1 Manager s Report on Submissions Received in respect of the Amendments to the Draft Navan Local Area Plan Under Section 20 (3) (k) of the Planning & Development Act May 2011
2 Section 1 Introduction & Consultation Process 1.0 Introduction The purpose of this report is to detail the outcome of the consultation process on the Amendments to Navan Local Area Plan ; to set out the Manager s response to the issues raised in the submissions made on the draft and the recommendations of the Manager on any changes to the amendments to the Draft Plan as considered appropriate. The report is now formally submitted to Navan Town Council and Meath County Council for consideration at the council meetings on the 7 th and 13 th June 2011 respectively. The report relates to lands in Johnstown and Athlumney which were designated as Local Area Plan 1 in the Navan Development Plan Pre Draft Consultation Process A period of pre-draft consultation was undertaken for this local area plan. The nonstatutory pre-draft consultation phase comprised of the preparation and publication of a consultation paper for the LAP area. The consultation paper gave a broad overview of the main issues that arise in the area encompassed in the LAP and to indicate options and possible solutions to these issues. The pre-draft consultation phase commenced on the 22 nd March 2010 and concluded on the 19 th April A total of 20 written submissions were received during the display period of the consultation period; 17 of these related to the preparation of the draft LAP and 3 related to environmental screening documents. 1.2 Draft Consultation Process A draft Local Area Plan was subsequently prepared for subject lands. The draft Local Area Plan was placed on public display from 6 th December 2010 until 1 st February 2011 and during this time submissions were invited from the public. Public advertisements were placed advising of the publication of the draft plan and a number of statutory and community organisations were informed about the draft plan. The draft Plan was available for inspection in a number of locations: Planning & Community Department, Abbey Road, Navan. Meath County Library/Navan Branch Library, Railway Street, Navan. Navan Town Council Watergate St, Navan. Johnstown Shopping Centre, Bailis. A total of 12 submissions were received during this public consultation stage. This report was formally submitted to the Councils for consideration at the meeting of Navan Town Council on 1 st March 2011 and at the meeting of Meath County Council on 7 th March 2011.
3 Following the distribution of the Manager s Report, the Elected Members considered the report to decide whether to make the Local Area Plan with or without modifications or not to make the plan. At a Council meeting of MCC on the 4 th April and NTC on 12 th April 2009, it was resolved to place proposed amendments to the draft Local Area Plan on public display. The amendments to the Draft Local Area Plan were placed on public display for a 4 week period (20 th April to the 20 th of May 2011). A total of 3 written submissions were received. 1.3 Next Steps Not later than 8 weeks from publication of the amendments the manager shall prepare a report on the submissions received and submit same to the Elected Members for their consideration. This report is being formally submitted to Navan Town Council for consideration on the 7 th June 2011 and Meath County Council for consideration at the County Council meeting of Meath County Council on the 13 th of June Following consideration of the manager s report, the local area plan shall be made or amended as appropriate by the planning authority by resolution no later than a period of 6 weeks after the report has been furnished to all the members, with all, some or none of the material alterations as published. The formal making of the Local Area Plan is done by resolution of the council. During the entire plan-making process, the Council is restricted to considering the proper planning and sustainable development of the area. They must also take into account statutory obligations and any relevant Government policies and objectives in force. Department of Communications, Energy and Natural Resources Section 2.2 Detailed Consideration of Submissions received Upon receipt of each submission the submission was given a number and it is this numbering sequence which is used in the report. The submissions are available for inspection in the Planning Department, Abbey Mall, Abbey Road, Navan. Submission Number Name and Address 1 Department of Education and Skills Summary The submission makes reference to the decision of Meath County Council to grant planning permission for a new school in the Johnstown area (File Ref. NT/100032). The Dept. advises that the granting of said planning permission should in no way imply a commitment on the part of the Dept. of Education and Skills to acquire this particular site for St. Stephen s National School. It is stated that this site would not be of sufficient area
4 to provide a campus to meet the projected educational needs in the Johnstown area. It outlines however, that it may be required for additional educational purposes. The submission also notes that Meath Local Authorities has initiated a CPO on the former St. Martha s College site with the intention of providing a permanent campus for educational purposes including inter alia St. Stephen s National School. Manager s Response Meath County Council and Navan Town Council notes the contents of the submission of the Dept. of Education and Skills. The LAP 1 lands have a specific role to play in the provision of educational facilities for Navan, with the lands identified as a location for three new schools; a primary school, special school and a post primary school. It is noted that the members of Navan Town Council demonstrated a positive and proactive approach to the provision of educational facilities by supporting the granting of File Reg. Ref. NT by way of material contravention procedures. However, it is fully acknowledged that lands subject of planning permission Plan. Reg. Ref. NT which extend to 2.79ha in area, are not sufficient to cater for the educational needs of this area. Therefore, all lands zoned for G1 use i.e. to provide for necessary community, recreational and educational facilities in the Navan Development Plan are retained in the LAP. Furthermore, as outlined in the submission, Navan Town Council has initiated CPO procedures and submitted an order to An Bord Pleanála on the 16 th March for the compulsory acquisition of land i.e.- Navan Town Council Compulsory Purchase (No.1) (Navan Educational Campus). Manager s Recommendation No change required. Submission Number 2 NRA Name and Address Summary The submission advises that the Authority has no comments to make in regard to the proposed amendments.
