5 GENERAL CONDITIONS 1. The terms, conditions, requirements, limitations and restrictions set forth in this permit, are "permit conditions" and are binding and enforceable pursuant to Sections , , , or through , Florida Statutes. The permittee is placed on notice that the Department will review this permit periodically and may initiate enforcement action for any violation of these conditions. 2. This permit is valid only for the specific processes and operations applied for and indicated in the approved drawings or exhibits. Any unauthorized deviation from the approved drawings, exhibits, specifications, or conditions of this permit may constitute grounds for revocation and enforcement action by the Department. 3. As provided in subsections (6) and (5), Florida Statutes, the issuance of this permit does not convey any vested rights or any exclusive privileges. Neither does it authorize any injury to public or private property or any invasion of personal rights, nor any infringement of federal, State, or local laws or regulations. This permit is not a waiver of or approval of any other Department permit that may be required for other aspects of the total project which are not addressed in this permit. 4. This permit conveys no title to land or water, does not constitute State recognition or acknowledgment of title, and does not constitute authority for the use of submerged lands unless herein provided and the necessary title or leasehold interests have been obtained from the State. Only the Trustees of the Internal Improvement Trust Fund may express State opinion as to title. 5. This permit does not relieve the permittee from liability for harm or injury to human health or welfare, animal, or plant life, or property caused by the construction or operation of this permitted source, or from penalties therefore; nor does it allow the permittee to cause pollution in contravention of Florida Statutes and Department rules, unless specifically authorized by an order from the Department. 6. The permittee shall properly operate and maintain the facility and systems of treatment and control (and related appurtenances) that are installed and used by the permittee to achieve compliance with the conditions of this permit, are required by Department rules. This provision includes the operation of backup or auxiliary facilities or similar systems when necessary to achieve compliance with the conditions of the permit and when required by Department rules. 7. The permittee, by accepting this permit, specifically agrees to allow authorized Department personnel, upon presentation of credentials or other documents as may be required by law and at reasonable times, access to the premises where the permitted activity is located or conducted to: a. Have access to and copy any records that must be kept under conditions of the permit; b. Inspect the facility, equipment, practices, or operations regulated or required under this permit; and c. Sample or monitor any substances or parameters at any location reasonably necessary to assure compliance with this permit or Department rules. Reasonable time may depend on the nature of the concern being investigated. Page 2 of 32.

6 GENERAL CONDITIONS: 8. If, for any reason, the permittee does not comply with or will be unable to comply with any condition or limitation specified in this permit, the permittee shall immediately provide the Department with the following information: a. A description of and cause of noncompliance; and b. The period of noncompliance, including dates and times; or, if not corrected, the anticipated time the noncompliance is expected to continue, and steps being taken to reduce, eliminate, and prevent recurrence of the noncompliance. The permittee shall be responsible for any and all damages which may result and may be subject to enforcement action by the Department for penalties or for revocation of this permit. 9. In accepting this permit, the permittee understands and agrees that all records, notes, monitoring data and other information relating to the construction or operation of this permitted source which are submitted to the Department may be used by the Department as evidence in any enforcement case involving the permitted source arising under the Florida Statutes or Department rules, except where such use is prescribed by Sections and , F.S. Such evidence shall only be used to the extent it is consistent with the Florida Rules of Civil Procedure and appropriate evidentiary rules. 10. The permittee agrees to comply with changes in Department rules and Florida Statues after a reasonable time for compliance; provided, however, the permittee does not waive any other rights granted by Florida Statutes or Department rules. A reasonable time for compliance with a new or amended surface water quality standard, other than those standards addressed in Rule , shall include a reasonable time to obtain or be denied a mixing zone for the new or amended standard. 11. This permit or a copy thereof shall be kept at the work site of the permitted activity. Page 3 of 32.

