4 dt. 1,"July 2016 Item No. 4: with 3) Preamble: The Fees Regulating Authority has been constituted vide notification dt 19"' March 2016 under Maharashtra Unaided Private ~rofessional Educational Institutions (Regulation of Admissions and Fees) Act, In the matter of administration and finance autonomy is conferred on this' Authority. 1-0 ensure discipline in the financial matters four posts of accounts officer have been created. 1 (a) "No expenditure from authority's funds shall be permiss~ble unless justified and duly approved. In the matter of day to day and petty expenses note should be submitted to the Secretary for approval. No unwarranted and unnecessary spending shall be permissible. In case of major expenditure permission of Chairperson should be obtained. Having regard to purpose and quantum if the Chairperson considers it necessary to seek mandate of the full house he shall so direct and accordingly such proposal shall be placed before full house." In the matter of transacting official business it is resolved thus: 2(b) "While seeking direction practice of making submission and seeking necessary approval be followed strictly. In the matter of major decision approval shall be obtained from the Chairperson. If in the opinion of the Chairperson, it is necessary to place it before full house he shall so direct and accordingly proposal shall appear on the agenda of the meeting of the Authority. As regards communications/grievances received from the stakeholders/general public/aggrieved person the Secretary shall cause it to be processed and apprise the Chairperson in the form of submission in writing. To ensure accountability it is necessary to observe practice of seeking directions on file. For that subject wise files be maintained. Acting on oral direction should be avoided. Any dereliction of duty shall be viewed seriously." (2) Consequence of Non-Submission of Proposals for Fees to the Fees Regulating Authority and the right of Management to Collect Interim fee till the final determination of the Proposal for the particular Academic Year: In this regard Sections 14(1) (b) and 14(2) reads as under: "Section 14(1)(b) : in the event of nun-submission of proposal for upward revision of fees to the Fees Regulating Authority within the me-limit specified by the Authority, the fees structure as approved by the Authority and applicable during the previo~~s academic year shall continue to apply, Section 14(2) : Pending the decision of the Fees Regulating Authority, the management shall be at liberty to collect the interim or adhoc fee as the case may be, till the final determination for the particular academic year. " It is explicit from the aforesaid provisions that in the event Management of the unaided institutions ether failing or not intending to submit proposals for upward revision of the fees to the Fees Regulating Authority, the fees structure approved by the Authority (Shikshan Shulka Samiti or Fees Regulating Authority as the case

5 may be) and applicable during the previous Academic Year shall continue to apply' As regards right of the Management to collect the interim fee till final determination of proposals, Section i4(2) empowers the Management to do so, till the determination of fee proposal for the particular Academic Year. As regards limit of interim fee it shall not be more than 5% of the fees approved by the Authority and applicable during the previous Academ~c Year. Provided ~uch increase is warranted. The Management collecting interim fees shall specify in the receipt issued to the students that the fees so collected is only interim and IS subject to finalization by the Authority. In the event the increase is not allowed or if it is allowed less than 5%, the Management shall be under obligat~on to refund the excess amount of fees so collected. (3) Adhoc fees for various new courses / new institutions started in the Academic Year : Under Section i4(2), pending the decision of the Fees Regulating Authority, the management is given liberty to collect adhoc fees till final determination for the particular Academic Year. In view of this, the Authority in its meeting dated Oi specifies the adhoc fees as mentioned in the table below: Applied Arts 69000/-

In the event the fees finalized by the Authority for respective courses is less than the adhoc fees, the Management shall be under obligation to refund the excess amount of fees so collected.

7 I ~vt-r ING FI~A dt 1."! irly 2026 (4) It has been repeatedly repsited in the media that 32 Engineering Colleges affiliated ta, Nagpur University were inspected and were found deficient in the mab-lrer of infrastructure, teaching stafff etc. It is further reported that, the University is not divulging names of 32 deficierst co%leges. While submitting the fees proposals, institution is required to give deta~ls of available infrastructure, available teaching and non-teaching staff and expenditure incurred over the same. These are the factors taken into considerat~on while finalizing fees structure. It is therefore necessary to ascertain the names of 32 deficient colleges and also ascertain details of deficiencies and then to verify it from the fees proposals submitted by tlie respective colleges to this Authority. This exercise will reveal whether the colleges submitted correct data to justify claiming particular amount of fees. There is a possib~lity of these institutions got enhanced amount of fees approved by submitting wrong / inflated facts and figures. The Authority has decided to take suomotu cognizance of the media report, recently reported in the Times of India, Nagpur Edition dated the Authority unanimously has decided to authorize the Secretary to write to the Registrar of the Nagpur University to reveal the names of 32 deficient colleges and also make available to this Authority the report prepared by panels constituted by AICTE. (5) Clarification: In the matter of charging process fee, it is clarified that process fee shall be O.lO/o of the total amount of fee proposed during particular academic year. For e.g. institution proposes fee of Rs. 50,000/- per student for a given academic year, and its total intake capacity or actual strength, whichever is higher, based on total duration of course is 100, then process fee shall be computed on Rs. 50,000 X 100= Rs. 50,00,000/-. Payable process fee shall be Rs. 5,000/-. Proposal submitted without process fee or with deficient process fees shall not be entertained. The processing fee shall be paid by internet banking only in the name of "SECRETRY, FEES REGULATING AUTHORITY, MUMBAI". The details of bank account is as under : Account lvo. : '[FSC No. MAHB Bank Name : Bank of Maharashtra, Bandra (E) (164) IvlICR Code : (6) Matters to be included Auditors report In order to carry on efficient verification of fee proposal under the Unaided Institutions under Maharashtra Unaided Private Professional Educational lnstitut~ons (Regulation of Admissions and Fees) Act, 2015 as far as possible, thc proposals may accompany audited income expenditure accounts and the balance sheet. Auditor should be Chartered Accountant within the meaning of Chartered Accountant Act Following are the matters to be included in the Auditors report.

8 8 rt?a 1\/11[171NG rit, ll!l\l I) Whether proper books of Account are kept by the Institutions including that of each segment. 2) Whether method of Accounting followed is of accrual basis including that of every segment. In case, the institution is following cash method of accounting in the past whether the change is carried out form financial year 2015,-16 3) Whether auditors have obtained all the informations and explanations which were necessary for the purpose of audit and for determination of fees by the Authority. 4) Whether the Accounts of the Trust are submitted on by following accounting standard 17 or equivalent ind AS and certified by the Statutory Auditor of the Institutions as true and fair representation of segmental reporting. The segment being every course for which the approval of the fees is sought before the Authority. 5) Whether proper books of account have been kept by the Trust and every segment. 6) Whether in the opinion of the Auditor and according information and explanation given to him the accounts give true and fair view " i) In the case of Balance sheet the state of affairs of the institution and segment as at 31'' March ii) In the case of Income and Expenditure account of the surplus/deficit of the institutions and segment. for. the year ended on that date."
