3 1 Introduction 1.1 Statement of Intent Aim and Rationale Dorset Police together, will work together to establish a clear procedure for the implementation of the care of persons found in a public place that may be living with Dementia. This procedure will support the principles of the Crisis Care Concordat by effective partnership working to support those individuals who may be suffering a crisis due to their condition. This document contains the local multi-agency procedural guidelines and has been prepared and agreed by staff from the agencies above. This document relates to a local agreement regarding the care of persons found in a public place that may be living with a Dementia type illness. 1.2 Our Visions and Values Dorset Police is committed to the principles of One Team, One Vision A Safer Dorset for You Our strategic priority is to achieve two clear objectives: To make Dorset safer To make Dorset feel safer In doing this we will act in accordance with our values of: Integrity Professionalism Fairness and Respect National Decision Model The National Decision Model (NDM) is the primary decision-making model used in Dorset Police. The NDM is inherently flexible and is applied to the development and review of all policy, procedure, strategy, project, plan or guidance. Understanding, using and measuring the NDM ensures that we are able to make ethical (see Code of Ethics), proportionate and defensible decisions in relation to policy, procedure, strategy, project, plan or guidance. 4 Code of Ethics The Code of Ethics underpins every day policy, procedures, decision and action in policing today. The Code of Ethics is an everyday business consideration. This document has been developed with the Code of Ethics at the heart ensuring consideration of the 9 Policing principles and the 10 standards of professional behaviour. Monitoring is carried out through the Equality Impact Assessment process which has been designed to specifically include the Code of Ethics. 1.3 People, Confidence and Equality This document seeks to achieve the priority to make Dorset feel safer by securing trust and confidence. Research identifies that this is achieved through delivering services which: 1. Address individual needs and expectations 2. Improve perceptions of order and community cohesion 3. Focus on community priorities 4. Demonstrate professionalism 5. Express Force values 6. Instil confidence in staff This document also recognises that some people will be part of many communities defined by different characteristics. It is probable that all people share common needs and expectations whilst at the same time everyone is different. Comprehensive consultation and surveying has identified a common need and expectation for communities in Dorset to be:- - Listened to - Kept informed - Protected, and - Supported. 2 Standards 2.1 Legal Basis As an organisation we have a duty of care to safeguard members of our community from harm. This procedure focuses on such persons that appear to be confused having been found in a public place and may appear to lack mental capacity. Under the Mental Health Act and the Mental Capacity Act the police have a legal duty to safeguard such persons. Dementia Safe Havens Procedure P09:2015V1.0 4

5 2.2 People, Confidence and Equality Impact Assessment During the creation of this document, this business area is subject to an assessment process entitled People, Confidence and Equality Impact Assessment (EIA). 6 3 Procedure 3.1 Aims of the Joint Policy To ensure that: a) A person located with a Dementia type illness receives the attention and the most appropriate form of care they need while respecting their rights as an individual; b) Attention and care are provided in the most appropriate place and by the people best qualified to provide it; b) The attention and care is provided as soon as possible with the minimum of disruption and stress to the person concerned. 3.2 Definition of a Dementia type illness The definition for the purpose of this document is a confused person who may be displaying symptoms including memory loss, confusion, mood changes and difficulty with day-to-day tasks General Procedural Guidelines Within the Dorset area, the meaning (i.e. the preferred first choice) of 'place of safety' under the Act will be as follows: The Person s normal place of residence, relative or known medical practitioner Outside of business hours and/or if the above cannot be easily ascertained the place of safety (Safe Haven) temporarily used in support of this policy. When a police officer/pcso locates a person living with a Dementia type illness, the person concerned should be conveyed to the relevant place of safety. The FCR will hold a list of those premises that have joined this policy Transporting to a place of safety Police officers/pcsos will transport the person to the place of safety in the most appropriate vehicle depending on the individual s needs and risk assessment, except where the found person requires medical assessment at an Accident and Emergency Department, in which case an ambulance will be requested Persons the place of safety cannot accept: The place of safety will not accept persons that are suffering from a mental health illness and are in need of detention under Section 136 Mental Health Act. The place of safety will not accept anyone who is drunk or under the influence of illegal drugs or violent including the offering of violence. The place of safety is the final arbiter regarding the decision whether to accept a person or not. There will be a maximum time limit of 2 hours a person will be able to stay at the safe haven, unless both Police and Staff agree to vary this. Any Dementia Safe Havens Procedure P09:2015V1.0 6

7 significant extension beyond this include a discussion with the relevant Social Service. Any dispute that cannot be resolved please refer to the escalation process Other guidelines Refer to force procedure regarding any property seized from the person during any searches. Legally held property should be documented in PNB and retained by staff. The PC or PCSO should remain with the found person until after the completion of the handover procedure and both place of safety staff and Police agree it is safe to do so The escorting officer will complete and submit prior to the conclusion of their duty a SCARF as per current guidelines and submit to the Safeguarding Referral Unit. Existing Multi Agency Safeguarding and information sharing processes will be utilised to support this policy. 10 APPENDIX A - Guidance notes for the Handover This form is intended to assist both Police and staff in the formal process of handing over the found person. The form is to be completed jointly by the police officers accompanying the person to the place of safety and the on duty staff who the person is handed over to. I.D. confirmed and source To establish that we have the correct details for the person and by what method these were confirmed. This could be by documents found on the person. Details Unknown unknown risk Place found be as precise as possible i.e. on pavement, outside 143 Station Road, Verwood. Circumstances Provide as much information as possible. What was said by the person, any self-harming, behaviour of person at time of being located, whether person wishes to be at the doctors etc. Person searched? Result of search to be noted. Physical condition of person include injuries / cuts, any indications of drink / drugs.