7 GENERAL CONDITIONS: 12. The permittee shall comply with the following: a. Upon request, the permittee shall furnish all records and plans required under Department rules. During enforcement actions, the retention period for all records will be extended automatically unless otherwise stipulated by the Department. b. The permittee shall hold at the facility or other location designated by this permit records of all monitoring information (including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation) required by the permit, copies of all reports required by this permit, and records of all data used to complete the application for this permit. These materials shall be retained at least three years from the date of the sample, measurement, report, or application unless otherwise specified by Department rule. c. Records of monitoring information shall include: 1) the date, exact place, and time of sampling or measurements; 2) the person responsible for performing the sampling or measurements; 3) the dates analyses were performed 4) the person responsible for performing the analyses; 5) the analytical techniques or methods used; 6) the results of such analyses. 13. When requested by the Department, the permittee shall within a reasonable time furnish any information required by law which is needed to determine compliance with the permit. If the permittee becomes aware the relevant facts were not submitted or were incorrect in the permit application or in any report to the Department, such facts or information shall be corrected promptly. 8 SPECIFIC CONDITIONS: PART A Solid Waste Facility General Requirements 1. Facility Designation. This landfill shall be classified as a Class I closed landfill and shall be monitored and maintained in accordance with all applicable requirements of the Florida Administrative Code. 2. Permit Application Documents. This permit is valid for long-term care, monitoring and maintenance of approximately 235 acres of the landfill site in accordance with all applicable requirements of Department rules, and the reports, plans and other information (3-ring binders, 2 volumes), submitted as follow: a. 11 SPECIFIC CONDITIONS: PART A Solid Waste Facility General Requirements 3. Permit Modifications. a. Any activities not previously approved as part of this permit may require a separate permit unless the Department determines a permit modification to be more appropriate. Permits shall be modified in accordance with the requirements of Rule , F.A.C. A modification which is reasonably expected to lead to substantially different environmental impacts and which requires a detailed review by the Department is considered to be a substantial modification. b. Rule (1), F.A.C. (effective date November 28, 1989) requires monitoring and maintenance of the facility in accordance with an approved closure plan for a minimum of 20 years from the date of closing. Any request for approval of a reduced long-term care period for the shall be submitted as a permit modification to provide the Department with reasonable assurance that the facility poses no significant threat to human health or the environment. Such a request must demonstrate that the facility has stabilized as defined in Rule (61), F.A.C. (effective date November 28, 1989), and as further described in Specific Condition No. A.4. c. This permit authorizes the construction and operation of the gradient management system and other related appurtenances, as shown on the Construction Drawings referenced in Specific Condition #A.2.e.(1), above. 1) Completion of construction activities and documentation of the certification of construction completion documentation for the leachate collection/underdrain system improvement project listed in Specific Condition #B.2., shall be submitted by June 23, New Facility Stabilization Determination and Permit Renewal Requirements. a. Except as otherwise specified below, on or before October 13, 2009, the permittee shall submit a Stabilization Assessment Report (SAR) to evaluate the effectiveness of the closure plan and determine if the Toytown Landfill has stabilized as defined in Rule (61), F.A.C., meaning that biological and chemical decomposition of the wastes has ceased or diminished to a level so that decomposition no longer poses a pollution, health, or safety hazard, and if the landfill: - Was constructed and operated in accordance with approved standards, and has a leachate control system and a liner; - Was closed with appropriate final cover, good vegetative cover was established, and a good monitoring system was installed; - Has a 10-year history after closure of no violations of water quality standards or minimum criteria detected in the monitoring system, and no increases over background water for any monitoring parameters which may be expected to result in violations of water quality standards or minimum criteria; and, - Has no detrimental erosion of cover, and subsidence of waste has ceased. 12 SPECIFIC CONDITIONS: PART A Solid Waste Facility General Requirements Specific Condition No. A.4.a., continued The SAR shall include evaluations of: the water quality monitoring system, gas generation within the landfill footprint and at the property boundary, integrity of the landfill cover systems, occurrence of subsidence and verification that a minimum of 24 inches of soil remains over the waste-filled areas of the facility. 1) In the event that the conclusions of the SAR indicate that Toytown Landfill has stabilized, the permittee shall prepare a certification, signed and sealed by a professional engineer, verifying that long-term care has been completed in accordance with the closure plan. The permittee shall submit to the Department a request to authorize termination of long-term care, monitoring and maintenance activities at the facility, including: a signed/sealed copy of the certification; a signed/sealed copy of the SAR; and, schedule for proper abandonment of all monitoring locations described in Parts E and F of this permit 2) In the event that the conclusions of the SAR indicate that the Toytown Landfill has not stabilized, the permittee shall continue the monitoring and maintenance activities in accordance with the specific conditions of this permit until it expires, and shall complete the activities required by Specific Condition A.4.c., below. Alternatively, the permittee may submit a notification to the Department indicating that the facility does not meet the stabilization criteria described above and that extension of the long-term care period is appropriate in lieu of the SAR as described above on or before October 13, In accordance with the notification provided by Pinellas County Utilities, Department of Solid Waste Operations received October 22, 2009 [ref. SC#A.2.d.], the County has elected not to submit the Stabilization Assessment Report that was due by October 13, 2009 and intends to continue monitoring and maintenance activities at the facility. Accordingly, the long-term care monitoring and maintenance period for the is hereby extended until at least June 23, Amended b. No later than April 13, 2010, the Department will notify the permittee that either: 1) The Department approves the termination of the long-term care activities and relieves the permittee from the specific conditions of this permit; OR 2) The Department does not approve the termination of the longterm care activities, and the long-term care period shall be extended. In this case, the long-term care period and continued monitoring and maintenance activities in accordance with the specific conditions of this permit are required until it expires. Page 9 of 32.

In the event that the Department determines that the long-term care period shall be extended (see SC#A.4.b.(2)), on or before December 15, 2014, the permittee shall either: 1) submit a second SAR to evaluate the effectiveness of the closure plan and determine if the Toytown Landfill has stabilized as defined in Rule (61), F.A.C. (described in SC#A.4.a.) OR 2) apply for renewal of the long-term care permit on forms and in a manner prescribed by the Department, to assure conformance with all applicable Department rules. Long-term care plans shall be updated at the time of permit renewal to reflect changes in closure design and long-term care requirements and revised financial assurance cost estimates (not inflation adjusted) shall be provided as part of the permit renewal documentation. The application shall include an engineering report that evaluates the landfill cover, subsidence, gas generation and migration, stormwater control and the status of other landfill systems. The application for permit renewal shall also include the last evaluation of the ground water monitoring plan listed in Specific Condition No. E.11. d. In the event the permittee prepares a second SAR (see SC#A.4.c.(1)) and the conclusions indicate that Toytown Landfill has stabilized, the permittee shall submit the items described in Specific Condition No. A.4.a(1) to support a request to authorize termination of long-term care, monitoring and maintenance activities at the facility. e. In the event that the permittee prepares a second SAR (see SC#A.4.c.(1)) and the conclusions indicate that Toytown Landfill has not stabilized, the permittee shall continue the monitoring and maintenance activities in accordance with the specific conditions of this permit or its successors. f. In the event that the permittee elected to not prepare a second SAR (see SC#A.4.c.(1)), an application for renewal of the long-term care permit shall be submitted as required by Specific Condition No. A.4.c.(2). 5. Professional Certification. Where required by Chapter 471 (P.E.) or Chapter 492 (P.G.), Florida Statutes, applicable portions of permit applications, permit modifications and supporting documents which are submitted to the Department for public record shall be signed and sealed by the professional(s) who prepared or approved them. 6. General Conditions. The permittee shall be aware of and operate under the General Conditions. General Conditions are binding upon the permittee and enforceable pursuant to Chapter 403, Florida Statutes. Page 10 of 32.

