1 Wyandotte County Developmental Disabilities Organization ALL THE INFORMATION YOU NEED AND WANT Your Rights and Responsibilities There are a variety of community service providers available in Wyandotte County. You can get a list of those providers and the types of services that they provide from your case manager or by contacting WCDDO. You may receive services from any community service provider you choose. Your case manager can help you access the community service provider of your choice. If you would like to receive services from someone who is not a community service provider, WCDDO will work with that provider or their agency to become an affiliated provider. You have the right to select and receive case management services from any qualified affiliated provider or WCDDO. If you are receiving HCBS-MR funding, you will have to select a provider from the list of qualified affiliated providers. If you do not receive HCBS-MR funding or participate in a licensed service, you can select case management from the approved list. This service is covered by Medicaid or a fee for service option available. You have the right to receive services without discrimination as to the severity of your disability, unless the Secretary of SRS determines you present a danger to yourself or others. In this situation, you may be offered alternatives to community based services You have the right to receive services which are responsive to your personcentered plan. It should include opportunities of choice and ensure all rights are afforded to you. You have the right to receive services for which you are eligible as long as state and federal funding is available. You also have a right to transfer your state and federal funds to any affiliated community service provider in Kansas. 2 Consumer Rights and Responsibilities A provider shall at all times encourage and assist each person served to understand and exercise the person s individual rights and to assume the responsibilities that accompany these rights. Each person served shall be guaranteed the same rights afforded to individuals without disabilities. These rights may be limited only by provisions of law or court order, including guardianship, conservatorship, power of attorney or other judicial determination. These rights shall include the following: Being free from physical or psychological abuse or neglect, and from financial exploitation; Having control over the person s own financial resources; Being able to receive, purchase, have, and use the person s personal property; Actively and meaningfully making decisions affecting the person s life; Having privacy; Being able to associate and communicate publicly or privately with any person or group of people of the person s choice; Being able to practice the religion or faith of the person s choice; Being free from the inappropriate use of a physical or chemical restraint, medication, or isolation as punishment, for the convenience of a provider or agent, in conflict with a physician s orders or as a substitute for treatment, except when physical restraint is in furtherance of the health and safety of the person; Not being required to work without compensation, except when the person is living and being provided services outside of the home of a member of the person s family, and then only for the purpose of the upkeep of the person s own living space and of common living areas and grounds that the person shares with others; Being treated with dignity and respect; Receiving due process; and Having access to the person s own records, including information about how the person s funding is accessed and utilized, and what services were billed for on the person s behalf. A provider shall train each agent regarding these rights. In addition, a provider shall offer training at least annually regarding these rights and effective ways to exercise them to each person served, to the guardian if one has been appointed, and to the person s parent and other individuals from each person s support network. Self-Directed Supports I/DD Waiver Services These are an array of supports consisting of Financial Management Services, Personal Assistant Services, Overnight Respite Care, and Sleep Cycle Support that are available to individuals who reside with a person/persons who meet the definition of family or in a setting that would otherwise be licensed. These services provide necessary support for individuals in order to meet their daily living needs and/or to ensure continuation of stay in their current setting. These services also provide for paid staff to perform essential in -home assistance any hour of the day or night, in the absence or presence of non-paid care givers, as determined to meet the individual s needs. Family is defined as any person immediately related to the individual. Specifically: parents (including adoptive parent), grand-parents, spouses, aunts, uncles, sisters, brothers, first cousins and any step -family relationships. Personal Assistant Services allow the person to self-direct residential supports, day supports, or supports in their family home. These services provide necessary one-onone assistance both in the home and community. Personal Assistant Services includes assisting with Activities of daily living such as bathing, grooming, toileting, transferring, health maintenance activities, feeding, mobility and exercises. This also includes independent activities of daily living such as shopping, house cleaning, seasonal chores, meal preparation, laundry & financial