HICKORY, SUITE #324 DENTON, TEXAS In the event of inclement weather and County Offices are officially closed on a RFP opening day, RFPs will be received until 2:00 p.m. of the next business day, at which time said RFPs will be publicly opened. The Enclosed REQUEST FOR PROPOSAL is for your convenience in submitting an offer for the enclosed referenced services for Denton County. Sealed proposals shall be received until 2:00 P.M., Monday, June 22, 2015 MARK ENVELOPE: RFP # , QUEUING SYSTEM TAX OFFICE Denton County is always very conscious and extremely appreciative of the time and effort you must expend to submit an offer. We would appreciate your indicating on any "NO OFFER" response and requirements of this RFP which may have influenced your decision to "NO OFFER". B. IT IS UNDERSTOOD THAT Denton County, reserves the right to accept or reject any and/or all proposals as it shall deem to be in the best interest of Denton County. Receipt of any proposal shall under no circumstances obligate Denton County to accept the lowest proposal. The award of the contract shall be made to the responsible proposer whose proposal is determined to be the lowest and best evaluated offer resulting from negotiation, taking into consideration the relative importance of price and other evaluation factors set forth in the request for proposal. C. PROPOSALS SHALL include all required documents. Each original proposal and all required copies shall be placed in a sealed envelope, manually signed in ink by a person having the authority to bind the firm in a contract and marked clearly on the outside. Facsimile and electronic transmittals shall not be accepted. D. LATE PROPOSALS: Proposals received in County Purchasing Office after submission deadline shall be returned unopened and will be considered void and unacceptable. Denton County is not responsible for lateness of mail, carrier, etc., and time/date stamp Page 2 of 18

3 clock in Purchasing Office shall be the official time of receipt. E. ALTERING PROPOSALS: Any interlineation, alteration, or erasure made before receiving time must be initialed by the signer of the proposal, guaranteeing authenticity. F. WITHDRAWAL OF PROPOSAL: A proposal may not be withdrawn or cancelled by the proposer for a period of ninety (90) days following the date designated for the receipt of proposal, and proposer so agrees upon submittal of their proposal. G. PROPOSALS WILL BE received and publicly acknowledged at the location, date, and time stated above. Proposers, their representatives and interested persons may be present. Proposals shall be received and acknowledged only so as to avoid disclosure of the contents to competing proposers and kept secret during the negotiation/evaluation process. However, all proposals shall be open for public inspection after the contract is awarded, except for trade secrets and confidential information contained in the proposal so identified by proposer as such. H. DISCLOSURE OF CERTAIN RELATIONSHIPS: Chapter 176 of the Texas Local Government Code requires that any proposer or person considering doing business with a local government entity disclose in the Questionnaire Form CIQ, the proposer or person's affiliation or business relationship that might cause a conflict of interest with a local government entity. By law, this questionnaire must be filed with the records administrator of Denton County no later than the 7th business day after the date the person becomes aware of facts that require the statement to be filed as defined in , Local Government Code. A person commits an offense if the person violates Section , Local Government Code. An offense under this section is a Class C misdemeanor. A copy of the law is available at: The forms for reporting are available at: By submitting a response to this request, the proposer represents that it is in compliance with the requirements of Chapter 176 of the Texas Local Government Code. INFORMATION/QUESTIONS: All questions shall be posted to Denton County s on-line bidding services, by the stated deadline. Proposers are responsible for insuring all answers to questions are reviewed prior to proposal submittal. Answers provided to posted questions address minor irregularities and are for clarification purposes only and do not revise or modify the specification requirements. Answers to questions that result in revisions to the specifications will be addressed by Addendum. No oral statement of any person shall modify or otherwise change, or affect the specifications. 4 J. ADDENDA: Addenda are written changes, additions, alterations, corrections or revisions to specifications which change the scope of work. Any addenda issued during the time allowed for the preparation of proposals shall be covered in the proposal and, in executing the contract; they shall become a part thereof. Failure of a Proposer to receive any addendum shall not release the Proposer from any obligations under his proposal, provided said addendum was posted and distributed by BidSync. Proposers are responsible for insuring all addendums are reviewed prior to proposal submittal. All addenda can be reviewed at K. PRE-PROPOSAL CONFERENCE: A pre-proposal conference will be held on June 9, 2015 commencing at 2:00 pm at the Mary and Jim Horn Government Center, 1505 E. McKinney, Room 132/133, Denton, TX A tour of the Denton and Carrollton sites will be held immediately following the Pre-proposal Conference. It is strongly recommended that all Proposers intent on submitting proposals for the project attend the Pre-proposal Conference. L. TERM/PAYMENT: A separate Notice to Proceed and Purchase Order will be issued for each Project. Payment for each Project will be made upon completion and acceptance, and contingent on construction schedules and available funding. Software maintenance will continue until it is no longer useful to Denton County. M. PROPOSER RESPONSIBILITY: It is the responsibility of each proposer before submitting a proposal: 1. To examine thoroughly the contract documents and other related data identified in the proposal documents, to visit the site to become familiar with and satisfy proposer as to the general, local, and site conditions that may affect cost, progress, performance, etc. 2. To consider federal, state, and local laws and regulations that may affect costs, progress, performance or furnishing of the work. 3. To study and carefully correlate proposer s knowledge and observations with the contract documents and such other related data. 4. To promptly notify the County Director of Purchasing of all conflicts, errors, ambiguities, or discrepancies which proposer has discovered in or between the contract documents and such other related documents. N. SUBMITTAL OF CONFIDENTIAL MATERIAL: Any material that is to be considered as confidential in nature must be clearly marked as such by the proposer and will be treated as confidential by Denton County. O. MINIMUM STANDARDS FOR RESPONSIBLE PROSPECTIVE PROPOSERS: Proposer shall submit information on its organization, experience and staff assigned to the project; provide headquarters, nearest office and managing office for the projects stated herein; and show level of organizational responsibility of key projects of staff members by submitting resumes of such. A prospective proposer must affirmatively demonstrate its responsibility by providing evidence of the following requirements: Page 4 of 18

