5 Employee Rights under the OHSA Right to know How to do their job safely - procedures, training, hazardous materials, and how to protect themselves (ie PPEs, etc) Right to participate Bring H&S concerns to their Supervisor s attention for remediation, and have a voice in the Joint Health & Safety Committee Right to refuse unsafe work (Section 43 (1) OHS Act) Workers have the right to refuse unsafe work unless The danger is inherent in the worker s work or a normal condition of the worker s employment, or The work refusal would directly endanger the life, heath, or safety of another person

6 Employee Obligations under the Act 6 Work in Compliance with the Occupational Health & Safety Act ( the Act ) and its Regulations (i.e. WORK SAFELY!) Regulations: Industrial Establishments; Healthcare & Residential; WHMIS USE ALL PPE s required and provided by the employer REPORT HAZARDS, unsafe conditions, or contraventions of the Act to your Supervisor immediately DO NOT REMOVE or make ineffective any safety or protective device put in place by the employer DO NOT USE any equipment, machine or device that may endanger yourself or any other worker DO NOT engage in pranks or horseplay, etc.

7 Employer Obligations under the Act 7 Take Every Reasonable Precaution to protect the Health & Safety of workers Provide information, instruction, and supervision pertinent to the employee s function Post the written Occupational Health & Safety Policy and establish a Health & Safety Program (i.e.. JOHSC, Training, Infection Control, Policies & Procedures, WHMIS) Post a copy of the Occupational Health & Safety Act and monitor compliance Provide and maintain required equipment, materials and protective devices per manufacturer s recommendations Supply Personal Protective Equipment and ensure workers know how to use all equipment, materials and protective devices properly and safely

13 Reporting an Injury There is no reason to believe you will be injured during your time at Ontario Shores. If for some reason you are, report the injury or incident to your supervisor immediately! You can also report hazards to your supervisor to avoid injury to yourself or others. The Internal Responsibility System keeps it safe for everyone!

14 Your Personal Safety is Paramount Everything is a learning opportunity and work can be fun, but BE MINDFUL! Pay attention, accidents only take a second and usually can be prevented Injuries can change your whole life and everything you had planned for it

15 WORK SAFELY! James Wright - Ottawa It seemed like one hell of a good opportunity. I got a job as an apprentice tinsmith and was earning high school credits. Two weeks into the job, I fell fifty feet -five stories- off a ladder and now I'm paralyzed from the waist down. I was eighteen when it happened. As it stands now, I'll be in a wheelchair for the rest of my life. The fall shattered my lower spine and six years later I'm still in a lot of pain. Usually, I can only get three to five hours of sleep a night. Getting hurt like I did, there are lots of things you miss out on. I was very active, I played a lot of sports, and now what I think I miss most is being able to go out and live free- I find that I'm always dependant on somebody. After all that's happened, I don't feel resentful. I have a better understanding of what I lost and what I still have. I feel grateful to be still alive. An accident like that can happen so easily, at the snap of your fingers. So if you don't feel safe, tell your boss and ask for training. I never received any proper safety training, if I had, I might not have fallen off that ladder. Source:

16 WORK SAFELY! Randy's Story Eighteen-year-old Randy Georges never dreamed how his life would change on that day in He had just started a new part-time job at a popular restaurant where he worked in the kitchen. Randy was asked to pour cooking oil through a filter in order to clean it, something he hadn't done before. Before starting to pour the oil he asked for a safety apron and gloves but was told they weren't necessary. Unfortunately the boiling oil spilled and splashed all over him. He suffered third degree burns on his neck, chest, hands, stomach, groin and feet. He still suffers pain today as a result of this incident. Randy's injury was completely preventable. He didn't know at the time that he had the right to refuse unsafe work. It is Randy's hope that all young workers know their rights and that no one ever has to learn this in the painful way that he has. Source:

17 WORK SAFELY! Dan Kramp Guelph In August 1999, Dan Kramp was just 15 years old and working as a summer student at a meat processing plant. Dan's arm was caught in a meat auger, pulling him in from his fingertips to his shoulder. He is very lucky just to be alive and even after major restorative surgery has only limited use of his arm and hand. Dan is currently finishing high school. Source:

18 WORK SAFELY! Hello, In July of 2000, Doug, my eldest son who had just turned 20, was killed in a workplace accident. I would like a chance to tell Doug's story so hopefully other young people will realize that they can't always go along with what their boss tells them, even if they're new, even if they think they might get fired. I also want companies to hear Doug's story, so they understand they have to train their employees, especially the young ones, and they have to provide safety equipment. Doug died while he was in a machine, cleaning out hardened cement. Another machine, which shared a power supply with Doug's, was started up. This caused my son's machine to start up as well, and its blades started to spin. The blades basically squashed Doug's insides, killing him. His lungs collapsed, his liver was shattered, his portal vein was torn (the portal vein is found near the lower intestines), and his ribs were broken. My son died because his company didn't provide him with locks to perform a machine lockout. It was an easily preventable accident. I lost my eldest child who had so many dreams ahead of him. 23 Safe Use of Sharps Containers Must be put together properly or they can come apart, spilling the contents. There are locks in the four corners of the container. Push firmly on all four corners and listen for the click. Only then is it safe to use. Container is only to be filled to black line and then replaced.

24 Workplace Violence Workplace violence is a serious issue at Ontario Shores Centre for Mental Health Sciences (Ontario Shores). Workplace violence is one of the most complex and dangerous occupational hazards facing nurses (McPaul & Lipscomb, 2004) long-term care residents were killed in Ontario by fellow residents

25 Definitions Workplace Violence: a) The exercise of physical force by a person against a worker in a workplace that could cause or causes physical injury to the worker, b) An attempt to exercise physical force against a worker in a workplace that could cause physical injury to the worker (Bill 168 An Act to amend the Occupational Health & Safety Act, 2009).

26 Definitions Workplace Violence con t: c) A statement or behaviour that it is reasonable for a worker to interpret as a threat to exercise physical force against the worker, in a workplace, that could cause physical injury to the worker

27 Workplace Violence Prevention

28 Policy Ontario Shores has a Workplace Violence, Harassment and Bullying, and Domestic Violence Policy. Copies are available on Intra (Ontario Shores intranet site) intranet and in the Administrative Policy Manual located in each unit/department. Policies are reviewed on a yearly basis.

29 Triggers of Workplace Violence Disrespect (real or perceived) Rude and/or condescending treatment Lack of privacy Fear Frustration Crowded environment Unmet needs hunger, pain, inability to communicate Poor surveillance Frequent medication changes Long hospitalization Anxiety

30 Types of Workplace Violence Type 1 Criminal Intent Type 2 Client/Customer Type 3 Employee related Type 4 Personal Relationship

31 Reporting Incidents of Workplace Violence Incidents of workplace violence need to be reported. Incidents numbers are increasing, but may be still under-reported. Reasons for not reporting incidents: Fear of reprisal Part of the job No lost time; therefore, no need to report Victim may feel responsible for the assault or situation

32 Domestic Violence Bill 168 (Amendment to the OHS Act) requires an employer to take all reasonable precautions for the protection of the worker if a domestic violence situation would likely expose a worker to physical injury in the workplace. Domestic Violence is an example of workplace violence as soon as it enters the workplace.

33 Work Safely! Remember Always wear a multi-break away badge holder! Always wear a personal alarm if working on Patient Care Units, and make sure it s tested regularly! Be SCENT-FREE!!! Stay healthy and use proper body mechanics, lifting measures, hallway mirrors, and Personal Protective Equipment provided Be alert and correct or report hazards immediately!
