1 Massachusetts Chapter National Association of Housing & Redevelopment Officials January 2017 NEWS Published by Massachusetts NAHRO Boston, MA Vol. XLI No. 1 DHCD Issues Contract Guidelines and Template On December 27, DHCD issued the long-awaited guidelines for the provisions of housing authority contracts, as required by section 7A of Chapter 235 of the Acts of DHCD Public Housing Notice includes the contract provision guidelines, which are the minimum requirements for a contract of employment, a mandatory cover sheet, and a contract template, all of which were agreed to in concept by MassNAHRO. All three are intended to serve as tools for local housing authorities in the execution of Executive Director contracts, and for DHCD in the review of those contracts. Each submission to DHCD must have a completed four-page Mandatory Contract Cover Sheet to initiate the required review by DHCD. The 14-page template is intended to facilitate prompt review and approval of contracts for those LHAs electing to utilize it. Special contract provisions can be included in the optional rider to the template. Discussions with DHCD on the guidelines, template, and the required cover sheet began over a year ago. The common goal was to provide Boards and s important guidance on contract provisions, allow local flexibility for special provisions in the rider, and to expedite DHCD review and approval of 242 contracts, using a standard template as the vehicle. Approving 242 current contracts in a timely fashion is a daunting task for DHCD staff, given all the variations at LHAs statewide. During this time of major changes, it was troubling that so much time was spent on the back and forth between DHCD and LHAs on contract approvals. Guidance on basic and equitable provisions was badly needed. DHCD and MassNAHRO encourage LHA Boards and s to use the template, as the Legislature has granted DHCD the power to strike any contract provisions that do not conform to the contract guidelines on which the template is based. The Legislature also empowered DHCD to terminate an s contract directly if DHCD finds clear and convincing evidence of a demonstrable threat to tenant safety attributable to the conduct of the or financial misconduct or criminal activity by the, even though DHCD is not a party to the contract. In such extreme circumstances, it is hoped the LHA Board would exercise its duty to terminate a contract long before DHCD needs to get involved. Data is still being compiled on a revision to the salary guidelines. $72 Million in Operating Subsidy Sought in Fiscal 2018 Budget The most crucial MassNAHRO budget objective is to maintain the operational viability of local public housing, while enhancing the quality of life for all residents. New operating subsidy will help local housing authorities to provide the maximum number of apartments available for occupancy by qualified applicants including the homeless, and local families, veterans, and the elderly. As rents are capped by law, subsidy must make up the shortfall between income and budgeted operating costs. However, subsidy has basically been level funded since the 2007 law suit by the Boston, Cambridge, and Brookline Housing Authorities. Now the unfunded mandates in Chapter 235 will place substantial, additional burdens upon LHAs once the regulations are promulgated and costs assigned. The Baker-Polito Administration has consistently vetoed any increase in subsidy, even the meager $500,000 voted by the Legislature twice for fiscal The Governor's request for fiscal 2018 subsidy will be announced in late January. MassNAHRO, and our public housing advocate allies like MassUnion of Public Housing Tenants and CHAPA, are respectfully requesting support of $72 million in Operating Subsidy ( ). Note that six budgets ago Governor Patrick requested $71 million. The actual need is now closer to $80 million. Public housing is a cost-effective alternative to emergency housing in shelters or motels, that can cost $2,500 a month. Three quarters of LHA residents are seniors, frail elderly and the disabled. Subsidy makes up only 25% of LHA operating revenue with residents themselves paying the other 75%! To reduce costs LHAs have formed consortia and energy cooperatives, used regional legal counsel, accessed regional senior service coordinators, established purchasing consortia for utilities and insurance, set up voluntary mutual aid arrangements, plus implemented three new Regional Capital Assistance Teams (RCATs), in addition to many more local initiatives. LHAs have maintained remarkably low vacancy rates but now need new resources to keep units available and to implement all the Ch. 235 reforms voted by the Legislature. $72 million is a reasonable request if public housing is to remain viable. MassNAHRO will issue regular Legislative Alerts throughout the state budget process to keep members informed. The support of your local legislators is important. Please note Legislative Information Day is not until April 13. In the meantime, please reach out to those able to preserve your housing for those most needy.