5 1. have adequate financial resources, or the ability to obtain such resources as required; 2. be able to comply with the required or proposed delivery schedule; 3. have a satisfactory record of performance; 4. have a satisfactory record of integrity and ethics; and 5. be otherwise qualified and eligible to receive an award. Denton County may request representation and other information sufficient to determine proposer's ability to meet these minimum standards listed above. P. SALES TAX: Denton County is by statute exempt from the State Sales Tax and Federal Excise Tax; therefore, the proposal price shall not include taxes. Q. DEBT: Denton County reserves the right to reject any proposal submitted by a Proposer who owes a debt to the County. Debt includes delinquent taxes, fines, fees and delinquencies arising from written agreements with the County. R. PROPOSALS/PROPOSERS MUST COMPLY WITH: Proposals/proposers must comply with all federal, state, county and local laws governing or covering this type of service. S. HISTORICALLY UNDERUTILIZED BUSINESS (HUB) CONTRACTING: 1. The goal of Denton County is to ensure all HUBs, as described in the Texas Government Code, Title 10 Subtitle D, Chapter 2161, have maximum opportunities to participate in the County s procurement in awarding of contracts and subcontracts. 2. Denton County will make a good faith effort to increase contract awards for the purchase of goods or services from the HUBs. HUB proposers are encouraged to participate in the county s purchasing and procurement process. While the County is oriented to adhere to good faith efforts, nothing in this effort shall be construed to establish set-asides or mandatory quotas. 3. The County and all prime contractors (if subcontracts are to be let) will take the affirmative steps listed below: a. Placing qualified small and minority businesses and women s business enterprises on solicitation lists. b. Assuring that small and minority businesses, and women s business enterprises are solicited whenever they are potential sources. c. Dividing total requirements, when economically feasible, into smaller tasks or quantities to permit maximum participation by small and minority business, and women s business. Page 5 of 18

