Approval of Meeting Agenda Commissioner Ische moved to approve the agenda as presented. Commissioner Look seconded, and the motion passed by voice vote. Agenda Item #3. Consent Items (a) SWMCB September 28, 2016 Draft Meeting Minutes (b) Checks and Claims Commissioner Ische moved to approve the minutes of the September 28, 2016 meeting and the checks and claims as presented. Commissioner Callison seconded and the motion passed by voice vote. Agenda Item # Work Plan and Budget; Resolution # Trudy Richter, SWMCB staff, provided an overview to the Board on the Draft 2017 Work Plan and Budget which includes solid waste policy development and legislative advocacy; research beneficial to the region; opportunities to share best practices and host county staff educational opportunities; regulatory programming and regional data collection; as well as an evaluation of the role and services needed by SWMCB beginning in Ms. Richter informed the Board that the 2017 budget has been reduced by 12 percent. Commissioner Callison moved that the Board approve Special Resolution # approving the 2017 SWMCB Work Plan and Budget and setting the assessment formula for Special Project Costs, as presented; and that upon adoption of the assessment formula by the SWMCB for Special Project Costs, each member county shall take necessary action on its assessment to participate in the 2017 SWMCB Work Plan and Budget in an amount equal to its base and formula based assessment as stated. Commissioner Reinhardt seconded and the motion passed on a roll call vote as noted below. 2

Anoka County Attorney Services for SWMCB Ms. Richter asked the Board to approve an agreement with the Anoka County Attorney s office for legal fees in the amount of $5,000 in 2016, and $10,000 in 2017, for the provision of legal services to SWMCB. SWMCB s former attorney, Harry McPeak, Assistant Ramsey County Attorney, retired in July. Commissioner Reinhardt moved to approve the new contract, Commissioner Look seconded, and the contract passed by voice vote. Agenda Item #6. Overview of Organics Management in the Region Paul Kroening, Hennepin County, and Kate Bartelt, Ramsey County, provided the Board with an overview of the Organics Management Panel they facilitated at the July Board meeting. A good discussion followed with additional information requested of staff including drop off and curbside costs for managing residential organics, as well as organics management options, locations and tipping fees. Updates Chair Workman updated the Board on SWMCB s October 17, 2016 meeting with MPCA Commissioner Linc Stine. She reminded the Board that the Board s last meeting for 2016 will take place Wednesday, November 30, 2016, at Metro Counies Government Center. BACKGROUND/JUSTIFICATION The Fiscal Management and Reporting Procedures adopted 15 years ago by the Board in January 2001, set forth the procedure for payment of invoices submitted to the SWMCB. The procedure states that, No payment on any professional services contract invoice, or any invoice for services performed by a consultant or any other person or organization providing professional services, shall be made unless approved by the Chair, Vice-Chair and fiscal agent, so long as the payment is within the overall contract amount approved by the Board or Chair. In the absence of the Chair or Vice-Chair, the Secretary/Treasurer may also approve such payment with the Chair or Vice-Chair. The Chair shall report to the Board, and the Board shall ratify, any such payments for professional services at its next meeting. The Chair and Vice-Chair have previously approved for payment the following invoices: Jill Brown: Payment of $3, for August and September communication services (Contract # ) EI: Payment of $8, for July-September project work (Contract # ) Anoka County: Payment of $5,000 for legal services (Contract # ) RRA: Payment of $29, for October professional services (Contract # ) RRA: Payment of $2, for October expense reimbursement (Contract # ) Stoel Rives: Payment of $2,000 for legal services (Contract # ) The Chair and Vice-Chair have also previously approved the following Community POWER grantee payments: Grantee Payment Amount Lao Assistance Center of Minnesota $2,000 National Sports Center $1, District 10/Como Community Council $2,400 Minnesota Landscape Arboretum $1,020 4

7 REQUEST FOR BOARD ACTION 2017 Legislative Principles 11/30/2016 BOARD MEETING DATE AGENDA ITEM NO. 5 BOARD ACTION REQUIRED: Approval of the 2017 SWMCB Legislative Principles BACKGROUND/JUSTIFICATION: Annually, the Board adopts legislative principles to provide guidance to its lobbyists. During the session, the lobbyists seek additional guidance from SWMCB s Executive Committee, if needed, and if a full Board meeting is not imminent. 8 The Solid Waste Management Coordinating Board Adopted: The Solid Waste Management Coordinating Board (SWMCB) is a joint powers board comprised of two commissioners from Anoka, Carver, Dakota, Hennepin, Ramsey and Washington counties. To enhance intergovernmental coordination, the SWMCB also includes ex-officio representation from the Minnesota Pollution Control Agency (MPCA). Member counties work together to increase the efficiency and environmental effectiveness of the region's solid waste management system to benefit taxpayers of the region. The SWMCB is the regional forum for policy development to improve waste management outcomes in the region and state Legislative Principles 1. The SWMCB supports the State s statutory goals in Minn. Statutes 115A.02, including the solid waste management hierarchy that prioritizes recycling, composting, and processing over landfilling. The SWMCB supports measuring the progress made on Minn. Statutes 115A.02 s environmental and public health goals through waste management programming that will: Reduce the amount and toxicity of waste; Separate and recover materials and energy from waste; and Reduce landfilling. The SWMCB also supports reducing barriers for developing new processing technologies. 