It s amazing how fast 2016 passed. We made some great progress in 2016 regarding the implementation of Chapter 235. Agreed upon Procedures (AUP) are well underway. Most, if not all, agencies have completed the first AUP draft year and know what to expect for the next review. Regional Capital Assistance Teams (RCATs) are in place, and most agencies have met their RCAT Director. Further, agencies with fewer than 500 state units and have a FYE on December 31 have already worked with the RCAT to plan for their new Capital Improvement Plan (CIP) year. Anyone who is panicky about working with their team should talk to one of the agencies that have completed their 2017 CIP. You will be happy to hear that the RCATs are great to work with and they are making the 2017 CIP easier to plan than ever before. The tenant surveys for the Chapter 200 and 705 units have been completed and about 33% of the residents responded. Results were favorable. Surveys for Chapter 667 will be mailed over a couple of years as there are so many residents. The first batch of 667 surveys have been mailed and responses are plentiful. Nice job to Cate Mingoya and others in DHCD who are working on this project. The statewide waiting list hit some obstacles but is in process with hopes for implementation in It is time to welcome 2017 with new resolutions. Along with the usuals - pay down debt and save more money, exercise, eat healthier and drop some weight - I have added a couple more resolutions. I resolve to enjoy the last few months serving as the Massachusetts NAHRO President and work as hard as I can for the betterment of Massachusetts public housing residents. I resolve to work hard for what is fair and right for the benefit of all who work at a Massachusetts PHA. I resolve to greet all people with a smile and with respect, even those who have been difficult in the past. I resolve to make 2017 a good year! I wish you a happy, healthy and prosperous 2017! 3 January MassNAHRO Dues Statements Issued The 2017 dues statements for all agency and individual members of MassNAHRO have been mailed. By vote of the Board of Directors, agency dues were increased by 2%. The Board recognizes the fiscal challenges confronting LHAs today, so hardship waivers of dues are available upon request. In addition to receiving the monthly newsletter and reduced fees for training and conference activities, MassNAHRO members benefit from the premium savings and dividends from the highly successful Self-insured Workers' Compensation Group. Member LHAs also realize substantial operational savings from participation in the 14-year-old MassNAHRO Section 8 Centralized Waiting List. Both the Annual and Fall Conferences this year won accolades for the excellence of the sessions and the information they provided to the delegates. There are many issues to be resolved going forward in 2017, including LHA funding, implementation of the Housing Portal centralized list in July, Board Member Training this spring, monitoring of the planning year for the Performance Management Review, employment contract and salary guideline revisions, management agreements, and much more. Agencies and individuals are kindly requested to return their dues statements at their earliest convenience. Thank you for your continued support of the Association. Agency membership includes all five Board Members and the of each member authority. Individual and Affiliate Memberships are available as well. Regional Capital Assistance Moves Forward The three regional capital assistance teams (RCATs), based at the Taunton, Leominster, and Chelmsford Housing Authorities, are moving forward in providing services to their respective regions. These LHAs increased staff to provide services regionally to other LHAs, beginning in July. The program is enjoying early success in providing LHAs with technical assistance in activities related to procurement issues, capital improvement planning, and eventually unit turnovers. RCAT services include portfolio needs assessment, capital plan creation and plan maintenance, capital project management, and assistance in securing funds from DHCD for specific projects. Year two will provide services related to creating a maintenance plan, implementing a bulk procurement program and initiating force account crew special projects, such as a unit turnover initiative. The teams are funded through the bonding authorized by the Legislature for LHA capital improvements in the last Housing Bond Bill. Services will be provided to participating LHAs free of charge. LHAs with 500 or fewer stateaided units are required to participate, unless granted a waiver. The goal is to increase the technical capacity available for smaller LHAs to maximize the utility of the state modernization program, and to facilitate collaboration across LHAs to capture economies of scale through bulk purchasing. RCAT project managers have attended MassNAHRO conferences and regional meetings to outline the technical assistance available and how LHAs can participate most effectively. The activities of each RCAT is overseen further by an Advisory Board comprised of 9 members from participating LHAs, 1 DHCD member and 1 member appointed by the host LHA. Each RCAT Host Authority (HHA) has a three-year contract with the option to renew for 2 additional one-year periods. Services may be broken into two categories: Trainings and Direct Services. Trainings are to be delivered to a group audience, and Direct Services will be tailored to meet the needs of each individual LHA in the region. The RCATs are not responsible for orchestrating LHA Board approval or tenant engagement around an LHA s Capital Improvement Plan (CIP). The RCAT is also not responsible for managing the public process relating to the LHA annual plan. These three matters are the responsibility of the LHA. However, the RCAT will be available to advise LHAs on managing these if requested. The RCAT Directors meet monthly at MassNAHRO. 3 9C Budget Cuts Face Legislative Scrutiny Due to revenue shortfalls, Governor Baker implemented emergency 9C cuts to the FY 2017 state budget in December. The cuts will not have an impact on the housing authority subsidy account for FY The FY 2017 Budget Guidelines issued by DHCD increased the Non-Utility Allowable Expense Level (ANUEL) cap by 3% on LHA state-aided budgets. The Administration and the Legislature recognize the importance of funding the changes mandated by the new local housing authority law and keeping the maximum number of apartments available for occupancy. Reforms will be implemented locally for both RCATs and the Centralized Waiting List Housing Portal. Both are intended to generate some operational efficiencies at the local management level. The Legislature has indicated that the tax revenues for the holiday season will make up the shortfall the Administration is projecting, and that a supplemental budget will be taken up that would restore the 9C cuts once again, including those impacting MRVP ($2.4M), housing authority subsidy ($500,000), and other affordable housing and homeless initiatives. 