Therein you requested the first page of the three oldest classified documents at DIA. A search of DIA's system of records located three documents responsive to the subject of your request. DIA reviewed the three documents and determined that some portions must be withheld in accordance with 5 U.S.C 552 (Freedom of Information Act), Exemption (b) (1) - Executive Order 12958, as amended, Section 1.4 (c) and Exemption (b) (3) - 10 U.S.C 424. Exemption (b) (1) applies to material which is properly classified pursuant to an Executive Order in the interest of national defense or foreign policy. Exemption (b) (3) applies to information specifically exempted by a statute establishing particular criteria for withholding. All reasonably segregable portions of the documents are enclosed. You have the right to an administrative appeal of these decisions which must be filed within 60 days from the post mark date of this correspondence.