2. The SWMCB supports local governments providing and planning for solid waste and recycling services. The SWMCB opposes pre-emption of local control and unfunded mandates. 3. The SWMCB supports SCORE funding to supplement local government funding of recycling and opposes SCORE funding being diverted to non-environmental purposes. The SWMCB supports SCORE funding to increase jobs, enhance economic development, and incentivize local governments to augment current recycling programs. The SWMCB supports an improved business environment for Minnesota with the development of recycling market initiatives to enhance the state s economy and support state recycling goals. The SWMCB supports county/business partnerships to educate and assist in the implementation of the commercial recycling mandate. 8

9 4. The SWMCB supports replacement of all diverted funds as well as fully funding Metropolitan Landfill Contingency Action Trust Account (MLCAT) and Closed Landfill Investment Fund (CLIF). These two critical programs ensure landfills, when closed, remain protective of our environment and water resources. 5. The SWMCB supports product stewardship programs that include the basic principles of producer responsibility to provide environmental protection, local government cost recovery, indemnification of government from any product liability, and measurable and enforceable goals. 6. The SWMCB supports the Legislature identifying resources to increase organics collection and management and to reduce food waste. The public and private sectors need resources to facilitate increased organics recycling efforts. 7. The SWMCB supports the MPCA ensuring compliance with Minn. 10 REQUEST FOR BOARD ACTION Transition Planning: Introduction of Process 11/30/2016 BOARD MEETING DATE AGENDA ITEM NO. 6 BOARD ACTION REQUIRED: N/A BACKGROUND/JUSTIFICATION: Following an RFP process, Phil Eckhert has been hired under RRA s contract to provide an independent evaluation of the SWMCB, its key functions and effectiveness. In 2017, the SWMCB s normal five year procurement for consultant services going forward into 2018 and beyond will occur. Through the transition planning process, the Board and policy staff will evaluate the continued need for regional activities and functions. 11 REQUEST FOR BOARD ACTION Contract Approvals: Scopes and Budgets 11/30/2016 BOARD MEETING DATE AGENDA ITEM NO. 7 BOARD ACTIONS REQUIRED: The Executive Committee recommends approval of 2017 Vendor Contract Scopes and Budgets; approval of an extension of term only to June 30, 2017 for Environmental Initiative to complete its contract scope working with corporate level chains and property managers; and approval of a contract with Waste Wise for $23,580, using budget available for SWMCB s 2016 Work Plan research, to work with County staff on multi unit recycling barriers (specifically enclosure designs) and the impacts of State Building Code and of local ordinances. Upon approval of these contract amendments, the Board directs Chair Workman to execute agreements as indicated above following legal review. BACKGROUND/JUSTIFICATION: The 2017 Work Plan and Budget adopted last month anticipated a certain level of services and budgets from various individuals and entities to perform the work needed to fulfill the Work Plan objectives. These firms were selected for contracts for up to five years with scopes and budgets negotiated annually. This is the final year of the five year contracts. In addition, there is a contract with Anoka County Attorney s Office for joint power board legal services. Environmental Initiative has been working since the last quarter of 2015 with a focus on engaging, at the corporate level, retail chains and property managers region-wide. EI continues to work to identify alternatives for successfully reaching the corporate level for company-wide recycling changes rather than chain location by chain location. This work continues to be timely since the adoption of a commercial recycling mandate which took effect January This is an extension of term only to complete the original contract scope and provide recommendations. A $23,580 scope of services with Waste Wise is proposed to continue the work of county staff with multi unit residential recycling. Waste Wise will research and identify current codes, local ordinances and preferred designs for improving existing solid waste enclosures. Collaborating with a diverse group of stakeholders, Waste Wise will develop a Work Plan to address specific and actionable next steps for improving existing enclosures currently creating barriers to recycling for both multi unit residences as well as strip mall commercial establishments. 11