4 4 Housing Committee Meets with State Public Housing Officials On December 8, the MassNAHRO Housing Committee met with DHCD Associate Director Sarah Glassman, Director of Housing Development and Construction Amy Stitely, Director of Housing Management Laura Taylor, and Director of Planning and Policy Cate Mingoya. Brief summaries of agenda items appear below. Performance Management Review - DHCD is testing the FMS physical condition tool to be used during the PMR at several sites. LHAs should refer to the Fall Conference power point (handout) available online. The 12/31 LHA reports are due February 14. Technical assistance for the facilities management component is still available. The FMS team works well, but each FMS does things a little differently. Management Agreements - DHCD is awaiting financial analysis data and several sample scenarios from TAG, the consultant. They are reworking several of the draft documents and crunching numbers. MassNAHRO will check back with TAG as to their progress. Contract Guidelines and Template DHCD issued the ED Contract Guidelines/Template (PHN # ) and the ED Hiring Guidelines (PHN # ). The ED Salary and Qualifications Schedule and the FY2017 Budget Guidelines, currently in effect, should be referred to by LHAs when setting the salary for a new ED or providing any increase to an existing ED. In the meantime, DHCD plans on issuing an update/ revision to the Budget Guidelines to address salary/cap until the comparability study is completed. Approximately, 12 LHA budgets are being held up due to contract issues. The impacts could be related to section 7A of Chapter 121B and DHCD's striking of non-guideline compliant provisions. Comparability Study - DHCD is using MHP to do the procurement. The scope will include local and out of state PHAs, for profit housing managers, CDC executive directors, local public managers and others. MassNAHRO has retained The Nelrod Company to do a HUD criteria-based comparability study. The Nelrod survey has gone out with the results expected in February. They will be shared with DHCD. There will be no budget exemptions for salary increases. Any increases have to be within what the LHA can afford. Reasonable allocations should be based upon workload and programs. The DHCD study may require a separate survey if the Nelrod one doesn t cover all data. Combining findings should render a comprehensive analysis to base new salary guidelines. DHCD will work with LHAs on the study, but do not plan on putting the draft out for comment by LHAs prior to publishing. AUP Planning Year - The information presented at the Fall Conference is on the DHCD web page, including 7 common findings. A lengthy debate followed on the Board's signing of time sheets. DHCD promised to look at this. (Since the meeting, DHCD removed the item from the AUP protocol.) Mandatory Board training will soon address the appropriate level of Board oversight. Under the new procurement January 2017 law, LHAs may need to use Ch. 149 for procuring service contracts. LHAs should reach out to the AG and IG regarding LHA implementation of new procurement laws in regard to costs and prevailing wage and the possibility of increased costs. It was noted that the service contract portion of the guides sent in a PHN seem to not require payment of prevailing wage. DHCD will look into it. Vacant Unit Funds - The new streamlined process was published in a PHN on November 4 to expedite the use of funds to get units back on line. Director Stitely referred the Committee to the notice. The ability of LHAs to revise their CIP was discussed. Regulations Round Two - The process was outlined. There is a second draft of 760 CMR sections 4, 6, 11, and 63. Time will be provided in January for written comments only but no hearings. DHCD listened to the comments and made what they feel are good revisions. Miscellaneous Items - The 9C cuts will not impact LHA budgets. The Public Housing Community Development Committee's recommendations are on the Governor's desk, along with several new policy recommendations. The ModPHASE awards will be made in January. DHCD recommended going forward with capital projects assuming no awards. DHCD also recommends that applicants develop supportive services components anyway to be more competitive in future rounds. The online Board training is close to being rolled out, perhaps in February or March. The Tenant Training Project is under development at the Mel King Institute. MassNAHRO is participating in the planning. There are two parts, orientation and education on specific targeted areas like budgets, etc. The Housing Portal roll out is set for June. Data migration is scheduled to begin in September. The contractor DHCD selected is Zagaron. The Elderly Tenant Satisfaction survey (year 1 of 3) is getting a 60% response rate. LHA have 60 days to respond to the recent family survey. Cover letters are going out. Where family samples were small, the results will be held and merged with the 667 surveys to protect tenant anonymity. The definition of veteran is that found in section 1 of 121B. It lists the family members eligible for veterans preference. 