management. Also included are socialization & recreation activities. Assistance may also involve obtaining necessary medical services & reporting changes in condition & needs. The PA may accompany or provide transportation to accomplish any of these tasks. Sleep Cycle Supports are provided to individuals who live with someone meeting the definition of family, or are provided to children in custody residing in a setting that does not meet the definition of family. The primary purpose of Sleep Cycle Support is to give overnight assistance to an individual in case of emergencies or to assist with repositioning. A Sleep Cycle Support attendant is ready to call a doctor, hospital, or provide other assistance if an emergency occurs. The attendant must be immediately available, but can sleep when not needed. Overnight Respite Care services are provided to individuals who live with someone meeting the definition of family, or are provided to children in custody residing in a setting that does not meet the definition of family. Respite Care is designed to provide relief for the individual's family member who serves as an unpaid primary care giver. Respite is necessary for families who provide constant care for individuals so family members are able to receive periods of relief for vacations, holidays & scheduled time off periods. 3 4

3 Agency-Directed Supports Day Supports Supportive Home Care (SHC) services are provided by an Agency (not self-directed by the person receiving services) to assist a person living with someone meeting the definition of family or a child in custody. Family is defined as any person immediately related to the individual. Specifically: Parents (including adoptive parent), grand-parents, spouses, aunts, uncles, sisters, brothers, first cousins and any step-family relationships. These are individualized (one-to-one) services that provide direct assistance with: Daily living / personal adjustment, Attendant care, Assistance with medications that are ordinarily self-administered, Accessing medical care, Supervision / Reporting changes in condition & needs, Extension of therapy services, Ambulation/exercise, Household services essential to health care at home or performed in conjunction with assistance in daily living (such as shopping, preparing meals, bathing, using appliances, dressing, feeding, making the bed, doing laundry, & cleaning the bathroom & kitchen). These are provided by CSS licensed entities for individuals 18 years of age or older. These services include regularly occurring activities that provide a sense of participation, accomplishment, personal reward, personal contribution, or remuneration and thereby serve to maintain or increase adaptive capabilities, productivity, independence or integration and participation in the community. Day Supports also include the provision of pre-vocational services which are aimed at preparing an individual for paid or unpaid employment, but are not job-task oriented. These services include teaching such concepts as compliance, attendance, task completion, problem solving and safety. Such activities shall be appropriate for or lead to a lifestyle as specified in the individual s Person Centered Support Plan. These opportunities can include: Socialization, Recreation, Community inclusion, Adult education, & Skill development in the areas of employment, transportation, daily living, selfsufficiency, and resource identification and acquisition. Residential Supports For Adults: These are provided to waiver individuals, 18 years of age or older, who live in a residential setting and do not live with someone meeting the definition of family. This licensed service provides assistance, acquisition, retention, and/or improvement in skills related to activities of daily living such as but not limited to: Personal grooming, Cleanliness, Bed making, Household chores, Eating, Food preparation, Social and adaptive skills necessary to enable the individual to reside in a non-institutional setting. For Children: These are available to minor children, ages 5-21 (eligibility ends on the 22nd birthday) who are determined eligible for the Medicaid Program through a waiver of requirements relating to the deeming of parental income. Children's Residential Supports shall be provided in a family foster home licensed by KDHE. These services include teaching such concepts as compliance, attendance, task completion, problem solving and safety. Such activities shall be appropriate for or lead to a lifestyle as specified in the individual s Person Centered Support Plan. These opportunities can include: Socialization, Recreation, Community inclusion, Adult education, & Skill development in the areas of employment, transportation, daily living, self-sufficiency, and resource identification and acquisition. Supported Employment Supported Employment is competitive work in an integrated setting with on-going support services for individuals who have DD. Competitive work is defined as compensated work in accordance with the Fair Labor Standards Act. An integrated work setting is a job site that is similar to that of the general work force. Such work is supported by any activity needed to sustain paid employment by persons with disabilities. Specialized Medical Care This service provides long-term nursing support for medically fragile and technology dependent individuals. The required level of care must provide medical support for a beneficiary needing ongoing, daily care that would otherwise require the beneficiary to be in a hospital. The