Situation. The purchase of items by individuals from U.S. Forces resale activities for the purpose of resale, the production of income, trade, barter, transfer, delivery, pawning, or otherwise disposing of items which have been exempt from customs duties under Article XI of reference (a), or were purchased from U.S. Forces resale activities, is prohibited except as authorized by reference (b). This order is punitive in nature in that a violation pertaining to the sale or transfer of merchandise other than authorized herein may result in judicial action under the Uniform Code of Military Justice for military personnel in addition to other administrative actions including administrative suspension of privileges and potentially debarment. 2. Concept of Operations (1) Reference (a) provides, in part, that tax free items imported into Japan and sold by authorized outlets can be sold only to persons possessing exchange privileges per current regulations of the Armed Forces. Reference (b) provides guidance and limitations on when and what items that are owned by U.S. Forces authorized personnel, to include U.S. official contractors, can be transferred to residents of Japan in exchange for money, or by gift, donation, or other disposition. References (c) and (d) establish and implement policy on control of merchandise sold by activities under U. S. Forces, Japan. (2) This Command's policy is to restrict the sale of all items offered by any U. S. Forces, Japan, appropriated or non-appropriated fund resale activity to authorized patrons only. References (a) and (b) identify those persons authorized to make purchases at appropriated or non-appropriated fund resale activities. Personnel purchasing controlled/restricted items from these facilities agree to allow inspections or continued future accountability actions by Criminal Investigation Division (CID) representatives. 2

3 (3) All items sold by Department of Defense (000) retail activities on U. S. Forces, Japan facilities are generally controlled; however, the following commodities are found to be in high demand on the local black-market and will be subject to greater scrutiny. The below limits apply to purchases made by individuals at 000 retail activities and exceeding the below purchase limits constitutes a violation of this order: (a) Alcoholic Beverages. This term includes all beverages containing alcohol excluding beer and wine. The maximum amount of alcoholic beverages that can be purchased is one gallon daily per purchase and no more than 4 gallons per month. (b) Wine. For the purpose of this order, wine is considered a separate category. The maximum amount of wine allowable to be purchased is 1 case or 12 bottles daily and no more than 2 cases or 24 bottles per month. This limitation is waived during special events featuring wine tasting and sales_ (c) Beer. For the purpose of this order, beer is a separate category. The maximum amount of beer that can be purchased is 3 cases daily and no more than 16 cases per month. A case is defined as twentyfour 12 ounce cans or bottles or any combination of different sized vessels containing 288 fluid ounces. (Okinawa only). will be 3 (d) Cigarettes. Limitation on the purchase of cigarettes cartons per week and no more than 16 cartons per month. (e) Petroleum products, including gasoline, kerosene, oil and other lubricants will not be dispensed into a motor vehicle which does not display the United States Forces Japan Form 15 (Road Tax Sticker) with exception of vehicles displaying United States Consulate license plates, and automobiles bearing temporary Japanese registrations plates for which the purchaser is an authorized exchange patron and possesses proof of ownership (temporary registration) of the vehicle. This does not prohibit the purchase of such petroleum products for rental vehicles by United States Forces authorized personnel, and United States official contractors and their employees, subject to the presentation of a valid rental agreement by such individuals at the time of purchase. Retired military personnel possessing kanji registration plates on their vehicles must display the Armed Forces Retired Sticker on their vehicle and their Armed Forces Identification Card at the time of purchase. (f) No person subject to this regulation will sell, exchange, barter, use as a gift, or otherwise dispose of any gasoline or petroleum product to persons other than United States Forces authorized personnel and United States official contractors and their employees. The Commander, Marine Corps Bases Japan has been authorized to establish more stringent control limitations than the maximum purchase limits established by higher headquarters. 3

4 (g) Gasoline will only be dispensed into the gas tank of an authorized vehicle or into an approved container for dispensing into authorized vehicles or lawn equipment. (4) Bona Fide Gifts: Per reference (b), nothing in this order is intended to prohibit the extension of normal social courtesies as permitted by law or to prohibit the giving of bona fide gifts of nominal value commensurate with the established practice prevailing in Japan. "Bona fide gift" means a thing of value that is transferred to another without actual or anticipated compensation or special favors. "Nominal value" means not having a value greater than $ dollars. b. Subordinate Element Tasks (1) Commanding Officers. Commanding Officers are directed to inquire into each case of a suspected violation of this order by military members under their cognizance and are directed to take appropriate administrative and/or disciplinary actions as required. Cases of suspected violations of this order by civilians should be forwarded to the Command Inspector General, Marine Corps Bases Japan (MCBJ CIG) for appropriate administrative action per reference (g). (2) Retail AAFES/MCCS Employee(s) (a) When patrons purchase controlled items in the quantities detailed above, or over the set control limits, employees are prohibited from selling those controlled items without ensuring proper sales forms have been completed. A Letter of Authorization, enclosure (2) must be presented to sales outlets when authorized personnel purchase alcoholic beverages, beer and/or wine in quantities exceeding the above limitations. The sales clerk is required to complete an over purchase slip, enclosure (3), and have it certified by the purchaser. Letters of authorization will be obtained from Battalion/Squadron Commander or higher for service members. In the case of civilians, the letter of authorization will be obtained from the Camp Commander of the Camp where the purchase is to be made. (b) At no time will an individual, or family member of this individual, patronize more than one sales outlet during a 24-hour period for the purpose of evading the limits set out above. This system of avoidance is hereinafter referred to as "Circumvention." Furthermore, prior to a purchase, it is the responsibility of the patron to inform the sales clerk that they have exceeded the set limitations within a 24-hour period. (c) AAFES employees will report all suspicious behavior such as patrons who purchase amounts of alcohol in the limitations set out 'above more than biweekly to the AAFES Retail Store Manager. Once notified, the AAFES Retail Store Manager will report these types of sales and the specific instances to the Safety and Security Manager, AAFES, Okinawa, Japan. 4

