14 History is fun! But why SCORPs? Why must the State/Territory SLO create a comprehensive outdoor recreation plan when local governments and other State entities eventually receive the LWCF grant funds (excluding indirect cost rates for administration)?.

15 History is fun! But why SCORPs? Why must the State/Territory SLO create a comprehensive outdoor recreation plan when local governments and other State entities eventually receive the LWCF grant funds (excluding indirect cost rates for administration)? In general, public capital dollars must be obligated to projects consistent with policy-level priorities identified in a comprehensive plan and usually ranked with cost details on a multi-year Capital Improvement Plan (CIP). Both plans are subject to public scrutiny. This encourages thoughtful public infrastructure projects and ensures we re addressing identified needs with our limited public $.

16 History is fun! But why SCORPs? Why must the State/Territory SLO create a comprehensive outdoor recreation plan when local governments and other State entities eventually receive the LWCF grant funds (excluding indirect cost rates for administration)? Since NPS gives LWCF grant $ to the SLO, the SLO must have a planning tool identifying statewide priorities that grant applications respond to. The plan is broad and remains at the policy level; it is not a ranked list with project costs like CIPs.

17 How comprehensive is it? A matter of debate ~ can vary to encompass all dimensions of public outdoor recreation plus all the outdoor recreation providers, users, and other stakeholders. Too broad? Sets no clear or achievable goals, no priorities Too narrow? Not sufficiently thorough or flexible to meet varied State needs

18 LWCF Act & Wilderness Act both signed September 3, 1964

19 Land and Water Conservation Fund Act 16 USC 460l-4. The purposes of this Act are to assist in preserving, developing, and assuring accessibility to all citizens of the United States of America of present and future generations and visitors such quality and quantity of outdoor recreation resources as may be available and are necessary and desirable for individual active participation in such recreation and to strengthen the health and vitality of the citizens of the United States by (1) providing funds for and authorizing Federal assistance to the States in planning, acquisition, and development of needed land and water areas and facilities and (2) providing funds for the Federal acquisition and development of certain lands and other areas.

20 A comprehensive statewide outdoor recreation plan shall be required prior to the consideration by the Secretary of financial assistance for acquisition or development projects. The plan shall be adequate if, in the judgment of the Secretary, it encompasses and will promote the purposes of this part: Provided, That no plan shall be approved unless the Governor of the respective State certifies that ample opportunity for public participation in plan development and revision has been accorded.

29 LWCFA 6(f)(3): No property acquired or developed with assistance under this section shall, without the approval of the Secretary, be converted to other than public outdoor recreation uses.

30 LWCFA 6(f)(3): The Secretary shall approve such conversion only if he finds it to be in accord with the then existing comprehensive statewide outdoor recreation plan and only upon such conditions as he deems necessary to assure the substitution of other recreation properties of at least equal fair market value and of reasonably equivalent usefulness and location:

31 LWCFA 6(f)(3): Provided, That wetland areas and interests therein as identified in the wetlands provisions of the comprehensive plan and proposed to be acquired as suitable replacement property within that same State that is otherwise acceptable, shall be considered to be of reasonably equivalent usefulness with the property proposed for conversion.

32 36 CFR 59.3(b)(9) prerequisites for conversion NPS will consider conversion requests if the following prerequisites have been met: 9)The proposed conversion and substitution are in accord with the Statewide Comprehensive Outdoor Recreation Plan (SCORP) and/or equivalent recreation plans.

33 The Federal Lands for Parks and Recreation Act of 1969 Justification for receiving public benefit conveyance of federal surplus lands for public park and recreation area purposes needs to include reference to meeting needs identified in a SCORP and other relevant planning documents.

35 LWCF Act ~ Revisiting the purpose The program provides matching grants to States for the acquisition and development of public outdoor recreation sites and facilities and the statewide comprehensive outdoor recreation planning requirements of the program.

37 SCORP ~ Overall Purpose Describe role of LWCF in State s provision of outdoor recreation resources, and Policies for use of its LWCF apportionment.

38 SCORP Goal To direct each State's use of its LWCF apportionment. Note the direct linkage to OPSP s function although the OPSP is not a required element

39 SCORP Objectives Fulfill the purposes of the LWCF Act; Provide each State the maximum opportunity and flexibility to develop and implement its plan; Describe LWCF s role in the State's provision of outdoor recreation resources and policies for use of its LWCF apportionment; Provide a basis for determining each State's LWCF eligibility; and Ensure relevant, influential and timely planning for the State's use of its LWCF apportionment.

40 SCORP ~ Basic Elements 1. Name of state agency authorized to represent and act for the state in dealing with the DOI Secretary for LWCF purposes.

Other information as called for by the DOI Secretary The SCORP shall take into account relevant federal resources and programs and shall be correlated so far as practicable with other state, regional and local plans.

44 The plan must describe the process and methodology to meet the guidelines. The planning process must include ample opportunity for public participation involving all segments of the state's population. Must contain a wetlands component pursuant to Section 303 of the Emergency Wetlands Resources Act of The plan may consist of a single document or may be comprised of multiple documents

45 SCORP minimum requirements The plan must be comprehensive. Identifies outdoor recreation issues of statewide importance based upon, but not limited to, input from the public participation program; identify those issues the State will address through the LWCF and those issues which may be addressed by other means; Evaluates demand, but not necessarily through quantitative statewide surveys or analyses; and

46 Submission Requirements 3 copies to NPS; encouraged to post the Plan on the agency s website and use other means for distributing it to the public. New plans and/or updates every five years, but amendments may be submitted at any time. Must include the Governor s approval and her/his certification that there was ample opportunity for public participation.
