2 Iw ORLEANS POLICE DEPART_NT GIST On Sunday, September 4, 2005 at approximately 9:00AM, several Seventh District Police Officers responded to the area of Chef Menteur Highway and Downman Road, in reference to a Signal 1 08 (officer needs assistance - life is in danger), as mention was made of officers being down. The officer on the radio advised that two fellow New Orleans Police Officers were down, which was interpreted by responding officers that the police officers were shot, under the Danzinger Bridge located at Chef Menteur Highway and Downman Road. Units from the Seventh District immediately responded to the area. While en route, officers were advised that the subjects shooting at the police were on the Danzinger Bridge headed westbound towards the Third Police District area. Upon arrival, officers from the Seventh District engaged the subjects on the Danzinger Bridge. The subjects on the Danzinger Bridge, which was determined to be seven (7), were confronted and ordered by the responding officers to raise their hands. The subjects immediately began going for cover behind the concrete barrier on the bridge, while some of the male subjects armed themselves and began firing handguns at the officers, who subsequently returned fire striking five of the seven subjects. Two of the subjects continued to fire at officers as they fled over the Danzinger Bridge towards the Third District. Officers pursued the subjects, where one was apprehended at the Friendly Inn Motel located at 4861 Chef Menteur Highway and the other was mortally wounded on the scene. Upon surveying the scene on the Danzinger Bridge, Officers of the Seventh District located five subjects lying on the north side of the bridge suffering from gunshot wounds. Officers learned that one subject was pronounced dead on the scene while the other four were transported to West Jefferson Hospital, Marrero, Louisiana for treatment. (It is unknown if Police Officer Jennifer Goodenough was interviewed, concerning her knowledge of what occurred on Sunday, September 4,2005.) *** Let it be known there were relief worken who were being fwed upon by the assailants, but fled the area before they could be interviewed. None of the law enforcement officers or relief workers sustained any injury from being fired upon. PERSONS INTERVIEWEDIINJURED FROM GUNFIRE The following individuals sustained gunshot wounds and were located on the pedestrian walkway of the Danzinger Bridge: 1. Susan Bartholomew, black female, date of birth 3/5/67, unknown address. 1) Three (3) gunshot wounds to the left leg 2) One (1) gunshot wound to the right arm. 3) Fractured left femur 4) Amputated right arm 2. Leshia Bartholomew, black female, date of birth 6/25/88, unknown address. 1) One (1) gunshot wound to the middle of stomach 2) One (1) gunshot wound to the left lower buttocks 3) One (1) gunshot wound to the middle of the buttocks 4) One (1) gunshot wound to the left middle back 3. Leonard Bartholomew Sr., black male, date of birth 12/22/60, unknown address. 1) One (1) gunshot wound (entrance! exit) to left heel 2) One (1) gunshot wound to the upper bac~. 3) One (1) gunshot wound to the head which exited above the right ear (Sergeant Arthur Kaufman and Detective Jeffrey Lehrmann conducted verbal interviews with the above three wounded individuals.) 7 e,_ NEW ORLEANS POLICE DEPARTMENT PERPETRA TOR(S) The following subjects were identified as perpetrators of an Attempted Murder on the Police Omcers and Saint Landry Parish Deputy: 1) Jose Holmes, black male, date of birth June 13, 1986, last known address 2136 Congress Street, New Orleans, Louisiana, Social Security number. WOUNDS: Jose Holmes sustained gunshot wounds to his left hand and elbow, right elbow, neck area and stomach and is being treated at West J efierson Hospital, Marrero, Louisiana. He is presently going through therapy and is requiring the use of a colostomy bag. Charges against Jose Holmes for attempted murder of the above mentioned New Orleans Police Officers and the Saint Landry Parish Deputy are pending. RECORD: A Motion Computer check of Mr. Jose Holmes shows he had two (2) prior arrests on attachments on 5/26/04 and 4/8105. No dispositions were available. 