3 Dear Personal Service Setting Operator, This package provides you with resources and information regarding the Region of Peel by-law that regulates personal service settings and permits disclosure of health inspection information to the public (Region of Peel By-law ). Personal Service Settings (PSS) include businesses like yours that are regularly inspected by the Public Health department. These businesses offer services such as tattooing, ear and body piercing, manicures, pedicures, facials, hairdressing, barbering and other aesthetic services. Personal service settings have been associated with the transmission of blood-borne infections such as hepatitis B and C, as well as other disease-causing bacteria such as Mycobacterium spp and Staphylococcus. Operators in the Region of Peel (Mississauga, Brampton, and Caledon) are required to post an inspection summary sign. The sign includes the results of the last health inspection and must be placed at the entrance to their business. Failure to do so may result in a fine. Fines may also be given to operators who fail to attain compliance during inspections. The public is also able to access inspection information online. The information in this booklet will provide further details about requirements and expectations. Peel public health inspectors will work with you to address any questions you may have about the program. Your cooperation in complying with the by-law is appreciated. 4 Personal Service Settings (PSS) Performance Disclosure Program Personal Service Settings (PSS), regularly inspected by the Public Health department, are businesses where tattooing, ear and body piercing, manicures, pedicures, facials, hairdressing, barbering and other aesthetic services are provided. Personal service settings have been associated with the transmission of blood-borne infections such as hepatitis B and C, as well as other disease-causing bacteria such as Mycobacterium spp and Staphylococcus. What is the PSS Performance Disclosure Program? The PSS Performance Disclosure program provides the public with an opportunity to make an informed decision when choosing a personal service setting. 96% of Peel residents surveyed said that knowing the inspection results would be an important factor in their decision making when choosing a personal service business. The program is based on the Regional Municipality of Peel Personal Service Settings By-law The by-law requires operators to post inspection signs and adhere to operational standards. Inspection results are also available online. When did the new by-law come into effect? The by-law has been in effect since January 1, Why is it important to comply? To prevent the spread of infections to customers/workers Customers will be looking for a green, PASS, inspection sign To maintain a good reputation and avoid loss of business To avoid charges and fines for violations Personal Service Setting Inspections The Ministry of Health and Long-Term Care requires local health units to conduct regular infection prevention and control compliance inspections for personal service settings. Additional inspections will be conducted to investigate complaints or as needed. Peel Public Health inspectors do not make appointments for inspections. Peel Public Health inspectors carry photo identification and business cards. If you are approached by an individual claiming to be a public health inspector, we encourage 2

5 you to ask for proper identification if you are not familiar with the inspector. A written inspection report outlines any infractions that need to be corrected and the time frame to correct these infractions. A Peel Health Inspection Summary Sign will be provided by your public health inspector and must be posted immediately. The number of inspections each year may vary and depends on the risk level of a personal service setting. Inspections are conducted a minimum of once per year. Additional inspections will be conducted to investigate complaints or as needed. What will happen during my inspection? There will be a change in the way inspections are conducted as you will now receive a Peel Health Inspection Summary sign. The colour of the sign depends on the total points of the inspection. What do the points mean? Numerical point values of 3, 5 or 15 points are associated with infractions on the inspection report. Critical infractions are valued at 15 points. An example of a critical infraction is inadequately sterilizing equipment that breaks the skin. Critical infractions are likely to transmit infections and directly affect the safety of the public. Semi-critical infractions are worth 5 points. An example is reusing single-use equipment on multiple clients. Infractions that are least likely to transmit infections are worth 3 points. An example is poorly maintaining work surfaces. As an operator, what is my responsibility under the by-law? Operators must post the Peel Health Inspection Summary sign issued by Peel Public Health in a conspicuous place, clearly visible to members of the public, at or near the main public entrance of the business or the location where the personal service is performed. If the Peel Health Inspection Summary sign is lost, missing or damaged, it is the responsibility of the operator to notify Peel Public Health. Operators also need to follow operational standards to ensure that they are in compliance with the PSS Regional by-law and the Infection Prevention and Control Best Practices for Personal Service Setting guidelines published by the Ministry of Health and Long-Term Care. Do I have to post the Peel Health Inspection Summary sign? Yes. Once a sign is issued, posting the sign is a requirement under the by-law and it must remain posted. 3