12 PREVIOUS ACTION ON ITEM, IF ANY: In October, the Board adopted a 2017 Work Plan and Budget for services requiring the Vendor Contract Scopes and Budgets presented herein. Environmental Initiative is already under contract for the scope requesting an extension in term only. In 2016, multi unit county recycling staff has worked on various tools for increasing recycling including meetings with regional haulers, distribution of educational items and a workshop with architects and haulers, property managers and cities to better understand the challenges presented by enclosures for multi-unit residents. The work proposed by Waste Wise is to continue the focus on enclosures by researching codes and ordinances and collaborating with stakeholders on enclosure needs and designs to provide a work plan and recommendations for next steps. 14 CAPITOL HILL ASSOCIATES Legislative Advocacy and Intergovernmental Relations Contract Term: January 1, 2017 December 31, 2017 Contract Amount: $58,500 Scope of Services Advise the SWMCB on governmental and legislative affairs including the following services: Attend SWMCB, Executive Committee and Policy Staff meetings, as needed. Work with SWMCB Management Consultant and policy staff and provide strategy for implementing SWMCB s 2017 legislative principles. Develop strategies for the legislative session related to SWMCB s 2017 legislative principles including SCORE, CLIF, MLCAT funding as well as issues that may be raised related to landfill abatement including waste hierarchy goals and restriction and disposal, the advancement of new technologies, recycling market development and product stewardship. For any SWMCB initiated legislation, identify and secure bill authors. Work with key legislative committee chairs, members and staff to advance SWMCB legislative initiatives. Assist with the preparation and dissemination of background materials and work with SWMCB staff and commissioners to provide testimony on solid waste issues impacting the SWMCB. Share legislative platform specifics with Governor s Office staff and appropriate Administration officials. Work with other stakeholders and develop coalitions, as necessary, to advance the SWMCB s legislative platform. Regularly monitor all committee hearings with jurisdiction over solid waste finance and policy issues. Review all bills and amendments introduced during the legislative session and determine impact on SWMCB priorities. Assist SWMCB with intergovernmental relations with relevant state agencies. Identify opportunities for SWMCB to more effectively integrate solid waste policy with the State s energy, environmental and economic development issues. 16 Gorton Studios Website Management Services Contract Term: January 1, 2017 December 31, 2017 Contract Amount: $25,000 Scope of Services Website tasks 1) Provide web management and technical services necessary to maintain and update rethinkrecycling.com using the Drupal content management platform. Specific tasks may include, but are not limited to: a. Implement changes to navigation and content organization as requested. b. Assist SWMCB staff with broken link reports and repairs. c. Identify and implement security updates and complete monthly site reviews for errors and other issues. d. Provide server support, when necessary. 2. Provide support to SWMCB staff on website measurement using Google Analytics. 3. Manage content management system user settings and permission levels. 4. Provide as-needed support and training to SWMCB staff on using the content management system. 5. Provide technical advice generally for the websites and related technological improvements including evaluating future website needs for purposes of preparing an RFP for future website services. 6. Coordinate the evaluation, research and recommendation efforts on various regional topics through the creation of SWMCB subcommittees as directed by Policy Staff. Coordinate work of all SWMCB vendors to meet Work Plan objectives. Assist in the coordination of SWMCB s transition planning and implement changes agreed to by the Board. Assist in identification of non-msw regional issue development Coordinate evaluation and possible changes to regional hauler licenses and the Joint Powers Agreement. Manage communications and website usage analytics. Respond to inquiries from the public and staff via the websites, social media sites, and direct contact. Present and/or provide reports to the Policy Team, Executive Committee and the Board on items related to communications and outreach. Legislative Advocacy, 2017 Legislative Initiative Planning, and Intergovernmental Relations Provide regular coordination over lobbying activities to ensure that efforts remain consistent with SWMCB priorities. Work with lobbying firm to prepare briefings/testimony talking points for SWMCB members and/or staff. Coordinate SWMCB efforts regarding MPCA rulemaking, legislative initiatives, and meetings between MPCA leadership and SWMCB members and/or staff. Assure participation by SWMCB in product stewardship initiatives. Coordinate SWMCB interests with Greater Minnesota on E Waste contract issues post statute revisions. Coordinate the development of 2018 legislative platform and policy development. Coordinate the development of scopes and contracts for needed research and manage work of selected vendors. Data Collection and Research Support work of SWMCB for data gathering and transitioning to MPCA long form and new ReTRAC Reconnect system. Manage vendors responsible for data management. Evaluate data needs and whether or not ReTRAC Reconnect meets all of the counties data needs for county master plan responsibilities. Manage research vendor procurement and work scopes. General Administration Oversee all financial management and contract implementation activities by: o Managing the SWMCB's accounting system. o Managing all SWMCB contracts and contractor invoices. o Managing financial reporting requirements and preparing financial reports to the SWMCB. o Preparing technical and other budget amendments, as needed. 7 P a g e 19

