1 DEPARTMENT OF HEALTH, STATE OF FLORIDA DEPARTMENT OF HEALTH PETITIONER, v. CASE NO ASIF HUSSAIN CHOUDHURY, M.D., RESPONDENT. ADMINISTRATIVE COMPLAINT Petitioner Department of Health (Department) files this Administrative Complaint before the Board of Medicine (Board) against Respondent Asif Hussain Choudhury, M.D., and in support thereof alleges: 1. Petitioner is the state agency charged with regulating the practice of medicine pursuant to Section 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 458, Florida Statutes. 2. At all times material to this Complaint, Respondent was licensed to practice as a physician within the State of Florida, having been issued license number ME At all times material to this Complaint, Respondent's address of record was Metropolis Avenue, Suite 101, Fort Myers, Florida

At all times material to this Complaint, Respondent was an employee of Riverwalk Endoscopy and Surgery Center, LLC (Riverwalk), and he also had medical privileges at Lee Memorial Hospital (Lee Health). Facts Relating to Patient G.D.1 5. On or about May 3, 2017, Respondent performed an endoscopic procedure at Lee Health on a 26-year-old female, Patient G.D. 6. Patient G.D. was sedated for the procedure. 7. During the procedure, Respondent inserted at least one of his fingers into Patient G.D.'s vagina. 8. Respondent's actions were outside the scope of the practice of medicine. Facts Relating to Patient V.Q.2 9. On or about June 15, 2017, Respondent performed a colonoscopy at Riverwalk on a 56-year-old woman, Patient V.Q. 10. Patient V.Q. was sedated for the procedure. 11. During the procedure, Respondent inserted at lease one of his fingers into Patient V.Q.'s vagina. 1 These facts are contained within Department Case Number These facts are contained within Department Case Number
3 12. Respondent's actions were outside the scope of the practice of medicine. Facts Relating to D.N On or about June 15, 2017, Respondent performed a colonoscopy at Riverwalk on a 49-year-old woman, Patient D.N. 15. Patient D.N. was sedated for the procedure. 16. During the procedure, Respondent inserted at least one of his fingers into Patient D.N.'s vagina. 17. Respondent's actions were outside the scope of the practice of medicine. COUNT I 18. Petitioner realleges and incorporates paragraphs one through seventeen as if fully set forth herein. 21. Section (1)0), Florida Statutes (2016), subjects a physician to discipline, including suspension, for "[e]xercising influence within a patient-physician relationship for purposes of engaging a patient in sexual activity." 3 These facts are contained within Department Case Number

Respondent violated Section (1)(j), Florida Statutes (2016), by using his position of authority as a physician to engage or attempt to engage his patients in sexual misconduct in one or more of the following ways: a. Inserting his finger(s) into Patient G.D.'s vagina; b. Inserting his finger(s) into Patient V.Q.'s vagina; and/or c. Inserting his finger(s) into Patient D.N.'s vagina. 23. Based on the foregoing, Respondent violated Section (1)(j), Florida Statutes (2016). COUNT II 24. Petitioner realleges and incorporates paragraphs one through seventeen as if fully set forth herein. 25. Section (1)(nn), Florida Statutes (2016), subjects licensee to discipline for violating any provision of Chapter 458, Florida Statues (2016), Chapter 456, Florida Statutes (2016), or any rules adopted pursuant to Chapters 456 and 458, Florida Statutes. 26. Section (1)(v), Florida Statutes (2016), subjects a licensee to discipline for engaging in sexual misconduct. 27. Section (1), Florida Statutes (2016), defines sexual 4
5 misconduct as, "a violation of the professional relationship through which the health care practitioner uses such relationship to engage or attempt to engage the patient or client, or to induce or attempt to induce such a person to engage in, verbal or physical sexual activity outside the scope of the professional practice of such health care profession". 28. Section , Florida Statutes (2016), provides, "The physician-patient relationship is founded on mutual trust. Sexual misconduct in the practice of medicine means violation of the physician-patient relationship through which the physician uses said relationship to induce or attempt to induce the patient to engage, or to engage or attempt to engage the patient, in sexual activity outside the scope of the practice or the scope of generally accepted examination or treatment of the patient. Sexual misconduct in the practice of medicine is prohibited." 29. Rule , Florida Administrative Code, provides, in pertinent part: "(1) Sexual contact with a patient is sexual misconduct and is a violation of Sections and (1)(j), F.S. (2) For purposes of this rule, sexual misconduct between a physician and a patient includes, but it is not limited to: 5
6 (a) Sexual behavior or involvement with a patient including verbal or physical behavior which 1. May reasonably be interpreted as romantic involvement with a patient regardless of whether such involvement occurs in the professional setting or outside of it; 2. May reasonably be interpreted as intended for the sexual arousal or gratification of the physician, the patient or any third party; or 3. May reasonably be interpreted by the patient as being sexual." 30. Respondent committed sexual misconduct in one or more of the following ways: a. Inserting his finger(s) into Patient G.D.'s vagina; b. Inserting his finger(s) into Patient V.Q.'s vagina; and/or c. Inserting his finger(s) into Patient D.N.'s vagina. 31. Based on the foregoing, Respondent violated Section (1)(nn), Florida Statutes (2016), by committing sexual assault as defined in Section (1)(v), Florida Statutes (2016); Section (1), Florida Statutes (2016); Section , Florida Statutes 6
7 (2016); and/or Rule 64B , Florida Administrative Code, (2016). WHEREFORE, Petitioner respectfully requests that the Board enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent's license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate. 8 NOTICE OF RIGHTS Respondent has the right to request a hearing to be conducted in accordance with Section and , Florida Statutes, to be represented by counsel or other qualified representative, to present evidence and argument, to call and cross-examine witnesses and to have subpoena and subpoena duces tecum issued on his or her behalf if a hearing is requested. A request or petition for an administrative hearing must be in writing and must be received by the Department within 21 days from the day Respondent received the, pursuant to Rule (2), Florida Administrative Code. If Respondent fails to request a hearing within 21 days of receipt of this, Respondent waives the right to request a hearing on the facts alleged in this pursuant to Rule (4), Florida Administrative Code. Any request for an administrative proceeding to challenge or contest the material facts or charges contained in the Administrative Complaint must conform to Rule (5), Florida Administrative Code. Mediation under Section , Florida Statutes, is not available to resolve this. NOTICE REGARDING ASSESSMENT OF COSTS Respondent is placed on notice that Petitioner has incurred costs related to the investigation and prosecution of this matter. Pursuant to Section (4), Florida Statutes, the Board shall assess costs related to the investigation and prosecution of a disciplinary matter, which may include attorney hours and costs, on the Respondent in addition any other discipline imposed. 8