2) Madison Lance, black male, date of birth September 1, 1956, last known address is unknown. WOUNNDS: Lance Madison did not sustain any injury. Lance Madison was apprehended on the scene at 4861 ChefMenteur Highway and booked with the following charges: R.S. 14:27130':' Relative to eight (8) counts of attempted murder on Police Omcers. (Deceased) WOUNDS: Observed wounds were to the right elbow, right flank and back of the neck. 4) Name Unknown, black niale, approximately 25 to 30 years of age located in the driveway of 4861 Chef Menteur Highway. (Deceased) WOUNDS: Observed were five (5) gunshot wounds to the back, which were consistent with a shotgun blast. PERPETRATORS'S WEAPONS 01. One (1) blue steel Colt,.357 magnum, Model Trooper MKIII, revolver, 5 inch barrel, six (6) shot handgun, );Jeariog serial number 84044J. (The weapon was confiscated by Sergeant Arthur Kaufman on Monday, September 5, 2005 at about 10:00AM, from the scene on side of the Danzinger Bridge. It was subsequently submitted in to Central Evidence and Property and Receipt Number was assigned the evidence.) The ATF Trace Summary Report reflected the handgun's dealer information was from Goudeau Incorporated, PO BOX Miles South on Highway 29, Cottonport, Louisiana The shipping date to the business was listed as 03/ At this time, no purchase information on the weapon or history has been obtained. It should be noted that after Hurricane Katrina passed, the City of New Orleans was in a state of chaos and confusion. 15 Iw ORLEANS POLICE DEPART.NT. INVESTIGATIVE SUPPORT DMSION J-OS934-0S SCENE DESCRIPTION Responding officers located and investigated two scenes related to this incident. One scene was located on the Danzinger Bridge westbound and the other was at the, Friendly Inn Motel, located at 4861 ChefMenteur Highway. The first scene located approximately fifty (50) yards from the foot of the Danzinger Bridge (north side) in the westbound lanes. this scene is described as follows: The scene on the Danzinger Bridge is located near the 6000 block of Chef Menteur Highway just west of the intersection with Downman Road. The bridge consists of a three lane roadway on the north side of the bridge. There is also a very narrow pedestrian walkway which allows pedestrians to travel from east to west. The roadway and pedestrian walkway are separated by a three foot high concrete barrier. Behind the barrier, officers located and secured the five (5) subjects, all of whom suffered gunshot wounds. One of the perpetrators, an unidentified black male, approximately six ( 6) feet tall wearing a white t shirt, bluel gray shorts, and black tennis shoes had expired on the scene. The other four subj ects were treated on the scene and transported to West Jefferson Hospital for treatment. Sergeant Kaufman noted approximately ten (to) strike marks on the concrete barrier in the immediate vicinity of where the subjects were located. The "second scene was located west of the Danzinger Bridge at the Friendly Inn Motel, located at 4861 Chef Menteur Highway. The motel is a two story dwelling with a driveway which one would enter from ChefMenteur Highway. The driveway leads into an open parking lot area. In the driveway next to an abandoned Chevrolet van, whereby no license plate infonnation was available, was an unidentified black male who also expired on the scene. This black male was clad in a light colored polo shirt, a white t shirt, and white under shorts protruding from a pair of blue jean shorts, white socks, and white tennis shoes. 16 Iw ORLEANS POLICE DEPART.NT J-OS934-0S NARRATIVE On Friday, October 14, 200S at about 10:00AM, the follow up investigation into the shooting incident on the Danzinger Bridge, which occurred on Sunday, September 4, 2005, was assigned to Detective Sergeant ~ard Dugue', who is assigned to the Major Case Homicide Section of the Investigative Support Division. This assignment was made by Lieutenant James H. Keen, commander of the Major Cas~ Homicide Section. The initial investigation was being handled by Sergeant Arthur Kaufman of the Seventh Police District's Investigative Unit. On Friday, October 14, 200S at about 3:00PM, Sergeant Gerard DUgue' had the occasion to meet Sergeant Arthur Kaufman at the temporary Seventh District Police Station at the location of Chef Menteur Highway and Read Boulevard. Sergeant Kaufman gave Sergeant Dugue' a verbal account of what occurred on the Danzinger Bridge on Sunday, September 4, 2005 at about 9:00AM. Sergeant Kaufman's explanation of what occurred on Sunday, September 4, 200S at about 9:00AM is documented briefly in the initial incident police report under New Orleans Police Department item number J-OS934-0S. The following is a gist of that report: On Sunday September 4, 2005 at approximately 9:00AM several Seventh District Police Officers responded to the area of Chef Menteur Highway and Downman Road; in reference to a Signal 1 08 (officer needs assistance -life is in danger) call. The female officer on the radio advised that two fellow New Orleans Police Officers were down under the Danzinger Bridge located at ChefMenteur Highway and Downman Road. Units from the Seventh District immediately responded to the area. While en route, officers were advised that the subjects shooting at the police were on the Danzinger Bridge headed westbound towards the Third Police District. Upon arrival, the officers, who were in Task Force uniforms with New Orleans Police Department patches, were met with gunfire from four (4) of seven (7) subjects who were running onto the Danzinger Bridge, westbound. Two of the subjects, one later identified as Jose Holmes and the other who remains unidentified, continued to fire in the direction of the officers from behind the barrier while the two remaining subjects, one later identified as Lance Madison, continued to run towards the top of the bridge also firing at the pursuing officers. The scene was later secured and Lance Madison was taken into custody. Four other subjects, later identified as Holmes, Leonard Bartholomew, Liesha Bartholomew and Susan Bartholomew, were wounded and subsequently transported to West Jefferson Sergeant Gerard Dugue' Badge: 436 Unit:

17 Iw ORLEANS POLICE DEPARniNT Medical Center Hospital and underwent surgery. Sergeant Kaufman related two (2) perpetrators were shot and killed during the incident and were unidentified at that time. Once the scene was secured, Sergeant Kaufman stated Deputy David Ryder of the Saint Landry Parish Sheriff's Office arrived at the Friendly Inn, located at 4861 Chef, Menteur Highway, and positively identified" Lance Madison as one of several shooters who fired upon him as he escorted several rescue volunteers with boats over the high rise on Interstate 10. Deputy Ryder also identified the perpetrator lying in the driveway of the motel as a shooter as well. Sergeant Arthur Kaufman related he arrived on the scene a short time prior to Lance Madison being apprehended and verbally advised Madison of his rights and the charges against him. Madison stated he understood his rights and the charges at that time. He mentioned Lance Madison was later transported to the Greyhound Bus Terminal by Officers Geoffrey Murret and Ignatius Hills, which was set up as a booking facility. Larice Madison was booked with eight (8) counts of 14 Article 27/30 relative to Attempted First Degree Murder of Police Officers. On the scene, the bodies of the two deceased perpetrators remained with no Coroner's Office support available to retrieve them. Officers from the Seventh Police District later placed the bodies under guard for several hours until Lieutenant Michael Roussell was able to pick them up and transport them to the Jefferson Parish Coroner's Office, where they were held until they were picked up and transported to Saint Gabriel, Louisiana " where a temporary morgue was set up for the hurricane disaster. On Tuesday, October 11, 2005 Sergeant Kaufman related he proceeded to the Greyhound Bus Station, temporary site of New Orleans Police Department's Central Evidence and Property, located in the 1000 block of Loyola Avenue. Sergeant Kaufman stated he was able to turn in the gun he recovered from the scene of the shooting on the Danzinger Bridge in to Clerk Hebert. He related the gun, a Colt,.357 magnum, Model Trooper MKIII, revolver, 5 inch barrel, six (6) shot handgun, bearing serial number 84044J, was turned in and Receipt # was assigned the weapon. A copy of the initial incident report by Sergeant Arthur Kaufman under New Orleans Police Department item number and dated 9/4/05 will be placed in the case file for" future reference and should be considered seh explanatory. A joint investigation then ensued with Sergeants Gerard Dugue' and Arthur Kaufman. Sergeant Kaufman also related to Sergeant Dugue' several interviews were done with police officers and civilians. 18 .. Iw ORLEANS POLICE DEPART.NT Prior to departing the scene, Sergeant Kaufman spoke with two (2) witnesses. The first witness identified as James Youngman, noted in the witness section on page # 10 of this report, stated he was on the Downrnan Road side of the Danzinger Bridge when he observed several black males shooting at police officers near Downman Road, and then fleeing over the bridge. Youngman advised that he also observed the police officers return fire and chase the males over the Danzinger Bridge. Sergeant Kaufman related this was a brief verbal statement, as Officers were unable to obtain any audio or video taped statements due to post storm conditions. The second witness was identified as Lakiesha Smith, noted in the witness section on page # 10 of this report. Mrs. Smith stated she evacuated from her residence to the Friendly Inn at 4861 Chef Menteur Highway. Mrs. Smith stated she was on the second floor balcony of the Friendly Inn when she observed police officers pursuing two black male subjects. Mrs. Smith stated she immediately recognized the two males as those who had been looting and robbing people after the storm. Mrs. Smith stated she observed police officers chase one male, clad in a light colored shirt and blue jeans, into the motel driveway. Mrs. Smith stated she observed the male reach into his right waistband and turn towards the street. Mrs. Smith stated she heard loud gunshots and the male fell to the ground. Mrs. Smith observed the second male, later identified as Lance Madison, clad in all black, flee towards the rear of the motel