20 o Coordinating with Dakota County, the SWMCB financial agent, to retain and disburse all funds on behalf of the SWMCB and provide other financial management and reporting services, as needed. o Developing a 2017 budget to compliment the 2017 work plan. o Negotiating one-year, 2017 contract extensions for needed contractors. Provide all Board and committee administration activities for the SWMCB by: o Coordinating six Board meetings. o Coordinating up to six Executive Committee meetings. o Convene monthly policy and as needed communications SWMCB staff meetings. o Purchasing supplies and website domain registrations; managing printing, postage, and meeting expenses. o o Managing SWMCB file sharing library when developed. Collaborate with Stakeholders to Develop a Work Plan to Address Specific and Actionable Next Steps for Improving Existing Enclosures for Recycling Needs. Proposed Goals: The goals of this work plan and budget are to work closely with SWMCB s subcommittee on multi-unit residential recycling to: Research current building codes and local ordinances that influence the design of solid waste enclosures found at existing multi-unit residential sites and commerical sites, where similar issues are in evidence. Meet with stakeholders to determine what aspects of existing ordinances or codes result in the most effective enclosures to allow for necessary hauler operations, resident access and protection from nuisances. Interview ten-fifteen local city planners as to their interpretation of their current codes/ordinances. Develop an enclosure inventory checklist which will be used by members of the stakeholder group to gather data on existing enclosures in their community. This data will be used to inform the development of enclosure modification designs/guidelines. Based on data collected from the enclosure inventory process, discuss up to 3 enclosure modification designs/guidelines that would meet the stakeholder groups preferred upgrade parameters for existing enclosures. Make recommendations on next steps for a work plan that may include, but not be limited to, the development of model ordinances or designs for use in the SWMCB region to address current enclosures to have the flexibility needed to accommodate increased recycling and organics management. 22 REQUEST FOR BOARD ACTION Community Power: Its Legacy 11/30/2016 BOARD MEETING DATE AGENDA ITEM NO. 8 BOARD ACTION REQUIRED: N/A BACKGROUND/JUSTIFICATION: SWMCB voted in the Fall of 2015 to discontinue its Community POWER (Partners On Waste Education & Reduction) Grant Program, an Environmental Education grant program that existed from 2002 through Grants for Round 15 were awarded in August 2015 and all grant-related activities have now been completed as of November, During its 13 years of investment, SWMCB distributed $2.1 million to 159 individual county and 40 multi-county grantees. More than one hundred community organizations actively engaged 110,000 residents, and more than 3 million people were reached with waste and toxicity reduction and recycling messages. In final recognition of the many community groups that have participated in SWMCB s Community Power Grant Program, two grantees will present short examples of work they were able to perform as a result of SWMCB s grant program. Bancroft School / Art Your Engines Hennepin This group was one of the pilot grantees receiving a two year grant award. They built upon their previous grant project of engaging the 3rd grade students, school staff and 3rd grade classroom families in recycling, waste reduction and toxicity reduction education. They hosted the school Wellness Night during their two years, assisted the 3rd graders in writing and preforming a Green Play, and helped the students make puppets for the play out of recycled materials. They had an interactive learning booth at the all-school carnival and created project idea books for all of the Bancroft teachers to use in future lesson plans. Grant Amount $12,000 22

23 Sisters of St Joseph s / Sarah s an Oasis for Women Ramsey Sarah s an Oasis for Women provides transitional housing for single (mostly Somali) immigrant women who learned about recycling and waste reduction in their first year in Round 14 of the grant project. In the second year, now Round 15, Sarah s staff continued to educate the women on the new house rules at Sarah s about what they can and cannot recycle, how to properly dispose of toxic waste and read the content labels, and how to generate less waste. The women were encouraged by new Recycle/Garbage/ Organics bins now placed throughout Sarah's residency in the bedrooms, bath, kitchen and common room. All new residents to Sarah s housing are provided with one-on-one education of the house waste reduction rule at their orientation. The mandatory monthly meetings now offers waste reduction education in the form of speakers, games and resource materials. When leaving Sarah s, these women are prepared to continue their waste reduction and recycling efforts.