6 d. Establishing delivery schedules, where the requirements permit, which encourage participation by small and minority business, and women s business enterprises. e. Using the services and assistance of the Small Business Administration, the Minority Business Development Agency of the Department of Commerce and the Texas Procurement and Support Services (TPASS) Centralized Master Bidders List HUB Directory. 7 II. EVALUATION CRITERIA AND SUBMITTALS A. EVALUATION CRITERIA: The award of the contract shall be made to the responsible proposer whose proposal is determined to be the lowest evaluated offer resulting from negotiations, taking into consideration the relative importance of price and other factors set forth in the Request for Proposals in accordance with the Texas Local Government Code, Chapter 262. The evaluation criteria will be grouped into percentage factors as follows: 50% Proposer s total proposed price 20% Proposer s Support/Service/Qualifications 30% The proposed product and services meeting Denton County s needs, requirements and time constraints/schedule Discussions may be conducted with responsible proposers who submit proposals determined to be reasonably susceptible of being selected for award. All proposers will be accorded fair and equal treatment with respect to any opportunity for discussion and revision of proposals. Revisions to proposals may be permitted after submission and before award for the purpose of obtaining best and final offers as determined to be in the best interest of Denton County. B. RFP SUBMITTALS AND EVALUATION TENTATIVE SCHEDULE: RFP Released: May 26, 2015 Pre Proposal: June 9, 2015 Questions Close: June 11, 2015 RFP Submittal: June 22, 2015 Tentative Interview/Demonstrations July 13, 2015 Tentative Award: August 4, 2015 C. SUBMITTALS: Submittals shall take the form of a bound 8 ½ inch by 11 inch proposal with a Table of Contents and all pages numbered. Each section shall be clearly identified and tabbed as listed below. For proper comparison and evaluation, Denton County requests that proposals follow the format outlined below. Tab 1 - Cover Letter - A brief introductory letter of representation. Tab 2 - Proposal Pricing/Delivery - Pricing shall be itemized for all items requested in this proposal. Brief notes referencing specific line items may be included, if necessary, for explanation. Complete and return attached Proposal Pricing Form. Tab 3 - Contractor Background Information - This section should include a description of the proposer experience with other services similar to the one described herein. a. Submit company background information including principle place of business, length of existence, breadth of experience and expertise, management structure, Page 7 of 18

8 and any other information that demonstrates relative qualifications and experience. b. Project Manager Identify the proposed Project Manager and include a resume. c. References Proposer shall submit with this proposal a list of at least three (3) references where like services or similar projects have been performed by their firm. d. Vendor Acknowledgement Form as required herein. e. Address any performance related litigation that your firm may be, or has been, involved in over the last five (5) years. f. Identify if your firm has had any contracts terminated due to non-performance over the last five (5) years. g. Identify adverse actions sanctioned by any regulatory authorities over the last five (5) years. Tab 4 Scope of Work a. Include a statement that all products and services quoted in proposal are in full accord with the specifications or a brief listing of all those specification sections to which the proposer takes exception. All comments shall be listed and numbered in order of the respective article of the specification. This statement is required even if no exceptions are noted. b. Include a proposed project implementation schedule per project identifying tasks, responsibilities, and estimated time commitments from the County. Identify all critical milestones. Tab 5 - Descriptive Literature - Illustrative or descriptive literature, brochures, specifications, drawings, diagrams, etc., that provide additional proposer/product information with regard to issues addressed in other areas of the Proposer s proposal. 9 III. SCOPE OF WORK A. Purpose Denton County s intent of this Request for Proposal and resulting contract is to obtain proposals to implement an automated electronic queuing system for use in the following five Denton County Tax Office locations: Projects Tentative Installation Completion Schedule Project A - Denton County Government Center Carrollton 1029 W. Rosemeade Pkwy. Carrollton, Texas Upon Award Project B - Precinct 3 Government Center N. Valley Parkway Lewisville, Texas Project C - Denton County Southwest Courthouse November Canyon Falls Drive Flower Mound, Texas Project D - Denton County Government - Frisco Spring FM 423 Frisco, Texas Project E - Mary and Jim Horn Government Center Spring E. McKinney Denton, Texas See attached Exhibit A for floorplans for each project. The intent is to install the projects in phases contingent on construction schedules and available funding. The system for Project A - Denton County Government Center Carrollton will be installed upon award of contract. B. Background - Each Tax Office location contains Denton County computers on the Denton County IP network and State of Texas Motor Vehicle Registration and Title computers on the State of Texas IP network. The Denton County IP network and the State of Texas IP network are not connected and are not routable between each other. All Denton County Tax Office locations have IP connectivity between each other using the Denton County network. Internet access is available on the Denton County network. Full internet access may not be available on the State of Texas network. C. System Hardware 1. Server Platform a. A hosted solution will be considered. Page 9 of 18

