1 Work instruction Multi-level individual metering for standard Section 73 certificate applications 1. Overview What Who Why 1.1. At a glance Most multi-level building developments that are strata or stratum subdivided must have individual meters fitted for each lot. So, when developers build a multi-level development, they must prepare their building for possible individual (cold water) metering. Water Servicing Coordinators (WSCs) and Development Services Officers (DSOs) might process Section 73 certificate applications that require multilevel individual metering (MLiM) Scope This instruction applies to standard Section 73 Certificate (including Development, Anticipated requirements and Feasibility ) applications for multi-level developments that are: residential commercial - serviced apartments, mixed development subdivision and commercial subdivision only, or mixed - residential/ commercial developments only. 2 2. Instruction 2.1. Introduction The Multi-level individual metering guide on Sydney Water s website gives you all the details about multi-level individual metering (MLiM). The main points that affect the Managing New Developments process (MNDP) and, more particularly, the standard Section 73 Certificate application process are: 1. Generally, when developers build their multi-level development*, they are now required to install the plumbing needed so that individual metering (MLiM) can occur when they either Strata or Stratum subdivide [*For a definition, go to Section 3. Definitions] 2. Not all multi-level developments require MLiM look at the MLiM guide for the details as well as this work instruction 3. After the standard Section 73 certificate application is received in edeveloper for a development that requires MLiM, the DSO sends an MLiM undertaking with the NOR (or other requirements letters eg Anticipated requirements, Feasibility ) to the WSC 4. After the WSC prints that undertaking, they get the Developer to sign it, make a copy and return the copy to the DSO 5. After the undertaking has been signed satisfactorily, and any other requirements met, the DSO can issue the Section 73 Certificate. Steps to follow IMPORTANT: There are TWO main decision points to help you decide if MLiM applies to your development and you need to use this instruction: (Decision point 1): Only use this instruction if your development is one of the following Development types and Development sub-types (they are the same types used in edeveloper): For: Development Type = Residential AND EITHER Development sub type = Development OR Other/Multi Unit/Mixed OR Strata Subdivision OR Stratum Subdivision Development Type = Commercial AND EITHER Development sub type = Serviced Apartments OR Mixed Development Subdivision OR Commercial Subdivision Development Type = Mixed AND Development sub type = Residential/Commercial If your development is NOT one of these combinations, MLiM does NOT apply and this work instruction ends here. (Decision point 2): If it IS one of these combinations, use step 1 below to finally decide if MLiM applies to your development (and you continue to use this instruction): Step 1: WSC complete Application entry work item in edeveloper This step starts with you selecting the Development Type and Development sub type fields in the Application Entry work item. 4 For: Development Type = Residential AND EITHER Development sub type = Development OR Other/Multi Unit/Mixed your edeveloper fields look like this: and you follow either of these instructions: If your development is NOT being Strata or Stratum subdivided, click the No radio button for Strata/Stratum Subdivision. Then, click Yes or No to answer Development contains multi-level building : - If you clicked No, this work instruction ends here (as MLiM doesn t apply). - If you clicked Yes, you must complete the next two fields Number of multi-level buildings and No. of levels in tallest building. (MLiM applies.) Go to step 2. If your development IS being Strata or Stratum subdivided, click the Yes radio button for Strata/Stratum Subdivision. Then, click Yes or No to answer Development contains multi-level building : - If you clicked No, this work instruction ends here (as MLiM doesn t apply). - If you clicked Yes, you must complete the next two fields Number of multi-level buildings and No. of levels in tallest building. (MLiM applies.) Go to step 2. Or: For: Development Type = Residential AND EITHER Development sub type = Strata Subdivision OR Stratum Subdivision your edeveloper fields look like this: and you follow these instructions: Click Yes or No to answer Development contains multi-level building : - If you clicked No, this work instruction ends here (as MLiM doesn t apply). 5 - If you clicked Yes, you must complete the next two fields Number of multi-level buildings and No. of levels in tallest building. (MLiM applies.)go to step 2. ***** Step 2: DSO check WSC has correctly completed application at Accept application and assign case 2.1 Using the instruction above in step 1, check that the WSC has completed both the Checklist for the submission of an e-developer Application and the edeveloper fields correctly (for MLiM) by reviewing the relevant fields in the Case Enquiry General tab (see note 1 on page 10 for details). 2.2 If not correct, reject work item back to WSC (and this instruction goes back to step 1). 2.3 If correct, release work item and go to step 3. ***** Step 3: DSO compile draft NOR and MLiM undertaking and attach to Create Draft Notice IMPORTANT: (1) The WSC s actions in step 1 above will cause all the MLiM fields to appear in edeveloper for the application and help to auto-populate the NOR and MLiM undertaking templates. (2) For Feasibility applications, the Undertaking will not appear in edeveloper (or the templates) plus the words auto-inserted into the Feasibility letter will only be advisory. 3.1 Retrieve the NOR (or other requirements letter) and MLiM undertaking templates from edeveloper and review both for correctness NOTE: The NOR auto-inserted MLiM words MUST be deleted if the development is NOT multi-level ie more than two levels (including the ground floor). 3.2 Attach NOR to Attach Draft Notice/ Letter and undertaking to Attach Draft MLiM Undertaking fields in Create Draft Notice work item. 6 ***** Step 4: DSO review draft MLiM undertaking and complete Review Draft Notice 4.1 Open draft NOR and MLiM undertaking and review for correctness 4.2 If not correct, amend NOR and/ or MLiM undertaking 4.3 When correct, attach final NOR and/ or MLiM undertaking to related fields in Review Draft Notice work item. (Note: It s mandatory to attach the undertaking.) Go to step 5. ***** Step 5: WSC receive and process MLiM undertaking and attach to Submit MLiM Undertaking work item in edeveloper 5.1 Open and view the NOR from the View S73 Requirements work item 5.2 Open the Submit MLiM Undertaking work item from your job queue Document Owner: Assurance Manager, Urban Growth Page 6 of 14