intensive medical needs of the beneficiary must be met to ensure the person can live outside of a hospital or ICF/ID. For the purpose of this waiver, a provider of specialized medical care must be a registered nurse (RN), a licensed practical nurse (LPN) under the supervision of an RN, or another entity designated by the Kansas Department for Aging and Disability Services. Providers of this service must be trained with the medical skills necessary to care for and meet the medical needs of beneficiaries within the scope of the State s Nurse Practice Act. The service may be provided in all customary and usual community locations including where the beneficiary resides and socializes. This is a process whereby a registered nurse evaluates the level of wellness of a consumer to determine if the consumer is properly using medical health services as recommended by a physician and if the health of the consumer is sufficient to maintain him/ 5 6

This includes checking and/or monitoring the following: Orientation to surroundings, Skin characteristics, Edema, Personal hygiene, Blood Pressure, Respiration, Pulse, Adjustments to medication. Non I/DD Waiver Funding /Service Options: These are supports or items that meet an individual s assessed need by improving and/ or promoting the person s health, independence, productivity, or integration into the Assistive Services community, and are directly related to the individual s Person Centered Support Plan with measurable outcomes. Examples include, but are not limited to wheelchair modifications, ramps, lifts, modifications to bathrooms and kitchens (specifically related to accessibility), and assistive technology (i.e. items that improve communication, mobility or assist with activities of daily living or instrumental activities of daily living in the home and work place). This service provides support to a consumer who has a medical need that could become critical at any time. The medical alert device is a small instrument carried or worn by the consumer which, by the push of a button, automatically dials the telephone of a Medical Alert Rental predetermined responder who will answer the call for help. The following are examples of medical needs that might require this service: quadriplegia, severe heart conditions, difficult to control diabetes, severe convulsive disorders, severe chronic obstructive pulmonary disease, & head injury. Vocational Rehabilitation (VR) Services is a separate funding source from the I/DD waiver that helps Kansas citizens with disabilities find employment. The services provided are customized according to each person s unique needs, skills, interests and abilities. You can apply for VR and remain on the I/DD Waiver waiting list. Services may include physical and mental restoration services such as artificial limbs, psychotherapy, and physical therapy, training, aids, and other adaptive devices, job placement services, student services, supported employment and referral to other services. Website: Application can be found on this webpage Wyandotte County Vocational Rehabilitation Contact: Scott Adwell 402 State Avenue Kansas City, KS Phone: Wyandotte County CDDO State Aid Funding Project The purpose for the funding is to assist with the unmet needs of persons within the Wyandotte CDDO service area. The range and scope of products, goods and services should promote the health, safety and welfare of the beneficiary. The funding will cover medically necessary procedures, equipment, supplies and such things as medical supplies, therapy, dental exams, or eye wear (not otherwise paid by Medicaid). Each application will be reviewed by the WCDDO Funding Committee and decisions are made on a case-by-case basis. 7 8

5 In the case of Medicaid funded program, services or products; these may be covered in some instances if there is no funding available. This will include van lift, wheel chair and/or repair and modification. In some cases if the amount exceeds the allowable amount the applicant or may be responsible for remaining amount. Who is Eligible? Anyone who has completed the eligibility /intake process and has been found eligible for I/DD services and resides in the Wyandotte County Developmental Disabilities Organization service area. KanCare Members have 3 plans to choose from : How do you apply? You may request an application from our office located at 701 North 7th Street KCK Room 346. An application will be mailed or faxed at your request. If you have an I/DD case manager, they will have an application and assist you with completing providing the proper documentation required to complete the application process. If you have questions please contact (913) , TTY: TTY: Do you know about open enrollment as a KanCare Member? TTY: #771 You will receive your open enrollment packet 30 days before your one-year anniversary in KanCare. If you were added to someone's existing KanCare case, you will be up for open enrollment the same time as your family's case. After you receive your open enrollment packet, you will have until 60 days past your KanCare anniversary date to make changes to your KanCare health plan. Open enrollment means you can change your plan if you want to be covered by a different plan, or you can keep your same health plan. If you are happy with your current health plan, you do not need to do anything at all. Again, if you do not want to change health plans, you will automatically be re-enrolled in your same plan. But if you want to change your health plan, you will need to let us know by following