EXHIBIT "D" 2:00 SCOPE OF WORK SJMC warrants compliance of all applicable laws and regulations regarding the use of pesticides and container disposal; that all power equipment used to apply chemicals shall be certified by the Louisiana Department ofagriculture and Forestry (LDA&F) and that it will maintain a full time staff inember working within the Parish certified in category 8d by the LDA&F. Furthermore, the mosquito abatement program offered by SJMC is an integrated pest management approach as described in the official LMCA training manual (Third Edition 1993) as well as inspection and surveillance to determine specific need and extent of control measures to be applied. SJMC will provide mosquito abatement services outlined in this proposal to the geographic region of St. John the Baptist Parish excluding the communities of Manchac and Pleasure Bend INSPECTION & SURVEILLANCE The purpose of inspection and surveillance in a mosquito control program is to define the problem in terms of type, extent, and location. Since the problem is biological, it is
10 I r L dynamic, and requires an almost constant input and analysis of data. This information gathering effort is directed to both mosquito larvae and adults, but while the techniques and objectives employed in tracking these life forms differ considerably, SJMC has the professional and technical expertise to perform these duties. a) LARVAL MOSQUITO INSPECTION The object of inspecting for larval mosquitoes is to continue our work of locating and mapping active breeding sites. The long range goal of this program phase, the actual locating and recording of a11 major breeding sites in the Parish, is an ongoing process. This information makes it possible to quickly return to these sites following a rainfall event and effect control across a Iarge area. It is, quite simply, a technique that makes the overall program more effective and more efficient. The data obtained by inspections will be recorded to show larvae density as specified in Section 2.01 (a); representative samples from each breeding site will be collected ana identified to genus; fourth instar larvae will be identified to species if practical. The resulting data will be used in determining larvicide and adulticide needs as well as in evaluation of said treatments. Said data will be recorded and maintained on Larva Survey Report (attached). RAINFALL DATA Since rainfall is a major factor in hatching floodwater mosquito eggs, data on rainfall events are very important. This information, used to guide Inspectors to mosquito breeding areas most likely to be flooded, will be collected three (3) times each week during the mosquito season from fourteen (14) rain gauges located in representative sites throughout the Parish. 6
11 e c) ENCEPHALITIS SURVEILLANCE In addition to the above surveillance, SJMC agrees to conduct Expanded Encephalitis Surveillance Protocol as per Eibit E upon authorization of the Parish President CHEMICAL CONTROL Chemicals used in the performance of the proposed contract will be limited to those approved for the control of mosquitoes by the Federal Environmenta.l Protection Agency. Applications will be made in accordance with label directions, as will the handling and disposal of empty pesticide containers. a) ADULT MOSQUITO CONTROL Control measures directed against adult mosquitoes will include spraying by both ground based equipment and aircraft. A dual level approach is considered essential, because of problems presented by residential expansion into prolific mosquito breeding areas. GROUND SPRAY OPERATIONS The primary means of applying chemicals from ground level to control adult mosquitoes will be via vehicle mounted ultra low volume (LJLV) sprayers. A minimum of four (4) vehicles outfitted with ULV sprayers equipped with flow control systems that use radar operated or GPS ground speed sensors to adjust the chemical flow rate to the vehicle speed with three pre-programmed rates.
12 r Additionally, each spray vehicle will be equipped with a map and tracking system to report time, location, speed and vehicle direction, as well as indicating when the sprayer was actively spraying and when it was not spraying. These vehicles will be outfitted also with a communication system to contact the Night Supervisor and/or Program Manager. These vehicles will be marked for identification as specified by contract documents. During the mosquito season, ULV truck mounted sprayers will be checked before each use for correct chemical application rate, and recalibrated if necessary. Also, a Droplet Spectrum Analysis will be performed routinely during the mosquito season to monitor droplet size generation. The analysis will be performed by an Ames DC-III unit, a computer driven device developed by the U.S. Army to rapidly and accurately calculate droplet spectrums. This testing is vital in maintaining the spray droplet size within federal chemical label specifications which, in turn, produces optimum control resuits. The exact acreage to be sprayed from the ground for control of adult mosquitoes must be determined by the extent and duration of the problem encountered, and the necessity to reduce their population to an acceptable level, however, we shall spray a maximum of two hundred fifty thousand (250,000) acres/6, 500 miles of roadway each calendar year during the term of this agreement. The pesticides used will be limited to those approved by Federal Environmental Protection Agency (EPA) and will be applied in accordance with label directions. In addition to vehicle mounted sprayers, hand-held thermal and/or non-thernnal sprayers will be employed when practical. AERIAL SPRAY OPERATIONS As previously explained, the use of aircraft to apply insecticide is important to St. John Parish. The aircraft provides ability to apply control pressure across a large area in a 9
