NEW BUSINESS At its regular meeting of June 24, 2014, Council passed a resolution to accept the application for the DVP that would vary the Village s Subdivision Control Bylaw #168, waiving the requirment for the construction of off-site services in relation to a proposed subdivision for 235 Aylmer Road. Notices were sent out to property owners in the area of the subject property as required by Section 922 of the Local Government Act. Council is now being asked to consider passing a resolution approving the Development Variance Permit. Resolution: That Council authorize the issuance of Development Variance Permit No. 70 pertaining to a proposed subdivision 235 Aylmer Road, Chase, BC 8.1 Appointment of Election Officers Pursuant to Section 41 of the Local Government Act, the Council must appoint a chief election officer and a deputy chief election officer for the purposes of conducting an election. Resolution: That Deputy Corporate Officer Tammi Pretty be appointed as the Chief Election Officer and Chief Administrative Officer Joni Heinrich be appointed as Deputy Chief Election Officer for the 2014 General Local Government Election. 8.2 Election Bylaw Pages In order for a bylaw to apply in relation to a local government election, the bylaw must be adopted at least 8 weeks before the first day of the nomination period of the general local election. In the case of the 2014 election, the first day of nomination period is September 30, The bylaw therefore must be adopted by August 5, 2014 at the latest to apply to the 2014 election. Resolution: That the amendments for the Village of Chase Bylaw No Election Bylaw be approved as presented.

CALL TO ORDER Mayor Anderson called the meeting to order at 4:02 p.m. To help support the Canada Day fireworks a raffle was held in the community. Mayor Anderson drew the winning ticket which entitled Dan from Econo Span to a helicopter ride on Canada Day from Lakehead Helicopters. 2. 5 Page 2 of 6 Regular Council Minutes June 24, REPORTS a) Mayor and Council Reports Mayor Anderson Mayor Anderson has attended several Shuswap Watershed Council (formerly SLIP) meetings. Councillor Berrigan Council Berrigan attended the Citizens on Patrol BBQ Councillor Crowe On June 7 th Councillor Crowe attended a meeting of the Museum Society. On June 21 st Councillor Crowe worked with the Fire Department volunteers washing cars as part of a fundraiser for four year old Megan Leverrier who is battling cancer. Councillor Lepsoe June 11 Canada Day meeting June 12 Shuswap tourism meeting at Sicamous on a houseboat. CAO and Chamber Manager also attended June 18 Canada Day meeting 6. DELEGATIONS Jerilynn Maki, Canadian Cancer Society, delivered a presentation on Tobacco Reduction through Municipal Partnership with Interior Health. She apologized for the absence of the other members of the delegation. She highlighted the proposal of municipalities passing no-smoking bylaws pertaining to public places such as playground areas, to reduce triggers to help those who are trying to quit smoking and to promote health within the community. 7. Amendments to Resolution #2014/06/24_004: Add to the definition under 2.5 noting the minimal amount of training under members requirements (basic firefighting certificate); Under remuneration amend to ensure it is not a step pay system and is simply $14.00 per hour for the Basic Level Training Certificate; Add an explanation clarifying maintenance personnel are not an officer position; Under Item 2.4 strike the upper age requirement of 65 and amend to note they are required to meet certain basic fitness levels; The reporting structure will be amended for accuracy. CARRIED #2014/06/24_006 Moved by Councillor Crowe Seconded by Councillor Berrigan That a regular Council meeting be held Monday, November 10, 2014 in order to conduct the business of the previously cancelled November 11, 2014 regular Council meeting. 7 Page 4 of 6 Regular Council Minutes June 24, Presentation of Village of Chase plaque Honouring Outstanding Community Service Councillor Lepsoe noted the Village has a plaque which is intended to honour outstanding community service. Last year s recipient was Chase HEAT and this year he suggested it be presented to Chase Soccer who are self-run and selffunded. Moved by Councillor Lepsoe Seconded by Councillor Crowe That the plaque honouring outstanding community service be presented to the Chase Soccer organization. CARRIED #2014/06/24_008 Councillor Lepsoe will inform the organizers the plaque will be presented at the Canada Day celebrations. 8.4 Community Contest for New Flag design Feedback is requested from Council on the feasibility of running a contest to design a new flag which will represent the Village. If approved, the intention would be to have a flag raising ceremony at the Cornstock festival. Moved by Councillor Scott Seconded by Councillor Berrigan That a community contest for a new flag design be referred back to Administration to do further investigation and report back at a later meeting. CARRIED #2014/06/24_ Community Works Fund (Gas Tax Fund Program) Moved by Councillor Berrigan Seconded by Councillor Crowe That the Village of Chase enter into the Community Works Funds Agreement under the Administrative Agreement on the Federal Gas Tax Fund in British Columbia. CARRIED #2014/06/24_ Whitfield Landing 235 Aylmer Road Application for Development Variance The owner of the property at 235 Aylmer Road has applied to subdivide the property into 5 parcels. The Village s Subdivision Control Bylaw #168 requires that off-site services be either constructed, or that funds be guaranteed for the services to be constructed. In the current case, the owner wishes to subdivide the property for future development without constructing off-site services (road, water and sewer upgrades) at this time. The owner is requesting a variance of the servicing requirements in exchange for the registration of covenants on title of all newly created parcels that will prohibit any development without having off-site services constructed or financially guaranteed. Notice under Section 922 of the Local Government Act must be given to property owners/occupiers within 50m of the of the land that is subject to the permit prior to Council passing a resolution approving any such permit. A public hearing is not required for this process.