10 b. The server operation system platform shall be Window c. The system shall have the ability to run in a VMWare virtual environment. The System shall support high availability and scalability and perform under periods of high usage and high processing loads. d. The system shall have the ability to recover from a hardware or application failure. Built-in redundancy and fail-over architecture to ensure seamless system recovery is preferred. 2. Desktop Platform a. The supported Denton County desktop operating system platform is Windows 7 64-bit or greater. b. Client software shall not require the Java platform. c. Client software shall be compatible with Microsoft Internet Explorer 10 or greater. d. Describe any additional software that must be installed on the desktop in order to use all system functions at the desktop. Explain the function of this software. 3. Tablets a. If tablets will be required as part of the system package, describe the tablet requirements and functions. b. Describe options for securing tablets to prevent theft. 4. Kiosk a. The kiosk shall be a standalone hardware platform that does not require connectivity to a local computer system. b. The kiosk shall be powered by 120 volt AC power. c. The kiosk shall have a battery backup system. d. The kiosk shall support tool-less access to change consumables. e. Kiosk shall have touchscreen capabilities. 5. Display Units a. The system shall include a size appropriate flat screen display per location based on the size of the public waiting area. b. Mounting hardware and installation shall be included in the pricing. c. Display system shall have split screen capabilities to allow for additional screening of information/data as decided upon by Denton County (i.e. public service announcements). D. System Software 1. Queuing Application Software a. Denton County expects to procure a Commercial Off-the-Shelf Software (COTS) system that is easily customizable. The software shall support multiple administrator configurable queues per location. b. System shall have the ability to scale to increase functionality or enhancements based on funding and service requirements of Denton County. c. System shall have the ability to interface with all systems used by the Denton Page 10 of 18

11 County Tax Office, including TxDMV, RTS and Spindlemedia, is preferred. Describe options available for system interfaces. d. System shall have the ability to print paper tickets for each queue. e. Describe all options and methods available for users, supervisors, and administrators to access the system functions and dashboard. 2. Data Base Platform a. The database platform shall be Microsoft SQL Server 2012 or Microsoft SQL Server 2012 Express. 3. System Backup a. The system shall be compatible with available industry standard backup software. b. The system shall allow for continued use during backups. 4. Queue Servicing a. The ability to service and advance the queue shall be present at each customer service window. b. All customer service windows shall have access to all queues. 5. Queue Monitoring a. The system shall have the ability to view and adjust all queues at all locations from a remote location. b. System shall have multiple configurable security roles that can be assigned to users (i.e. administration rights, supervisor rights). 6. Altering a. The system shall generate alerts automatically and send the alerts through . b. The system shall have the ability to manually configure alerts. c. The administrator can configure alert conditions based on the number of tickets waiting for service. d. The administrator can configure alert conditions based on average wait time. e. The administrator can configure alert conditions based on average time at window. f. The system shall include a web-based administrative dashboard. 7. Reporting a. The system shall have reporting functionality that can be accessed through a web browser. The ability to schedule automated s containing reports is preferred. b. The system shall have the ability to create HTML or PDF reports and export data to third party applications such as Microsoft Excel. c. The system shall include canned reports and have the ability to create custom reports. d. The system shall perform analysis and generate reports on trends (peak hours, bottlenecks, etc.) Page 11 of 18

12 E. Kiosk Software/Public User Interface 1. User Interface a. The kiosk user interface shall be ADA compliant. b. The kiosk shall support multiple languages and at a minimum support both English and Spanish. c. The kiosk must prompt the customer for the type of transaction they need, such as title transaction, license plate renewal, property tax payment, etc. 2. Administrator Configurable Options a. The administrator can apply branding (logos, mission statements, color schemes, etc.) to the kiosk user interface. b. The administrator can configure kiosk interface to collect additional user data such as zip code, transaction type (motor vehicle or property tax transaction), queue locator (from which office data is derived), etc. 3. Ticket Printing a. The system shall have the ability to print paper tickets for each queue. b. The administrator can apply branding (logos, organization name, website, etc.) to ticket. c. The time the ticket was issued shall be printed on ticket. d. The estimated time of service shall be printed on ticket. e. The estimated wait time shall be printed on ticket. f. Tickets shall support multiple languages (e.g. English / Spanish) g. Consumable media (paper) shall not be proprietary and be generally available off-the-shelf. h. Consumable ink and ink cartridges (if printer is not thermal) shall not be proprietary and be generally available off-the shelf. i. A visual and audible alert shall be displayed at the kiosk when ticket consumables are approaching end-of-life. j. An administrative alert ( , popup, etc.) shall be sent when ticket consumables are approach end-of-life. 4. Display Units a. Numbers being served shall be displayed on Display Units. b. Numbers being served can be integrated with other content or programming on the Display Units. 5. Audible Calling a. Visual calling shall be augmented by an automated, audible announcement of ticket and window number. F. Training - Provide training to all Tax Office personnel who will be using the queuing system. Provide training for the managers and supervisors for purposes of reviewing customer flow and generating standard and ad hoc reports. Page 12 of 18

13 G. System Support 1. Full Service Support a. Full service support is required for all equipment and software purchased under this RFP for at least the initial term of the contract. For the purposes of this contract, full service means all service, repair, parts, and maintenance necessary to keep the equipment operating in a manner that meets the manufacturer s published performance specifications and the requirements of this RFP. Support shall include at a minimum: System maintenance Software upgrades Documentation revision and updates Preventative maintenance Hardware replacement and upgrades Help Desk support 2. Technical Support a. Technical support by the service provider shall be available to the Denton County Tax Office during the hours of 8:00 am to 5:00 pm Monday through Friday Central Standard Time by telephone using a toll free number. 3. Response a. Response to reported problems must occur within one (1) hour, with problem resolution within eight (8) hours unless otherwise agreed to by authorized Denton County Tax Office managers. H. Additional System Capabilities Provide information for additional system capabilities to include, but not limited, to the following. Do not include pricing for additional capabilities in your proposal pricing. 1. Describe system s ability for ticketless queuing. 2. Describe system s ability to enter the system remotely. 3. Describe system s ability to send s and text messages to users indicating their queue position and status in the queue. Page 13 of 18

14 IV. GENERAL CONTRACT TERMS AND CONDITIONS C. CONTRACT: This request for proposal, submitted documents, and any negotiations, when properly accepted by Denton County, shall constitute a contract equally binding between the successful proposer and Denton County. No different or additional terms will become a part of this contract with the exception of a Change Order. D. CONFLICT OF INTEREST: No public official shall have any interest in this contract, except as permitted by and subject to the disclosure requirements of Vernon's Texas Codes Annotated, Local Government Code, Title 5, Subtitled C, Chapter 171. E. CONFIDENTIALITY: All information disclosed by Denton County to successful proposer for the purpose of the work to be done or information that comes to the attention of the successful proposer during the course of performing such work is to be kept strictly confidential. F. CHANGE ORDERS: No oral statement of any person shall modify or otherwise change, or affect the terms, conditions or specifications stated in the resulting contract. All change orders to the contract will be made in writing by Denton County Director of Purchasing. G. ASSIGNMENT: The successful proposer shall not sell, assign, transfer or convey any contract resulting from this RFP, in whole or in part, without the prior written consent of Denton County Commissioners. H. VENUE: This agreement will be governed and construed according to the laws of the State of Texas. This agreement is performable in Denton County, Texas. I. INDEMNITY: Successful proposer shall defend, indemnify and save harmless Denton County and all its officers, agents and employees from all suits, actions, or other claims of any character, name and description brought for or on account of any injuries or damages received or sustained by any person, persons, or property on account of any negligent act or fault of the successful proposer, or of any agent, employee, subcontractor or supplier in the execution of, or performance under, any contract which may result from proposal award. Successful proposer shall pay any judgment with cost which may be obtained against Denton County growing out of such injury or damages. J. DESIGN, STANDARDS AND PRACTICES: Design, strength, quality of materials and workmanship must conform to the highest standards of engineering practices and/or professional services. K. PATENTS/COPYRIGHTS: The successful proposer agrees to protect Denton County from claims involving infringements of patents and/or copyrights. L. TERMINATION OF CONTRACT: This contract shall remain in effect until contract expires, completion and acceptance of services or default. Denton County reserves the right to terminate the contract immediately in the event the successful proposer fails to: 1. meet delivery or completion schedules, or Page 14 of 18