13 minimal effort by residents simply emptying standing water from flower pots, boats, rain gutters, trash, etc. This is particularly true in the control of the Southern House Mosquito Culex quinquefasciatus), an important disease vector and the Asian Tiger Mosquito Aedes albopictus) which breeds readily in almost any water holding container. As a part of this proposal, we will establish a Public Education Program to alert residents of the importance of controlling mosquitoes around the home and explaining what measures they can take to help in this effort. This will be done by producing public information releases in the form of literature distribution, appearances on commercial and government television and radio broadcasts and the contracted use of commercial radio. One of the literature tools to be used is the brochure, "Tracking Down Your Mosquito Problems." This brochure was developed specifically to combat mosquitoes breeding in domestic environments; it graphically demonstrates problem areas around the home, and offers suggestions for their solution. A sample of the brochure is attached OPERATIONS 3.03 HOLIDAYS SJMC will observe the Parish holidays as noted in contract specifications COMPLAINTS SJMC will take whatever steps that are reasonable necessary to remedy the cause of a complaint and to notify the Parish of its disposition in the report given weekly to the Parish. 12
14 We will also provide the Parish with a full explanation of the disposition of any complaint involving a customer's claim of damage to private property as the alleged results of actions of our employee or agents PROGRAM EQUIPMENT SJMC will provide a minimum of four (4) vehicles for the application of larvicides and adulticides. All vehicles and other equipment will be kept in good repair, have a clean appearance and in sanitary condition acceptable to the Parish at all times. Each vehicle will be clearly identified as a mosquito control vehicle as per contract specifications and all power equipment will have a State certification number attached. a) GENERAL Prior to the starting date of the contract, we will submit an inventory of each truck to be used including truck type, type of equipment contained thereon and the unit number. In the event of equipment breakdown, it shall be repaired promptly. If repair cannot be completed promptly, sufficient equipment shall be obtained from other sources. Each spray vehicle will be equipped with a map and tracking system to report time, location, speed and direction of the vehicle as well as indicating when the sprayer was actively spraying and when it was not spraying. The Parish monitor will be given the night telephone numbers for SJMC through which the Night Supervisor and/or Program Manager may be reached if it is necessary and advisable to alter spray assignments. 13
15 b) CALIBRATION Each sprayer will be properly calibrated and checked for accuracy prior to each use. Droplet size will be determined on a routinely during the mosquito season by an Ames DC-III unit, a computer driven device developed by the U.S. Army to rapidly and accurately calculate droplet spectrums. When performed, proof of calibration and droplet size will be submitted to the monitor as part of the monthly report. The monitor will be allowed to make una.nnounced inspections on vehicles and take chemical samples for analysis OFFICE SJMC has already established, and will mainta.in its office and shop facility in St. John Parish on a year-round basis. The facility will be equipped with telephones and will have a responsible person in attendance from 8:00 a.m. to 4:30 p.m. on Monday through Friday, excluding holidays as defined herein Reporting SJMC will submit all reports in the manner required by the contract specifications RATES For Mosquito Control Services required to be performed pursuant to this contract, the charges for the first year shall be the lump sum rates as fixed by this contract. Annual compensation for the second and subsequent years of the 14
16 term shall be adjusted upward to reflect changes in the cost of doing business, as measured by fluctuations in the Consumer Price Index (CPI). Said adjustment shall be equal to the net percentage increase of the United States Consumer Price Index, United States City Average, as published by the United States Department of Labor, Bureau of Labor Statistics ("CPI") during the twelve (12) month period for which CPI data is available immediately preceding such date ADDITIONAL COMPENSATION Fees for additional compensation resulting from abatement efforts beyond the normal scope of this contract or encephalitis protocol activities are noted in the contract specification documents section 12.02, pages 18 & BREACH OF SERVICE In the event of non-performance by the contractor, St. John the Baptist Parish has the right to terminate this contract by providing contractor thirty (30) days written notice of its intent to cancel should contractor not remedy the default or cure the non-performance. LIMITATION OF LIABILITY The Parish recognizes that it is not possible for SJMC to warrant or guaranty that by utilizing the surveillance and/or the mosquito control services delineated herein for SJMC to eradicate any and/or all mosquitoes which may come within the Parish and/or which are bred within the Parish and which carry one or more virus, and/or other mosquito transmitted disease, including without limitation Eastern Equine Encephalitis, St. Louis Encephalitis, West Nile virus, dengue, malaria, yellow fever, which may be injurious to the health of one or more residents of the Parish and/or any persons temporarily within the Parish and/or any animal in the Parish. Accordingly, SJMC, and any of its employees andlor agents and/or members and/or insureds and/or contractors, shall not be responsible and/or liable to the Parish andlor any one acting through the Parish for any claims, and/or 15
17 a. r damages and/or liability and/or fines and/or penalties and/or causes of action arising out of andlor relating to andlor resulting from any and/or all viruses and/or sickness andlor illness which may be caused directly and/or indirectly and/or in conjunction with any other disease and/or virus and/or immune deficiency associated with any person which is attributable in any fashion from the results of one or more mosquito bites, whether the effect from such bites is immediate andlor results from the cumulative effect of mosquito bites obtained over time. 16
18 a 1 PROPOSAL SUMMARY SJMC agrees to abide by all the specifications described in Exhibits "A, B, C, D, E and F" of the 2007 Contract Documents & Specifications Mosquito Control Program for St. John Parish, Louisiana that are not in conflict with this proposal. SJMC shall provide the services described under this agreement for an annual fee of $687,500. subject to such adjustments as specified in this agreement. This amount shall be paid to SJMC in equal monthly installments of 66 $57,291. for the first Contract Year period. This proposal supersedes and replaces all other proposals and contracts.
