PSD. Film technicians, production companies, and other miscellaneous individuals and business must provide a minimum of one professional production credit in order to be listed. (NOTE: This is not required in all categories; contact the WVFO for more details.) Listing Forms and detailed Instructions are available at The WVFO maintains the right to edit all listings for layout purposes and maintains the right to exclude any listing from publication if the listing does not meet the criteria set forth in the Instructions. 5

7 Deadline for Getting Listed. Deadlines vary to submit new or modified listing forms. The WVFO provides notice of deadlines via media, Blast (see below to sign up for WVFO newsletter), and on its website. PSD Content Disclaimer. 8 Filming in West Virginia INCENTIVES Direct Use Exemptions. By applying for a Direct Pay Permit with the West Virginia Tax Department, purchases and rentals in West Virginia of tangible personal property directly used in an Entertainment Production Project (see definition below) and purchases in West Virginia of services directly used in an Entertainment Production Project are exempt from the six percent (6%) Consumers Sales and Service Tax. (Note, however, that food, beverages alcoholic and non-alcoholic and motor fuel are taxable.) Registration with the Tax Department is required, and with the exception of Sole Proprietors, all vendors must also register with the WV Secretary of State s Office (for details, see Doing Business in West Virginia below). [The phrase Entertainment Production Project means the physical creation and manufacture of motion pictures, television programs, commercials, music videos, and other similar types of Entertainment Properties.] Lodging Exemptions. Exemption from the Consumers Sales and Service Tax (6%) and exemption from the Local Hotel/Motel Tax (varies per region) on lodging stays in excess of thirty (30) consecutive days per person at the same facility. This is an automatic exemption; registration with the state is not required. River On Demand TM. As a complimentary service made possible by the drawdown of Summersville Lake by the U.S. Army Corps of Engineers, Huntington District, the West Virginia Film Office is able to offer an open filming window on the Gauley River between November 1 and November 30 for motion picture and television productions that require special whitewater releases. Flood control of the region, and other safety issues, will always take precedence, and advance notice is always required. On occasion, special releases may occur outside this window, but many conditions will apply. Most state-owned property is fee free, but fees may occur in certain circumstances, including cost recovery (see Permits section below). All requests for use of state property should be first submitted to the West Virginia Film Office to ensure navigation of the appropriate channels of communication among state agencies. Miscellaneous Enhancements. Depending on the scope of an Entertainment Production Project, the West Virginia Film Office may assist with negotiations of soft incentives (e.g., discounted location fees, office space rental, lodging, vehicle rentals, etc.). The West Virginia Film Office exploits an established statewide network of governmental agencies and economic development, tourism, and community leaders to secure attractive rates on many services. PERMITS The West Virginia Film Office does not require permits, but depending on the selected filming location, various state and federal agencies may require permits/agreements and/or advance notice, especially if filming involves special needs (such as, road closures, use of pyrotechnics, etc.). In all situations, the West Virginia Film Office is the best first resource to act as a liaison among appropriate agencies. Special Effects and Explosives. All Entertainment Production Projects are reviewed on a case-by-case basis. If the production is closed and does not involve the public, no permit is required. For proximate audience and class D fireworks, one or more permits may be necessary. A license for the pyrotechnic operator may also be required. Permits are day/event specific. Requirements for filming vary greatly on city- and county-owned properties. Contact the West Virginia Film Office to assist in communicating with city and county leaders and agencies. State Property Capitol Complex Grounds. There is no location fee to film on Capitol Complex Grounds (Charleston) during normal business hours (M-F, 8am-5pm). Each Entertainment Production Project must complete the agreement Request to Use Capitol Grounds and submit it for approval to the General Services Division. A valid certificate of insurance must accompany the agreement. Cost recovery may be charged for services and equipment provided by GSD and for filming outside normal business hours. Contact the West Virginia Film Office for a copy of the agreement or call GSD at State Property Transportation Facilities. All Entertainment Production Projects are reviewed on a case-by-case basis and reasonable advance notice is required for use of state-owned transportation facilities (roadways, railways, waterways, public transit systems). A written agreement may be required based upon the scope of the filming activity and a copy of a valid certificate of insurance is required. Cost recovery may be charged for services and equipment provided by the WV Department of Transportation, and a fee may apply if special needs are requested (such as, road closure, intermittent control, etc.). Contact the West Virginia Film Office to ensure navigation through the appropriate channels of communication. State Property Parks & Forests. To film in a state park or forest, an Entertainment Production Project must sign a one-time agreement and commercial enterprise agreement and provide a copy of a valid certificate of insurance. The commercial enterprise 7