the instructions in the packet mailed to you on the anniversary date of when you joined KanCare. All members will have 60 days to review their open enrollment packet and decide whether or not they want to stay in their plan or change to a different plan. Almost everyone will receive their open enrollment packet 30 days before their one-year anniversary in KanCare. If you were added to someone s existing KanCare case, you will be up for open enrollment the same time as your family s case. After you receive your open enrollment packet, you will have until 60 days past the anniversary date to make changes to your KanCare health plan. Amerigroup Sunflower United Health Care Dental care for people 21 and over: -Two cleanings annually -Scaling and polishing procedures Through the Healthy Rewards program, members can earn $10, $15, or $25 in debit card credits for over-the-counter items each time they get certain health checkups and screenings. We help certain members get free cell phones through Safe- Link and up to 250 free minutes of service each month plus: -200 bonus lifetime minutes -Unlimited nationwide text messages -Free outbound calls to Member Services Coverage may not be offered in certain remote service areas. Taking Care of Baby and Me prenatal and postnatal program with: -Health resources and coaching -A special self-care book -Information on Warm Health and how to enroll -A helpful tips brochure with information on enrolling in Text4Baby, centering pregnancy group visits and more. Smoking Cessation program that includes a full range of nicotine replacement therapy products, as well as coaching and support services. One dental visit for adults 21 and older every six months. Members can earn $10 - $50 or more on a CentAccount rewards card for healthy checkups to use for over-the-counter items. SafeLink and Connections Plus are programs that provide a free cell phone to members. Safe- Link provides up to 250 free minutes of service per month. This includes free calls to and from Sunflower Health Plan. Members will be able to have telephone access to their Kan- Care providers. Start Smart for Your Baby - This program gives support and education for moms, babies, and families. The program includes the services below. There is no cost to member. -Start Smart home visits for new mothers -Start Smart baby showers for pregnant mothers -Start Smart birthday programs for children. Members can participate in a smoking cessation program, including They can also be referred to Sunflower s smoking cessation program offered through Healthy Solutions for Life. Adult dental services are a benefit. Members over 21 can get an examination. They also get an x- ray and teeth cleaning. Members can earn up to $80 in Wellness Reward debit cards to help them become and stay healthy. They can earn the gift cards by going to health screenings and checkups. Our Member Advocates can help certain members get free cell phones through SafeLink. The advocates can help with: -Picking the right cell phone provider -Help with the application -Educate on phone benefits -Get the member connected with the program. The member can get up to 250 free minutes of service each month. Coverage may not be offered in some service areas. A free book named Baby Basics will be sent to each member who is pregnant. You can earn great rewards with Baby Blocks if you are pregnant. Join Baby Blocks and get a $20 gift card or a cool diaper bag. Stay with the program after your baby is born and you can earn up to eight rewards in all. Adult members can go to two more podiatry (foot doctor) appointments each year. Extra over-the-counter (OTC) medicines through mail order for all waiver groups and certain members receiving SSI. $120 annually ($10 member monthly allowance) toward the purchase of OTC products through a secure website. Free rides to community health events and free caregiver transportation to Medicaid-covered appointments for all waiver groups and certain members receiving SSI. Healthy Families Program Our Healthy Families program is designed to help families with children ages 7-13 who are overweight or obese, or at risk of becoming overweight or obese, live healthier lives. We also provide practice visits to OB/GYNs and dentists for members with developmental disabilities to help them become more comfortable with preventive care visits. Our MyStrength online program offers elearning to help members overcome depression and anxiety. This online program includes simple tools, weekly exercises, mood trackers and daily inspirational quotes and videos. The program may be used on its own or with other care. We have targeted disease management for members with asthma, COPD, diabetes, heart disease or high blood pressure through our Healthy Solutions for Life Program. Members can enroll in any of these programs. There is a weight management program for adults by referral only. We will provide more vision services. The services will include more coverage for lenses. For our members on the IDD Waiver and some members with behavioral health needs, we will provide free rides to job related activities. The rides are six one way or three round trip rides that can be used for attending job interviews or when member s usual ride to and from a job is not available. Families with children age 2 to 8 can join in the Sesame Street Food for Thought program which will be offered throughout the State. The program is where families can learn from Sesame Street characters about eating healthy on a budget