9 Page 6 of 6 Regular Council Minutes June 24, 2014 Moved by Councillor Crowe Seconded by Councillor Berrigan Council accepts the Development Variance Permit application that requests that the requirements under the Village s Subdivision Control Bylaw #168 for off-site services in relation to a proposed subdivision for 235 Aylmer Road be waived with the provision of covenants on title of all all newly created parcels prohibiting any development until off-site services are constructed or funding for such construction is guaranteed; AND That notice under Section 922 of the Local Government Act be given prior to the approval of the permit. 10 VILLAGE OF CHASE Bylaw No A Bylaw to provide for the Establishment and Regulation of a Volunteer Fire Department for the Village of Chase The Council of the Village of Chase in open meeting ENACTS as follows: 1. INTRODUCTION 1.1 The Municipal Fire Department will be known as Village of Chase Fire Department (the Department). 1.2 This bylaw may be cited as Village of Chase Volunteer Fire Department Establishment and Regulation Bylaw No. 795, DEFINITIONS 2.1 Fire Chief means the person appointed by Council as the head of the Fire Department or his/her designate. 2.2 Fire Protection Area means the lands within the boundaries of the Village of Chase. 2.3 Incident means a fire or any other class of circumstance that may cause harm to persons or property. 2.4 Member means any volunteer person or officer that has successfully completed the probationary period and has been appointed by the Fire Chief as a member of the fire department. All members (except those in any junior firefighter program instituted from time to time) must be at least 18 years of age. 2.5 Minimum Level of Training means the Basic Level Fire Fighting Certificate as set out by NFPA 1001 Standard, and includes applicable and written examinations and practice evaluations, such satisfactory completion providing Department members with the basic training to serve the community. Each member will be provided one year to complete all necessary training to obtain a certificate of completion. Every effort will be made to ensure that all firefighters will be trained to the minimum level of training within 8 months of joining the fire department.

11 2 Bylaw No Officer means the Fire Chief, Deputy Fire Chief, Captain, Lieutenant, Safety Officer and Training Officer. All officers must complete and pass the first level of the International Fire Service Training Association (IFSTAS) approved Officer Training course to either have an opportunity to become an officer or to continue serving in an officer role. Existing officers will be given eight months in which to complete the training and if they are not satisfactory, will be removed of their officer status. 2.7 Operational Guidelines means rules, regulations and policies necessary for the proper organization and administration of the Department. 2.8 Probationary Period means the period of time which allows the Fire Chief to determine whether the new recruit has the ability to learn the skills necessary to be a competent fire fighter, as well as professional and mature attitude to work with others in stressful situations. Initially this probationary period will be three months, but may be extended or shortened by the Fire Chief depending on the ability of the new recruit to demonstrate their suitability. 2.9 Public Service Calls means the provision of assistance in non-emergency situations to persons within the Fire Protection Area such calls may be responded to at the discretion of the Fire Chief or his/her designate Recruit means a volunteer person who is participating in training and practice activities and is acting within the probationary period Road Rescue Response Area means the area shown on the Map attached to this bylaw as Schedule A and is described as: All areas along Highway #1 (Neskonlith, McGilvary Lakes, Pritchard & Pinantan area) to the Monte Creek Interchange Southwest on Highway 97 from the Monte Creek Interchange to Westwold South on the Chase Creek/Falkland Road approximately half way to Falkland at Moser Road North (approximately 50 km) past Squam Bay on Adams Lake Road (to Honeymoon Bay) and Bear/Laokin Creek Road area East on Highway #1 to Balmoral Store including Sorrento, Shuswap Lake Estates, Notch Hill, Turtle Valley North Shuswap up to and including Seymour Arm

