ADMINISTRATIVE COMPLAINT Petitioner, Department of Health, files this Administrative Complaint before the Board of Nursing against ReSpondent, Sylvia S. Peters, C.N.A., and in support thereof alleges: 1. Petitioner is the state agency charged with regulating the practice of nursing assistance pursuant to Chapter 20.43, Florida Statutes; Chapter 456, Florida Statutes; and Chapter 464, Florida Statutes. 2. At all times material to this Complaint, Respondent was certified to practice as a nursing assistant within the State of Florida, having been issued certification number CNA Respondent's address of record is 2326 Tulip Street, Sarasota, Florida

2 4. At all times material to this Complaint, Respondent provided home health care services to Patient A.B., an elderly female. 5. On or about November 19, 2017, Respondent stole a gold ring with a square aquamarine stone valued at approximately $ from Patient A.B. COUNT 6. Petitioner realleges and incorporates paragraphs one through five as if fully set forth herein. 7. Section (1)(b), Florida Statutes (2017), subjects a certified nursing assistant to discipline for intentionally violating any provision of Chapter 464, 456, or the rules adopted by the Board of Nursing. 8. Section (1)(m), Florida Statutes (2017), subjects a certified nursing assistant to discipline for making deceptive, untrue, or fraudulent representations in or related to the practice of a profession or employing a trick or scheme in or related to the practice_of a profession. 9. Respondent intentionally made deceptive, untrue, or fraudulent representations in or related to the practice of a profession and/or employed a trick or scheme in or related to the practice of a profession by stealing a ring from an elderly patient. 3 10. Based on the foregoing, Respondent violated Section (1)(b), Florida Statutes (2017), by intentionally violating Section (1)(m), Florida Statutes (2017). COUNT II 11. Petitioner realleges and incorporates paragraphs one through five as if fully set forth herein. 12. Section (1)(b), Florida Statutes (2017), subjects a certified nursing assistant to discipline for intentionally violating any provision of Chapter 464, 456, or the rules adopted by the Board of Nursing. 13. Section (1)(h), Florida Statutes (2017), subjects a certified nursing assistant to discipline for engaging in unprofessional conduct, as defined by Board rule. 14. Rule 64B (4), Florida Administrative Code, defines unprofessional conduct to include stealing from a patient. 15. Respondent intentionally engaged in unprofessional conduct by stealing a ring from Patient A.B. 16. Based on the foregoing, Respondent violated Section (1)(b), Florida Statutes (2017), by intentionally violating Section (1)(h), Florida Statutes (2017), by engaging in unprofessional DOH v. Sylvia S. 4 conduct as defined by Rule 64B (4), Florida Administrative Code. WHEREFORE, Petitioner respectfully requests that the Board of Nursing enter an order imposing one or more of the following penalties: permanent revocation or suspension of Respondent's license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of Respondent on probation, corrective action, refund of fees billed or collected, remedial education and/or any other relief that the Board deems appropriate. 6 NOTICE OF RIGHTS Respondent has the right to request a hearing to be conducted in accordance with Section and , Florida Statutes, to be represented by counsel or other qualified representative, to present evidence and argument, to call and cross-examine witnesses and to have subpoena and subpoena duces tecum issued on his or her behalf if a hearing is requested. A request or petition for an administrative hearing must be in writing and must be received by the Department within 21 days from the day Respondent received the Administrative Complaint, pursuant to Rule (2), Florida Administrative Code. If Respondent fails to request a hearing within 21 days of receipt of this Administrative Complaint, Respondent waives the right to request a hearing on the facts alleged in this Administrative Complaint pursuant to Rule (4), Florida Administrative Code. Any request for an administrative proceeding to challenge or contest the material facts or charges contained in the Administrative Complaint must conform to Rule ,2015(5), Florida Administrative Code. Mediation Pursuant to. Section , Florida Statutes, is not available to resolve this administrative complaint. NOTICE REGARDING ASSESSMENT OF COSTS Respondent is placed on notice that Petitioner has incurred costs related to the investigation and prosecution of this matter. Pursuant to Section (4), Florida Statutes, the Board shall assess costs related to the investigation and prosecution of a disciplinary matter, which may include attorney hours and costs, on the Respondent in addition to any other discipline imposed.