complex. Mrs. Smith advised Sergeant Kaufman that she was in the process of relocating to Dallas, Texas, to live with her sister at an unknown address. Sergeant Kaufman mentioned Mrs. Smith could add nothing further. He stated this too was a brief verbal statement, because it was impossible to obtain an audio or video tape statement, due to post storm conditions. Sergeant Kaufman related it should be noted that attempts to contact and obtain technical support from the New Orleans Police Department's Crime Lab and Cold Case Homicide Investigators, as well as New Orleans Health Department Emergency Medical Services proved futile, as the City of New Orleans was still reeling from Hurricane Katrina. The wounded were triaged by members of Northeast Louisiana Ambulance Service, (unit 103) who were stationed at Read Road and Chef Menteur Highway, and transported to West Jefferson Medical Center for treatment, accompanied by Detective Lehrmann. Once the initial scene investigation was completed, Sergeant Kaufman returned to the temporary Seventh District Police Station, which was located at ChefMenteur Highway and Read Boulevard, to interview the officers involved in the shooting incident. It should be noted that there was no audio visual equipment available to memorialize the following statements. Sergeant Kaufman met with Deputy David Ryder who gave the following verbal statement relevant to this incident: Deputy David Ryder stated he was assigned to boat rescue operations in the City of New Orleans following Hurricane Katrina. Deputy Ryder stated on the morning of September 4, 2005 at approximately 8 :45 a.m. he was escorting several volunteer rescue personnel eastbound over the Interstate 10 High-rise. As Deputy Ryder came to the top of the high rise, he noticed several subjects on.the down stroke past the Downman Road exit. Deputy Ryder stated that several of the subjects opened fire on their convoy, at which time he was forced to retreat to avoid being struck by gunfire. Once the scene was secured, Deputy Ryder related he was escorted to the Friendly Inn at 4861 ChefMenteur Highway and he positively identified Lance Madison and the unknown deceased male in the driveway as two of the several persons who opened fire on his convoy. Sergeant Kaufman then met with Sergeant Kenneth Bowen who gave the following verbal statement relevant to the shooting incident on the Danzinger Bridge: On the morning of September 4, 2005, Sergeant Kenneth Bowen st~ted he was on proactive patrol in the Seventh District, in an attempt to keep peace and prevent looting. Sergeant Bowen related he was monitoring the Seventh District Police radio channel when he heard a distress call come out. He mentioned a female officer advised that two police were down, which he understood to have been shot, under the Danzinger Bridge near Chef Menteur Highway and Downman Road and subjects were shooting at persons Sergeant Gerard Dugue' Badge: 436 Unit:

20 e. NEW ORLEANS POLICE DEPARTl\lINT in the area. Sergeant Bowen stated he boarded a truck driven by Officer Michael Hunter and occupied by several other police officers. Sergeant Bowen stated he was the front seat passenger of the truck. He mentioned the truck proceeded to the area of the Danzinger Bridge at which time. the truck stopped and he, Sergeant Bowen, shouted for the subjects on ~e bridge to raise their hands in the air. He stated the subjects immediately went for cover, while arming themselves, and fired upon the officers. The subjects then all jumped behind a cement barrier for cover to ambush the officers exiting the rear of the truck. To protect his own life and the lives of the other officers exiting the truck, Sergeant Bowen stated he fired several shots into the concrete barrier to deter the subjects from standing and aiming at the officers. Sergeant Bowen mentioi,led he began to shout to the subjects to throw their weapons off the side of the bridge. Sergeant Bowen related he observed a young male subject jump from the bridge onto the grassy area several feet below, to flee. Sergeant Bowen mentioned he then heard gunfire from the immediate area. Officers Faulcon, Villavaso, and Barrios engaged the armed subjects behind the cement barrier and then ceased firing. Sergeant Bowen also observed two males running west over the bridge, while gunshots could be heard coming from those two subjects, who were shooting back at the officers on the bridge. Sergeant Bowen stated he exited the truck and cautiously peeked over the cement barrier. He observed two dark colored handguns lying on the cement nex;t to stationary subjects. Sergeant Bowen jumped over the cement barrier and kicked the weapons over the side of the bridge. Sergeant Bowen ran down the bridge and into the tall grassy area on the side of the bridge to look for the young male subject who fled. While walking through the grassy area next to the