6 What happens if an operator does not comply with the requirements of the by-law? Public health inspectors can issue tickets or orders for non-compliance under the by-law. What type of legal action can be expected? Infractions, especially those seen frequently or observed from one inspection to the next, may result in a Provincial Offences Notice (ticket). Legal action can be taken even when a green, PASS and/or yellow CONDITIONAL PASS inspection summary sign is issued. When conditions are deemed an immediate health hazard, an order under the Health Protection and Promotion Act and a red, SERVICE(S) CLOSED inspection summary sign is issued. Operators who do not follow a closure order may be charged and summoned to appear in court. If the court finds the defendant guilty, an individual operator may be fined up to $5,000, and a corporation up to $25,000, for each day or part of a day on which the offence occurred. Do I need a license to operate my business? Yes. Every PSS business operating in the City of Mississauga and the City of Brampton is required to obtain a PSS license. For the Town of Caledon, a PSS license is required for specific services only. Licensing is a municipal responsibility and is not provided by Peel Public Health; however approval from Peel Public Health is required in the application for a license. See Appendix A for further information on obtaining a municipal license. Will inspection results be available to the public? Inspection results for personal service settings will be accessible to the public through signage at the business and online. The green, PASS inspection summary sign means that the PSS business is in substantial compliance with both the Regional PSS by-law and the Infection Prevention and Control Best Practices for Personal Service Settings. There may still be non-critical infractions associated with the service. Will the business be re-inspected? In most cases, infractions observed during an inspection that results in a green sign are followed up during the next regular inspection. Re-inspections can take place at the discretion of the public health inspector. The yellow, CONDITIONAL PASS, inspection summary sign means that the PSS business is in significant non-compliance with the Region of Peel Personal Service Settings By-law and the Infection Prevention and Control Best Practices for Personal Services Settings. Infractions that pose a health risk must be corrected. Will the premises be re-inspected? Yes. If a PSS business receives a yellow, CONDITIONAL PASS inspection summary sign, it will be inspected again. The operator must keep the yellow sign posted until the public health inspector completes a follow-up inspection. Based on the findings from the follow-up inspection, the public health inspector will issue a new appropriate sign for the business. If the infractions have been corrected, a green, PASS, inspection summary sign can be issued. However, if the infractions are not corrected, another yellow sign will be issued and must remain in place until the next scheduled inspection. Continued non-compliance may result in legal action. 5

The red, SERVICE(S) CLOSED, inspection summary sign means that a health hazard/risk was found by a public health inspector for one or more services and that the service(s) specified must remain closed until the public health inspector determines the risk(s) is removed. A public health inspector will issue an order to close the service(s) under the Health Protection and Promotion Act. What happens after a personal service business posts a SERVICE(S) CLOSED sign? If a business is issued a red sign, the operator must do the following: Stop providing specified service(s) immediately Post the Peel Public Health red, SERVICE(S) CLOSED, inspection summary sign in accordance with By-law Remove and/or correct the conditions listed on the inspection report and the closure order to remove the health risk(s) Contact the public health inspector for a follow-up inspection when the conditions have been removed and/ or corrected. A follow-up inspection by a public health inspector must be conducted prior to providing the service(s). Will the premises be re-inspected? Yes. The operator is responsible for ensuring the service(s) remain closed and that the red sign is posted. The red sign will be removed and replaced with a new sign if the followup inspection demonstrates that the service(s) are free of health risks. 6

9 Nail kits Nail files, buffer blocks, pumice stones/blocks, toe separators, and similar items are for one time use only. These items must be discarded immediately after their first use. Storing of client nail kits is not permitted. Do not use any single use device provided by the client. Questions?