7 Amerigroup Sunflower United Health Care Free in-home pest control for all waiver groups and certain members receiving SSI, with a maximum benefit of $500 per calendar year. Members must own the property to receive this benefit (excludes members residing in ICF/MR, assisted living and nursing facilities, group homes, or similar settings). Community Programs for Healthy Children: Sunflower offers free services to promote healthy lifestyles for kids, such as membership fees to Boys & Girls Clubs and Adopt a School Program. Children can join in free activities at the YMCA, Boys and Girls Clubs, and 4-H and selected Parks and Recreation Departments. Adults on the FE and PD waiver and Health Home members with behavioral health needs can get free activities with selected Parks and Recreation offices also. Amerigroup Sunflower United Health Care Hypoallergenic Bedding Members with allergies or certain other conditions can get up to $100 for the calendar year to use toward special bedding items. To receive the benefit, a doctor must recommend/order the product, and the member must have an allergy diagnosis. Parents can order hypoallergenic blankets and pillowcases that help with a child s asthma after seeing their doctor. Our asthma programs can help children and their parents learn how to better manage their health. Weight Watcher Vouchers - Members can receive one Weight Watchers voucher for four weeks of classes, plus payment of the initiation fee. Our Choose Health Program targets members with chronic health conditions. The program helps members determine how emotions can impact their condition (i.e. stress, poor sleep, and change in appetite). As a part of the program, participants are assigned a Choose Health Coach who works with the entire health care team to ensure members have everything they need to feel their best. Our adult members can go to FREE Weight Watchers classes for three months. You can also earn a $50 gift card to be used toward workout gear for finishing the program. Kids age 10 to 17 who are watching their weight can earn a $50 gift card in the Join For Me program. They earn the gift card by finishing the Join For Me program. We provide members of certain waiver populations with a medical escort if needed. In-home telemonitoring is available for adults only. This service helps members be able to be at home when they need help to manage their chronic heart failure, heart diseases or high blood pressure. PD and FE waiver members can receive a supply of adult briefs to help save them money. Adult members on the PD and FE waivers can pick one free home safety or support product per year from a catalog of home help items through their care coordinator. FE members can also get an annual wellness calendar through their care coordinator. have everything they need to feel Respite Care for caregivers of Frail Elderly waiver members and extra respite care for members of Autism and Intellectual/ Developmental Disability waiver groups (excludes members living alone or residing in ICF/MR, assisted living and nursing facilities, group homes, or similar settings). Personal assistant services for members in the Intellectual/Developmental Disability waiver group. Up to 8 hours a year of respite for caregivers of members on the Frail Elderly waiver. We also provide 50 hours for respite care or hospital companionship for those on the Intellectual/ Developmental Disability waiver. We offer medication review for members living in foster care and persons with Intellectual Developmental Disabilities. We have Peer Coaches that can help someone who is just coming out of a hospital for behavioral health needs. The Peer Coaches help the member to get better and work on not going back to the hospital

8 ABUSE, NEGLECT, AND EXPLOITATION ABUSE is defined as the intentional infliction of pain or injury, unreasonable confinement, sexual abuse, intimidation, cruel punishment, or deprivation by a caretaker or another person of goods or services that are necessary to avoid physical or mental harm or illness. NEGLECT is defined as the failure or omission of one s self, caretaker or another person to provide goods or services that are necessary to ensure safety and well being and to avoid physical or mental harm or illness. Special note: If an individual is harmed by another individual receiving services, a friend, or a relative while receiving services from the provider, the incident is to be investigated as neglect when it is reasonable to expect the incident could have been avoided by the person/provider responsible for providing their care, services, supervision, etc. EXPLOITATION is defined as misappropriation of property or taking unfair advantage of an adult's physical or financial resources for another individual s personal or financial advantage by the use of undue influence, coercion, harassment, duress, deception, false representation or false pretense by a caretaker or another person. If you suspect Abuse, Neglect or Exploitation has occurred contact Adult Protective Services at DISPUTE RESOLUTION You can access the Dispute Resolution process whenever you have a problem with your service provider or WCDDO. You will need to follow the steps outlined below. Your case manager or WCDDO can assist you with any of the steps listed. 1. Talk to your Case Manager 2. Access the agency internal grievance process 3. Access WCDDO dispute resolution process 4. File a dispute with the Council of Community Members 5. Request professional mediation 6. File an administrative Appeal with the State of Kansas 7.