bridge, Sergeant Bowen observed several handguns lying in the grass near the bridge. Sergeant Bowen looked under the bridge, but did not see the young male. Sergeant Bowen then observed that the young male who had fled off the bridge had been detained and handcuffed by another NOPD officer, without incident. Sergeant Bowen mentioned he could see that officers were still chasing the other two male subjects on foot over the bridge when he observed one of the subjects being chased, later identified as Lance Madison, discard his weapon over the bridge into the Industrial Canal. Sergeant Bowen stated he ran back to the truck and began to drive it over the bridge. The subjects were observed running into the motel complex on the opposite side of the bridge. Sergeant Bowen assisted in setting up a perimeter on the east side of the apartment complex. Sergeant Bowen related he observed that the east side was heavily flooded and therefore ran back to the front of the complex. Once in front, Sergeant Bowen observed that one of the two subjects who had fled over the bridge was stationary just inside the apartment complex. This subject was arrested by State Police without incident. Sergeant Kaufman then met with Sergeant Robert Gisevius who gave the following verbal statement relevant to this incident: On the morning of September 4, 2005 Sergeant Robert Gisevius mentioned he was on proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. Sergeant Gisevius was monitoring the Seventh District Police radio channel when he heard a distress call come out. A female officer advised that two police were down (believing the officers were shot) under the Danzinger Bridge, near Chef Menteur Highway and Downman Road. Sergeant Gisevius stated he boarded a truck driven by Officer Michael Hunter and occupied by several other police officers. The truck proceeded to the area of the Danzinger Bridge, at which time officers exited the truck. As Sergeant Gisevius exited the rear of the truck on the drivers' side, he related he overheard several officers yelling and identifying themselves. The sergeant then heard several gunshots. Sergeant Gisevius then observed two black male subjects running west towards the top of the bridge. He stated the subject clad in all black turned, firing towards the officers. Sergeant Gisevius then gave chase after the two assailants and heard several additional gunshots come from the top of the bridge. Sergeant Gisevius stated he then overheard female officer relaying information as to the further direction of flight of the two black male subjects. As Sergeant Gisevius neared the top of the bridge, he heard one shot from what he believed to be a high powered rifle. The sergeant was unable to distinguish where the shot came from. He related the subjects were pursued down the west side of the Danzinger Bridge where they were engaged in front of 4861 Chef Menteur Highway. He stated assisting officers wounded one of the subjects in the driveway of the hotel. Sergeant Gisevius mentioned himself and responding units set up a perimeter around the hotel, in an effort to contain the second fleeing subject. Sergeant Kaufman then met with Officer Robert Faulcon who gave the following verbal statement relevant to this incident: On the morning of September 4, 2005, Officer Robert Faulcon stated he was on proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. Officer Faulcon was monitoring the Seventh District Police radio channel when he heard a distress call come out. A female officer advised that two police officers were down (shot) under the Danzinger Bridge near Chef Menteur Highway and Downman Road. Officer Faulcon boarded a truck driven by Officer MichaerHunter and occupied by several other police officers. The truck proceeded to the area of the Danzinger Bridge at which time officers exited the truck. Sergeant Gerard Dugue' Badge: 436 Unit:

22 e e NEW ORLEANS POLICE DEPARTMENT Upon exiting the truck, Officer Faulcon observed several subjects, both male and female, walking westbound up the Danzinger Bridge. Officer Faulcon noted that several of the subjects were in possession of handguns. As Officer Faulcon exited the truck, he announced his police presence. He mentioned several of the subjects then jumped over the concrete pedestrian barrier, while opening fire on the officers. Fearing for his safety, and fellow officers on the scene, Offic'er Faulcon stated he returned gunfire in an attempt to neutralize the threats. He further mentioned several assisting officers secured this scene as he, Officer Faulcon, and Sergeant Gisevius pursued another threat which was fleeing westbound over the Danzinger Bridge towards the Third District.. Officer Faulcon arrived at the bottom of the Danzinger Bridge and engaged another perpetrator at the entrance to the Friendly Inn. Officer Faulcon stated the male subject noticed the police presence