7 5.3 Click on View in View MLiM Undertaking to see the MLiM undertaking. 5.4 Explain the MLiM requirement to your customer. Remember that all the details about MLiM are on the Sydney Water website. ***Help with MLiM enquiries (technical or MLiM exemption)*** If you need help, contact Sydney Water, MLiM Operations by (preferred) or phone the MLIM Operations Manager (Anthony McMillan) on and quote the edeveloper case number. Please make the initial enquiry on behalf of the developer. If necessary, they can discuss the requirement with the developer. If the developer is enquiring about an exemption from the requirement, they may need to provide justification in writing. MLiM Operations will record what has happened and, if needed, will you with the details and quote the case number. If the result is that the MLiM requirement is withdrawn and/ or that the undertaking will NOT be signed, you must attach a copy of the in place of the undertaking. 5.5 Print MLiM undertaking and obtain the developer s signature. Notes for signing: 1. You only have two choices about who signs the undertaking - either: (1) an individual person if it isn t a company or (2) an authorised person if it is a company (someone in the company with authority to sign for the undertaking terms). 2. In the signing area, strikethrough which ever does not apply where the * appears. 3. The printed names of both the witness and person signing MUST be legible (after its scanned). 5.6 Attach a scanned copy of the signed undertaking to the Attach signed MLiM Undertaking field (and retain the original with your office records). 5.7 If the DSO has rejected MLiM Undertaking in step 6, the Submit MLIM Undertaking work item will re-appear in your job queue and a field will appear at the bottom of the page detailing the DSO s rejection reason. 5.8 Fix error and resubmit work item (until accepted in step 6). ***** Document Owner: Assurance Manager, Urban Growth Page 7 of 14

8 Step 6: DSO review signed MLiM undertaking and complete Review MLiM Undertaking work item 6.1 Click on View field in Review MLiM Undertaking work item to open a signed copy of the MLiM undertaking. Note: If the requirement to sign an undertaking was waived in the step above, a copy of the Sydney Water MLiM Operations detailing this will be attached instead of the undertaking. (If you need to talk to MLiM Operations, see that for contact details or MLIMinternal@sydneywater.com.au or phone the MLIM Operations Manager (Anthony McMillan) on ) 6.2 Make sure that undertaking has been signed and witnessed at the bottom and check that the following items comply: In the signing area, the undertaking must be struck through for which ever does not apply where the * appears and The printed names of both the witness and person MUST be legible. NOTE: There are two choices about who signs the undertaking - either: (1) an individual person if it isn t a company or (2) an authorised person if it is a company (someone in the company with authority to sign for the undertaking terms). 6.3 Click Yes or No radio button against Is the Undertaking accepted? and, if rejecting undertaking/ clicking No, type in a reason in the field below. 6.4 If you clicked No, the work item will go back to the WSC to fix and resubmit (and this instruction goes back to step 5 above). 6.5 If you clicked Yes, go to step 7. ***** Step 7: DSO/ WSC Review NOR Requirements / Outstanding Conditions A field has been added to the Review NOR Requirements work item called MLIM Undertaking Received. 9 7.1 DSO will make sure that the MLiM undertaking has been received and select either the Yes or No radio button. (Remember that if the MLiM requirement was waived (back in step 5) the WSC only needs to attach a copy of the supporting from MLiM Operations.) NOTE: DSO - Check that the Review MLiM Undertaking work item is not sitting in your work queue. 7.2 If DSO selected No, the WSC is notified via the Outstanding Conditions ** work item. To complete that work item, the WSC will attach the MLiM undertaking to Attach Document and release the work item. NOTE: WSC - Check that the Submit MLiM Undertaking work item is not sitting in your work queue. DSO will make sure that MLiM undertaking has been received and select either the Yes or No radio button (in the Review NOR Requirements work item). 7.3 Once the DSO selects Yes, this instruction ends. **NOTE: A new condition statement MLiM Undertaking has also been added to the (WSC) Outstanding conditions work item. Definitions Term Developer Development Services Officer (DSO) e-developer Multi-level development (or building) Multi-level individual metering (MLiM) Notice of Requirements (NOR) Section 73 Certificate (S73) Water Servicing Coordinator (WSC) Definition A person who either: has been given an approval under Part 6, Division 9 of the Sydney Water Act 1994 and is seeking a Section 73 Compliance Certificate, or is seeking approval to adjust, deviate or extend an existing Sydney Water asset on whose behalf the WSC has made an e-developer Application. Officer of Urban Growth business area within Sydney Water who manages the developer process. An internet deployed software application that manages and distributes work items to all users according to pre-defined rules. Development with more than a ground floor that is not a house, townhouse or terrace. (Note: Ground floor is counted as a floor (or level ).) A requirement that certain types of multi-level development need to either set their plumbing up for, or install, individual metering of each strata or stratum lot. A formal notice issued to the developer by Sydney Water under Section 74 of the Sydney Water Act 1994, in response to an application for a Section 73 Certificate. Also known as Notice Letter. A Subdivider/Developer Compliance Certificate issued under Division 9 Section 73 of the Sydney Water Act, The Listed Provider who manages the application, design and construction of any water, wastewater or stormwater works for asset creation and asset protection.