14 SPECIFIC CONDITIONS: PART A Solid Waste Facility General Requirements 7. Permit Acceptance. By acceptance of this Permit, the permittee certifies that he/she has read and understands the obligations imposed by the Specific and General Conditions contained herein, including the dates of permit expiration and renewal deadline. It is a violation of this permit to fail to comply with all permit conditions and deadlines. 8. Regulations. Requirements for closure (Rules through , F.A.C.), long-term care, monitoring and maintenance (Rule , F.A.C.), and financial responsibility (Rule , F.A.C.) that are included in the Solid Waste Management Facilities rule with an effective date of Nov. 28, 1989 remain in effect for Toytown Landfill. Otherwise, the requirements in the current Solid Waste Management Facilities rule (Chapter , F.A.C., effective August 12, 2012) are in effect, except as identified by the Specific Conditions of this permit. In the event that the regulations governing this permitted operation are revised, the Department shall notify the permittee, and the permittee shall request modification of those Specific Conditions that are affected by the revision of regulations to incorporate those revisions. Amended and Prohibitions. The prohibitions of Rule , F.A.C., shall not be violated by the activities at this facility. Page 11 of 32.

15 SPECIFIC CONDITIONS: PART B Construction Requirements 1. Construction. All significant construction activities shall be approved by the Department prior to initiating work, and may require a permit or permit modification unless specifically authorized otherwise. a. Ongoing activities to fill localized depressions and repair areas of erosion in the final cover and restore the topography of Toytown Landfill to conditions described by the final survey prepared in 1989 are authorized by this permit. The purpose of these activities is to minimize ponding and improve storm water runoff over waste-filled areas as described in correspondence prepared by SCS dated October 29, 2004 [ref. SC#A.2.b.(4)]. Upon completion of the filling and grading activities, the County shall submit signed and sealed copies of a new final survey and comply with Specific Condition No. B.2.a.(2). b. This permit authorizes the construction of the improvements to the gradient management underdrain system and other related appurtenances as identified in the documentation referenced in Specific Condition #A.2.e. New Certification of Construction Completion. All information required by this Specific Condition shall be signed and sealed by a licensed professional engineer or land surveyor as appropriate. At the completion of all authorized construction, information listed below shall be provided to the Department for approval as part of the Certification of Construction Completion. a. Within sixty (60) days after any specified construction has been completed or as otherwise specified in this permit, the following activities shall be completed: 1) The owner or operator shall submit a Certification of Construction Completion, Form (2), signed and sealed by the professional engineer responsible for the construction to the Department for approval, and shall arrange for Department representatives to inspect the construction in the company of the permittee, the engineer, and the facility operator. 2) The owner or operator shall submit Record Drawings/Documents showing all changes (i.e. all additions, deletions, revisions to the plans previously approved by the Department including site grades and elevations). The Record Documents shall include as-built plans details and elevations (survey) as appropriate. 3) The owner or operator shall submit a narrative indicating all changes in plans and the cause of the deviations, and certification by the design engineer to the Department. 4) The engineer of record shall provide a report to verify conformance with the project specifications. The report including all related testing results shall be submitted to the Department along with the completion of construction documents. Page 12 of 32.