and quickly turned towards the officer reaching for an object from his right waistband. Officer Faulcon felt this to be an imminent threat to his safety and the safety of his fellow officer. At this time he mentioned he opened fire to neutralize the threat. This subject was struck and fell to the ground in the driveway. of the Friendly Inn. Once this subject was secured, Officer Faulcon assisted in establishing a perimeter for the other wanted subj ect who fled to the rear of the motel parking lot. Sergeant Kaufman then met Officer Michael Hunter who gave the following verbal statement relevant to this incident: On the morning of September 4, 2005 Officer Michael Hunter, as mentioned by the other officers, related he was on proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. Officer HUnter mentioned him to be monitoring the Seventh District Police radio channel when he heard a distress call come out. A female officer advised that two police officers were down (shot) under the Danzinger Bridge near Chef Menteur Highway and Downman Road. Officer Hunter stated he entered a rental truck and drove several officers to the immediate area. He stated he drove the truck upon the Danzinger Bridge, at which time officers exited the truck. Officer Hunter related he exited the driver's door of the truck and observed two black males fleeing towards the top of the Danzinger Bridge heading in a westbound direction. Officer Hunter announced his presence and ordered the two males to stop. Officer Hunter stated he observed both males to be in possession of handguns. The first male he mentioned, clad in black shorts and a black shirt, turned to the officer and fired his weapon several times. The second male, also carrying a handgun, was clad in a light colored polo shirt and blue jean shorts, Sergeant Gerard Dugue' Badge: 436 Unit:

23 e e NEW ORLEANS POLICE DEPARTMENT Once fired upon, Officer Hunter stated he returned fire in an attempt to neutralize the threat. Officer Hunter fired his duty issued 'Glock', Model 22,.40 caliber (NOPD serial # NOI396PD) discharging three rounds. Officer Hunter further mentioned he lost sight of the fleeing males and remained on the initial scene to assist Sergeant Bowen. Sergeant Kaufman then met with Officer Ignatius Hills who gave the following" verbal statement, relevant to this incident: On the morning of September 4, 2005, Officer Ignatius Hills basically corroborated he was on proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. Officer Hunter related he also heard a distress call come out. He stated the female officer advised that two police were down (shot) under the Danzinger Bridge near Chef Menteur Highway and Downman Road. Officer Hills stated he entered the rear of a rental truck with several officers and was driven to the immediate area. He mentioned the truck proceeded to the area of the Danzinger Bridge, at which time officers exited the rear of the truck. Officer Hills stated he began to exit the rear of the truck and heard numerous shots being fired in the direction of the truck. Officer Hills observed a black male, clad in a t-shirt and shorts, fleeing eastbound down ~e westbound lanes of the Danzinger Bridge. Officer Hills mentioned he ordered the male to stop several times but he continued to run in an attempt to make good his escape. Officer Hills stated he engaged in a foot pursuit which continued down the bridge then heading westbound under the bridge. Officer Hills related he observed the black male being apprehended by an assisting outside agency officer. Officer Hills stated he then returned to the initial scene and assisted in securing the perimeter. " Sergeant Kaufman then met with Offi~er Anthony ViIlavaso who gave the following verbal statement relevant to this incident: On the morning of September 4, 2005 Officer Anthony Villavaso related he was also on proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. He mentioned he overheard over the Seventh District Police radio channel a distress call come out. He mentioned he heard a female officer state that "two police officers were down (shot) under the Danzinger Bridge near Chef Menteur Highway and Downman Road. Officer Villavaso stated h~ entered the rear of a rental truck with several officers and was driven to the immediate area of the Danzinger Bridge. Upon arrival, he mentioned he and the other officers exited the rear of the truck. Officer Villavaso related he followed Officer Faulcon out the truck and observed several subjects near the pedestrian barrier of the bridge, in possession of handguns. As Officer Villavaso exited the truck, he announced his police presence. He' stated several of Sergeant Gerard Dugue' Badge: 436 Unit:

Fearing for his safety and fellow officers on the scene, Officer Villavaso related he returned gunfire in an attempt to neutralize the threats. Once the threat was neutralized, Officer Villavaso stated he followed Sergeant, Gisevius and Officer Faulcon over the bridge towards the Friendly Inn. Officer Villavaso stated he took into custody a male subject who was later released. Officers were unable to find this subj ect in possession of any weapons or positively identify him as being involved. At this time, Officer Villavaso mentioned he remained with this subject while the incident unfolded at the Friendly Inn. Sergeant Kaufman then met with Officer Robert Barrios who gave the following verbal statement relevant to this incident: On the moming of September 4, 2005, Officer Robert Barrios also related he was assigned to conducting proactive patrol in the Seventh District in an attempt to keep peace and prevent looting. Officer Hunter stated he was monitoring the Seventh District Police radio channel when he heard a distress call come out. The female officer advised that two police were down (shot) under the Danzinger Bridge near ChefMenteur Highway and Downman Road. Officer Barrios related he also entered the rear of a rental truck with other officers and was driven to the immediate area of the Danzinger Bridge. He stated the officers exited the rear of the truck, upon arrival on the bridge. Officer Barrios related he exited the rear of the truck and observed several of the subjects located near the pedestrian barrier in possession of handguns. He mentioned Officers began announcing their presence. He stated the subj ects began jumping over the concrete pedestrian barrier and they opened fire on the responding officers. Fearing for his safety and safety of other officers, Officer Barrios related he opened fire, in an attempt to neutralize the threat. Officer Barrios stated he then proceeded towards the top of the bridge to assist Sergeant Gisevius and Officer Faulcon. Once at the bottom of the Danzinger Bridge, Officer Barrios mentioned he assisted Officer Villavaso in securing a male subject who remains unidentified. Officer Barrios stated he remained with Officer Villavaso while they secured the male. Learning that no technical support was available, Sergeant Kaufman stated he returned to the scene on Monday, September 5, Sergeant Kaufman mentioned he canvassed under the Danzinger Bridge and located the lone-handgun noted in the evidence section on page 12 of this report. The weapon was described as a blue steel Colt, Trooper, Mark III revolver, with the cylinder in the open position and void of any shell casings. The scene was contaminated with debris from the storm. 25 e e NEW ORLEANS POLICE DEPARTMENT Kaufinan mentioned no blood samples, photographs, or measurements were taken, as well as the fact that no casings were located. He related he seized the weapon and secured it to be placed on the evidence books at a later date. On Thursday, September 8, 2005, Sergeant Arthur Kaufinan and Detective Jeffrey Lehrmann went to West Jefferson Hospital's Intensive Care Unit and Critical Care Urnt, where they spoke with medical staff personnel. Sergeant Kaufinan related they were advised that all of the wounded subjects were listed in critical condition except Leonard Bartholomew Sr., who was listed in stable condition. The investigators were able to speak with Leonard Bartholomew, Sr., who related the following: Mr. Leonard Bartholomew Sr. stated he and his family was walking to the Winn Dixie Supermarket located on Chef Menteur Highway, on the Third Police District side of the Danzinger Bridge, when his nephew started shooting at military vehicles that pulled up behind them. He stated he did not remember anything after that. The investigators then were able to speak with Susan Bartholomew, who related the following: Mrs. Susan Bartholomew stated she was with her family on the Danzinger Bridge when her nephew, whom she identified as Jose Holmes, and some of his friends started shooting. She stated she did not know who they were shooting at. Susan Bartholomew stated she was then shot from what she thought was a military helicopter. She indicated she remembered nothing beyond that.. Sergeant Kaufman mentioned the remaining two subjects, Liesha Bartholomew and Jose Holmes, could not be interviewed due to their medical conditions. Sergeant Kaufinan added he had planned to interview them, whenever possible, at a later date. Sergeant Kaufinan and Detective Lehrmann returned to West Jefferson Medical Center Hospital on the morning of Thursday, September 22, Sergeant Kaufman and Detective Lehrmann learned from hospital personnel that Jose Holmes was still in intensive care and not expected to be released for several weeks. Hospital personnel advised that Leonard Bartholomew had been released a few days after arriving at the hospital. Sergeant Kaufman and Detective Lehrmann proceeded to the eighth floor of the hospital and met with Susan Bartholomew and Liesha Bartholomew. Sergeant Gerard Dugue' Badge: 436 Unit:
