1 Rob McKenna ATTORNEY GENERAL OF WASHINGTON Consumer Protection Division 800 Fifth Avenue Suite 2000 MS TB 14 Seattle WA (206) REQUESTS FOR PROPOSALS The Washington State Attorney General s Office enforces the state s Consumer Protection Act and other state laws that protect consumers. Its mission is to secure a competitive marketplace free from deceit and unfairness. The Consumer Protection Division achieves this mission by: providing consumers with fraud prevention information, doing business training to promote voluntary compliance, offering an informal complaint mediation process, taking legal action, and working for changes through the legislative process. The settlement of lawsuits brought by this Division sometimes results in restitution money that is set aside to fund consumer education or business training projects outside our office. These funds must be used to remediate the harm caused by the actions which gave rise to the settlement, which can be general or specific depending on the language used in the court order. The specific language of each court order resolving the case directs the subject matter limitations of cy pres ( next best use ) grants. We will alert interested groups--including those who notify us that they are interested in our funds-- when we are ready to review grant requests for specific funds. Current Request for Proposals: REQUEST FOR APPLICATIONS FOR PROJECTS TO PROMOTE MENTAL HEALTH: Projects in Washington state aimed at promoting mental health; emphasizing programs that are targeted at low-income, elderly or vulnerable consumers or to ameliorate the negative effects of over-prescribing and inappropriate off-label use of mental health drugs. The specific fund availability and controlling court order language is: Geodon/Pfizer ($790,000) ; Said payment shall be used by the States to fund or assist in funding programs directed at mental illness treatment, including but not limited to education and outreach or for other uses permitted by state law, at the sole discretion of each Signatory Attorney General. Caremark ($154,000): States that receive a Monetary Portion shall make a cy pres distribution of these funds, pursuant to a state-specific Cy Pres Distribution Plan, to a political subdivision(s)

2 thereof or to a state agency or program, a non-profit corporation(s) and/or a charitable organization(s), at the sole discretion of the Attorney General of each respective State, with the express condition that the funds be used to benefit low income, disabled, or elderly consumers of prescription medications, to promote lower drug costs for residents of that State, to educate consumers concerning the cost differences among medications, or to fund other programs reasonably targeted to benefit a substantial number of persons affected by the Covered Conduct that is the subject of this Consent Decree. Deadline for physical receipt of grant applications: November 19, 2010, 5:00 p.m. (PDT) Resolution documents are attached as Addendum A. Funding Focus The AGO has resolved many cases in which the court has approved using funds recovered for consumers in a cy pres restitution or next best use manner. For example, courts have restricted funds to support consumer education or awareness in specific areas, such as technology, privacy, identity theft, or other general consumer protection issues. Although the AGO s selection criteria are dependent upon a number of factors, the AGO Grant Selection Committee typically awards funding to projects that meet a combination of the following criteria: reach the population of consumers who were harmed by the unfair or deceptive practice, reach underserved populations, offer the greatest public benefit potential per dollar spent, or provide a unique or necessary service to the state. Projects should be strengths-based and applications should detail those strengths and along with your strategies achieve your project goals. Applications should also describe approaches and methods tailored specifically to the needs of targeted constituents in your service areas. Contract Period This is a one-time grant opportunity. Projects should be operational within 12 months of the grant approval date and have established results within 24 months. Organizations receiving funding from the AGO are required to provide a status report and final report See sample agreement attached as Addendum B. Grant Uses and Limitations The AGO does not provide funding for general operating costs, including salaries and benefits for staff. Administrative costs must be limited to 10 percent of your project budget and the AGO requires that the majority of your budget be used in providing direct goods or services to constituents. Capital investments such as computer hardware and audio/visual equipment are considered inappropriate expenses, should be available as part of an organization s infrastructure and should not be acquired using grant funds. Geographic Reach The Office of the Attorney General is interested in receiving proposals that will be targeted within Washington state. Applicants are encouraged to seek out collaborators around the state in order to reach as many regions as possible. Where appropriate to achieve statewide scope, partnership projects of different agencies or institutions are encouraged. Although it is not a requirement, proposals that include commitments from other sources of matching funding, supplemental funding, and/or other resources, for the purpose of funding a project of statewide coverage or reaching as many geographic or population areas around the state as possible are encouraged.