16 SPECIFIC CONDITIONS: PART B Construction Requirements 3. Record Drawings/Documents. The Record Drawings/Documents shall include, but not be limited to, the following information: a. As-built survey of location and elevations along all underdrain piping, pump station tie-ins, force main transmission lines, and associated cleanouts [ref. Spec ]; b. Ground surface elevations, pump station depths and influent pipe invert elevations for proposed leachate pump stations (PS-518 through PS-522) identified on Sheet No. M-1 of the Construction Drawings [ref. SC #A.2.e.(1)]; elevations and slopes for the proposed slotted underdrain pipe, and elevations for the proposed leachate force main pipe identified on Sheets Nos. C-11 through C-19 of the Construction Drawings [ref. SC #A.2.e.(1)]; c. A compact disc or other electronic media that includes all available photographs documenting all stages of the construction project. Each photograph shall include the camera date stamp; d. Documentation that demonstrates that all leachate underdrain pipes have been video inspected, cleaned and tested [ref. Spec B.]. Documentation that demonstrates that all leachate force main pipes have been cleaned and pressure tested [ref. Spec B]. This documentation shall also detail all deficiencies discovered and corrective actions taken; and, e. Abandonment records for piezometers that need to be replaced due to construction activities as required by Specific Condition #E.6.; construction details for replacement piezometers as required by Specific Conditions #E.5.a., and #E.5.c. New Pre-Construction Submittals. a. At least thirty (30) days prior to initiation of any construction activity, unless otherwise specified, the permittee shall submit the following information to the Department: 1) A complete set of Plans and Specifications to be used for construction which includes all changes (i.e., all additions, deletions, revisions to the Plans previously approved by the Department). All changes shall be noted using strikethrough (strikethrough) for deletions, and underline (underline) for additions. All changes in the Plans and Specifications shall be accompanied by a narrative indicating the change. Significant changes in the Plans, as determined by the Department, shall require a permit modification. All changes in the Plans shall be noted on the Plans and the cause of the deviation and a recertification of the alternate design by the design engineer shall be provided. These alternate designs shall be approved by the Department prior to construction. If no changes have been made to the construction Plans or Specifications, the permittee shall notify the Department in writing that no changes have been made, and re-submittal of these documents will not be required prior to construction. 17 SPECIFIC CONDITIONS: PART B Construction Requirements 5. Pre-Construction Meeting Notification. The Department s Environmental Services Program, Waste Permitting Section staff shall be notified at least one (1) week prior to all pre-construction meetings. Prior to initiating construction activities, the permittee shall make arrangements for the Engineer of Record to meet on site and discuss all plan changes with the Department s Environmental Services Program, Waste Permitting Section staff. A copy of the minutes from the pre-construction conference shall be submitted to the Department within two (2) weeks of the conference. New Construction Schedule and Progress Report. a. No later than one (1) week after the pre-construction meeting, the owner or operator shall submit a construction schedule which includes estimated dates for each portion of the construction to the Department. b. An updated construction schedule and progress report shall be submitted to the Department monthly, by the 15 th of the following month. The monthly progress report should be submitted electronically in PDF format. The monthly progress reports shall include, but not be limited to: 1) A narrative explaining the status (and any delays) of major stages of the construction; 2) A summary of submittals and change order requests; 3) Monthly progress meeting minutes; and, 4) Color copies of photographs, which are representative of the typical construction activities for the reporting period and show overall views and details of major stages of construction. If digital photographs are taken, a CD or DVD containing the photographs may be submitted in lieu of printed copies. New Construction Tolerances. Construction tolerances shall be as specified in the Technical Specifications for this project [ref. SC#A2.e.(2)]. New Laboratory and Field Testing Requirements. Field and laboratory testing of materials used during the construction activities associated with the underdrain system improvements shall be conducted by a qualified testing laboratory. 18 SPECIFIC CONDITIONS: PART B Construction Requirements 9. Construction Quality Assurance. a. The Engineer of Record or another qualified professional engineer shall make periodic inspections during construction to ensure that design integrity is maintained. b. Construction Documents. A complete set of construction drawings and shop drawings, which include daily additions, deletions and revisions, shall be maintained on-site at all times for reference. c. Spills. 1) Leachate or dewatering fluids shall not be deposited, injected, dumped, spilled, leaked, or discharged in any manner to the land, surface water or ground water outside the limits of the slurry wall at the Toytown Landfill at any time during the construction activities. 2) The Department shall be notified in accordance with Specific Condition #C.4.b., of all fuel, oils, greases, solvents, lubricants, etc., that are spilled or leaked in areas that may discharge outside the limits of the slurry wall at the Toytown Landfill. The permittee shall ensure that all personnel working on the landfill site (including contractors and subcontractors) shall utilize all appropriate measures to prevent spills and leaks of fuel, solvents, lubricants, oils, etc. d. Defective Work. Unsatisfactory, defective or non-conforming work shall be reported to the Engineer and shall be corrected, or the reasons for not correcting the work shall be recorded and maintained onsite for reference and inspections. Documentation of the corrections or reasons for not correcting the work shall be submitted with the Record Documents required by Specific Conditions #B.2., and #B.3. e. Monitor wells and piezometers shall be protected at all times during construction. In the event that a monitor well or piezometer is damaged, the Department shall be notified in accordance with Specific Condition #C.4.b. f. All grubbing materials, trash, excess soils and excavated refuse shall be loaded and transported to the Bridgeway Acres Class I Landfill for disposal [ref. SC #A.2.e., Section 1.2]. Any of these materials stored at the construction site overnight shall be tarped at the end of each working day, and shall be stored no longer than 48 hours. New Granular Fill Material. The selected trench backfill material shall have a minimum hydraulic conductivity of 80 ft/day [ref. Spec A.5.]. The frequency of permeability tests to be performed on the trench backfill material to demonstrate the required permeability shall be 1 per 1,500 CY during construction [ref. Spec A.5.a.]. New Underdrain System. HDPE force main transmission lines shall be subjected to pressure tests to detect leaks in the piping [ref. Spec ]. New Page 15 of 32.

19 SPECIFIC CONDITIONS: PART C Operation Requirements 1. Control of Access. Access to, and use of, the facility shall be controlled to prevent unauthorized dumping, or use of the facility by unauthorized persons as required by Rule (3)(i), F.A.C., and to protect the monitoring devices and general landfill condition. Amended Control of Nuisance Conditions. a. The operating authority shall be responsible for the control of odors and fugitive particulates arising from this facility. Such control shall minimize the creation of nuisance conditions on adjoining property. Complaints received from the general public and confirmed by Department personnel upon site inspection shall constitute a nuisance condition and the permittee must take immediate corrective action to abate the nuisance. b. In the event that the odor control measures performed at the facility do not sufficiently abate objectionable odors offsite, the permittee shall submit an odor abatement plan to the Department within 60 days of initial detection. The odor abatement plan shall include at a minimum, a description of the proposed corrective actions and implementation schedule. 3. Stormwater Management System. The existing stormwater management system shall be designed, constructed, operated and maintained to prevent surface water from running on to waste-filled areas. The existing stormwater management system shall also include a stormwater runoff control system designed, constructed, operated, and maintained to collect and control stormwater to meet the requirements of Rule , F.A.C., and the requirements for management and storage of surface water in accordance with Rule (10), F.A.C., to meet applicable standards of Chapters and , F.A.C. Modification to the current stormwater management system associated with the future uses of the closed landfill may require a separate permit from the Department s Environmental Resource Permitting Program or the Southwest Florida Water Management District. 4. Facility Maintenance and Repair. a. The site shall be properly maintained, including erosion control, maintenance of final cover (soil and vegetative cover), maintenance of the monitor wells, maintenance of the gas probes, maintenance of the leachate collection and removal system, maintenance of the stormwater management system, prevention of ponding over waste-filled areas and access control. b. In the event of damage to any portion of the landfill site facilities, failure of any portion of the landfill systems, fire, explosion, or the development of sinkhole(s) at the facility, the permittee shall immediately (within 24 hours of discovery) notify the Department explaining such occurrence, remedial measures to be taken, and time needed for repairs. Written, detailed notification shall be submitted to the Department within seven (7) days following the occurrence outlining the cause of the failure and action taken to prevent such failures from recurring. c. In the event that any portion of the ground water monitoring system or gas probes are damaged (including dry wells or wells that cannot produce a sufficient volume of water to collect a sample), a plan for corrective action shall be submitted to the Department in accordance with Specific Condition No. C.4.b. Corrective actions which include the relocation or installation of replacement/new monitor wells shall be authorized as part of a minor permit modification to be completed in accordance with Specific Condition No. E.5., or as otherwise approved by the Department. Page 16 of 32.