12 3 Bylaw No ADMINISTRATION Establishment/Responsibilities 3.1 The Chase Volunteer Fire Department is hereby established and has the responsibility for fire suppression and prevention within the Fire Protection Area, and the responsibility for fire suppression and prevention in any other areas outside the Fire Protection Area into which formal agreements are entered between the Village of Chase and appropriate entities. 3.2 The Chase Volunteer Fire Department will also, from time to time, when adequate numbers of members are available for fire protection within the Fire Protection Area and any other areas for which fire suppression and prevention has been formally agreed, provide road rescue services within the Road Rescue Response Area. 3.3 The Chase Volunteer Fire Department will also, from time to time when adequate numbers of members are available for fire protection within the Fire Protection Area and any other areas for which fire suppression and prevention has been formally agreed, perform public service calls as well as emergency lift assists for the BC Ambulance Service upon request. 3.4 Rules, regulations and policies in the form of Operational Guidelines necessary for the proper organization and administration of the Department will be developed, and may, from time to time, be amended by the Fire Chief in consultation with the Chief Administrative Officer to fit the needs of the Department. Fire Chief 3.5 Reporting to the Chief Administrative Officer, the Fire Chief has complete responsibility and authority over the Fire Department subject to provisions of this bylaw, operational guidelines in effect from time to time, policies and other applicable legislation. 3.6 The Fire Chief in the performance of his/her duties: a. Will oversee the provision of services for the protection of lives, property and the environment within the Fire Protection Area b. Will work with the members of the department to periodically review the policies, procedures, operational guidelines and other applicable documents c. May make rules and regulations for the proper and efficient administration and operation of the Department and the discipline of its members c. May enforce all Village Bylaws in relation to fire protection, fire suppression and other fire related matters as may be directed by the Fire Services Act d. May exercise all powers given them by the Fire Services Act

13 4 Bylaw No Members e. Is responsible for the enforcement of this Bylaw and the adherence to operational guidelines and other applicable policies, bylaws and legislation f. Shall report to the Fire Commissioner s Office as required by the Fire Services Act g. Shall work with the Chief Administrative Officer to submit budget requests for upcoming budget years. 3.7 Every effort will be made to ensure a minimum of seven (7) firefighters (including one officer) are available at all times to ensure adequate response to a fire within the fire protection area and any areas for which the Village has an agreement to provide fire protection. 3.8 The Department will endeavor to have a minimum of fifteen members at all times, and will regularly recruit members and engage in activities in the community that provide an opportunity for the Department to increase its profile with the objective of building positive relationships and building membership. 3.9 The Department will consist of various positions, such structure shown in Schedule B forming part of this bylaw. Positions will be filled based on numbers of members and operational needs, all positions may not always be filled at any one time The Fire Chief will appoint members to required positions following all applicable operational guidelines pertaining to a selection committee, and in accordance with requirements outlined in the position descriptions developed by the Fire Chief in consultation with the Chief Administrative Officer All members will be required to have a criminal record check performed and will be required to provide a driving abstract any costs associated with either of these checks will be paid for by the Village of Chase All members who are engaged in Fire suppression or other physically demanding duties such as road rescue response will be required to take and pass a medical examination once per year, the cost to be paid for by the Village of Chase All new recruits will be required to attend all weekly practice meetings and will be required to take training as is deemed necessary by the Training Officer and the Fire Chief. Any recruit not successfully completing the probationary period will be dismissed from the Department.