5 (d) AAFES/MCCS Employees shall not make sales of items to persons whose purchase privileges have been suspended. It is the responsibility of employees to ensure the required identification cards reflect the individual's privileges are not suspended. (e) All AAFES/MCCS outlets located on MCB, Camp Smedley D. Butler will retain copies of enclosures el} through (3) at their respective facilities for one year and furnish them to the PMO upon request. (3) PMO (a) The Provost Marshal, MCB, Camp Smedley D. Butler is designated the responsible investigating agency for monitoring all purchase records of controlled items. The CID will be the point of contact for incidents occurring on property under Marine Corps Bases Japan. (b) The Provost Marshal will enforce the provision of this order, including but not limited to; apprehension/detention of violators, impounding of instrumentalities of a violation (e.g., vehicles used during commission of a violation), and seizure of the ~fruits" of a violation. (c) If a vehicle was utilized in the commission of a violation of this order, the vehicle will be seized and processed per reference (e). The driver will be issued a traffic citation per the provisions contained in reference (f). Additionally, the operator's SOFA driver's license will be seized and he/she will be issued a Temporary Suspension of Driving privileges Form, enclosure (8). Suspension of driving privileges will remain in effect until a completed investigation is submitted to MCBJ Traffic Court and a Traffic Court Officer makes an appropriate determination concerning the suspected violation. (4) MCBJ eig. The Marine Corps Bases Japan, Command Inspector General, is directed to inquire into each case of suspected violations of this order by family members, military widows/widowers, retirees, and DoD civilians, to conduct hearings and to impose authorized administrative actions as appropriate. 6. Administration and Logistics a. Notification To Suspend Privileges. When a commander or the MCBJ CIG receives an investigation involving a violation of this order, a Notice of Intent to Suspend Privileges letter (enclosure (4)) will be delivered to the individual concerned. In the case of the MCBJ CIG, telephonic notification of intent to suspend privileges is acceptable. When the Notice of Intent to Suspend Privileges letter is delivered to suspected offenders, the individual(s} will be required to acknowledge receipt by signing a return endorsement. A signed copy of the endorsement shall be retained by the Command and will be filed with the 5

6 MCBJO records of the case. A copy of the report of the alleged abuse, containing releasable documentary evidence of the alleged abuse, shall be an enclosure to the correspondence to ensure that the alleged abuser is properly put on notice of the nature and extent of the alleged abuse. b. Hearing. All hearings where the suspected offender is a service member will be conducted in accordance with reference (h) and all other hearings will be conducted in accordance with reference (i). c. Suspension of Privileges (1) When to Suspend. When no hearing is held due to the subject waiving their hearing or failure to appear at the designated hearing time without having requested a delay or where the recommendation pursuant to a hearing per paragraph llb of this order is to suspend privileges, privileges may be suspended. The Investigating Officer or designated representative will prepare a report detailing the results of his/her inquiry and recommendation for or against suspension of purchase privileges, utilizing enclosure (5) as an example. (2) Who Can Suspend. Only Commanding Officers, in the case of active duty military personnel, or the MCBJ Command Inspector General, in the case of all other persons subject to this order, may suspend purchase privileges. Suspension in excess of 90 days can only be ordered by Officers in'the grade of Major and above. Suspensions in excess of one year require the concurrence of the cognizant Commanding General and shall be reviewed by the Commanding General on the first working day following the 365th day of suspension. (3) Barment. Flagrant or repeated abusers may be debarred from U. s. Marine Corps installations in addition to any other remedies. In accordance with reference (il, a debarment order initiated by any component commander in Japan is valid at all U.s. military installations and areas in Japan. (4) Notification. Once it has been determined that an individual's privileges are to be suspended, the individual will be notified using a format similar to enclosure (6l. (5) Expiration of Suspension. The period of suspension shall be fixed at the time of suspension. If suspension is deemed appropriate, it should not normally be for less than 60 days nor more than 365 days. (6) Appeal. In addition to the procedures for appealing decisions of the MCBJ Command Inspector General, and the Request Mast process, all persons whose purchasing privileges are ordered suspended have the right to submit a written appeal within ten calendar days of the issuance of the order of suspension. The appeal shall be submitted in writing to the Commanding General of the unit directing the suspension. (7) Travel. When an individual's purchase privileges have been suspended or revoked, no special provisions will be made to reinstate 6

7 those privileges if he or she is traveling to an area outside of Okinawa Prefecture, Japan on Permanent Change of Station (PCS) orders, leave, Temporary Additional Duty or deployment. However, in the case of PCS orders or similar circumstances whereby the individual will not be returning in the near future, the individual may appeal to the cognizant Commanding Officer at the new location for issuance of a new, unrestricted ID card. 7. Command and Signal a. Command. The provisions of this order apply to all U. S. Marine and U. S. Navy personnel assigned to Marine Corps activities to include Marine Corps Air Station (MCAS)Iwakuni and Camp Fuji, DoD contractors and civilians, and their family members in Okinawa Prefecture, Japan with the exception of those Marines and Navy personnel of units assigned, attached or tenant to Command Fleet Activities or other Naval Activities permanently assigned to the Okinawa Prefecture, Japan. Additionally, this order applies to all DoD contractors and personnel and their family members, military widows/widowers, and retirees, making purchases from facilities located aboard U. S. Marine Corps or U. S. Navy installations. The purchase of tax/duty free imported goods from the aforementioned facilities constitutes agreement for later inspection and continued accountability by CID representatives if illegal transfer or wrongdoing is suspected. b.