20 SPECIFIC CONDITIONS: PART C Operation Requirements Specific Condition No. C.4., continued d. In the event that the stormwater management system is damaged or is not operating effectively, corrective actions shall be implemented within thirty (30) days of the written notification required in Specific Condition No. C.4.b., unless otherwise approved by the Department. e. The permittee shall conduct monthly inspections of the closed landfill at a minimum, and shall conduct supplemental inspections after major storm events. The inspections shall check for settlement, ponding, erosion, inadequate vegetation and slope seepage. Areas with significant erosion of the final cover (greater than 6 inches in depth) shall be repaired with clean fill, compacted and graded to maintain the original design slopes, and mulched and seeded/sodded within 30 days of discovery. 5. Leachate Management. a. The leachate collection and removal system shall be operated to maintain the leachate levels below the natural water table outside the slurry wall and an inward hydraulic gradient. Leachate shall be managed in accordance with the requirements of Rule (8), F.A.C., and as described in the document entitled Long-Term Care, Monitoring and Maintenance Plan, Toytown Closed Landfill, Revised, prepared May 2004 Long Term Care Plan, received July 10, 2013 [ref. SC#A.2.e.(3)], and other applicable Department rules. Amended b. Leachate Disposal. 1) Leachate collected in the lift station near the southeast corner of Toytown Landfill shall be pumped into the sanitary sewer operated by the City of St. Petersburg. Leachate pre-treatment is not currently required prior to arrival at the City s wastewater plant (WWTP). No later than thirty (30) days prior to the expiration of any contracts or agreements for the disposal of leachate at the City s WWTP, the permittee shall provide a copy of the contract renewal or the issuance of a new contract for leachate disposal. 2) In the event that the primary leachate disposal facility becomes unable or unwilling to accept leachate for disposal, within three (3) days of the cessation of leachate acceptance by the WWTP, the landfill owner or operator shall notify the Department and shall explain the contingency measures which will be implemented. The contingency measures shall be implemented within seven (7) days of the cessation of leachate acceptance at the WWTP, or in accordance with an alternate schedule approved by the Department. Page 17 of 32.

21 SPECIFIC CONDITIONS: PART C Operation Requirements Specific Condition No. C.5., continued c. Leachate Collection and Removal System (LCRS) Inspections/Maintenance. 1) In the event that renewal of this permit shall be required, the leachate collection and removal system and gravity pipelines, shall be video inspected or water pressure cleaned at cleanouts and access pipes to verify adequate performance at least once prior to permit expiration. An inspection report shall be submitted to the Department no later than December 15, 2014 that includes an evaluation of the effectiveness of the system, the locations of cleaning and video inspections (indicated on a Site Plan drawn to scale) with the locations and the cause of all obstructions encountered, proposed corrective actions, and schedule for implementation of corrective actions, as appropriate. If the pipes are water-jet cleaned, the report shall include a description of the method of cleaning. Components not performing adequately shall be cleaned and/or repaired. In the event that corrective actions are required, a final report describing repairs with photographic documentation shall be signed and sealed by a professional engineer, and shall be submitted to the Department to verify adequate performance of the LCRS. The permittee shall retain a copy of the final report, each inspection report, and each inspection videotape at the facility for reference, and shall provide a copy to the Department upon request. 2) The leachate collection drains, well point system, gravity pipelines, lift station, pumps and related sensors and controller mechanisms shall be inspected at least on a monthly basis. Documentation of all inspections shall be kept on file by the permittee, and provided to the Department upon request. Amended ) Upon the discovery of any defective portion of the LCRS, an investigation of the cause shall be conducted. Construction of improvements to the any part of the LCRS, including significant repairs to the leachate collection system, may require a permit modification pursuant to Specific Condition No. A.3.a. The design and related supporting documents for the construction of improvements shall be substantially equivalent to those required for new construction. d. Leachate quantities. 1) In the event of a failure of leachate metering or pumping equipment which is not corrected within 24 hours of detection, the Department shall be notified, and corrective actions implemented in accordance with Specific Condition No. C.4.b. 2) Leachate generation reports shall be compiled monthly and submitted to the Department semi-annually, by January 15 th and July 15 th of each year. Leachate generation reports shall include the number of closed acres, the quantities of leachate collected, pumped or hauled off-site to a WWTP, and daily precipitation amounts greater than one tenth of an inch. 22 SPECIFIC CONDITIONS: PART C Operation Requirements 6. Corrective Actions for Maintaining an Inward Gradient. In accordance with the description of the gradient control systems (leachate collection underdrain, well point dewatering system, swale near well MW-6A and leachate lift station) provided in the document entitled Long-Term Care, Monitoring and Maintenance Plan, Toytown Closed Landfill, prepared by SCS, dated May 2004 Long Term Care Plan, received July 10, 2013 [ref. SC#A.2.e.(3)], an inward hydraulic gradient shall be maintained across the slurry wall. For those instances when an outward gradient is measured at any monitoring pair, an inward gradient shall be restored within 31 days of discovery. If a persistent outward gradient is observed at any monitoring pair, a corrective action plan to re-establish an inward gradient shall be submitted to the Department for review and approval in accordance with Specific Condition No. C.4.b. Amended Page 19 of 32.

23 SPECIFIC CONDITIONS: PART D Recordkeeping 1. Financial Assurance/Cost Estimates. The permittee shall provide adequate financial assurance for this facility in accordance with Rule , F.A.C. (rule effective date Nov. 28, 1989). Financial assurance shall not be required for this facility after April 13, 2010 (which represents 20 years from the date that the landfill closure construction certification was approved). a. All costs for long-term care, monitoring and maintenance shall be adjusted and submitted annually, by March 1 st each year to: Solid Waste Manager, Solid Waste Section, Department of Environmental Protection, 3804 Coconut Palm Drive, Tampa, Florida As indicated in Specific Condition No. A.4.c.(2), financial assurance cost estimates shall be updated (not inflation adjusted) at the time of permit renewal to reflect changes in closure design and long-term care requirements. b. Proof that the financial mechanism has been adequately funded shall be submitted annually to: Financial Coordinator, Solid Waste Section, Department of Environmental Protection, 2600 Blair Stone Road, MS #4565, Tallahassee, Florida Amended Page 20 of 32.

24 SPECIFIC CONDITIONS: PART E Water Quality Monitoring Requirements 1. Water Quality Monitoring Quality Assurance. a. All field work done in connection with the facility's Water Quality Monitoring Plan shall be conducted in accordance with the Standard Operating Procedures (SOPs) described in DEP-SOP-001/01 (revised March 31, 2008, effective December 3, 2008) [or as replaced by successor SOPs], as referenced in Rule (1), F.A.C. All laboratory analyses done in connection with the facility s Water Quality Monitoring Plan shall be conducted by firms that hold certificates from the Department of Health Environmental Laboratory Certification Program under Chapter 64E-1, F.A.C., as referenced in Rule (1), F.A.C. The SOPs utilized and the laboratory s list of certified test methods and analytes must specifically address the types of sampling and analytical work that are required by the permit and shall be implemented by all persons performing sample collection or analysis related to this permit. Alternate field procedures and laboratory methods may be used if approved according to the requirements of Rules and , F.A.C., respectively. Amended b. The field testing, sample collection and preservation, and laboratory testing, including the collection of quality control samples, shall be in accordance with the requirements of and methods approved by the Department in accordance with Rule and Chapter , F.A.C. Approved methods published by the Department or as published in Standard Methods, or by A.S.T.M., or EPA methods shall be used. 2. Zone of Discharge. a. The zone of discharge for this facility shall extend horizontally 100 feet from the limits of the landfill slurry wall or to the property boundary, whichever is less, and shall extend vertically to the bottom of the surficial aquifer. b. The permittee shall ensure that the water quality standards and minimum criteria for Class G-II ground waters will not be exceeded at the boundary of the zone of discharge according to Rule , F.A.C., and that the minimum criteria listed in Rule , F.A.C., will not be exceeded outside the slurry wall. Replacement piezometers shall be constructed in accordance with the details provided in Table 1 of the document titled Long Term Care Plan, received July 10, 2013 [ref. Any existing piezometer that is damaged or abandoned due to construction activities shall be replaced by a new piezometer within one hundred and twenty (120) days unless otherwise approved by the Department. Amended All monitor wells and piezometers are to be clearly labeled and easily visible at all times. The permittee should keep all wells and piezometers locked to minimize unauthorized access. 4. Ground Water Sampling. The locations, parameters, and frequencies specified herein represent the minimum requirements for ground water monitoring. Additional samples, wells, and parameters may be required based upon subsequent analysis. Method Detection Limits must be reported at or below the Maximum Contaminant Levels established for the individual parameters to demonstrate compliance with Class G-II ground water standards referenced in Chapter , F.A.C. Collection of field-filtered samples is acceptable when conducted in accordance with the Department s January 1994 technical document Determining Representative Ground Water Samples, Filtered or Unfiltered. Ground water levels shall be measured for all sampling events described in Specific Condition No. E.4.b., at all wells listed in Specific Condition Nos. Ground water surface contour maps shall be prepared for each sampling event to include water elevations (referenced using a consistent, nationally recognized datum) calculated for each well and the surface water elevation measured in the northeast storm water pond. Prior to construction of any new or replacement wells (excluding well MW-10), the permittee shall request and receive Department approval of a minor permit modification. The following information is required to be submitted within 90 days of new or replacement well installation, or as stated below: a. Construction details for all new or replacement wells and piezometers shall be provided to the Department s Southwest District Office on Department Form No (30), Monitor Well Completion Form (attached). Amended b. Within one week of well completion and development, each new or replacement well shall be sampled for the parameters listed in Rules (7)(a), and (7)(c), F.A.C., plus bicarbonate and sulfate. Amended c. A surveyed drawing shall be submitted in accordance with Rule (3)(d)(1), F.A.C., showing the location of all monitor wells and piezometers (active and abandoned) horizontally located in degrees, minutes and seconds of latitude and longitude, and the elevation of the top of the well casing to the nearest 0.01 foot, using a consistent, nationally recognized datum. The surveyed drawing shall include the monitor well identification number, locations and elevations of all permanent benchmarks and/or corner monument markers at the site. The survey shall be conducted by a Florida Licensed Professional Surveyor and Mapper. Amended Page 24 of 32.