5 January Nominating Committee Accepting Letters for Board President Lisa Audette has named the 2017 Nominating Committee of the Association. Serving as Committee Chairman is former President Ray Murphy of Holyoke. Joining Ray are Life Members Tom Wade, formerly of Watertown; Brian Cloonan, formerly of Brookline; and our National NAHRO President Steve Merritt of Norwood. Also serving are new Committee Members Brenda Peacock of Bedford who is also President of the North Shore Housing Association; Julie Torres of Hudson; and outgoing President Audette. The seven-member panel is charged with formulating a slate of candidates for the MassNAHRO Board to be voted on by the membership at the election at the Annual Conference in May at the Sea Crest Hotel in North Falmouth. MassNAHRO Members in good standing interested in serving on the Board of Directors should sent a letter of selfnomination by February 17 to: Chairman Raymond P. Many questions remain on the implementation of the changes mandated by vote of your legislators. Come share your thoughts and views with those who voted for the new law. Explain the challenges you face locally and the impact of state operating subsidy on your fiscal viability, your residents, and your ability to implement all the additional regulatory and program changes coming in Securing new resources will be a great challenge as will funding for resident services. The squeaky wheel gets the grease. Legislative Day in the Great Hall of the State House is an excellent opportunity for legislators and local housing officials to join together in advocating for preserving housing and for services that aid local constituents. Legislators need to be kept informed about how your LHA responds to the needs of seniors, veterans and the homeless. Legislative Day has proven to be vitally important for meaningful communication between your authority and your elected representatives to the Legislature. Please save the date! The Violence Against Women Act (VAWA) The Violence Against Women Reauthorization Act (VAWA) of 2013 was signed into law on March 7, This change expanded VAWA protections and contains new notification and transfer requirements. The Final Rule was published in the Federal Register on November 16, HUD also published a new Notice of Occupancy Rights under the Violence Against Women, Model Emergency Transfer Plan, Model Emergency Transfer Request form, and HUD Certification form. PHAs must implement emergency transfer plans by June 14, Come to this training for a refresher on existing PHA requirements relative to VAWA as well as a discussion of HUD's new final rule. 6 6 MassNAHRO Insurance Group Extends Audit & Actuarial Contracts At its December quarterly meeting, the seven member Board of Directors of the MassNAHRO Insurance Group executed contracts with an audit firm and actuarial firm to produce the required annual reports on the activities and fiscal health of the Group for filing with the Massachusetts Division of Insurance and HUD Financial Management in Washington. Selected to conduct the annual audit was Meyers Brothers Kalicka, P.C. of Chicopee. The firm has extensive experience in auditing selfinsured groups. Chosen to generate the required actuarial report was Practical Actuarial Solutions, also with extensive experience in reviewing the actuarial status of the Group. At the same time, the Division of Insurance is conducting the statutorily-required audit of the Group. Additionally, at the meeting the Board reviewed the investment portfolio with a market value of $11.8 million, the consolidated financial reports for the third quarter, and the payment of legacy claims and new claims through December 12. Written premium through September totaled $5.4 million. January 2017 As required by the DOI, each board member executed the annual Conflict of Interest Statement. Group data was submitted to HUD via IBS, a HUD contractor charged with certifying compliance with the 10 PHA Insurance Group performance indicators required by HUD. The Board meets 5 times a year, and oversees and makes policy for the $13 million self-insured group, in conformance with the rules and regulations of the Division of Insurance and the HUD Financial Management Division in Washington. The Group is professionally managed under contract by a third-party administrator, CMS Associates. Administrative and support services are provided to the Group by MassNAHRO. The Group must comply with the 10 HUD performance indicators mentioned above to retain the Group s exemption from competitive bid requirements. 7 January The Everett Housing Authority (EHA) seeks a dynamic, passionate, technically-skilled individual to become its next Executive Director. The will report to a five person Board of Commissioners. This person must be thoughtful and sensitive to the needs and concerns of a diverse population and must possess strong leadership and an ability to resolve conflict. The will be responsible for the management of a total of 1068 housing units and vouchers; 671 State-Aided public housing units in 6 developments, and the administration of 365 Housing Choice Vouchers and 32 Massachusetts Rental Vouchers. A demonstrated ability to work independently with minimal day-to-day supervision is essential. The EHA has a fulltime staff of 22 employees, and receives its funding from the Massachusetts Department of Housing and Community Development and United States Department Housing and Urban Development. Eight years experience in housing management, community development, public administration, or a closely related field. Must have a working knowledge of fiscal management, maintenance systems, personnel and administrative management systems in public or private housing. Five year s supervisory experience of a staff of ten or more is required. Written and verbal skills required. Substantial background in the implementation of management controls and systems. Considerable knowledge of local, state, and federal governmental procedures and regulations as they relate to housing development, construction and the management of local housing authority operations. Experience working with people of various socio-economic backgrounds. Must be bondable. Certification as a Public Housing Manager from a HUD approved organization is required, but may be substituted by certification as a property manager or similar classification by a nationally recognized housing or real estate organization or by certification as a MPHA of a DHCD-approved Massachusetts Public Housing Administrator Certification Program.