15 2. otherwise perform in accordance with the accepted proposal. Breach of contract or default authorizes the County to award to another proposer, purchase elsewhere and charge the full increase cost to the defaulting proposer. Either party may terminate this contract with a thirty (30) days' written notice prior to the either party stating cancellation. The successful proposer must state therein the reasons for such cancellation. Prior written notice must be delivered in person or sent by registered or certified mail, return receipt requested, proper postage paid, and properly addressed to the other party at the address on the affidavit for the contractor or to the County Judge, 110 West Hickory, Denton, Texas. M. PERFORMANCE OF CONTRACT: Denton County reserves the right to enforce the performance of this contract in any manner prescribed by law or deemed to be in the best interest of the County in the event of breach or default or resulting contract award. N. PURCHASE ORDER: A purchase order(s) shall be generated by Denton County to the successful proposer. O. INVOICES: Invoices shall be mailed directly to: The invoices shall show: Denton County Auditor's Office P.O. Box 2055 Denton, Texas Name and address of successful proposer; 2. Detailed breakdown of all charges for the services or products delivered stating any applicable period of time; and 3. Denton County Purchase Order Number. Invoices shall be based upon actual services rendered and actual hours of performance and/or products delivered. P. PAYMENT: Payment will be made upon receipt and acceptance by the County of completed services and/or products ordered and receipt of a valid invoice, in accordance with the Texas Government Code, Chapter Successful proposer is required to pay subcontractors within ten (10) days. Q. OWNERSHIP: All plans, prints, designs, concepts, etc., shall become the property of Denton County. R. INSURANCE: Before commencing work, the successful proposer shall be required, at his own expense, to furnish the Denton County Director of Purchasing within ten (10) days of notification of award with evidence showing the following insurance coverage to be in force throughout the term of the contract: Page 15 of 18

16 1. Worker's Compensation in accordance with State Territorial Worker's Compensation Laws; and Employer's Liability Insurance: 2. Public Liability and property damage insurance coverage including, but not limited to, the liability assumed in the indemnification provisions (as specified in this RFP) fully insuring contractor's and/or subcontractor's liability for injury to, or death of, County employees and third parties, extended to include personal injury liability coverage, and for damage to property of third parties, with a minimum combined coverage for each occurrence of $500,000.00; and 3. Comprehensive automobile and truck liability insurance to include coverage of owned, hired, and non-owned vehicles with minimum limits of $300, each occurrence for bodily injury and $100, each occurrence for property damage. Such insurance is to include coverage for loading and unloading hazards. Each insurance policy to be furnished by successful proposer shall include, by endorsement to the policy, a statement that a notice shall be given to Denton County by certified mail thirty (30) days prior to cancellation or upon any material change in coverage. S. FUNDING: Funds for payment have been provided through the Denton County budget approved by the Commissioners Court for this fiscal year only. State of Texas statutes prohibit the obligation and expenditure of public funds beyond the fiscal year for which a budget has been approved. Therefore, anticipated orders or other obligations that may arise past the end of the current Denton County fiscal year shall be subject to budget approval. T.