Members missing more than two consecutive meetings in any 6 meetings may be asked to resign from the Fire Department, unless approval is granted in writing by the Fire Chief All members available for responses to fire and rescue calls will not be permitted to attend on any fire or rescue scene or any practice if they are under the influence of alcohol or debilitating or intoxicating drugs. Remuneration 3.16 All members will be considered volunteer, and will be provided compensation for practices and call-outs, such amount of compensation to be determined by Council. Stipends for members who hold officer positions will be determined by Council and are shown in Schedule C attached to and forming part of this bylaw. Fire Suppression 3.17 The Department shall not respond to fire or emergency outside the boundaries of the Fire Protection Area except where: a. An agreement for mutual aid exists with another local government or other organization; b. On property with respect to which an agreement has been entered into with any person or corporation to provide fire protection services; c. When ordered to do so by a senior level of government; d. When dispatched for road rescue services within the road rescue callout area; e. Authorized to do so by the Mayor or Acting Mayor of the Village of Chase, such authorization will be given based on the nature of the emergency The Fire Chief or another officer in command at an incident is empowered to enter premises or property where the incident has occurred and to cause any members, apparatus or equipment of the Department to enter, as they deem necessary, in order to combat, control or deal with the incident The Fire Chief or another officer in command at an incident shall have control, direction and management of all Department apparatus, equipment, and manpower assigned to an incident and, where an officer in command is in charge, they shall continue to act until relieved by a senior officer.

15 6 Bylaw No The Fire Chief or another officer in command at an incident is empowered to enter premises or property where the incident has occurred and to cause any member, apparatus or equipment of the Department to enter, as they deem necessary, in order to combat, control or deal with the incident The Fire Chief or another officer in command at an incident, is empowered to enter, pass through or over buildings or property adjacent to an incident and to cause members of the Department and the apparatus and equipment of the Department to enter or pass through or over buildings or property, where they deem necessary to gain access to the incident or to protect any person or property No person shall impede, obstruct, abuse or in any way hinder the Fire Chief, or any officer in command, or any member of the Department in attendance at an incident under the direction of the Fire Chief or officer command Anyone who fails to comply with an order or direction of the Fire Chief or any officer in command, or any officer or member of the Department engaged at any incident, may be forcibly removed from the scene of any such incident by a Peace Officer or any member of the Department The officer in command is empowered to order the evacuation of any building or structure that is directly involved with fire or other risk to life. The Fire Chief or their designate is empowered to order the evacuation of a building, structure or area which in their opinion is endangered by fire or other risk to life. In such cases no person other than the Fire Chief, officer in command, or member of the Department, Peace Officer, or other person authorized by any of these individuals shall remain in or shall enter those buildings, structures or areas The Fire Chief or officer in command is hereby empowered to cause to be pulled down or demolished, any adjacent buildings or structures when they consider necessary to do so in order to prevent the spread of any fire The Fire Chief or officer in command at any incident is hereby empowered to commandeer privately owned equipment which they consider necessary to deal with such incident. 4. ROAD RESCUE 4.1 The Department will respond to a road rescue incident within the boundaries of the Road Rescue Response Area if there are a minimum of seven (7) available fire fighters within the Fire Protection Area who will not be attending the road rescue call, with a minimum of two (2) fire fighters are available attend the road rescue call.