28 SPECIFIC CONDITIONS: PART E Water Quality Monitoring Requirements 6. Well Abandonment. All monitor wells and piezometers not a part of the approved Water Quality Monitoring Plan shall be plugged and abandoned in accordance with Rule (5), F.A.C., and the rules of the Southwest Florida Water Management District. The permittee shall submit a written report to the Department within 90 days of well abandonment documenting verification of the well abandonment. A written request for exemption to the abandonment of a well must be submitted to the Department s Environmental Services Program, Waste Permitting Section for approval. Amended Verification/Evaluation Monitoring. If at any time monitoring parameters are detected at concentrations significantly above background water quality, or exceed the Department's water quality standards or criteria at the edge of the zone of discharge, the permittee has 30 days within receipt of the laboratory data to resample the monitor well(s) to verify the original analysis. Should the permittee choose not to resample, the Department will consider the water quality analysis to be representative of current ground water conditions at the facility. If the data is confirmed, or if the permittee chooses not to resample, the permittee shall notify the Department within 14 days of this finding. Upon notification by the Department, the permittee shall initiate evaluation monitoring, prevention measures and corrective action as described in Rule (6), F.A.C. Amended Surface Water Sampling. All surface water bodies that may be affected by a contaminant release at the facility shall be monitored, except bodies of water contained completely within the property boundaries of the site which do not discharge from the site to surface waters (Rule (4), F.A.C.). The locations, parameters, and frequencies specified herein represent the minimum requirements for surface water monitoring. Additional samples, sampling locations and parameters may be required based upon subsequent analysis. Method Detection Limits must be less than or equal to the surface water criteria established for the individual parameters to demonstrate compliance with Class III (predominantly freshwater) surface water criteria presented in Chapter , F.A.C. Compliance with surface water criteria will be based on analysis of unfiltered samples. a. Surface water shall be monitored at following location: Location Monitoring Point WACS ID Number Northeast Storm Water Pond SW Monitoring point SW-1 is adjacent to the staff gauge in the northeast storm water pond (SG-2) as shown on Figure 1 entitled Existing Detection/Compliance Monitoring Wells and Gradient Monitoring Pairs, received July 10, 2013 (attached). Surface water elevations (referenced using a consistent, nationally recognized datum) shall be measured at the staff gauge located in the northeast retention pond (SG-2) during all sampling events described in Specific Condition Nos. E.4.b., and E.8.b., to a precision of 0.01 foot. Amended Hydraulic Gradient Monitoring Across the Slurry Wall. a. Horizontal hydraulic gradient across the slurry wall shall be measured monthly at the monitoring points listed in Specific Condition No. E.3.b., to a precision of 0.01 feet. Monthly water level measurements shall also be collected at wells MW-5 and MW-9, piezometers PZ-27 and the staff gauge located in the northeast storm water pond (SG-2). Results of the monthly gradient monitoring shall be submitted by the 15 th day of the following month to the Southwest District Office of the Department. b. If an outward gradient exists, steps for correcting the gradient shall be included with the related monthly data. If an outward gradient exists at any monitoring pair, weekly measurements shall be conducted until an inward hydraulic gradient is restored and maintained for at least 4 consecutive weeks. Damaged gradient monitoring points shall be replaced within thirty (30) days of Department approval. Page 26 of 32.

30 SPECIFIC CONDITIONS: PART E Water Quality Monitoring Requirements 10. Water Quality Reporting Requirements. The results of each water quality sampling event conducted at the facility to comply with the Specific Conditions of this permit shall be included in Electronic Data Deliverable (EDD) reports that include: a. Required water quality monitoring reports and all analytical results shall be submitted electronically. Water quality monitoring reports shall be submitted in Adobe pdf file format. The water quality EDD shall be provided to the Department in an electronic format consistent with requirements for importing the data into the Department's databases as summarized on the Department s web site at: Water quality monitoring reports shall be signed and sealed by a Florida registered professional geologist or professional engineer with experience in hydrogeological investigations and shall provide the information required by Rules (8)(a)1 through (8)(a)10, F.A.C., including: 1. Cover letter; 2. Summary of exceedances and recommendations; 3. Ground water contour maps; 4. Chain of custody forms; 5. Water levels, water elevation table; 6. Water Quality Monitoring Certification, using Department Form # (31); 7. Appropriate sampling information on Department Form #FD (DEP-SOP-001/01); and, 8. Laboratory and Field data and error logs, as applicable. [In addition to the Adobe pdf file format, this data and associated error logs shall be submitted in an ADaPT-compatible, comma separated text file format.] The reports of results shall be submitted to: - Department of Environmental Protection, Southwest District Office, Compliance Assurance Program, North Telecom Parkway, Temple Terrace, FL , SWD_Waste@dep.state.fl.us; and, - Department of Environmental Protection, Solid Waste Section 2600 Blair Stone Road, MS 4565, Tallahassee, FL , ADaPT.EDDs.and.Reports@dep.state.fl.us. b. The permittee shall submit to the Department the results of analyses reported for each sampling event conducted at the facility by the following due dates: 1. Specific Condition #E.4.b. results of ground water routine semi-annual sampling events at the background and compliance wells listed in Specific Condition #E.3. shall be submitted within 60 days from completion of laboratory analyses and no later than January 15 th and July 15 th of each year for the periods July 1 Dec. 31, and Jan. 1--June 30, respectively; 2. Specific Condition #E.5.b. results of ground water initial sampling events shall be submitted within 30 days from completion of laboratory analyses; 3. Specific Condition #E.7. results of ground water verification sampling events shall be submitted within 60 days from completion of laboratory analyses; 4. Specific Condition #E.8.d. results of surface water routine semi-annual sampling events shall be submitted within 60 days from completion of laboratory analyses and no later than January 15 th and July 15 th of each year for the periods July 1 Dec. 31, and Jan. 1--June 30, respectively. The permittee shall submit an evaluation of the water quality monitoring data every two years and prior to permit expiration as required by Rule (8)(b), F.A.C. Any ground water contamination that may exist shall be addressed as part of evaluation monitoring conducted at the facility in accordance with Rule (6), F.A.C. The monitoring plan evaluations shall be sent to: Florida Department of Environmental Protection, Southwest District Office, Environmental Services Program, Waste Permitting Section, North Telecom Parkway, Temple Terrace, Florida Amended and Page 28 of 32.