9 agreement may include a fee based on the extent of facilities used, disruption to park guests, staff time, etc.; any such fee will be determined on a case-by-case basis. To film in a wildlife management area, an Entertainment Production Project must sign a one-time agreement and commercial enterprise agreement and provide a copy of a valid certificate of insurance. The commercial enterprise agreement may include a fee based on the extent of facilities used, disruption to park guests, staff time, etc.; any such fee will be determined on a case-by-case basis. All commercial filming activities require a permit on federal lands nationwide. [ Commercial filming is defined as digital or film recording of a visual image or sound recording by a person, business, or other entity for a market audience, such as for a documentary, television or feature film, advertisement, or similar project. It does not include news coverage or visitor use.] Advance notice (30 days) is required, and cost recovery charges for all filming and still photography activities include the administrative/application cost recovery charge and any costs incurred by NPS for monitoring the permit (amount will vary based on size and complexity of permit). Proof of liability insurance is required, and in certain circumstances, you may also be asked to post a bond. Still photography requires a permit only when (1) the activity occurs where/when the general public is not allowed, (2) models, sets, props, etc. are needed (and not already part of the location s natural or cultural resources or administrative facilities), (3) the Park would incur additional administrative costs to monitor the activity; and/or (4) the park needs to provide management and oversight to (a) avoid impairment or incompatible use of the resources and values of the park, or (b) limit resource damage, or (c) minimize health or safety risks to the visiting public. News coverage does not require a permit, of either filming or still photography, but is subject to time, place, and manner restrictions, if warranted, to maintain order and ensure the safety of the public and the media, and to protect natural and cultural resources. 10 Federal Property National Forests. Commercial filming activities on National Forest System lands require a permit, and they are subject to land use fees and may be subject to cost recovery charges. Still photographers require a permit when (a) the activity occurs where/when the general public is not allowed, (b) models, sets, props, etc. are needed (and not already part of the location s natural or cultural resources or administrative facilities), and/or (c) the USFS would incur additional administrative costs to monitor the activity. Advance notice is required to obtain a permit; a minimum of 60 days is recommended. Cost recovery charges for filming and still photography activities may include a processing fee and costs incurred by USFS for monitoring the permit (amount will vary based on size and complexity of permit). Proof of liability insurance is required, and in certain circumstances, you may also be asked to post a bond. 11 HIGHWAY COURTESY PATROL If you require roadside assistance between the hours of 3:00 pm and 7:00 am, 7 days a week, 365 days a year, you may contact the West Virginia Courtesy Patrol Communications Center toll-free at Courtesy Patrol drivers assist stranded motorists; help reduce the chance of secondary accidents; provide gasoline or directions; and, in general, enhance safety on the state s roadways. Drivers patrol 25 assigned zones on all WV interstates and highway corridors in well-marked white F-150 trucks. The West Virginia Courtesy Patrol is operated by the Citizens Conservation Corps of West Virginia via contract with the Division of Highways. Further details can be found at INTERSTATE & OTHER SPEED LIMITS 70 mph (unless otherwise posted) on interstate highways; speed limits on other major highways and smaller roadways vary; be alert to posted notices. SEATBELTS Seatbelts are required by state law. MOTORCYCLISTS Motorcyclists are required to wear helmets and safety, shatter-resistant eye protection or face shield; headlights must be on at all times during operation. The state s Northern and Eastern Panhandles are in close proximity to the production hubs of Baltimore, Pittsburgh, and Washington DC. West Virginia has 35 public airports and dozens of private airports and landing strips. Of the state s 35 public airports, 8 offer commercial airline service, with the remaining offering general aviation airfields, among additional support services. 11

13 Climate West Virginia enjoys four distinct seasons. Depending on where you visit, the seasons can differ dramatically. In the low-lying areas and valleys, including the western regions of the state and the Eastern Panhandle, winters are quite mild and summers warm. In the central, more mountainous areas of the state (particularly, the Potomac Highlands), winters are much colder, with greater amounts of snow, and summers are pleasant and mild. The statewide average high temperature in July is in the high 70s, while in January, temps in the mid-30s are average. Precipitation across the state averages 40 to 60 inches per year, and snowfall averages 20 to 25 inches per year in most of the state, except for the Potomac Highlands region, which receives significantly greater amounts.