16 7 Bylaw No The Department shall not respond to a road rescue outside the boundaries of the Road Rescue Response Area unless: a. An agreement for mutual aid exists with another local government or other organization b. Ordered to do so by a senior level of government c. Authorized to do so by the Mayor or Acting Mayor of the Village The Fire Chief or an officer in command at an incident shall have control, direction and management of all Department apparatus, equipment, and manpower assigned to an incident and, where an officer in command is in charge, they shall continue to act until relieved by a senior officer. 4.4 The Fire Chief or an officer in command at an incident is empowered to enter premises or property where the incident has occurred and to cause any member, apparatus or equipment of the Department to enter, as they deem necessary, in order to combat, control or deal with the incident. 4.5 No person shall impede, obstruct, abuse or in any way hinder the Fire Chief or an officer in command, or any member of the Department in attendance at an incident under the direction of the Fire Chief or officer in command. 4.6 Anyone who fails to comply with an order or direction of the Fire Chief or any officer in command, or any officer or member of the Department engaged at any incident, may be forcibly removed from the scene of any such incident by a Peace Officer or member of the RCMP. 5. PENALTIES AND ENFORCEMENT 5.1 No person shall falsely represent themselves as a member of the Department. 5.2 Any person who contravenes any of the provisions of this Bylaw, or who suffers or permits any act or thing to be done in contravention of any provision of this Bylaw, or who neglects to do or refrains from doing anything required to be done by any provision of this Bylaw, commits an offence against this Bylaw and is subject to: a. A fine in accordance with the most recent Municipal Ticket Information Bylaw if an information respecting the infraction is laid by means of a ticket; or b. Upon summary conviction, a minimum fine of not less than One Thousand Dollars ($ ) and a maximum fine of Ten Thousand Dollars ($10,000.00) and the cost of prosecution. 21 VILLAGE OF CHASE Bylaw No A Bylaw to Establish Specified Fees and Charges in relation to Municipal Services WHEREAS the Community Charter, Chapter 26, S.B.C. 2003, and amendments thereto, empowers the Council to impose fees and charges in respect of all or part of a service of the municipality; AND WHEREAS the Municipal Council of the Village of Chase deems it necessary to provide for the imposition of such fees and charges; NOW THEREFORE, the Municipal Council of the Village of Chase in open meeting assembled, ENACTS AS FOLLOWS: 1. TITLE 2. FEES This bylaw may be cited as Village of Chase Fees and Charges Bylaw No Various fees and charges for the Village of Chase are established as set out in the following schedules, attached hereto and forming part of this Bylaw: Schedule A Administration and Office Fees; Schedule B Water, Sewer, Garbage Utilities Billing Cycle and Penalties; Schedule C Water and Sewer Utility Service Calls; Schedule D Water Service Rates; Schedule E Sewer Service Rates; Schedule F Solid Waste Service Rates; Schedule G Business License Rates. 3. SEVERANCE If any portion of this bylaw is declared ultra vires by a Court of competent jurisdiction or found to be illegal or unenforceable, that part or section shall be considered to be separate and severable from the bylaw to the intent that the remainder of the bylaw shall continue in full force and effect and shall be enforceable to the fullest extent permitted by law. 24 Schedule B to Village of Chase Fees and Charges Bylaw No UTILITIES BILLING CYCLE AND PENALTIES (a) (b) (c) The utility billing will be accomplished in 3 billing periods identified as follows: January 1 to April 30 May 1 to August 31 September 1 to December 31. Payments are applied to the oldest balance first, then to current charges. All water, sewer and garbage charges left unpaid on the second business day after January 1 in each year shall be transferred to property taxes and shall bear interest beginning the second business day after January 1 until paid in full at the rate established by the Provincial Government for arrears and delinquent taxes.

Minimum annual solid waste utility charge: $ Annual cost for the collection and disposal of solid waste from each approved solid waste container: 1 x / week 2 x / week 240 L $ $ L $ $ Annual cost to lease each solid waste container from the Village of Chase: 240 L $ L $ Replacement cost of Village owned solid waste or recycling container: $ Solid waste container exchange rate, per request: $ Any person may be charged retroactively for solid waste collection service. 8. All solid waste utility charges and other fees or charges imposed under this bylaw may be collected in the same manner and with the same remedies as property taxes on the premises in respect of which they are imposed and, if unpaid on December 31 of the year in which they are imposed and due and payable, on the 1 st of January of the following year shall be deemed to be taxes in arrears. 9. Council may exempt a person from all or part of a solid waste utility charge issued hereunder if they are satisfied that: a) Having considered all of the surrounding circumstances, it would be in the best interests of the Village to exempt the person; or b) Having considered all of the surrounding circumstances, it would be just and fair to so exempt the person. 10. Non-receipt of a utility billing will not exempt the customer from paying for the services received. 11. All curb side collection service customers will be invoiced in accordance with the current Village of Chase Fees and Charges Bylaw.