32 SPECIFIC CONDITIONS: PART F Landfill Gas Management 1. Landfill Gas NPs and Title V Air Requirements. a. This solid waste permit will meet the statutory requirement to obtain an air construction permit before modifying or constructing a source of air pollution, except for those landfills that are subject to the prevention of significant deterioration (PSD) requirements of Chapter , F.A.C. Facilities that are subject to the PSD requirements shall obtain an air construction permit from the Bureau of Air Regulation prior to beginning construction or modification pursuant to Rule , F.A.C. b. The permittee shall comply with any applicable Title V air operation permit application requirements of Chapter , F.A.C., and 40 CFR 60, Subparts WWW and CC, as adopted by reference at Rule , F.A.C. Title V Permit applications shall be submitted to the District Air Program Administrator or County Air Program Administrator with air permitting authority for the landfill. c. The permittee shall submit to the Division of Air Resources Management, Department of Environmental Protection, Mail Station 5500, 3900 Commonwealth Blvd., Tallahassee, FL , any amended design capacity report and any Non-Methane Organic Compound (NMOC) emission rate report, as applicable, pursuant to 40 CFR (a)(3) and (b). 2. Gas Monitoring and Control. a. Landfills that receive biodegradable wastes shall have a gas management and control system designed to prevent explosions and fires, and to minimize off-site odors, lateral migration of gases and damage to vegetation. Landfill gas shall be monitored and controlled as required by Rule , F.A.C. b. Landfill gas shall be monitored to demonstrate compliance with the criteria established in Rule (1)(a), F.A.C., (less than 25% of the lower explosive limit (LEL) for combustible gases in on-site and offsite structures, and less than 100% of the LEL for combustible gases in perimeter gas probes at the property boundary). Landfill gas monitoring results shall be reported as a percent of the LEL, calibrated to methane. c. The results of the quarterly monitoring required by Rule (2)(c), F.A.C., shall be submitted to the Department by the following dates: Measured During Report Submitted By Quarter 1 April 15 th of each year Quarter 2 July 15 th of each year Quarter 3 October 15 th of each year Quarter 4 January 15 th of each Page 29 of 32.

The landfill gas monitoring locations are described in Section O ( Landfill Gas Monitoring and Management System ), prepared by SCS, revised September 3, 2004 [Ref. SC#A.2.b.(2)]. The ambient gas monitoring points and perimeter gas monitoring probes are located on Figure 2-1 entitled Location of Monitoring Wells Used in Anova Analyses, prepared by SCS, received March 29, 2005 (attached), and shall be sampled at least quarterly for concentrations of combustible gases determined as a percent of the LEL calibrated to methane, as described in Rule (2), F.A.C. Gas Remediation. If the results of gas monitoring show that combustible gas concentrations exceed 25% of the LEL calibrated to methane in structures or 100% of the LEL calibrated to methane at the property boundary, the permittee shall immediately take all necessary steps to ensure protection of human health and notify the Department. Within 7 days of detection, a gas remediation plan detailing the nature and extent of the problem and the proposed remedy shall be submitted to the Department for approval. The remedy shall be completed within 60 days of detection unless otherwise approved by the Department. Page 30 of 32.

34 SPECIFIC CONDITIONS: PART G Closure and Long-Term Care Requirements 1. Closure Permit Requirements. The permittee shall perform long-term care, monitoring and maintenance for the facility in accordance with Rule , F.A.C. (effective date of Nov. 28, 1989), and the information submitted in Attachment P-1 ( Long-Term Care, Monitoring and Maintenance Plan ) prepared by SCS, dated May 2004 [Ref. SC#A.2.a.(1)] the document titled Long Term Care Plan, received July 10, 2013 [ref. SC#A.2.e.(3)]. Amended Use of Closed Landfill Areas. a. Several uses of the have been approved by the Department. These uses include portions of the landfill property that are located both interior and exterior of the slurry wall, as follow: - South Pinellas Aeronautical Radio Kontrol Society (SPARKS) Included a paved runway area and associated facilities for operation of radio controlled airplanes, located interior of the slurry wall. - Leachate Pump Station Leachate pumping facilities located within the slurry wall transfer leachate collected in the lift station to the sanitary sewer system operated by the City of St. Petersburg for proper treatment and disposal. - Cell Phone Tower Facilities Included tower and associated structure, located exterior of the slurry wall along the eastern property boundary. b. Uses of closed landfill areas not described in Specific Condition No. G.2.a., require consultation with and approval by the Department prior to conducting these activities in accordance with Rule (1), F.A.C. The Department retains regulatory control over any activities which may affect the integrity of the environmental protection measures such as the landfill cover, drainage, final cover materials (soil and vegetation), monitoring systems or stormwater controls. A plan detailing the proposed activities and the potential effects on the landfill systems shall be submitted for Department review to comply with the requirements of the Department s document entitled Guidance for Disturbance and Use of Old Closed Landfills or Waste Disposal Areas in Florida, Version 2.1, dated February 3, 2011, or successor document. Authorization to conduct the proposed improvements to the Toytown Landfill or adjacent areas may require a modification of the Long-Term Care permit to comply with Specific Condition No. A.3.a. Amended and Page 31 of 32.

An amendment to the Declaration to the Public filed in the Pinellas County Property Records on April 10, 1998 shall be prepared that identifies the Toytown Landfill as a closed Class I Landfill.