3 Who Should Apply 501(c)(3) private non-profit organizations, tribal organizations, public or private schools, or local, county or state government entities serving Washington state consumers may apply. Grants are available to any organization currently receiving funding from the Consumer Protection Division Cy Pres grant program; provided that the organization is current in its reporting requirements under the existing agreement. Organizations must have the capacity to implement their proposed project within the time period stated above. Each letter must specify the partnership agreement, and how the partner will support the project. Project Evaluation (20 points) List two goals you expect to achieve as a result of this project. List two outcomes you expect to see as a result of achieving those goals.

A detailed and accurate budget must be kept, and any significant increase or decrease to a budget line item must be reported to the AGO. Although the format of the reports is not a condition of the grant award, reports must include a budget detail of progress to date, project narrative which includes measurables such as constituents reached, number of new clients, direct contacts made with the community, new partnerships developed, and copies of any collateral material produced in the process of program delivery, including all relevant financial attachments. A sample report form is attached and complies with our requirements. These reports must be signed by an authorized officer of your organization. If there should be any changes in your organizational leadership or key personnel during the term of the grant, please inform our office immediately. All reports shall be sent to Mary Gould, Outreach & Education Coordinator at the Washington State Attorney General s Office, Consumer Protection Division, th Ave., Suite 2000, Seattle, WA Any funds that have not been used in the delivery of the agreed upon services must be returned to the AGO no later than Month day, year. Record Maintenance and Inspection: By signing this document, you agree to maintain adequate records to enable expenditure and stewardship of the grant funds to be easily confirmed. Be prepared to support all expenditures made with AGO monies through documentation, including receipts and invoices. You also agree to make your books and records available for inspection at reasonable times and permit the AGO to monitor and conduct an evaluation of operations under this grant. Such an evaluation may include a visit by AGO staff 2

84 to observe your organization s project, a discussion of the project with your organization s staff, and a review of financial and other records connected with this grant. Compliance: If the AGO deems the progress of your project for which you have received grant funds unsatisfactory, we reserve the right to terminate the grant and request that any unspent grant funds be returned. An unsatisfactory performance may also preclude your organization for grant award qualification in any future grant cycles. Public Records: Information regarding this grant may be publicly disclosed. If your organization would like to make a public announcement about this award, please provide our office with the opportunity to comment in advance on the proposed media release. 85 Grantee Reporting Guidelines During the term of the grant, it shall be required of to provide both interim and final written reports to the Attorney General s Office. Please refer to your grant agreement for a schedule of your report due dates. The report should include a narrative and all relevant financial attachments. If the grant to your organization supported a particular project, the report should focus specifically on that project. Please submit one hardcopy and one digital copy via . Other documents may be requested by the grant administrator. Such periodic reports are necessary not only for proper oversight to ensure accountability, but also serve as a valuable learning tool for both your organization and the Attorney General s Office. Narrative Report Requirements 1. Please limit answers to each of the questions below to no more than one page. 2. Describe your progress towards the grant outcomes that were outlined in your proposal. a. What has been the actual impact for participants due to your program? b. If the project delivered services, please indicate numbers of clients served. c. Please describe clients demographic information such as race/ethnicity, age, gender and geography as appropriate. 3. In writing your interim report, please focus on reporting both your progress up until the time of the report as well as on describing how you plan to proceed. 4. Describe your successes and accomplishments as well as the challenges you have encountered. a. How did you respond or how do you plan to respond to the challenges of your project? 5. Give specific examples highlighting any changes in your project plan, timeline, staff or finances that affected the project s outcomes. Include a summary on any adjustments you have had to make on your original proposal. 6. Describe your future goals and plans for the program.

86 7. In the final report, please inform us of whether the grant was beneficial or ineffective in regards to your project and include an evaluation of your project. In doing so, please describe the method you used to evaluate your project. Financial Report Requirements 1. Using an excel spreadsheet provide the AGO with a detailed budget report. Please include all actual versus budgeted expenditures. Please include specifically how funding from the Attorney General s Office was expended, including all costs associated with the project, staff and contractor salaries, equipment purchases and travel expenses. 2. Please include and explain any significant variances in your budget from what you proposed prior to the commencement of your project in your narrative report. 3. Include an explanation of any left over grant funds, or funds that were not spent on the approved project. 4. Be prepared to support all expenditures made with AGO monies with receipts and/or invoices.
